A lot has happened<br />

since<br />

<strong>the</strong> last article<br />

was written<br />

and I hope<br />

you will bear<br />

with me if I<br />

concentrate<br />

on <strong>the</strong> subject<br />

matter<br />

<strong>of</strong> <strong>the</strong> criminalization<br />

<strong>of</strong><br />

<strong>the</strong> seafarer<br />

and <strong>Master</strong>s in particular. I spoke on<br />

this subject at <strong>the</strong> Safety4Sea Forum in<br />

A<strong>the</strong>ns, Greece at <strong>the</strong> beginning <strong>of</strong> <strong>the</strong><br />

month and <strong>the</strong>re appears to be a lot <strong>of</strong><br />

misunderstanding as to whom and what<br />

will represent <strong>the</strong> <strong>Master</strong> in such cases.<br />

My argument is that <strong>the</strong> rule <strong>of</strong> common<br />

law must be applied and that is that<br />

a person is presumed “innocent until<br />

proven guilty;” not “guilty until proven<br />

innocent.” This is a contentious issue<br />

and I do not believe that all seafarers are<br />

innocent. The core issue here is that <strong>the</strong>y<br />

have access to proper legal representation<br />

and that <strong>the</strong>ir case is heard fully and<br />

independently.<br />

The case <strong>of</strong> <strong>the</strong> Ocean Atlas in South<br />

America highlights this problem. With<br />

paperwork in order and all forms completed,<br />

but <strong>the</strong>n <strong>the</strong> master is taken<br />

ashore and <strong>the</strong> ship spends three weeks<br />

detained before being released, and it is<br />

said to have been an administrative mistake.<br />

I sincerely hope that all members<br />

<strong>of</strong> <strong>the</strong> crew have recovered from this<br />

ordeal. Being <strong>American</strong> I believe that<br />

<strong>the</strong>y will, but it is still an unwarranted<br />

stressful situation.<br />

I choose this incident because it is relevant<br />

to <strong>American</strong> seafarers and brings<br />

home that <strong>the</strong> world is a changing place<br />

where such incidents can occur when<br />

least expected. It can happen to seafarers<br />

<strong>of</strong> any nationality and in any place.<br />

All too <strong>of</strong>ten <strong>the</strong>se events take place in<br />

countries that have a legal framework<br />

that at <strong>the</strong> least is suspect.<br />

One <strong>of</strong> <strong>the</strong> projects at <strong>the</strong> IMO that I<br />

have been involved with is <strong>the</strong> preservation<br />

<strong>of</strong> evidence. This came about due<br />

to <strong>the</strong> IMO paper LEG 99/INF.2 (10<br />

February 2012) titled “Draft Guidelines<br />

on <strong>the</strong> collation and preservation <strong>of</strong> evidence<br />

following an allegation <strong>of</strong> a serious<br />

crime having taken place on board a ship<br />

or following a report <strong>of</strong> a missing person<br />

from a ship, and pastoral and medical<br />

care <strong>of</strong> victims” which was submitted by<br />

Philippines, <strong>the</strong> United Kingdom and <strong>the</strong><br />

Cruise Lines <strong>In</strong>ternational Association<br />

(CLIA).<br />

This paper left <strong>the</strong> master exposed<br />

and I quote “The overarching role <strong>of</strong> <strong>the</strong><br />

<strong>Master</strong> is to ensure <strong>the</strong> preservation <strong>of</strong><br />

life and <strong>the</strong> safety <strong>of</strong> passengers and crew.<br />

Therefore, <strong>the</strong> care <strong>of</strong> <strong>the</strong> passengers and<br />

crew should take precedence over any<br />

concerns related to <strong>the</strong> preservation <strong>of</strong><br />

evidence.” This is not acceptable. And <strong>the</strong><br />

assumption is that crimes involve only<br />

passenger ships, which is not true. There<br />

are a number <strong>of</strong> rising incidents that can<br />

be construed as criminal acts and should<br />

have been investigated and not swept<br />

aside for <strong>the</strong> operation <strong>of</strong> <strong>the</strong> ship.<br />

This is a complex situation with many<br />

players in <strong>the</strong> mix from different bodies<br />

<strong>of</strong> <strong>the</strong> shipping industry and it is going<br />

to be difficult to resolve. My concern<br />

is that no master whe<strong>the</strong>r member or<br />

not is left exposed. The reply to this<br />

paper on behalf <strong>of</strong> IFSMA was led by<br />

Charles Boyle <strong>of</strong> Nautilus <strong>In</strong>ternational<br />

along with assistance from me and Allan<br />

Graveson. The reply has been submitted<br />

and once it has been reviewed and<br />

commented on <strong>the</strong> result will be posted<br />

on <strong>the</strong> IFSMA website along with o<strong>the</strong>r<br />

supporting documents so that members<br />

can follow <strong>the</strong> progress.<br />

I am not a salesman and never will be;<br />

<strong>the</strong> number <strong>of</strong> times I hear <strong>of</strong> seafarers<br />

coming forward after <strong>the</strong> event when<br />

<strong>the</strong>y believed that <strong>the</strong> P&I Club lawyer<br />

was <strong>the</strong>re for <strong>the</strong>m and it was not so.<br />

I would not criticize <strong>the</strong> P&I Clubs as<br />

in a number <strong>of</strong> cases <strong>the</strong>y have done<br />

excellent work and gone beyond <strong>the</strong>ir<br />

remit, but mariners must be aware <strong>of</strong> <strong>the</strong><br />

fact that <strong>the</strong>y represent <strong>the</strong> ship-owners<br />

interest first. That was why <strong>the</strong>y were<br />

formed.<br />

Regrettable as it is <strong>the</strong>re is a need for<br />

mariners and in particular masters to<br />

look at having personal insurance for<br />

pr<strong>of</strong>essional liability. There are a number<br />

<strong>of</strong> different policies to be had which vary<br />

in <strong>the</strong> cover that is provided, but I would<br />

advise that <strong>the</strong> <strong>Master</strong>MarinerProtect is<br />

looked at first and o<strong>the</strong>rs judged against<br />

it. I have coming across my desk a number<br />

<strong>of</strong> cases where masters have lost<br />

everything. This is regrettable and in<br />

most cases <strong>the</strong>y were not to blame, but<br />

where <strong>the</strong> incident took place left <strong>the</strong>m<br />

exposed.<br />

There is a task force regarding criminalization<br />

comprising Executive <strong>Council</strong><br />

members and <strong>the</strong> Secretariat researches<br />

into incidents and passes information to<br />

<strong>the</strong>m, but this is after <strong>the</strong> event. To assist<br />

in this particular work I would ask if any<br />

reader comes across or is made aware <strong>of</strong><br />

a criminal incident involving ships or<br />

seafarers to please forward it IFSMA HQ<br />

direct, or via Captain Jerry Benyo, so<br />

that we can build a proper set <strong>of</strong> data on<br />

how seafaring is changing.<br />

Working towards stopping <strong>the</strong> criminalization<br />

<strong>of</strong> seafarers is one <strong>of</strong> <strong>the</strong> subjects<br />

I will always fight for.<br />
