O’Donnell is remindingNorfolk County homeownersabout the importance of filing forHomestead protection.O’Donnell noted, “As yourelected Norfolk County Registerof Deeds, I am pleased to informcounty homeowners abouta valuable consumer protectiontool. Indeed, for most of us ourhome is the most important financialasset we have. If you owna home, and it is your primaryresidence, one way to protect it isto file a Homestead. The Homesteadlaw provides a homeownerwith limited protection againstthe forced sale of their primaryresidence to satisfy unsecureddebt up to $500,000.”Another feature of the Homesteadlaw is the allowance for afiling of an Elderly Homesteadapplication, which defines anelder as a person who is 62 yearsof age or older. This protectioncan be increased if the elderlycouple are each 62 years of ageor older and file jointly.The Register further noted,“Back in March of 2011, theHomestead law was updatedby an act of the MassachusettsLegislature. Current law statesa valid Homestead cannot beterminated when refinancing amortgage. Other enhancementsthat took place back in 2011 statethat a Homestead can provideprotections for a primary homeeven if it is kept in trust. Thedefinition of a primary residencewas also further expanded to includea manufactured or mobilehome.”While a Homestead providesimportant protections for homeowners,it is important to notethere are certain debts that areexempted from protection underthe Homestead Act. These includefederal, state and localtax liens, as well as mortgagescontracted for the purchase of aprimary home and nursing homeliens. Most other mortgages,debts, and encumbrances existingprior to the filing of the Declarationof Homestead, alongwith probate court executionsfor spousal and child support,are also not covered under theHomestead protection statute.Homestead documents are recordedat the Registry of Deedsfor a state imposed fee of $36.
