Legally High<br />

Intro<br />

<strong>The</strong> fight for legalization has been long in South Africa.<br />

<strong>The</strong> first law’s in South Africa regarding cannabis came<br />

about in the late 19th century. Hindu and Malay slaves<br />

were prohibited to use cannabis as it made them lazy and<br />

lethargic; hence the first laws were put in place. Cape Town<br />

politicians sent a letter to <strong>The</strong> League of Nations in 1925,<br />

which set the basis for worldwide criminalization of cannabis.<br />

Since we as South African’s are very much to blame for the<br />

global cannabis prohibition, we need to now be part of the<br />

solution. Activist groups such as the Dagga Couple and the<br />

Rastafarian movement have pushed for many years to get to<br />

where we are now. Where is that exactly? Well that’s a good<br />

question.<br />

On the 18th of September the Constitutional Court declared<br />

the existing legislation unconstitutional and, decriminalized<br />

cultivation and possession of cannabis for private<br />

consumption. What this basically means is that it is no longer<br />

an offence to grow your own cannabis at home as well as use<br />

it as you see fit. As great as this may sound, it has opened<br />

up a legal grey area. How much a person can grow or store<br />

at one time, and what really defines the word “private”?<br />

While police raids are still a regular occurrence and no new<br />

legislature has been put forward, we are trying to find out<br />

what is legal and what isn’t.<br />

Growing your own<br />

Becoming a green thumb is not as difficult as you might think.<br />

<strong>The</strong>re is a saying in the cultivation community, “it will grow”.<br />

It’s called weed for a reason. To grow cannabis in an outdoor<br />

environment is not difficult, you can easily grow enough<br />

cannabis in one season to last you the whole year. Legally,<br />

there has been no limit stipulated as to how much one<br />

person can cultivate.<br />

However, the more you grow, the more reason for someone<br />

to think you are distributing. If the police get wind of your<br />

garden, they will come and investigate, often confiscating<br />

plants and dried herbs. <strong>The</strong>reafter, it is left up to you to prove<br />

that you are not dealing. You are guilty until proven innocent.<br />

<strong>The</strong>re is a silver lining though. If you are renting, most lease<br />

agreements stipulate that no illegal drugs may enter the<br />

premises. Since the ConCourt ruling, cannabis is no longer<br />

considered an illegal drug in a private setting. This means that<br />

unless specifically mentioned in your lease, you are allowed<br />

to cultivate in your residence.<br />

Here are a few tips to stay on the right side of the law:<br />

• Grow within reason. You don’t have to have<br />

the biggest garden in your town. Just grow<br />

enough for yourself.<br />

• Don’t sell or trade your cannabis. All it takes<br />

is one transaction, and you will have found<br />

yourself on the wrong side of the law.<br />

• Scales and zip-lock bags are considered<br />

evidence of dealing. Make sure that these items<br />

are not found on your premises.<br />

Legally High<br />

As a distributer and retailer<br />

Here comes the controversy. If you are selling cannabiscontaining<br />

products, you are required to have a license.<br />

<strong>The</strong> only exception to this rule is hemp seed and hemp<br />

seed oil (not to be confused with CBD oil derived from<br />

hemp) as it is a nutritional supplement containing no<br />

cannabinoids. <strong>The</strong>re seems to be two routes to getting<br />

a license: <strong>The</strong> traditional healers and SAHPRA.<br />

Traditional healer licence<br />

This type of license has been around for a number<br />

of years. <strong>The</strong> holder of such a license may dispense<br />

unregulated medicines for traditional purposes.<br />

We asked Krithi Thamer, founder of Holistic Releaf<br />

Dispensaries, how they got their traditional healers<br />

licence:<br />

“Well, you would need to prove that it is a calling<br />

traditionally. We are partnered with Ethekwini<br />

Traditional Health Practitioners and over and above<br />

that, we are affiliated to Dr. Sharmilla Patil, a US medical<br />

doctor and Ayurvedic Practitioner. This also falls under<br />

traditional medicine and currently globally, we have<br />

over 62000 trials showing efficacy of natural based<br />

medicines for a number of conditions. I think there<br />

has to be some form of regulation, especially around<br />

traditional medicines, to just ensure safety of a patient.”<br />

<strong>The</strong> legality of all this is questionable considering<br />

no new legislature has been passed since the<br />

decriminalisation, and these licenses have been highly<br />

controversial in the cannabis community. <strong>The</strong> intent of<br />

a company seems to be the most significant factor in<br />

whether it is shut down or not. Holistic Releaf operates<br />

like a legitimate medical facility, with the care of their<br />

patients being their primary concern. This is what local<br />

police and government are looking for, and attempting<br />

to shutdown such an establishment would only result in<br />

public outcries.<br />

SAHPRA certified<br />

At the end of January <strong>2019</strong>, the South African Health<br />

Products Regulatory Authority (SAHPRA) released a<br />

statement condemning all distributers of cannabiscontaining<br />

products.<br />

“Currently, there are a number of outlets and individuals<br />

that are selling cannabis-containing products (including<br />

oils) for medicinal use. In terms of the provisions of<br />

section 14(1) of the Medicines and Related Substances<br />

Act, 1965 (Act 101 of 1965), “no person shall sell any<br />

medicine, medical device or IVD which is subject to<br />

registration by virtue of a declaration published in terms<br />

of subsection (2) unless it is registered.”<br />

<strong>The</strong> cannabis-containing products and oils that are<br />

currently available in South Africa and which have not<br />

been registered or approved by SAHPRA are, therefore,<br />

illegal.<br />

Suppliers and users of such illegal products are exposing<br />

themselves and others to legal and health risks as the<br />

safety, efficacy and quality of these products cannot be<br />

assured. – SAHPRA(Status of Cannabis cultivation and<br />

medicinal use)”<br />

On the 2nd of <strong>April</strong>, <strong>2019</strong>, House of Hemp went public<br />

