Driving well but not as up to

but not as well as in the past

A ROUND of recent golfing 

book sales show that prices 

have declined from the heady 

heights of past years, but 

rarities can still drive bidding 

to satisfactory heights. 

The first separately printed book 

devoted entirely to the game of golf is 

Thomas Mathison’s The Goff. An Heroi- 

Comical Poem. First published in 1743 in 

Edinburgh, it was posthumously re-issued 

there on two more occasions before the 

century’s end, in 1763 and 1793. 

What makes it even more startling as 

the first flickering flame of a tradition of 

golf literature is that it was not until the 

1820s that another work entirely devoted 

to golf, The Rules of the Thistle Golf 

Club, was published. 

In 1721, James Arbuckle’s poem, 

Glotta, had made a passing reference to 

the game now played by millions across 

the world, but it was Mathison, an 

Edinburgh-born and trained legal writer, 

or lawyer’s clerk, who produced the 

golfing classic that the great American 

golf book collector Joseph Murdoch 

memorably described as, “standing alone 

in a century of silence”. 

The Goff satirises in 358 lines of verse, 

and in mock heroic vein, a game played 

on Leith Links, near Edinburgh, and while 

it is first and foremost a poetical exercise, 

it provides a great deal of information on 

the way the game was played at the time 

and the equipment used. 

The poem makes reference to the 

leading players of the day, the 

‘Caledonian Chiefs’, who were drawn 

from the professional elite of Edinburgh 

and were founder members of the first 

golf club, The Company of Gentlemen 

Golfers. The principal protagonists are 

Pygmalion [the author] and Castillo, who 

was later to be identified as Alexander 

Dunning, an Edinburgh bookseller and 

the year in which Les raisons... was 

published Henry contracted typhoid and 

died, and De Caux moved to Heidelberg, 

where he found employment with the 

Prince Palatine, husband of his late pupil’s 

sister, Elizabeth of Bavaria. 

It is to Elizabeth that the second and 

perhaps most appealing part of the work 

is dedicated. It is this second of the three 

parts (the third deals with manufacture of 

organs) that contains some of the more 

interesting of the work’s engraved 

illustrations. It deals with the construction 

of grottos and fountains, and though the 

Norfolk catalogue reproduced only the 

title page, I have found a couple of other 

illustrations from copies sold elsewhere in 

recent years. 

What would seem to be a giant figure 

of Neptune (left) is seen in a plate from 

the slightly wormed and stained 1615, 

Frankfurt first edition in a contemporary 

English binding of blind-stamped calf, 

possibly Mathison’s brother-in-law. 

All three 18th century editions of this 

foundation work are of the greatest 

rarity, but the 1793 third edition offered 

as part of the Bonhams Edinburgh 

‘Scottish’ sale of August 18-21 was not 

the first to have come onto the open 

market this year. In February, PBA 

Galleries of San Francisco had put up for 

sale a copy of the 1763 second edition.

Life is a work rarely seen in a 

jacket and this example made 

$2250 (£1365) in the PBA 

Galleries of San Francisco sale on 

August 6. 

The introduction to a 1981 facsimile of 

all three editions suggests that this 

second edition may actually be the rarest 

of the group, with only five copies 

recorded. Three are already in institutional 

collections – in the British Library, and in 

the libraries of the PGA, the Professional 

Golfers Association of America, and the 

USGA – and of the two remaining in 

private hands, one seems to be already 

A fount of knowledge on grottos 

THE lot in the Keys of Aylsham sale of 

August 27-28 that grabbed national 

media interest was the empty bottle of 

Madeira from Charles Dickens’ Gads Hill 

cellar that sold for £1250. 

However, another of the Norfolk best 

sellers was a 1615 first of a scientific 

work by Salomon de Caus, Les raisons 

des forces mouvantes avec diverses 

machines tant utilles que plaisantes aus 

quelles sont adionts plusiers desseings de 

grotes et fontaines. 

De Caus, or De Caux, also produced 

an important work on La Perspective, 

avec la raison des ombres et miroirs, that 

despite its French text was first published 

in London in 1612 and was dedicated to 

James I’s eldest son, Henry, Prince of 

Wales, to whom the author had taught 

perspective after his arrival in England a 

couple of years earlier. De Caux also 

worked in the royal gardens at Richmond, 

Greenwich and Somerset House, but in 

which sold for £8500 as part of Armand 

de Vuitry’s ‘Geometry and Space’ library 

at Sotheby’s in 2002.

destined for an institutional library. 

