• As S/C dismisses suit against US/Ghana
Military Co-operation Agreement

THE SUPREME Court has, in
a unanimous decision, thrown
out a consolidated suit filed
by Brogya Gyenfi, the Ashanti
Regional Youth Organizer of
the National Democratic Congress (NDC),
and one Emmanuel Koti challenging the
government’s decision to sign the United
States- Ghana Military Co-operation
Agreement.
The seven-member panel chaired by
Chief Justice Anin Yeboah said the full
reasons of the court would be ready on
May 20, 2020.
Subject matter
It would be recalled that in the year
2018, the NDC's Ashanti Regional Youth
Organizer sued the government over its
defence co-operation agreement with the
United States.
The applicant was praying the court to,
among other things, “set aside” the agreement
on the grounds that it was “not in
the national interest of Ghana, and contravenes
articles (1 (2), 2, 11, 33, 125, 135,
140, 75 and 73 of the 1992 constitution.”
Mr Gyenfi was also asking for “ a declaration
that the word ‘ratify’ used within the
provisions of Article 75 of the 1992 constitution
is a term of art which has a true
meaning of incorporating international law
and treaties into the domestic legal system
of the Republic of Ghana and not prior
approval or approval.”
He was further seeking a declaration
that the ratification by Parliament of the
supposed agreement between Ghana and
the Government of United States of
America on Defence Co-operation, the
Status of United States Forces, and Access
to and use of agreed facilities and areas in
the Republic of Ghana (hereinafter referred
to as Defence Co-operation Agreement)
on March 24, 2018, when the
supposed agreement had not been executed
by the President or person authorized
by the President as provided for by
Article 75 of the 1992 constitution, was
contrary to the said Article 75 of the 1992
constitution and same was null and void.
The defendants in the matter were
Gloria Akuffo, the Attorney General and
Minister of Justice, and Dominic Nitiwul,
Minister of Defence.
The suit came days after Parliament ratified
the pact despite stiff opposition from
the Minority, who had staged a walkout
during the debate in Parliament whilst the
Majority approved the pact.
Background
Following the ratification of the agreement,
US troops will, among other things,
be exempted from paying taxes on equipment
that is brought to Ghana as well as
use Ghana’s radio spectrum for free.
Government said it was only respecting
the existing Status of Forces Agreement
with the US signed since 1998 and reviewed
in 2015, under the previous National
Democratic Congress (NDC)
administration.
But the Minority contended that the
agreement, as it existed in the past, did
not have the same clauses like the current
one that gives the US unlimited access to
Ghana’s military facilities.
The United State Embassy in Ghana
explained that it was only planning joint
security exercises with Ghana, and that
would require that US military personnel
would be allowed access to Ghana’s military
facilities and that they were not going
to build a military base.
Stop sacking contact tracers

Agyemang Manu, has revealed
that residents of Bukom and
Jamestown are preventing contact
tracers who attempt to take samples
for Coronavirus testing.
At a press briefing yesterday,
Mr Manu pleaded with residents
to allow contact tracers into their
houses and do their work so we
can defeat the marauding virus
that has already killed 18 people in
Ghana and over 250, 000 people
globally.
“People are preventing contact
tracers from entering their homes
to do their work. We hear residents
in Jamestown and Bukom
are sacking them. Please allow the
contact tracers to do their work,”
Mr Agyemang Manu said.
The Health Minister also called
Ghanaians to wear the face masks
in a bid to stop the spread of the
Covid-19.
According to him, wearing the
masks and adhering to all the
safety measures will defeat the
killer virus earlier, so we return to
our normal lives.
Ghana on Monday recorded its
biggest jump in Covid-19 cases
from 2,169 to 2,719 within two
days.
This means 550 more cases
have been recorded since Saturday
when the last update was given.
According to the Ghana
Health Service, the Greater Accra
Region still leads with over 2000
cases.

