The undersigned hereby agrees as follows:
(1) Applicant understands and agrees that the Club, for the purpose of considering the proposal, will investigate Applicant’s financial responsibility, social position, and general reputation and those same attributes
of members of Applicant’s immediate family. In connection with this application for membership, Applicant hereby grants to Club, through its Board of Governors and any related committees, the right to obtain
references from past and/or present Club affiliations, and any other person or entity who may have any knowledge or information pertaining to Applicant. Applicant hereby grants to Club, through its Board of
Governors and any related committees, the right to obtain a credit report from any credit report agency.
(2) Applicant understands and agrees that all information regarding these matters will be made available to the Club’s Governors, Officers, General Manager, and members of any related committees. Applicant
hereby consents to such investigation and to all such disclosures and agrees never to make any demand on Club or any other person for the disclosure to Applicant of any of the information. Applicant hereby also
releases and discharges the Club, its Governors and Officers, and every other person who furnished, transmits or processes such information for the purpose herein mentioned, from any and all liability for having
done so, and this release shall be binding upon Applicant’s personal representatives, heirs, and assigns. Applicant agrees that Club has the absolute right to destroy and/or shred any and all documents pertaining to
Applicant’s request for membership in the event Applicant is not offered membership.
(3) Applicant and Club agree that if any dispute or controversy should arise in connection with Applicant’s membership status, use of Club facilities, payment of dues, fees, assessments, and charges, or by reason
of this application or anything related thereto, or any breach of any covenant, condition, obligation, agreement, or provision contained in or arising out of the Club’s “Membership Documents” including
but not limited to the following documents: the Articles of Incorporation of the Club (“Articles”), the Amended and Restated Bylaws of the Club (“Bylaws”); the Summary of Club Membership Program, the
Frequently Asked Questions, the Subscription Agreement and the Rules, Regulations and Policies of the Club (“Rules and Regulations”); then in that event Applicant and Club agree to submit the dispute(s) or
controversy(ies) to binding arbitration in conformity with the Dispute Resolution provision of the Club Bylaws.
(4) Applicant agrees that membership may be denied for any reason or no reason whatsoever, all in the absolute discretion of the Club’s Board of Governors. Applicant further hereby releases the Club,
its Officers, Governors and members from any liability in the event of such denial of ownership.
(5) Applicant represents that each statement in this application and/or its attachments is true and correct and agrees that any misrepresentation of any fact is grounds not only for rejection of membership, but for
expulsion, suspension and/or any other discipline if elected to membership whenever such is discovered by the Club.
(6) Applicant agrees to be bound by all of the terms of the Club Membership Documents now in effect or are hereafter effective by virtue of any subsequent amendment.
(7) Applicant and Club agree that should Applicant become a member of the Club, this Application for Membership shall constitute a contract and part of the obligations between the Applicant and Club.