With this in mind, PBA pointed out 

that what they were offering, a copy 

removed from an old binding and now 

preserved in a custom-made folding calf 

box, might well be the first and last 

chance to acquire a copy of this edition – 

indeed an exceptionally rare opportunity 

to acquire any of those three 18th 

century editions. They valued this copy of 

a poem that once sold for just a few 

pence at a very bullish $150,000- 

200,000. 

Joseph Murdoch’s copy of the 1793 

edition, in a 19th century cloth binding, 

had made $70,000 when PBA sold that 

great library back in 1998, and 

there was quite a bit of presale 

interest in the 1763 copy 

of The Goff that the 

Californian saleroom offered 

in February, but even the 

scarcest golf books are not the 

bankers they once were and 

no one was prepared go as 

high as the reserve price of 

$130,000.

Edinburgh, in cloth-backed 

boards, was also marked 

second edition on the title 

page but bears the 1793 

Edinburgh imprint of Peter Hill 

(who, by the by, was a 

member of the Edinburgh 

Burgess Golfing Society) and is 

in truth a copy of the third 

edition. Dedicated to ‘To all 

the lovers of Goff, in Europe, 

Asia, Africa and America’, this edition 

also has an appendix containing two 

other poems in praise of Goff and an 

addenda in which the names of ‘the most 

celebrated golfers left blank in the first 

[and second] edition’ are supplied. 

This one was more successful than the 

PBA second edition and found a new 

home at £21,500 with a collector from 

Aberdeenshire. 

For the only copy of the 1743 first 

edition of The Goff ever to have come to 

auction – at least in recent decades – one 

has to go back to 1986, when a copy in a 

later Zaehnsdorf binding made £17,000 

in a sale held by one of the pioneers of

made quite a bit more than the £1450 

managed by the Aylsham copy, which 

was complete in worn old boards – so 

was it cheap? 

Well there was quite significant 

damage to three of the plates and a quite 

a bit of browning elsewhere, but even so 

it may have been a good buy at that 

price.

PBA Galleries held their second 

specialist golf sale of the year on August 

6, when the bidding peaked at a record 

$13,000 (£7880) for an 1857 first edition 

of a work that is both the first book of 

golf instruction, and the first in prose 

about the game. 

The Golfer’s Manual, published in 

Cupar, was the work of Henry Brougham 

Farnie, though issued under the 

pseudonym, ‘A Keen Hand’. A native of 

Bruntisland in Fife who studied at St 

Andrews University, Farnie was the author 

of several guidebooks, editor of a Fife 

newspaper and later a journalist based in 

London. 

Topics covered in his manual include 

the history of the game, details of 

equipment, golfing terms, rules and a list 

of Scottish courses. In the original flexible 

and gilt-decorated red-cloth binding, 

featuring crossed golf clubs, it was 

complete with the lithographed 

frontispiece portrait of Allan Robertson, 

one of the first professional players of the 

game and a celebrated maker of featherfilled 

golf balls.

The first golf anthology was Historical 

Gossip about Golf and Golfers by ‘A 

Golfer’, now known to be one George 

Robb. Published in Edinburgh in 1863, 

the contents include a history of the 

Bruntisland Links, descriptions of the 

Dutch game of Kolf and the French Jeu 

de Mail, the now famous sketch of ‘Cock 

o’ the Green’, an early golfing obsessive 

by the name of Andrew McKellar, and 

‘The Golfer’s Garland’, one of the two 

poems added to the 1793 edition of The 

Goff. 

In the original bright green wrappers 

and formerly in the collection of O.M. 

Leland, whose signature and ownership 

markings it bears, the copy of Historical 

Gossip about Golf seen in San Francisco 

was bid to $11,000 (£6665).

THE Bavarian capital Munich 

is one of the major centres of 

the German art and antiques 

market and is home to many 

auctioneers, dealers and 

galleries. It is a city with 

numerous museums, catering 

for all tastes. 

The latest addition is the Brandhorst 

Museum with its multi-coloured facade, 

built to house the contemporary art 

collection of Udo and Anette Brandhorst. 