S/Court awards man
over GH¢600k

AFIVE-MEMBER Panel of
Supreme Court presided
over by Chief Justice
Kwesi Anin Yeboah has
awarded a man who became
paralyzed and lost his manhood
through an accident a damage compensation
in the sum of GHc622,600.
The Supreme Court in January this
year delivered judgement in the case titled
'Kwadwo Appiah vs Kwabena
Anane' in which the plaintiff is a victim
of an accident in 2009. He sued the
defendant for vicarious damages.
The matter, which was started from
the High Court, went to the Court of
Appeal and later landed at the Supreme
Court in eight years.
The plaintiff, Mr Appiah, initially
asked for ¢400,000 but was finally
granted ¢622,600.
The apex Court, in its judgment,
said in part that “the time has come to
be forward-looking and award realistic
and comparable compensation to comparable
injuries to adequately compensate
for the long-term deformity,
mental torture and unimaginable
losses suffered.”
Other members of the panel were Justice Baffoe-
Bonnie, Justice Yaw Appau, Justice Gabriel Pwamang
and Justice Nene Amegatcher (who delivered the
panel’s judgement).
Medical report
The victim is unmarried but has a child with no
prospects of fathering any child again.
The accident caused the victim to be paralyzed. Indeed,
the medical report put his loss of genital functions
as one hundred percent (100%); loss of mobility
at fifty (50%) and psychological injury as sixty percent
(60%).
The events giving rise to this case started on April,
28, 2009.
The case was fought in the High Court in Kumasi,
was reviewed and ruled upon on appeal by the Court
of Appeal and for a final and conclusive resolution,
the case ended up in the Supreme Court. It was decided
finally in January 2020.
However, the Court was faced with the issues of
“the appropriate level of compensation to adequately
compensate the plaintiff in his personal injury claim;

and whether or not the court could award
a higher amount than what was claimed
by the plaintiff.
What’s the story?
A timber merchant hired a truck to
cart his timber logs from Diaso, near
Dunkwa, in the Central Region to Mim in
the then Brong Ahafo Region.
On reaching a place called Kwabena
Kumah, the vehicle got involved in an accident.
The plaintiff sustained serious injuries
and was first sent to Goaso Government
Hospital and later transferred to the
Komfo Anokye Teaching Hospital in Kumasi,
where he received intensive care for
about 5 months before being discharged
to continue his treatment as an outpatient.
In 2012, he sued the owner of the
truck for the sum of Gh¢400,000.00 for
special and general damages for the negligence
of the driver resulting in the injuries
suffered in the accident.
It turned out the vehicle had not been
insured, did not have a road worthiness
certificate and the driver was not licensed by law
either to drive the vehicle at the material time.
Story at the High Court
In the judgment delivered on October 30,
2015, the court found first that: the accident was
not caused by negligent driving because the evidence
of the police was that the vehicle developed
a fault and fell down.
However, by permitting a vehicle to ply the
road without valid documentation such as road
worthiness certificate and insurance as well as authorising
an unlicensed driver to drive the truck,
the court held that the defendant should be held
vicariously liable for the plaintiff’s claim.
And what is vicarious liability?
That is where a person or entity is held for
damages or harm caused by someone else. An
example is when an employer is held liable for
the action of one of his employees.
The judge then awarded the plaintiff general
and special damages in the sum of
Gh¢20,000.00.
Dissatisfied with this decision, the plaintiff
appealed to the Court of Appeal.
In May 2018, the Court of Appeal reversed
the award on the assessment of damages made
by the High Court and awarded the plaintiff
damages (those that could be quantified and
those that couldn’t) and cost totalling

