So what we see today are the fruits of years of<br />

diligent work of a few young passi<strong>on</strong>ate and<br />

tenacious people who have taken advantage of<br />

everything that has happened from broadcast<br />

deregulati<strong>on</strong>, media expansi<strong>on</strong>, live<br />

opportunities, to endorsement deals.<br />

MUSIC BUSINESS AND LEGISLATION<br />

In recent years, there has <str<strong>on</strong>g>be</str<strong>on</strong>g>en sustained<br />

engagement <str<strong>on</strong>g>be</str<strong>on</strong>g>tween stakeholders and mem<str<strong>on</strong>g>be</str<strong>on</strong>g>rs<br />

of the Federal House of Representatives Ad Hoc<br />

committee to pro<str<strong>on</strong>g>be</str<strong>on</strong>g> activities of<br />

telecommunicati<strong>on</strong>s companies set up to resolve<br />

the issue of revenue share ratio. The current<br />

situati<strong>on</strong> sees the telecommunicati<strong>on</strong> companies<br />

earning a lot more than the actual c<strong>on</strong>tent<br />

owners, which in my opini<strong>on</strong> is unjustifiable.<br />

There have <str<strong>on</strong>g>be</str<strong>on</strong>g>en scenarios where telcos claim as<br />

much as 78 percent of total accrued revenue from<br />

music sale, leaving less than a quarter of the pie<br />

to <str<strong>on</strong>g>be</str<strong>on</strong>g> split <str<strong>on</strong>g>be</str<strong>on</strong>g>tween the aggregator, the record la<str<strong>on</strong>g>be</str<strong>on</strong>g>l<br />

and the artiste and any<strong>on</strong>e else in the producti<strong>on</strong><br />

value chain. The <str<strong>on</strong>g>be</str<strong>on</strong>g>neficiaries from this anomaly<br />

of course, are not eager to give grounds.<br />

There is no tenable reas<strong>on</strong> Nigeria should <str<strong>on</strong>g>be</str<strong>on</strong>g><br />

different. There is a global <str<strong>on</strong>g>be</str<strong>on</strong>g>st practice standard<br />

that we should guide the c<strong>on</strong>duct of business<br />

with the music space. We need to c<strong>on</strong>stantly<br />

remind aggregator platforms that no matter how<br />

well accepted and popular your platform is, at<br />

the end of the day, it is basically still a distributi<strong>on</strong><br />

platform. It is a store. When we get to a point<br />

where the pers<strong>on</strong> who provides distributi<strong>on</strong><br />

access is taking home more than 70 percent of<br />

the gross revenue, then it is clear that something<br />

is not right. We hope that so<strong>on</strong>er or later, every<strong>on</strong>e<br />

c<strong>on</strong>cerned does the needful, and we can<br />

enthr<strong>on</strong>e a system that delivers a fairer deal to<br />

every<strong>on</strong>e in the value chain.<br />

THE STRUCTURE<br />

The lack of functi<strong>on</strong>al structure in the music<br />

industry in Nigeria is a reflecti<strong>on</strong> of the state of<br />

the larger society. Gaps in policy positi<strong>on</strong> and<br />

ineffective enforcement within the music space<br />

are some of the major reas<strong>on</strong>s the piracy rate is as<br />

high as it is.<br />

The music industry has shown immense<br />

potential to grow and thrive, regardless of the<br />

major of the numerous challenges particularly<br />

the shrinking ec<strong>on</strong>omy and absence of adequate<br />

support from the government.<br />

I expect the industry to c<strong>on</strong>tinue to find smart<br />

soluti<strong>on</strong>s to some of these issues. We need a<br />

regulator that is <str<strong>on</strong>g>be</str<strong>on</strong>g>tter equipped to functi<strong>on</strong><br />

effectively. There is a lot of work that needs to <str<strong>on</strong>g>be</str<strong>on</strong>g><br />

d<strong>on</strong>e to ensure that the regulatory process is more<br />

effective. But more importantly, stakeholders need<br />

to embrace the task of working with all the<br />

relevant organizati<strong>on</strong>s and government agencies<br />

to ensure <str<strong>on</strong>g>be</str<strong>on</strong>g>tter results.<br />