It opened in May and includes over 60 

works by Cy Twombly. The new museum 

is now a magnet for tourists and local 

residents alike. For over 50 years Munich 

has also played host to Germany’s most 

important art and antiques fair, the Kunst 

Messe München (KMM). 

In recent years, however, the fair has 

been overshadowed by squabbles 

between the organising committee and 

their fellow dealers, which led to 

numerous participants setting up their 

own competing or complementary events 

in town. At the beginning of this year the 

old guard resigned and the remaining

priced at SFr28,000 which Swiss dealer 

Segal will show at the 54th Kunst 

Messe München – Fine Art & Antiques

organisers from North Germany to 

revamp the Kunst Messe München. When 

the deadline came however, only 30 

participants had signed up, less than a 

third of the required number. Not 

surprisingly, this year’s fair was cancelled, 

although the thwarted organisers have 

expressed high hopes in setting up some 

form of alternative for 2010. 

A contributing factor to the debacle 

was the fact that the German dealers 

association, which holds the rights to the 

title, withdrew its patronage and 

transferred its affection to the Fine Art & 

Antiques München. This fair was 

established in 2008 by several influential 

renegades from the KMM and held its 

successful premiere last October. Thus, 

this year’s staging has the somewhat 

cumbersome title 54th Kunst Messe 

München – Fine Art & Antiques 

München. 

It is being held from October 16 to 25 

in the Postpalast, near Munich’s central 

train station. The circular building, loosely 

inspired by the Pantheon in Rome, was 

built in the 1920s and is a prime example 

of the innovative architecture of that era. 

For many decades it was used as a 

sorting office for parcels, and after 

extensive renovation it became available 

for cultural events. Even so, space is still 

fairly limited and for this year’s fair the 

number of exhibitors is restricted to 40, 

which is twice as many as last year. 

The focus is very much on traditional 

fields of collecting, with several specialist 

dealers for porcelain, furniture from 

Baroque to Biedermeier, oriental art, silver 

and jewellery, among them several TEFAF 

stalwarts such as Galerie Neuse from 

Bremen (Kunstkammer objects, silver and 

furniture), Franz Bausback from 

Mannheim (carpets and oriental textiles) 

and Senger Kunsthandel from Bamberg 

(furniture and works of art). Michael 

Nolte from Münster will be presenting a 

large selection of early 19th century 

French bronze clocks and his colleague 

Antiquités Ségal from Basle is offering a 

mid-18th century, 10in (26cm) long 

Strasbourg faïence tureen in the form of 

a boar’s head.

IT remains to be seen, if this relatively 

new event will permanently take over the 

prime position for Munich’s fairs. While 

the future of the earlier KMM is still in 

the balance, there will most probably be 

another competitor to contend with. 

In 2010, the long-awaited new fair 

Highlights – Die internationale 

Kunstmesse München, organised by a 

group of top-notch dealers around 

Konrad Bernheimer, is due to hold its 

premiere. This fair, assuming it actually 

gets off the ground, will be the expanded 

version of the joint dealers’ exhibition 

Munich Highlights, which has been held 

at several venues in the centre of town 

since 2004. 

This year’s Munich Highlights, which 

runs from October 15 to 18, has grown 

in size yet again and now has 35 

participants, who are exhibiting at 15 

different locations. As in previous years, 

Bernheimer has the most guests (ten), 

among them the TEFAF veterans and local

rooms were previously used by Sotheby’s 

for sales and viewing, but as a result of 

the financial crisis and market turndown 

the auctioneers have reduced their 

presence in Munich and now retain an 

office at the same address and have 

made way for Sundheimer. He is playing 

host among others to

Gordian Weber, who will show 

antiquities in Munich.

A solid banker 

every six months 

ANOTHER autumn attraction is the art 

and antiques fair Kunst & Antiquitäten, 

which has been held in Munich twice a 

year, in May and October, for the last 40 

years and has had no need to change its 

concept. 

Never aspiring to be more than a 

reliable source of art and antiques from 

all fields, this fair with its 60 exhibitors, 

mostly from Bavaria, the rest from other 

parts of Germany, has cornered a good 

niche market. This autumn it is open from 

October 17 to 25 and is situated in the 

Paulaner Beer Hall at the Nockherberg, 

just east of the town centre. 

