Fledgelings Day Nursery <strong>Hornchurch</strong><br />

<strong>Terms</strong> & <strong>Conditions</strong> <strong>2021</strong><br />

Admissions & Registration<br />

Please complete all the information requested on the registration form and keep the nursery up to<br />

date if there are any changes. Upon receipt of all completed registration forms/deposits,<br />

management will check availability and offer a guaranteed place if available. We do not currently<br />

operate a waiting list but if we cannot meet the immediate needs of parents/carers, it is the<br />

parents/carers responsibility to reapply at a later date.<br />

Once a place has been offered a registration fee of £100 is due for payment along with 2 weeks<br />

deposit. A week prior to the start date we offer a flexible settling pattern with the nursery directly.<br />

Registration fee covers nursery settling in sessions. The payments must be made as 2 separate<br />

transactions with a reference stating: Registration Fee and your child's full name and a second<br />

transaction stating: Deposit and your child's full name, this will help us to locate your payments. If<br />

we do not receive the monies by the set timescale given, your child’s offer of place will be<br />

withdrawn. We ask the parents/carers to notify us by email when they are making the payment to<br />

accounts@fledgelingsdaynursery.co.uk<br />

Change of Attendance / Cancellation or Withdrawal<br />

No changes are permitted to the contracted sessions for the first 8 weeks from the start date,<br />

therafter the normal notice period will apply of 4 weeks to reduce sessions or to terminate contract.<br />

This is from the date written notice is received and acknowledged by Fledgelings Day Nursery. If a<br />

parent wishes to increase their child’s attendance immediately and a place is available this will be<br />

offered at the Nursery Manager’s discretion. If a parent chooses to leave the nursery prior to the<br />

end of the notice period, fees will be charged giving 4 weeks’ notice. Deposit refund will be<br />

processed via bank transfer within 4 weeks of your child’s leaving date.<br />

Fledgelings <strong>Terms</strong> & <strong>Conditions</strong> are available for all prospective parents/carers prior to joining us as<br />

part of our registration vetting procedure all parents/carers are expected to provide two forms of<br />

original identification i.e. the child’s birth certificate and the parents/carers passport (one being<br />

proof of current residential address) prior to attending. These will be witnessed by a member of<br />

the nursery management team.<br />

Fledgelings <strong>Terms</strong> & <strong>Conditions</strong> represent the entire agreement and understanding between<br />

parents/ carers and/or others responsible for payment of the fees and conditions, terms and<br />

representations to the fullest extent permitted by law. <strong>Terms</strong> & <strong>Conditions</strong> can be revised at any<br />

given time which will supersede all previous versions and parents carers will be notified via<br />

ParentMail. Please note, it is the parent/carers responsibility to refer to these. Upon receipt of<br />

payment of a registration fee and deposit fee means parent/carers are compliant in line with<br />

Fledgelings current <strong>Terms</strong> & <strong>Conditions</strong> & any revised <strong>Terms</strong> & <strong>Conditions</strong>.<br />

Fees<br />

All parents/carers will receive a monthly invoice in advance of each calendar month. Invoices will<br />

be sent out by the 20 th of each month and all payment of fees are due by the 5 th of each month.<br />

Any late payments will incur a late fee charge of £35.00 which will be added to your account.<br />

If in the event an account remains unpaid, the nursery has the right to cease the childcare place at<br />

any time and legal action may be taken (legal costs will be added to outstanding debts). The nursery<br />

accepts various forms of payment.<br />

Nursery fees are reviewed annually in January and parents/carers are given two months’ notice in<br />

writing. Minimum standard Fee increase is £2.00 per year.The Proprietor of the nursery can review<br />

the fees at any given time and will always give two months’ notice in writing of any changes. If any<br />

payments are returned a £35.00 administration charge will be added to your account.<br />

Full fees are charged for all absences, bank holidays, Christmas closure and 3 staff traing days per<br />

year (dates confirmed at the beginning of each year). The nursery will be closed Christmas Eve 16:00<br />

and re-open on the first working day after the new year bank holiday. Any additional sessions or<br />

Birthday cakes requested in writing. If this can be offered the additional cost will be added to your<br />

next month’s invoice or in the case where the parents/carers have already given notice, payment<br />

may be requested at that time.<br />

If a child attends the nursery claiming the 30 hours maximum free funding entitlement, a small cost<br />

for consumables is charged per day. Please refer to our current Fee Information Sheet.<br />

