misuse <strong>of</strong> SALW, and the need for effective regulation at<br />
all levels.<br />
<strong>The</strong> imperative for regulation is driven by the fact that<br />
small arms have legitimate and illegitimate uses, 34 which<br />
rules out absolute prohibition. This has been referred to as the<br />
paradox <strong>of</strong> SALW. 35 <strong>The</strong> paradox is epitomised by the selfdefence<br />
function <strong>of</strong> SALW, which has featured as an<br />
important issue in the international effort to formulate the<br />
guiding principles and standards on combating and<br />
preventing the proliferation <strong>of</strong> SALW.<br />
SALW double as weapons <strong>of</strong> self-defence against actual<br />
or perceived threats from others and as potential threats to the<br />
security <strong>of</strong> others from those bearing them. 36 With regards to<br />
nation-States, international law recognises the sovereign right<br />
and responsibility <strong>of</strong> States to protect themselves from<br />
external aggression and internal threats from insurgents in<br />
conformity with the rule <strong>of</strong> law. States also rightfully police<br />
their territory to maintain law and order. This is articulated in<br />
Article 51 <strong>of</strong> the United Nations Charter. 37 For this purpose,<br />