On offer are Baroque furniture and Art 

Nouveau and more or less everything in 

between. Among the more unusual 

pieces on offer are two saxophones made 

in the 1860s by Adolphe Sax, the 

inventor of the instrument. They are 

being sold by Gunther Joppig, who until 

recently was head of the musical 

instrument department at Munich’s town 

museum (Stadtmuseum). North German 

dealers Birbaumer and Eberhardt from 

Timmendorfer Strand are offering an 

ornate 2ft 5in (75cm) tall, 19th century 

ivory and horn mantel clock, laden with 

hunting motifs.

for Art Nouveau and modern design. The 

two main competitors are in Schwabing, 

just to the North of the town centre. 

Both Quittenbaum and Von Zezschwitz 

hold their major sales in October. 

Highlights at Quittenbaum’s sale on 

the 20th sale include this 22in (57cm 

with marble base) high bronze and ivory 

figure of Snake Dancer, left. 

It was modelled sometime after 1924 

by Otto Poertzel, one of the most 

renowned sculptors in this field. Born in 

Thuringia in 1876, Poertzel trained as a 

porcelain designer, following in his 

father’s footsteps, before he decamped to 

Coburg and later to Munich and Berlin, 

where he worked as a sculptor. 

In the 1920s and 1930s he received 

many commissions from members of the 

Saxe-Coburg-Gotha family, which 

ensured his financial independence. 

Alongside his conventional bronze 

portrait figures Poertzel is well known for 

his extravagantly posed dancing girls, 

such as this one. For some time, he 

cooperated so closely with Ferdinand 

Preiss, equally famous for his 

chryselephantine figures, that their 

unsigned works are difficult to tell apart. 

There is no doubt about the authorship 

of this Snake Dancer, which Quittenbaum 

has estimated at €28,000. It is signed on 

the base: Prof. Poertzel. In 1913 the artist 

was awarded an honorary professorship, 

a title he integrated into his signature.

Wealth of glass, 

from Gallé to Loëtz 

TWO days after the Quittenbaum 

auction, on October 22, local competitors 

Von Zezschwitz are holding their 

autumn sale. 

At the end of August two of the three 

founding members of the firm, which 

started trading in 2001, announced that 

they were retiring. 

Beate Dry von Zezschwitz and her 

husband Graham Dry have decided that 

eight years are enough and are leaving 

the running of the firm to their cofounder 

Carolin Bergner. Graham Dry 

will, however, continue to serve in an 

advisory capacity. 

The sale on October 22, their 55th, 

will as usual include a wide variety of 

applied and decorative art from all over 

the world. 

There will be glass vases by Emile Gallé 

and Loëtz, furniture by Richard 

Riemerschmid and Carlo Bugatti, 

silverware by Tiffany New York and 

ceramics from Meissen, Nymphenburg 

and Vienna, to name but a few. 

Whilst not being among the most 

expensive lots, the pair of electric 

candelabra pictured on page 46 is 

certainly one of the most impressive 

pieces on offer. With a total height of 7ft 

4in (2.23m), these 1920s sheet copper 

and gilt lamps on bird’s eye maple bases 

(shown without their glass shades) are far 

from climate-friendly – they use 20 bulbs 

apiece – but they are a great eye-catcher 

and most certainly a conversation piece, 

estimated at €9000.

African art collected 

over 40 years 

JUST over a year ago, Neumeister sold 

African sculptures from the vast and 

varied collection of the German-American 

businessman Walter Bareiss. 

On October 14-15 they are dispersing 

another collection, although this one is 

closer to home. It is the property of Karl- 

Ferdinand Schaedler, an internationally 

known expert on African art, who has 

been collecting for over 40 years, having 

first visited the Continent whilst working 

for the European Development Fund. 

During his long and varied career 

Schaedler taught at the University of Dar 

es Salaam in Tanzania and for several 

decades was an independent advisor to 

the German government in matters 

concerning international economic 

cooperation, development and aid. 

He also worked for several auction 

houses and from 2003 has been in-house 

expert for Neumeister’s sales of Tribal art. 

Now, shortly before his 80th birthday, he 

has decided to call it a day. 

He defines the auction as “an act of 

liberation for me and my children”. 