Childcare Vouchers<br />

Fledgelings Day Nursery accepts all major childcare vouchers. If however you have accumulated<br />

money in vouchers we are legally obliged to contact the relevant voucher company and refund them<br />

direct and the voucher company will refund the parent.<br />

Government Funding (Nursery Education places for 2,3 & 4-year olds)<br />

The nursery offers various sessions under the Free Early Educational Entitlement. It is the<br />

responsibility of the parents/carers to check each term that they are still eligible to claim funding<br />

and notify us if there are any changes. Parents/Carers are required to sign an initial parent’s<br />

declaration form and return this by the deadline given along with, proof of the original<br />

documentation requested. If in the event that we do not receive this information we CANNOT claim<br />

your 15 hours universal funding or up to 30 hours funding and the parents/carer will be required to<br />

pay fees in full for that term.<br />

Parents/carers claiming up to 30 hours funding are responsible to re-affirm their 30 hour code. If<br />

for any reason that a funding claim is not accepted by the Local Authority the parent/carer will be<br />

required to pay fees in full that term. The funding is applied to the parents/carer(s) monthly invoice.<br />

We offer funding as a stretched offer and have a parents/carer(s) funding information sheet. If<br />

parents/carer(s) are eligible and intend to claim the maximum 15 hours (1 day) and at a later date<br />

becomes eligible for 30 hours funding, parents/carer(s) must apply in writing, to see if there is<br />

availability to attend to use their full amount of funding that term. When leaving the nursery in the<br />

summer term to start school all funding stops on the 31 st August. Pro-rata funding would vary on<br />

the parents/carer(s) last invoice pending your child’s last day of attendance.<br />

Session<br />

The minimum days the nursery provides is 2 days however if you are solely 15 hours funded we<br />

offer limited 1 day session per week.<br />

Staff Training Days <strong>2021</strong><br />

It is extremely important that staff working within the nursery undertake regular training to ensure<br />

that they are kept up to date with current legislation and childcare practice. Therefore, for your<br />

child’s best interest, the nursery will be closed 3 times a year to facilitate this:<br />

• Friday, 19 th February <strong>2021</strong><br />

• Tuesday 1 st June <strong>2021</strong><br />

• Wednesday 27 th October <strong>2021</strong><br />

Staff training days are charged inline with the current fee structure.<br />

Funding Transfer<br />

Families leaving the nursery who currently are in receipt of government funding must notify us<br />

giving four weeks notice in writing. Please note, pending the timing of transfer within the<br />

term/breach of an existing parent’s declaration the parents may be liable for the fee cost for that<br />

remaining term/contract. Parents/carers are required to request the funding via their new provider<br />

from their start date. If eligible in line with the funding transfer guidance, the Local Authority will<br />

ensure the new provider is provided with the fee payment as soon as possible. In addition, a<br />

reduction of funding transfer hours, will be identified as part of the total hours for that term and<br />

the parents/carers will be notified. We cannot confirm/offer a place until we have received notice<br />

of information from the Local Authority in relation to eligibility of a Funding Transfer. We adhere<br />

to the Funding transfer guidance available at www.haveringeducationservices.co.uk/earlyyears<br />

All parents will require to notify the nursery if they are attending another setting and the use of<br />

funding.<br />

Absences<br />

All booked permanent and extra sessions or extra items must be paid for. No refunds are given for<br />

any missed attendance which includes sickness, holidays or unavoidable nursery closures (E.g.no<br />

power, water supply or adverse weather). Parents/carers are responsible to inform the nursery if a<br />

child is absent, as part of safeguarding procedures as all absences are monitored and followed up<br />

making contact with the parents/ carers. Holiday/absence forms are available. All parents will need<br />

to notify the setting before 12:00pm everyday your child absent. If in the event we have not been<br />

notified, we will liase with other professionals inline with our safeguarding procedures.<br />

Late Collection<br />

If a child is still at the nursery after the nursery has closed (after their booked session) the parent/<br />

carers will be contacted along with all emergency contacts provided on the registration form for<br />

collection. Two members of staff will remain on site and will follow safeguarding procedures liaising<br />

with the social care or out of hours team. A charge of £35.00 will be added for the first 15 minutes<br />

and £20.00 charge for every 15 minutes thereafter.<br />

General Data Protection Regulation Act 2018 (GDPR)<br />

To carry out our day to day operations and duties, this involves collecting and sharing various means<br />

of yours and your child’s personal and sensitive data. We have data processes which are compliant<br />

with the General Data Protection Regulation Law 2018 (GDPR), to ensure appropriate measures are<br />

in place to keep all data secure with legal obligations to protect the vital interests of the data subject<br />

and performance of a task carried out in the public interest. This information is stored on Microsoft<br />

iCloud and is GDPR compliant. We are registered with the Information Commissioner’s Office (ICO)<br />

which holds codes of practice, guides and references on current UK legislation and registers<br />

organisations. Information sharing is vital to safeguarding and promoting the welfare of the child.<br />