Gh¢150,000.00.
The defendant then appealed to the highest
court, the Supreme Court, requesting that they
reverse the decision of the Court of Appeal and
restore the award made by the High Court.
The Supreme Court judgement
In the words of Justice Amegatcher, “the
time has come to be forward-looking and award
realistic and comparable compensation to comparable
injuries to adequately compensate for the
long-term deformity, mental torture and unimaginable
losses suffered.
"This, we believe, will give affected persons
hope that the State for that matter and the justice
delivery system will not abandon them in their
times of need.
"It will also serve as a deterrent to vehicle
owners, drivers, professionals and workers into
whose care precious lives of people are entrusted”.
In arriving at a decision, the Court considered
the following factors:
It is not in doubt that as a result of the accident,
he became paralysed and this condition is
likely to remain for the rest of his life. He went
on the truck as a whole human being and after
the accident came out on a stretcher and has
been so ever since.
The plaintiff has gone through considerable
pain and suffering cannot work as a timber merchant
again and has no prospects of getting any
paid job from any employer. It is not out of
place to describe plaintiff as a total wreck and a
citizen of this country with reduced capacity to
enjoy the pleasures of life again.
"He is incapable of doing anything by himself,
cannot get an erection again and is totally
incontinent for the rest of his life. The plaintiff’s
condition is the worst that can happen to
any human being.
*Inflation, i.e., the purchasing power of
money and the economic factors of the day."
The Court also indicated that in June, 2012,
when the action was instituted claiming
GH¢400,000.00, the exchange rate of the
United States Dollars to the Ghana Cedis was
US$1=GH¢ 1.89.
In January 2020, the value was
US$1=GH¢5.60. The value of the initial claim
made by the plaintiff had therefore diminished
over the eight years that the case had lingered
on in the courts.
Damages
After considering all these factors, the
Court awarded the following damages:
Pre-trial loss of earnings GHc5000, special
damages for medical expenses etc-GHc10, 000,
future loss of earnings for 21 years at GHc800
per month-201, 600.00, Nursing attendant for
two nurses at 500 per nurse for 21 years-126,
000, general damages for pain, suffering, mental
agony, loss of amenities, loss of expectations
in life, physical disabilities and loss of sexual
pleasure-280, 000. The total damagest is
GHc622, 600.
So in the end, the court varied the award by
the Court of Appeal from GH¢150,000.00 to
GH¢ 622,600.00, something that rarely happens.
Conclusion
It is a fact that productive lives are being rendered
disabled due to serious injuries as a result
of road crashes.
According to the Police MTTD, 94% of road
crashes are caused through human error. Often
the criminal process leaves victims disappointed
with the paltry fines imposed on culprits as punishment.
Take ,for instance, the case of the woman in
her late twenties who was left paralyzed by an unlicensed
driver driving a vehicle not road-worthy.
He was only fined less than a thousand
Ghana cedis. Yet his victim continues to live with
the disability.
In the words of Justice Amegatcher while delivering
the judgment, “It could have been
avoided but for the recklessness on our roads,
coupled with impunity, indiscipline and lack of
value for human life by drivers who ply the roads
in this jurisdiction”.

Okyenhene also presented relief
items worth thousands of

distributed to vulnerable and poor
subjects in the communities.
The items include 400 bags of
rice, 100 bags of beans, 17 bags of
gari, 100 cartons of tuna, and 1000
boxes of tomato paste.

delivered to GIBA, GJA, PRIM-
PAG, NMC and the leadership of
state-owned media for onward
distribution to those they consider
frontline media workers
since they are best placed to identify
them.”

this will augment your supplies
and assist you as you rise to this
national call at this moment”.

Killing bed-bugs will improve academic work

Annan Wilberforce, has stated
that the ongoing disinfection and
fumigation exercise by Zoomlion
Ghana Limited in various second
circle institutions in the country
will improve academic work.
According to her, after the exercise,
the old canker of students
having to wake up all night to deal
with bed-bugs will be over, adding
that "this will help the students
have sound sleep which will positively
impact the academics of the
school.
She said unlike the past when
students didn't have to wake up
all night dealing with bed-bugs,
present students always came to
class exhausted and feeling sleepy.
"The exercise will affect everybody
positively because the students
will have peaceful
minds to learn and the
teachers will make their impacts,"
she state.
Mrs Annan Wilberforce,
therefore, appealed to the
government to, at least, repeat
this exercise every six
months.
Speaking about the exercise,

disinfection and fumigation exercise

rid them of bed-bugs, wall geckos
snakes and all kinds of reptiles.
"The good thing is that this exercise
is being done before schools
reopen and for the next six
months no bed-bugs, snakes, flies
and reptiles can come near because
the chemical
has sixmonth
potency,"
she added.
The first day
tour saw disinfection
and fumigation
done in
the dormitories,
dining halls,
classrooms, offices,
the administration
block
and other places
in such schools
as Edinaman SHS, Eguafo SHS,
Komenda SHS, Aggrey Memorial
SHS, Mfantsiman Girls,
Mankessim Tech. SHS, Methodist
SHS Salt-pond and Kwagyir Aggrey
SHS.
At Edinaman SHS, the first
team spoke with the headmaster
of the school, Mr Obeng
Ebenezer, who commended the
initiative by Zoomlion and stated
that the teachers, including himself,
had missed the ambiance of
school, and the students.
At Eguafo SHS, Mrs Philis Asante-Krobea
said the school spent
over GHC3,000.00 each term on
fumigating the domitories alone
because of bed-bugs and therefore
welcomed the exercise.

SHS, used the occasion to appeal
the government and Kingpork
Ghana Limited to speed up construction
works the road network
that links the school to other
places and expressed satisfaction
for the work done by Zoomlion.