as the first recipient of the SAHPRA licence. This makes<br />

them the first official legal cultivators in South Africa.<br />

As most of this legal product is destined for export,<br />

we eagerly await to see what will happen to the South<br />

African market. <strong>The</strong> situation worsened when SAHPRA<br />

placed a trade embargo on all CBD containing products.<br />

On the 5th of <strong>April</strong> it was announced that all imported<br />

CBD at customs would be returned to sender.<br />

Fields of Green for ALL<br />

We can’t talk about South African cannabis legalization<br />

without mentioning Fields of Green for ALL and their<br />

founders, <strong>The</strong> Dagga Couple.<br />

This non-profit organization has been pushing a very<br />

liberal approach to regulation which is suited to the<br />

South African cannabis culture. <strong>The</strong>y do not believe in<br />

restrictive licensing and want to see an inclusive model<br />

which brings the black market into the legal market.<br />

Achieving this won’t be an easy task as there are a lot of<br />

factors to consider.<br />

Fields of Green for ALL have put together an extensive<br />

document, compiling their desired outcomes. It is a<br />

truly impressive document, and most definitely worth<br />

Conclusion<br />

<strong>The</strong>re is still a lot to be decided in Parliament. From<br />

a legislation point of view, nothing has changed. It<br />

may still be some time until we see a fully legal and<br />

regulated model.<br />

Thankfully, as a nation we have taken steps in the right<br />

direction. Now, we all need to come together as a<br />

community to ensure this plant stays in the hands of<br />

the people. <strong>The</strong> power of cannabis is tremendous. Not<br />

just in its medical abilities, but in its almost limitless<br />

applications.<br />

This plant has been with us since the beginning of time,<br />

and it’s not going anywhere.<br />

CannaCulture SA is dedicated to one of nature’s miracle<br />

wonder plants, Cannabis. Information on this topic has<br />

been misleading and we are here to set the record straight.<br />

For decades, the truth behind this plant has been kept a well<br />

guarded secret but not anymore. Here, we will take you through a<br />

journey of how this plant was first discovered and how it is, today,<br />

used in the medical world and recreationally.<br />

Join the cause! Know the truth!<br />

Here are a few basics to help you grow cannabis in your own garden:<br />

Step 1 – Seeds:<br />

Buying seeds can be done internationally or locally from seedbanks and breeders. You can choose the strains that<br />

you wish to grow, and get the seeds delivered to your house. It’s that easy!<br />

Germination is when the dormant seed is placed in wet conditions, and it wakes up and starts to grow. To do this,<br />

place your seeds in some wet paper towel, making sure they don’t dry out. It could take a couple days to see the root<br />

shoot out of the seed, so be patient. When the root comes out, place the seed in soil about half a centimeter from<br />

the surface. Congratulation, you just joined the green revolution!<br />

Step 2 – Remove the males:<br />

Cannabis plants are very good at making seeds. <strong>The</strong> males have large pollen sacks that can pollenate a female from<br />

far away. <strong>The</strong> females want to be pollenated too, which is why they create sticky resin to catch pollen and smelly<br />

flowers to attract insects. Female plants that have not been pollenated will continue to produce this resin, and that<br />

is the goal of any cannabis grower. To make sure your plants don’t get pollenated, you must remove the male plants.<br />

Step 3 – Be patient:<br />

Cannabis plants need ample sunlight, nutrients and water to thrive. If this is your first time, don’t be too stressed.<br />

Growing during the season (planting before summer and harvesting before winter) in South Africa isn’t difficult, you<br />

just need to be patient and let nature take its course. Happy growing!<br />

Durban’s 420 friendly smoke spots<br />

If you live in Durban, or if you’re coming for a holiday like most<br />

South African’s do, then you’re in luck. Durban has some 420<br />

friendly spots that are not to be missed!<br />

<strong>The</strong> ConCourt ruling decriminalized private use of cannabis<br />

for consenting adults. However the word “private” is not<br />

clearly defined. This has opened up the opportunity for<br />

companies to create “private” smoking areas for cannabis users.<br />

295 Florida Road, Durban<br />

<strong>The</strong> Bobby Greenhash Foundation opened up a Bohemian Beach<br />

Bumz branch on Florida Road in Durban. This café style restaurant<br />

has only been open for a short time, but it is already a hotspot for<br />

Durban’s cannabis culture.<br />

Fully immerse yourself in cannabis with edibles and infused<br />

drinks, while enjoying the hipster décor and outside seating.<br />

Smoking cannabis is permitted in a dedicated smoking area and<br />

as long as you bring your own cannabis, rolling papers will be<br />
