Institutional Framework<br />
<strong>The</strong> institutional framework for regulating SALW comprises<br />
mainly <strong>of</strong> the NATCOM, the police as the main body<br />
responsible for law enforcement, and the courts. Inaugurated<br />
in 2001, the NATCOM is responsible for the following-<br />
registration and control <strong>of</strong> SALW; regulating the importation<br />
and exportation <strong>of</strong> SALW; detection and destruction <strong>of</strong> illicit<br />
SALW; granting <strong>of</strong> permits for exemptions under the<br />
ECOWAS Moratorium. 178 <strong>The</strong> reconstituted Committee<br />
(NATCOM), which should be the epicentre for the control <strong>of</strong><br />
illegal flow <strong>of</strong> SALW, is however incapacitated by several<br />
factors. <strong>The</strong>se include under-funding, lack <strong>of</strong> technical<br />
expertise, corruption on the part <strong>of</strong> law enforcement agencies<br />
and lack <strong>of</strong> political will to make it work. <strong>The</strong> lack <strong>of</strong> an<br />
independent status as prescribed by the Convention generally<br />
hampers the effectiveness <strong>of</strong> the Committee. 179<br />
<strong>The</strong> role <strong>of</strong> the police, which is directly responsible for<br />
enforcing the laws against illicit weapons alongside the<br />
courts, cannot be overrated. This notwithstanding, the two<br />
institutions are weighed down by inherent weaknesses and<br />
extraneous factors which substantially inhibit the effective<br />
performance <strong>of</strong> their roles. 180<br />
Summary <strong>of</strong> the State <strong>of</strong> SALW in Nigeria<br />
On the whole, the following summarises the nature <strong>of</strong> the<br />
SALW concern in Nigeria:<br />
i. SALW are becoming endemic in Nigeria and the rate<br />
<strong>of</strong> accumulation is increasing;<br />