SHSs need regular spraying to ward off bedbugs
YESTERDAY, we carried a story on the
spraying of senior high schools (SHSs)
by waste management giants, Zoomlion
Ghana Limited, to rid the schools of wall
geckos, reptiles and insects, particularly
bedbugs.
In that story, a headmistress expressed
joy at the spraying of bedbugs.
Bed bugs (Cimex lectularius) are
small, flat, parasitic insects that feed
solely on the blood of people and animals
while they sleep.
Information available says bedbugs
can live several months without a blood
meal. This means once they get to a
place, they can stay there for long even
if they do not get anyone or animal to
feed on their blood.
It means they have the patience to lurk
around till a victim comes.
It is said that these insects live everywhere
across the globe, no matter how
dirty or clean the place is, and spread rapidly.
Records say they have recently been
found spreading rapidly in parts of the
United States, Canada, the United Kingdom,
and other parts of Europe, even
in five-star hotels and resorts.
The insects hide during the day in
places such as seams of mattresses, box
springs, bed frames, headboards, dresser
tables, inside cracks or crevices, behind
wallpaper, or any other clutter or objects
around a bed. Bedbugs have been shown
to be able to travel over 100 feet in a
night but tend to live within 8 feet of
where people sleep.
Even though bedbugs are not known
to spread disease, it is said their bites
cause itching that can cause the victim to
scratch the body and eventually suffer
some secondary skin infections.
They can also be a nuisance because
the itching from their bites causes the
victim stay awake and scratch the body
and thus lose sleep and as such suffer insomnia.
This is where students and even their
teachers come in. Students suffering
from insomnia would not find it easy to
pay attention to their teacher whereas a
teacher suffering insomnia would not be
able to teach well either.
However at end of the day it is the
students who would suffer because he
may not perform creditably.
Therefore, education authorities and
the district assemblies should help to
spray schools at regular intervals to kill
bedbugs present and prevent others
from migrating to the schools.
The headmistress we mentioned earlier
was lamenting that her school needed
GHc3000. 00 every term to spray bedbugs.
Her lamenting can induce laughing
from those who think the amount is too
small to be complained about but for a
school, it is huge. That is why PTAs, old
boys and public-spirited people too must
come in to help disinfect the schools.
Zoomlion say the efficacy of their insecticide
persists for six months. Therefore,
the stakeholders can fall on them to
spray schools twice every year at a negotiated
charge that can help the schools
save some money for other things, and
also bring some joy resulting from absence
of bedbugs and their troubles.
RoyalHouse Chapel enjoys free
Zoomlion disinfection exercise
ROYALHOUSE Chapel International,
Ahenfie, Circle, has
benefited from the free disinfection
exercise by Zoomlion
Ghana Limited.
The free exercise has been conducted
in many churches, schools, corporate institutions
among other places..
RoyalHouse Chapel, which is the latest
organisation to benefit from Zoomlion's
free gesture, saw spraying gangs disinfect
the church’s main auditorium,
administration block, children block,
teens' service auditorium, international
service auditorium, Oil Dome and the entire
compound.
A Communications Officer of Zoomlion
Ghana Limited and spokesperson for
the Corporate Social Responsibility Disinfection
Exercise, James Deku, who was at
the church to monitor the exercise, in an
interview, indicated his outfit had devoted
over GHc1 million to disinfect selected organisations
where people congregate at no
cost to them to help contain the spread of
the 2019 novel coronavirus (Covid-19).
He said the company had also made
cash donations to the University of Ghana
Noguchi Medical Research Institute, and
the National Covid-19 Trust Fund and hygienic
materials to vulnerable groups as a
multifaceted approach to helping to contain
the spread of the virus.

had donated some relief items to vulnerable
groups to sustain them in this difficult