Please refer to our General Data Protection Regulation Policy.<br />

Insurance<br />

The nursery has Public Liability Insurance which is on display.<br />

Liability<br />

The nursery accepts no liability for any losses suffered by parents arising directly or indirectly, as a<br />

result of the nursery being closed or the non-admittance of their child to the nursery for any reason.<br />

We accept no responsibility for children whilst in their parents’ care whilst on the premises.<br />

We will not be liable to parents and/or children for any economic loss of any kind, for damage to<br />

the child or parent’s personal property. Any accidents or incidents relating to parking this will be<br />

the responsibility of the vehicle owners.<br />

Health and Safety Accident/Incident<br />

The nursery reserves the right to administer basic First Aid treatment where<br />

necessary. Parents/Carers are informed about any accidents/incidents and will be required to sign<br />

their child’s accident form which we retain a copy (Parents/Carers can request a copy for their<br />

information). For accidents of a more serious nature, the nursery requires consent on the<br />

registration form for your child to be taken to hospital and given emergency treatment or<br />

medication as advised by a medical professional. Parents/Carers are responsible to update the<br />

nursery of any changes relating to yours or your child’s details.<br />

Covid-19<br />

If any child or member of staff receive an official NHS Covid-19 POSITIVE test, then that child bubble<br />

and or whole nursery will be closed for 10 days. During these 10 days all children and staff from<br />

that bubble and or whole nursery must self-isolate. They may come out of isolation early if they<br />

have an official NHS Covid-19 NEGATIVE test.<br />

Due to the shared responsibility for social distancing and good hygiene practices between nursery<br />

and families, closure due to a POSITIVE official NHS Covid-19 test during these 10 day period will be<br />

charged at the usual rates. This enables Fledgelings Day Nursery to continue to be financially viable<br />

during this pandemic. This charge is necessary as no nursery insurer will cover any nursery for<br />

business interruption due to Covid-19 related closure. However if the Government do support us<br />

financially, then this will be reviewed, and parents notified accordingly.<br />

Nursery will confirm via ParentMail any closures due to isolation periods and reopening dates. All<br />

isolation periods for Covid-19 can be found on the NHS website.<br />

All families and staff members will follow all guidelines released by the Government regarding<br />

Covid-19. In particular all families, family members and staff members will follow the social<br />

distancing guidelines.<br />

Office for Standards in Education (Ofsted)<br />

Ofsted is our regulatory body. They inspect and regulate services that care for children and young<br />

people. Our Ofsted Certificate and report are available at our nursery. These are also available to<br />

view via our website: www.fledgelingsdaynursery.co.uk or via Ofsted website www.ofsted.gov.uk<br />

Policies and Procedures<br />

The nursery has numerous policies and procedures, which are continuously reviewed. These are<br />

available to view via our website. Copies can be made available if requested. We actively encourage<br />

Parents/Carers contributions and take this information on account.<br />

Safeguarding<br />

We are committed to safeguarding and promoting the welfare of children. We expect all staff,<br />

parents/carers and visitors to share this commitment to safeguarding our children and families.<br />

Staff are trained to look out for signs and symptoms and are required to report these to the<br />

Designated Safeguarding Officers who are contactable at all times.<br />

Safeguarding procedures are in place, which includes clear child protection procedures, and our<br />

safeguarding practices, which are to be followed. If the need arises where we have a concern about<br />

a child this may mean that we have to consult other agencies. Any concerns are discussed with<br />

parents/carers first unless we are in a situation where a child may be at risk or we have been advised<br />

by a professional body following safeguarding procedures. Please refer to our Safeguarding, Child<br />

Protection and Promoting Children’s Welfare Policy for further information.<br />

Complaints, Concerns<br />

We aim to always meet the needs of the children and parents/carers. Nevertheless, if a parent<br />

should have a concern/complaint we encourage you to in the first instance, speak to the Nursery<br />

Manager. Please see our complaints policy for further details.<br />

Agreement<br />

The nursery reserves the right to terminate the agreement with immediate effect in any case of<br />

non- payment of fees or if the parents/carers, child displays abuse, threatening or otherwise<br />

inappropriate behavior, or for any other reasonable cause. Intimidation or abuse to our staff may<br />

result in immediate termination.<br />

These <strong>Terms</strong> & <strong>Conditions</strong> represent the entire agreement and understanding between parents/<br />

carers and/or others responsible for payment of the fees and conditions, terms and representations<br />

to the fullest extent permitted by law.<br />

We reserve the right to update/amend these <strong>Terms</strong> & <strong>Conditions</strong> at any time. The nursery is<br />

operated by Maxvale Limited. The <strong>Terms</strong> & <strong>Conditions</strong> will be governed by English Law and are<br />

subject to the exclusive jurisdiction of the English Courts.<br />
