PURPOSE: The purpose of the <strong>Association</strong><br />

shall be to advance the science of<br />

jurisprudence, promote the administration of<br />

justice, uphold the honor of the profession of<br />

law, to encourage cordial discourage and<br />

interaction among members of the bar and<br />

between the bench and bar of <strong>St</strong>. <strong>Joseph</strong><br />

<strong>County</strong> and of the state of Indiana, and to<br />

correlate the various activities of the<br />

No Cell Phones in the Courthouse<br />

On November 14th the SJCBA hosed a lunch in<br />

the Law Library for the Washington High<br />

School <strong>St</strong>udents who participated in the “We<br />

The People,” Congressional Mock Hearing.<br />

Judges of this event, including the Honorable<br />

Randall T. Shepard (who assisted with the closing<br />

ceremonies), all joined the students for<br />

of Rights. Class members studied over<br />

the course of a semester to simulate a<br />

congressional hearing on a Mary Schmanski, teacher at<br />

EFFECTIVE JANUARY 1, 2012, CELL PHONES AND PDA’S<br />

ARE NOT PERMITTED IN ANY ST. JOSEPH COUNTY<br />

COURTHOUSE, WITH LIMITED EXCEPTIONS:<br />

1. Only attorneys, building personnel, and law enforcement officers<br />

may bring PDA’s, cell phones or similar electronic devices into the<br />

courthouse provided that the device is switched to vibrate (rather than<br />

audible) mode before entering the courthouse.<br />

2. By written authorization, a judge may permit an expert witness or<br />

other person to utilize a cell phone or PDA in a specifically designated area within the<br />

courthouse.<br />

Any person violating the rules regarding photography, cameras, cell phones, PDA’s or other<br />

electronic devices shall be subject to immediate confiscation of the device and may be fined<br />

up to $1,500.00 for violating the prohibition against an audio or visual recording or for permitting<br />

noise from an electronic device to disrupt court while in session. The penalty shall be<br />

imposed at the discretion of the judicial officer in whose courtroom the violation occurred.

Immediately following the CLE, the NLC and ISBA Young Lawyer<br />

section will be hosting a networking reception with sampling<br />

of wines, compliments of Tiedmann Wines. Hor d’oeuvers<br />

and a cash bar will be available. Space is limited, so please<br />

reserve your spot early. The cost for the CLE and reception<br />

is $40.00 and ISBA YLS members will receive a 50% discount.<br />

The Bi-Annual Local Practice Seminar was a success. A record number of more than 200 people attended the seminars, and most<br />

stayed for the Judicial Reception. Thank you to the committee, the speakers, and especially to the bar members who attended.<br />

Your involvement is the reason for the success. At the Judicial Reception, Tim Abeska presented Joshua Hains with the Thomas L.<br />

Schaffer Award for Pro-Bono service on behalf of the Volunteer Lawyer Network. Congratulations, Joshua! Your work is important<br />

to make legal services accessible to those who otherwise would not have access to a lawyer.<br />

Miller’s Vets is nearly 3 years old, and until now has been limited to putting<br />

uniforms on willing homeless veterans who are guests of our local shelters to<br />

restore their self respect and pride through the public’s cheering, standing,<br />

applause, thank you shouts, handshakes and hugs. It has been quite successful,<br />

performing in countless civic color presentations, parades and military funerals.<br />

On 11/11/11 we dedicated our new Veterans Service Center. It will be home<br />

to some 25 down on their luck veterans. We propose that it become the catalyst for a large program to find, identify,<br />

and register the hundreds in our area, so that we can thank them, help them, and upon their demise provide for their funeral<br />

and burial, for those without means provided by Miller’s Vets. This program is called “The Last Salute” and consists of supplying an<br />

Amish handcrafted coffin, funeral director services, a full military funeral, communion, music and flowers. The coffin will then be<br />

transported to Miller’s Vets Garden of Peace, graciously dedicated last year by the <strong>County</strong> Commissioners on behalf of the citizens<br />

of <strong>St</strong>. <strong>Joseph</strong> <strong>County</strong>.<br />

At the grave, seven rifles will fire three rounds each, the haunting refrain of Taps will be sounded, and conclude with the ceremonial<br />

triangular folding of our vaunted American flag to be presented to the next of kin. We are determined that no veteran will go<br />

unclaimed awaiting a group disposal.<br />

The Veteran’s Service Center is debt-free and its programs do not require large amounts of funding. However, donations to<br />

Miller’s Vets, 747 S. Michigan <strong>St</strong>., South Bend, Indiana, 46601 are always appreciated. It is a registered 501(c)(3) charity. The support<br />

of several members of our <strong>Bar</strong> has been tremendously helpful. We are grateful and thank all of you.

Changes to Federally Required Income Withholding<br />

Order Forms<br />

reminds everyone that there are changes to the federally-required<br />

Income Withholding Order form. Go to<br />

Changes in procedure from Indiana Supreme Court<br />

The Indiana Supreme Court has announced changes in procedure<br />

that become effective January 1, 2012. The Court order<br />

amends the Indiana Rules of Appellate Procedure, Rules of<br />

Evidence, Rules of Professional Conduct, Rules for Admission<br />

to the <strong>Bar</strong> and the Discipline of Attorneys, Rules of Trial<br />

Procedure, and Rules of Procedure for Post-Conviction<br />

Remedies. Also amended are Indiana Administrative Rules<br />

4,5,6,8,9, and 14. The orders are posted on the bulletin<br />

board in the Clerk’s office. The amendment can also be<br />

found at www.courts.IN.gov.<br />

Procedure to remove Transcript and/or Record of<br />

Proceeding for Superior Court Cases<br />

Attorneys requesting permission to remove an original transcript<br />

and/or record of proceedings for a Superior Court<br />

case or appeal are subject to the following procedure:<br />

1. File a CCSE in the subject case stating that they are removing<br />

the original transcript and/or record of proceedings<br />

from the Clerk’s office for copying and will return it<br />

to the Clerk’s office within 48 hours. If removed on a<br />

Friday, the record/transcript must be returned before<br />

the close of business on the immediately following Monday;<br />

2. The attorney shall in fact return the original transcript<br />

and/or record of proceedings to the Clerk’s office within<br />

48 hours or if removed on Friday by the close of business<br />

on the following Monday;<br />

3. The Clerk shall report any failure to comply with the<br />

above to the Chief Judge within 24 hours.