Coming up for sale are over 400 

pieces from all parts of Africa, as well as 

several works from Asia and South 

America. Shaedler was particularly 

attracted to cult objects from West Africa, 

and the collection contains particularly 

fine examples from Guinea, Liberia, 

Nigeria and Cameroon. Masks from the 

Dan of Liberia have estimates from 

€12,000 to €40,000, those of the Bobo 

in Burkina Faso from €25,000 to 

€30,000. 

A few of the pieces on offer can be 

attributed to individual craftsmen. Among 

them is a monumental, 5ft 2in (160cm) 

tall Yoruba mask, which was carved by 

the artist Bamgboye (c.1893–1978) and is 

estimated at €30,000 to €40,000. To 

round off the sale Schaedler’s extensive 

library, which has been grouped together 

in about 150 lots will be auctioned off, 

presumably many of them to the new 

owners of the pieces from his collection.

HERMANN Historica have been holding 

their biannual auctions of arms and 

armour, antiquities and historical 

collectables since the 1980s, although the 

beginnings of the firm go back 20 years 

before that. Their upcoming sale from 

October 5 to 9 contains several thousand 

lots and encompasses antiquities, 

including a further selection from the 

well-known Axel Guttman collection; 

pieces of armour, 17th century flintlock 

weapons, 18th century cannons, furniture 

made from antlers, narwhal tusks, a 16th 

century apothecary’s mortar bronze 

(estimate €16,000), a late 15th century 

German chain mail shirt (estimate 

€15,000) and a set of gold travelling 

cutlery, which once belonged to King 

Fuad I of Egypt (estimate €18,000). 

Surely among the most bizarre lots on 

offer is a so-called paradummy that goes 

by the name of Rupert. The 2ft 9in 

(85cm) tall puppet is made of sackcloth 

and was filled with wool, sand or wood 

shavings and fitted with its (or his) own 

little parachute. In the run-up to the 

Normandy landings many hundreds of 

Ruperts were dropped over France in 

order to divert the enemy’s attention 

under the code name Operation Titanic – 

it was a ruse that apparently succeeded. 

The Americans had employed similar 

decoys, which they called Oscar, 

apparently because they bore a certain 

resemblance to the Academy Award 

statue of the same name. 

Very few of the paradummies used in 

the war survived and they are almost all 

in private or museum collections. In the 

1980s a quantity of unused Ruperts were 

discovered at a disused airbase in England 

and found their way onto the market. 

One of these is being offered by 

Hermann Historica, estimated at €1000.

POSTERS and banners are up 

all over Brighton, the leaflets 

are running out and demand 

for tickets is high for this 

weekend’s Brighton Art Fair – 

the largest selling art 

exhibition on the South Coast 

where prices range from £50 

to £2000. 

The organisers received 300 

applications from contemporary artists 

across all media for the 100 available 

places at the three-day event (Friday 

October 2 to Sunday October 4) at the 

town’s Corn Exchange. 

Originally built in the early 19th 

century as the Prince of Wales’ riding 

school, the Exchange is adjacent to the 

Prinny’s domed stables, now The Dome 

theatre. 

Fair organiser Jon Tutton said: “We 

sold more than £500,000-worth of art at 

this fair last year, not including the 

commissioning work.”

Busy Bowman 

NEXT event in a busy autumn for 

Bowman Fairs is the fair at Stafford 

Bingley Hall County Showground from 

Friday to Sunday October 2 to 4. 

Some 320 standholders are expected, 

and adding variety to the fair’s traditional 

strengths of the furniture and silver are

Harrogate on Saturday and Sunday 

November 7 and 8. 

Said Helen Bowman: “We have had a 

great response from dealers all over the 

country supporting the event. We have a 

capacity of 350 in the two halls and have 

a number of stalls out on option and are 

busy getting confirmations.” 

Many standholders will go to York 

after the Staffordshire show. Newcomers 

to Bowman events include Le Style of 

London with Deco furniture and Malcolm 

Eglin Antiques from Northumberland 

with decorative antiques.

Keeping a 

beady eye 

on Harrow 

AMONG the most experienced of 

enthusiasts looking forward to this 

Sunday’s 20th annual Beadwork and 

Bead Fair in north-west London, 

Stefany Tomalin can testify to the 

lasting fascination beads can exert. 