Rev Gakpleazi pointed out that the

among key politicians in the fight
against COVID-19 in Ghana saying
it is the responsibility of the
President to keep the nation focused.
According to him, the government
should be cautious reacting
to political comments in the wake
of the pandemic since its primary
job is to ensure that Ghanaians are
protected.
“The President has to play the
bigger person in these politics because
he is the official leader of
the country. The government has a
primary role to play in building
consensus. I wish the vice president
had not replied the way he
did. The onus of bringing people
together lies on the President,” he
told Francis Abban on the Morning
Starr.
However, noted it will be difficult
for politicians to stop politicking
as elections get closer.
“At the moment it’s is important
that the nation focuses on defeating
COVID-19 which is
destroying the world. So far as the
elections are approaching in Dec it
is going to be difficult for politicians
to stay put”.
Meanwhile, former deputy Finance
Minister Cassiel Ato Forson
has admonished Vice President
Mahamudu Bawumia not to compare
the current COVID-19 pandemic
to the electricity crisis saying
it is inhumane to do that.
In a Facebook post, Mr Ato
Forson stated that “comparing a
pandemic to an energy situation
that occurred because the NPP
Government failed to invest in
power generation over an 8year
period only reflects the confusion
that has characterized your recent
pronouncements.
“In any case, it is inhumane to
compare a pandemic killing human
beings to an electricity generation
problem that was resolved by the

same government. It is time to
caution Dr. Bawumia not to be
proud of cosmetic macro-economic
data that fails to translate
into economic well-being. Today,
Ghana’s public debt has increased
from GHS 120.3 billion as at 31st
December 2016 to GHS 235

“Your government is struggling
to service interest on public
debt; as a result, lenders have
started charging penalties on delayed
interest payments. Sadly,
our debt levels are so high that
we risk becoming a high debt
distress country yet you have
failed to show humility and
competence in fixing your
mess.”
His comments come after
the Vice President in a jab encouraged
former President John
Mahama to compare data before
speaking.
According to Dr Bawumia,
the NPP has handled the
COVID-19 pandemic better
than the NDC would have handled
it.
“This time in the lives of our
country is really not a time for politics,
we are facing a global pandemic
and the focus of the
President is leading to make sure
the right things are done to protect
the lives of Ghanaians. that notwithstanding,
we have seen that the former
President John Mahama has been
making some statements and it has
been proven that many of those statements
are untruths.
“The data is very clear and so my
humble advice to the former President
is that he should take a look at the data
before you speak otherwise you would
end up embarrassing yourself. Agriculture
growth, we have performed better,
Industrial growth, we have
performed better, Inflation rate, we
have performed better…this is the
data…when it comes to jobs we have
created more jobs,” Dr Bawumia
stated on the sidelines of a COVID-19
meeting at the Jubilee House on Monday,
4 May 2020.
He added “I can say without
any fear of contradiction, the data
shows that in the history of the
Fourth Republic, there is no government
that has provided as
much infrastructure across all sectors
in its first term than the first
term the government of Nana
Addo Dankwa Akufo-Addo. If

Highlife Party on ‘Instagram Live’, not
holding back going all-out with aesthetics,

to dress in traditional attire.
At his party on Instagram
Live, he took viewers on a journey
of Highlife music covering the Ashanti,

Harm Kay also invited Ghanaian Highlife
legend, Kwabena Kwabena, to join him

GFA requests two-week
extension from CAF

Twum, has disclosed that the
FA has requested for an extension
from CAF to decide on
the future of the country's
2019/20 football season as yesterday
marked the deadline for
Member Associations to decide
whether to continue or truncate
the season.
The Ghana FA last week engaged
the various stakeholders
in a virtual meeting since the
outbreak of Vovid-19 to decide
on the future of the
2019/20 Ghana Premier
League.
Most of the clubs have suggested
that the 2019/20 football
season should be cancelled
whilst others have spoken
against the proposal.
The GFA is set to meet with
the Executive Council after
consulting with the clubs and
then later with the government
and health authorities before
taking a final decision.
Mr Asante Twum, in an interview,
confirmed that the
GFA had given CAF a situational
report on the pandemic
in Ghana.
"We have sent a situational
report by giving CAF enough
info on what is happening in
Ghana", he said in a media interview.
"We have notified them that
we cannot take a decision without
adhering to the directives
from the government. We have
given CAF an update and we
have requested for two weeks
within which we will come up
with a firm plan and decision
going forward," he added.

Hearts sign Nigerian
striker Ademola Kuti

joined Accra Hearts of Oak on a
free two-year deal with the Ghana

A club statement yesterday afternoon
read: “Hearts of Oak is
delighted to announce the signing
of striker, Kuti Ademola. The
lanky Nigerian professional has
signed a two-year contract with
the club.”
Kuti Ademola is officially the
fourth player to be announced by
the club after Niger midfielder
Abdourahamane Mamane Lawali,
Ivorian midfielder Eric Dizan and