As stated earlier, we have shown tremendous<br />

capacity to deliver great results in the face of<br />

crippling challenges. We can take a few steps<br />

further. The more positively involved the<br />

stakeholders are, the more likely we are to fix<br />

what needs to <str<strong>on</strong>g>be</str<strong>on</strong>g> fixed. While it is great to look<br />

after and look out for your pers<strong>on</strong>al businesses, it<br />

is also important to spare some time and energy<br />

to get involved in helping to ensure that we<br />

grow the needed structures and create an<br />

enabling envir<strong>on</strong>ment to operate optimally at<br />

your pers<strong>on</strong>al business level.<br />

THE ARTISTES<br />

As I close, I would like to pay tribute to all the<br />

heroes and heroines of the greatly inspiring<br />

Nigerian success story. True leaders and<br />

visi<strong>on</strong>aries, every<strong>on</strong>e, too numerous to menti<strong>on</strong>.<br />

The architects of the game – talents, la<str<strong>on</strong>g>be</str<strong>on</strong>g>l execs,<br />

media pers<strong>on</strong>alities, promoters, managers,<br />

directors, photographers, talent managers, PR<br />

c<strong>on</strong>sultants, bloggers, managers, agency<br />

pers<strong>on</strong>nel, brand managers, investors, stylists,<br />

ticketing soluti<strong>on</strong>s providers, venue owners,<br />

distributors, tech support resource and many<br />

more.<br />

You all have delivered <strong>on</strong>e of the most powerful<br />

gifts to the coming generati<strong>on</strong> – hope and<br />

c<strong>on</strong>crete reas<strong>on</strong> to <str<strong>on</strong>g>be</str<strong>on</strong>g>lieve. You will <str<strong>on</strong>g>be</str<strong>on</strong>g> forever<br />

celebrated.<br />

WAY FORWARD<br />

The Nigerian music industry has shown<br />

tremendous capacity for growth. And <strong>on</strong>e thing<br />

is clear; it can get a lot <str<strong>on</strong>g>be</str<strong>on</strong>g>tter if things are d<strong>on</strong>e<br />

right. Another thing to note is that it can get worse.<br />

We can quite easily fritter away the goodwill, and<br />

this moment can easily <str<strong>on</strong>g>be</str<strong>on</strong>g>come a point in our<br />

history when we were <strong>on</strong> the verge of seizing the<br />

main stage but missed the opportunity.<br />

It is hardly time to celebrate and relax. If<br />

anything, it is time to double our efforts and put<br />

in the work necessary to sort out the issues. We<br />

need to strengthen policy, regulati<strong>on</strong>,<br />

enforcement, engagement and cooperati<strong>on</strong>. We<br />

need to sort out our collective system as a matter<br />

of urgency. We cannot grow a world-class industry<br />

without a world-class collective structure to<br />

support it. The likes of Michael Jacks<strong>on</strong>, Bob<br />

Marley and 2Pac earned milli<strong>on</strong>s of dollars posthumously<br />

<str<strong>on</strong>g>be</str<strong>on</strong>g>cause of the existence of functi<strong>on</strong>al<br />

rights management systems.<br />

If we get lost in the euphoria of the present<br />

successes, which is but a tip of the ice<str<strong>on</strong>g>be</str<strong>on</strong>g>rg, we<br />

will lose out <strong>on</strong> getting to where we should <str<strong>on</strong>g>be</str<strong>on</strong>g>.<br />

Also, we need to fix the way the system works.<br />

For every Davido, for every Burna Boy, for every<br />

Teni The Entertainer, for every 2Baba, there is<br />

need for proper business management, proper<br />

road management, proper legal support, proper<br />

branding and packaging resource. Often times,<br />

we pay too much attenti<strong>on</strong> to the performer and<br />

the performance. We need to develop capacity.<br />

We need to train managers, publicists, lawyers.<br />

We need to have a system that provides certificate<br />

courses for each of these potential professi<strong>on</strong>s.<br />

The legal framework that supports<br />

entertainment in Nigeria needs to <str<strong>on</strong>g>be</str<strong>on</strong>g> c<strong>on</strong>siderably<br />

improved. People need to learn to respect their<br />

c<strong>on</strong>tracts. We need to see the law resolve decisively,<br />

issues of breach of c<strong>on</strong>tracts. We need legal<br />

precedence. The process of dispute resoluti<strong>on</strong><br />

needs to <str<strong>on</strong>g>be</str<strong>on</strong>g> overhauled. If we guide and regulate<br />

c<strong>on</strong>duct, the risk factors will <str<strong>on</strong>g>be</str<strong>on</strong>g> reduced. Investors<br />

will <str<strong>on</strong>g>be</str<strong>on</strong>g> more c<strong>on</strong>fident, knowing that their<br />

investments are protected. The entire system<br />

need to <str<strong>on</strong>g>be</str<strong>on</strong>g> properly fixed, for us to progress from<br />

where we are. It is time to roll up our sleeves and<br />

get our hands dirty.<br />