A founder-member of the Bead 

Society in 1989 and owner of Beads!, a 

shop in London’s Portobello Road from 

1982 to 2001 when the lease came to 

an end, Stefany, has written a number of 

books on beads, based on her huge 

collection. 

She says: “The Bead Society has 800 

members, some of whom travel to Africa 

regularly and pile up their tables with 

strings of beads, traded in the past from 

Venice, or made in Africa. 

“One dealer who will be at the fair is 

Abdul Touray with African beads and 

there will also be specialist ethnic dealers

WELL-ATTENDED though it was, last 

weekend’s fair at Alexandra Palace 

(Sunday September 20) was a bit of a 

stinker. 

An apologetic Blair Barrows of fair 

organisers Nelson Events explained: 

“The management at Alexandra Palace 

were having the surface of the floor in 

the West Hall re-laid using solvent-based 

materials. They were still working on this 

on the Sunday until we told them to 

stop. 

Although it was a good show – well 

attended and with more stallholders – it 

was a bit of a disaster for us. We had to 

refund a lot of our customers and some 

people had to visit the medical centre. 

“We are meeting with the Alexandra 

Palace management and will be 

contacting all our dealers with news of 

the outcome of that meeting.” 

Shared booking 

SOME encouraging results for the book 

trade from PBFA’s York National Book 

Fair, the largest in the UK, at York 

Racecourse on September 11 and 12. 

Boosted by more complimentary 

tickets, there was a record attendance of 

more than 2000 and exhibitor returns 

showed that the fair netted £503,549 

with an average per-exhibitor take £2600. 

Unlike last year, when a few very large 

sales skewed results and the fair took 

£582,449, there was a better share of the 

takings for all in 2009, with a great many

SIR – Oxfam makes no apology for running its shop 

network as an effective, innovative business in order to 

raise money to help us fight poverty all over the world. 

The more efficiently our shops run, the better we are able 

to make a difference to countless thousands of lives 

around the world. 

Oxfam shops are only successful when they are 

welcomed and embraced by the community in which they 

operate. 

Our bookshops are almost always opened in towns in 

which there is already a successful Oxfam shop that is 

working with the local community. We have to be 

accountable for the return on our investment and the 

investment of our supporters in the community who give 

us their time and donations. We certainly don’t target 

existing booksellers: we simply look to survive in a really

Oxfam bites back over the book trade 

SIR – We would like to give Oxfam’s 

perspective on the debate regarding our 

sales of secondhand books and bric-abrac 

(See Peter Moore’s View, How much 

of a charity case is Oxfam?, Back Page, 

ATG No 1902). 

We are naturally anxious to maximise 

the value of donations to our shops in 

order to provide funding for our projects 

fighting poverty in almost 70 countries 

across the world. As well as providing 

emergency relief for people affected by 

disasters such as floods and earthquakes, 

Oxfam also carries out long-term 

development work with poor 

communities, helping people to provide 

for their families, send their children to 

school and gain access to services that 

we take for granted, such as clean water 

and basic healthcare. 

Like other charities, we are constantly 

striving to be more professional in our 

quest to increase our income, so that we 

can offer more help to more people. 

Donors have different reasons for 

giving valuables. Sometimes people 

donate presents or inherited items, which 

they don’t want themselves, but feel that

giving them to charity is more appropriate 

than selling them for their own profit. 

Others give to us because they want 

to make a contribution to our work, and 

we want donors to know that their gift 

will be priced fairly and accurately and 

that we will use it to raise as much as

discourage dealers from buying items in

Scholars, Dealers and Collectors awards 

an annual bursary to a student studying

purpose of this bursary (value £400) is to 

enable him or her to travel in pursuit of 

their studies in the UK or abroad.

An industry that had operated broadly the same way 

for 100 years has been massively affected by all sorts of 

things in recent years: the lowering of retail prices for 

books, the huge growth in property rates and utility costs, 

and the rise of the internet and grocery retailers. 

Oxfam is not shutting down secondhand booksellers – if 

a business model is so marginal that an Oxfam shop 

opening nearby decimates it, then we are not the 

problem.

The role of Valued at Oxfam, a small 

team of staff and volunteers based in our 

West London office, is to help shops to 

value and sell donations that are worth 

more than the average, and to encourage 

supporters to donate valuable items.

