BOOKING CONDITIONS – <strong>2020</strong> SEASON<br />
KEY POINTS You enter into a booking with us when we issue our confirmation invoice. If you then cancel, there will be a cancellation charge. Initially this may<br />
only be a deposit, but can go up to 100%. You can make changes to your booking in certain circumstances. We make a charge for this. We can change and<br />
cancel your booking. We’ll pay you compensation in certain circumstances. We are responsible to you for providing your holiday but there are legal limits. Your<br />

These Booking Conditions and the information in the<br />
brochure and our website form the basis of your contract<br />
with Preferred Travel Services (‘we’ and ‘us’). ‘You’ means<br />
the person making the booking (including anyone who<br />
is added or substituted at a later date). References to<br />
‘brochure’ in these conditions shall also include references<br />
to our website.<br />
1.Your contract – when you make a booking you<br />
guarantee that you have the authority to accept and do<br />
accept on behalf of your party the terms of these booking<br />
conditions. A contract will exist as soon as we send our<br />
confirmation invoice. This contract is made on the terms of<br />
these booking conditions, which are governed by English<br />
Law, and the jurisdiction of the English Courts. You may<br />
however, choose the law and jurisdiction of Scotland or<br />
Northern Ireland if you wish to do so.<br />
2. Payment – in order to confirm your holiday, the<br />
appropriate deposit must be paid at the time of booking.<br />
The balance of the holiday cost must be received by the<br />
Balance Due Date which will be shown on our confirmation<br />
invoice. The Balance Due Date is 8 weeks before departure<br />
for Group A <strong>Holidays</strong> (holidays by air), 6 weeks before<br />
departure for Group B <strong>Holidays</strong> (holidays with no flight of<br />
more than 4 days duration) and 4 weeks before departure<br />
for Group C <strong>Holidays</strong> (holidays with no flight of 4 days or<br />
less). If you are booking after that date full payment must<br />
accompany your booking form. Reminders are not sent. If<br />
we do not receive payments due in full, on time, we shall<br />
cancel your travel arrangements and retain your deposit.<br />
3. Your holiday price – we reserve the right to change<br />
the prices of any of our holidays at any time. You will be<br />
advised of the current price of the holiday that you wish<br />
to book before your contract is confirmed. The price we<br />
charge for your travel arrangements is fully guaranteed and<br />
will not be subject to any surcharges after your contract is<br />
confirmed. Please note that items such as local city taxes<br />
at your holiday destination are not included in our prices<br />
and will be payable by you in situ.<br />
4. Changes by you – if, after our confirmation invoice has<br />
been issued, you wish to change your travel arrangements<br />
in any way, for example your chosen departure date or<br />
accommodation, we will do our utmost to make these<br />
changes but it may not always be possible. Any request<br />
for changes to be made must be in writing from the<br />
person who made the booking. You will be asked to pay an<br />
administration charge of £15 per person, and any further<br />
cost we incur in making this alteration. You should be aware<br />
that these costs could increase the closer to the departure<br />
date that changes are made and you should contact us as<br />
soon as possible. You can transfer your booking to another<br />
person, who satisfies all the conditions that apply to this<br />
booking, by giving us notice in writing as soon as possible<br />
and no later than 7 days before departure. Both you and the<br />
new traveller are responsible for paying all costs we incur<br />
in making the transfer.<br />
Note: Certain travel arrangements (eg. Air Tickets) may not<br />
be changeable after a reservation has been made and any<br />
alteration request could incur a cancellation charge of up to<br />
100% of that part of the arrangements.<br />
5. Cancellation by you – should you or a member of<br />
your party need to cancel the holiday once it has been<br />
confirmed, you must immediately advise us in writing.<br />
Notice of cancellation is only effective when it is received<br />
in writing at our offices (see Date Received in the table<br />
below). Since we incur costs in cancelling your travel<br />
arrangements, you will have to pay cancellation charges in<br />
the table (shown as loss of deposit up to the Balance Due<br />
Date and percentages of the total holiday cost thereafter).<br />
Insurance premiums are non refundable.<br />

