Governance<br />

The <strong>NDP</strong> acknowledges that good governance is the<br />

cornerstone of any well-functioning government in<br />

successful democracies. As such, we regard the practice<br />

of good governance as not only critical for the overall<br />

development of our society, but especially necessary to<br />

keep the trust of the people we serve.<br />

A re-elected <strong>NDP</strong> will give priority to improving<br />

governance through systemic and institutional changes<br />

to ensure that government works better for all.<br />

Additionally, it shall give strong focus and commitment<br />

to governance issues in the short, medium and long<br />

term to include:<br />

• Constitutional Advancement<br />

• Transparency and Accountability<br />

• Government Operations and the Public Service<br />

• Law and Order and National Security<br />

• Communications<br />

Constitutional Advancement<br />

The Virgin Islands 2007 Constitution made clear the rights and responsibilities of BVI and the UK. The UK’s decision to impose public<br />

registers of beneficial ownership on its Overseas Territories (OTs) by threat of Order in Council has created a sense of unease in BVI. In<br />

modern times, the instrument of Order in Council has only been used to ensure UK adherence to international human rights law. This<br />

decision was made without consultation with or the consent of the BVI Government.<br />

It is clear that the relationship between the Territory and the UK is no longer fair or balanced. Indeed, this divergence of approach<br />

creates an infringement of certain human rights in the BVI Constitution, including those relating to the protection of private and family<br />

life and privacy of home and other property, essentially causing an inherent conflict between the Constitution and any Order in Council.<br />

These events have demonstrated that a new and fundamentally different ‘constitutional construct’ is required; one better suited to the<br />

strategic goals and aspirations of BVI. A constitutional review will determine these desires and aspirations so that the Territory can<br />

move towards greater self-governance and to a deepening of the democratic institutions of government, as well as to enhance good<br />

governance, transparency and accountability. This will place BVI on a more progressive constitutional footing.<br />