I have found the last two weeks of the 

ATG Personal View section to be 

inexpressibly depressing. 

Having finished a Master’s in Art 

Connoisseurship only two weeks ago, I 

have been struggling to maintain a 

hopeful outlook for the future despite 

numerous rejections for the most 

mundane positions at dealerships and 

auction houses all over London. 

Perhaps an effort could be made to 

valuable to be sold in the shops goes to 

auction, where it is sold at the market 

price. We very much appreciate the 

support we receive from the traders and 

auctioneers who advise us, offer a 

valuation service and sell donations on 

our behalf.

A LAWYER WRITES 

A GALLERY owner presented me with a rather unusual 

scenario. He was putting on an exhibition for two 

artists simultaneously. The artists’ work was 

complementary in many respects. There was no 

dispute on this and each of the artists was happy in 

principle. 

Ever alert to new ideas, one of the artists (‘Artist A’) 

experimented by covering some of the second artist’s 

(‘Artist B’) work with a transparent yellow film. The 

result was that Artist A’s work then bore a greater 

similarity to Artist B’s work, as their colour schemes 

now looked similar, given that the abstract shapes 

which they both painted had some similarity in any 

event. The gallery owner was very struck by this 

suggestion, thought it an excellent idea, very original 

and wanted to add the covering film to just a couple of 

Artist B’s works at the joint exhibition. 

Artist B objected. The exhibition was approaching, 

and the dispute started to get serious. Nobody was 

going to pull out of the exhibition, and there was 

certainly nothing in writing on the issue. 

The gallery owner came to me. Was there any law 

on the point? 

He was surprised to hear that there was indeed and 

that the position in principle is covered by provisions of 

the Copyright, Designs and Patents Act 1988, under 

the heading ‘Moral Rights’. 

Section 80 states as follows: 

“(1) The author of a copyright literary, dramatic, 

musical or artistic work, and the director of a copyright 

film, has the right in the circumstances mentioned in 

this section not to have his work subjected to 

derogatory treatment.” 

Subsection (2)(a) states: 

“‘treatment’ of a work means any addition to, 

deletion from or alteration to or adaptation of the 

work ...” and 

Subsection (2)(b) states: 

“the treatment of a work is derogatory if it amounts 

to distortion or mutilation of the work or is otherwise 

prejudicial to the honour or reputation of the author or 

director”. 

Here the crucial word may well be “distortion”. The 

most similar case that I have come across which 

actually went to court took place in Canada. An artist 

claimed ‘breach of integrity’ after a Canadian shopping 

centre draped decorative ribbons over the necks of his 

sculpted geese. 

In 1962 there was an interesting case in France 

concerning the artist Bernard Buffet. He was awarded 

damages against a purchaser who had taken apart one 

of his works. Buffet had constructed a painting on six 

panels of a refrigerator, signing one panel. The judge 

decided that as there was only one signature, this 

constituted evidence of Buffet’s intention that the work 

be considered in its entirety. The result was that Buffet 

received damages for violation of his integrity rights 

because the owner of the fridge sold each panel 

separately. 

In Australia, a sculpture was commissioned by a 

company in Sydney. Unfortunately, the sculpture did 

not fit into its allotted space, so the company just

chopped away the upper bits. Not surprisingly, this was 

also an infringement of moral rights. 

The exploitation of aboriginal artists’ work has given 

rise to a number of allegations concerning their ‘moral 

rights’. In one of these, a textile designer, flattered to 

have her work exhibited at museum level, later saw her 

paintings mass produced as a clothing design in major 

retailers. The Aboriginal Art Management Association 

became involved, proceedings were issued, the stock 

was destroyed by agreement with the offending 

parties, and a financial settlement paid. 

What happened with the gallery owner and the two 

artists? They eventually settled it between them, 

agreeing that just one painting would be draped with 

the yellow film. The exhibition went well, and the 

gallery owner felt vindicated when a purchaser bought 

the work with the yellow film covering and also a work 

from Artist A which had similarities. The purchaser 

wanted the yellow film, as she could see that it 

enhanced the similarity between the two artists. 

So, just because you own a valuable work of art 

does not mean that you can slice it into pieces or 

otherwise ‘adapt’ it: you may land yourself with a claim 

for damages, or an injunction, for infringing the artist’s 

moral rights.