Please see clause 2 for definitions of Group A, B and C. The<br />
Date Received is the number of days before the departure<br />
date of the holiday we receive your cancellation in writing.<br />
Should one of the members of your party cancel who is<br />
sharing a double/twin room, the relevant single room<br />
supplement will become payable and added to your holiday<br />
cost.<br />
6(a) If we cancel your holiday – we reserve the right to<br />
cancel your booking. We will not cancel after the Balance<br />
Due Date has passed (see clause 2) except for unavoidable<br />
and extraordinary circumstances, or failure by you to pay<br />
the final balance, or because the minimum number (usually<br />
twenty) required for the package to go ahead hasn’t been<br />
reached. Unavoidable and extraordinary circumstances<br />
means a situation beyond our control, the consequences<br />
of which could not have been avoided even if all reasonable<br />
measures had been taken. If your holiday is cancelled<br />
you can either have a refund of all monies paid or accept<br />
an alternative holiday of comparable standard from us if<br />
we offer one (we will refund any price difference if the<br />
alternative is of a lower value). In the event a refund is<br />
paid to you, we will provide a full refund of your travel<br />
insurance premiums if you paid them to us and can show<br />
that you are unable to transfer or reuse your policy and pay<br />
compensation as shown in the table below except where<br />
the cancellation is due to unavoidable and extraordinary<br />
circumstances (see definition above).<br />
6(b) If we make changes to your holiday – it is a term<br />
of your booking that we are able to make changes to any<br />
aspect of your booking. If the change is insignificant, we<br />
will ensure that you are notified about it. Examples of<br />
insignificant changes include alteration of your outward/<br />
return flights which reduces your holiday duration by<br />
less than 12 hours, changes to aircraft type, change of<br />
accommodation to another of the same or higher star<br />
rating, changes of airline, a change of overseas airport. If<br />
we alter significantly any of the main characteristics of the<br />
travel services that make up your package we will give you<br />
the choice of accepting the change, receiving a refund, or,<br />
if one is offered, switching to an alternative holiday. If you<br />
choose to accept a refund we shall pay compensation as<br />
shown in the table below except where the cancellation is<br />
due to unavoidable and extraordinary circumstances (see<br />
definition above).<br />

The compensation that we offer does not exclude you from<br />
claiming more if you are entitled to do so.<br />
Costs incurred by you. If we make a significant change to or<br />
cancel your travel arrangements for any reason, we will not<br />
reimburse any expenses, costs or losses you incur relating<br />
to payments to third parties, including, but not limited to,<br />
insurance premiums, car parking, hotel accommodation,<br />
currency, connecting flights, or other travel arrangements<br />
such as kennelling fees etc.<br />
7. Our Liability to you – you must inform us without undue<br />
delay of any failure to perform or improper performance of<br />
the travel services included in this package. If any of the<br />
travel services included in your package are not performed<br />
in accordance with the contract, or are improperly<br />
performed, by us or the travel service suppliers, and this<br />
has affected the enjoyment of your travel arrangements,<br />
you may be entitled to an appropriate price reduction or<br />
compensation or both. We will not be liable where any<br />
failure to perform or improper performance of the travel<br />
services is due to: you or another member of your party;<br />
or a third party unconnected with the provision of the travel<br />
services in the package; or unavoidable and extraordinary<br />
circumstances, which means a situation beyond our<br />
control, the consequences of which could not have been<br />
avoided even if all reasonable measures had been taken.<br />
Our liability in cases involving, luggage, personal property,<br />
and money is limited to the excess for such items on your<br />
travel insurance policy.<br />
Our liability, except in cases involving, luggage, personal<br />
property, money, death, injury or illness, shall be limited<br />
to a maximum of twice the basic cost of your travel<br />
arrangements excluding, supplements, extras, extensions<br />
and insurance. Our liability will also be limited in accordance<br />
with and/or in an identical manner to a) the contractual<br />
terms of the companies that provide the travel services<br />
that make up your package. These terms are incorporated<br />
into this booking; and b) any relevant international convention,<br />
for example the Montreal Convention in respect of travel by air,<br />
the Athens Convention in respect of travel by sea, the Berne<br />
Convention in respect of travel by rail and the Paris Convention<br />
in respect of the provision of accommodation, which limit the<br />
amount of and conditions under which compensation can be<br />
claimed for death, injury, delay to passengers and loss, damage<br />
and delay to luggage. We are to be regarded as having all benefit<br />
of any limitation of the extent of or the conditions under which<br />
compensation is to be paid under these or any conventions. You<br />
can ask us for copies of the travel service contractual terms, or<br />
the international conventions.<br />
Under EU law (Regulation 261/2004) you have rights in some<br />
circumstances to refunds and/or compensation from your<br />
airline in cases of denied boarding, cancellation or delay to<br />
flights. Full details will be publicised at EU airports and available<br />
from airlines. However reimbursement in such cases will not<br />
automatically entitle you to a refund of your holiday cost from<br />
us. Your right to a refund and/or compensation from us is set out<br />
in these booking conditions. If any payments to you are due from<br />
us, any payment made to you by the airline or any other service<br />
provider will be deducted.<br />
It is a condition of our acceptance of liability that you notify us<br />
and our supplier(s) in strict accordance with the terms of clause<br />
9 of any claim made by you or any member of your party. Any<br />
person(s) to whom any price reduction or compensation is<br />
made (and their parent or guardian if that person is under 18<br />
years of age) must assign to ourselves or our insurers any rights<br />
they may have to pursue any third party in connection with the<br />
claim. In all circumstances you must provide us and our insurers<br />
with all assistance we may reasonably require.<br />
