You might think grandparents are entitled to see their grandchildren. And in an ideal world free of family conflict, the question doesn’t even come up – of course the doting grandparents can see little Katie, even spoil her a little, baby-sit when her parents need help – and develop strong intergenerational bonds with her over time. But in the real world, serious family conflicts are far from uncommon. Sometimes grandparents get caught up in those and cut off from contact with their grandchild. This may happen where the parents are engaged in a long divorce battle, incidentally sidelining the grandparents (who lose touch with their grandchild), or when there are conflicts between the grandparents and the child’s mom or dad, leading to the grandparents being denied access to their grandchild. In such unhappy situations, our Family Law Act allows grandparents to seek a court order for contact with their grandchild. Faced with such a request, the court must consider if contact is in the best interests of the child. That is the single over-arching consideration, beating out everything else. It’s up to the grandparents to prove to the court that access to the child is in the child’s best interest – in the particular (usually emotional and unsettled) family circumstances that led the grandparents to the courtroom door in the first place. The law doesn’t assume that contact with the grandparents is in a child’s best interest. Getting such a court order may well be an uphill battle for grandparents, unless they can come to some agreement with the child’s parent(s) who oppose the contact. That’s because a parent’s rights regarding their children are very significant. The Family Law Act spells out that each parent is their child’s guardian. Only a guardian has parental responsibilities (and each guardian may exercise all of them). These responsibilities include decisions about who the child should live and associate with. So if a parent doesn’t want the grandparents to see their grandchild, the court will be reluctant to interfere with the parent’s decision. And real conflict or hostility between grandparents and parents about such contact usually means contact isn’t in the child’s best interest. But all parental responsibilities (including about a child’s relationship with their grandparents) must be exercised in the best interests of the child. So while parental objections to contact count for a lot, they don’t trump the best interests of the child. The legislation highlights key things to consider when deciding what is in a child’s best interests. In a case like this, such things would include the child’s emotional well-being, their views (if the child is old enough), and the nature and strength of the child’s relationship with the grandparents. Taking into account all these factors, if the court decides contact is in the child’s best interest, then a grandparent is ordinarily entitled to contact for periods of time and on terms that work for the parents.
