SUMMARY OF ORDINANCE NO. 445<br />

Ordinance No. 445 proposes amendments to the Malibu Local Coastal<br />

Program (LCPA No. 18-004) and the Malibu Municipal Code (Zoning<br />

Text Amendment No. 18-005). The LCP amendment would amend<br />

Sections 3.3, 3.6, and 13.4 of the Local Implementation Plan (LIP) and<br />

add Sections 5.8, 13.13.1(A)(6), and 13.14(H). The changes to the LIP<br />

modify the standards and procedures in the LIP to facilitate the rebuilding<br />

of structures damaged or destroyed by natural disaster, regulate<br />

temporary housing and allow the removal of certain native trees.<br />

It also introduces a de minimis waiver process that can be used to<br />

make changes to an onsite wastewater treatment system or access way.<br />

The changes to the MMC are to sections 17.24.020, 17.40.040, and<br />

17.60.020. These changes mirror the changes to the LCP to ensure<br />

consistency with the LCP, and also make changes to the treatment of<br />

structures damaged or destroyed by natural disaster, particularly nonconforming<br />

structures which are allowed to be rebuilt within 10% of<br />

their prior size and adds citation/fine provisions for properties where<br />

temporary structures are not removed upon expiration of a temporary<br />

housing permit.<br />

The LCP amendment and the Zone Text Amendment do not take effect<br />

unless and until the LCPA is certified by the Coastal Commission,<br />

except that the changes to MMC sections 17.60.020 (nonconforming<br />

structures and uses), 17.40.040(A)(18)(introducing temporary housing<br />

permit requirement), and 17.40.040(A)(18)(f) (fine/citation procedures<br />

for failure to remove temporary housing structures) will take effect 31<br />

days after adoption. A full copy of Ordinance No. 445 is available for<br />

review in the City Clerk’s office.<br />
