46 <strong>Partner</strong> <strong>Migration</strong><br />
Before your partner category visa is granted, if you know that the date will not allow you a<br />
reasonable period for you to fi nalise your affairs and make the necessary arrangements to travel to<br />
Australia, you must advise the <strong>of</strong>fi ce <strong>of</strong> the department that is processing your visa application <strong>of</strong> your<br />
circumstances and consideration will be given to a later initial entry date. However, you may need to<br />
undergo new health or character checks before your visa can be granted.<br />
After your partner category visa has been granted, an initial entry date cannot be changed and,<br />
unless exceptional and compelling circumstances can be proven, your visa may be cancelled. You would<br />
need to re-apply for a visa.<br />
Travel during visa processing<br />
After you apply for a partner category visa, you should inform the department if you intend to travel (either<br />
to or from Australia) while your visa application is being processed.<br />
This is because, if you applied for a partner category visa while you were:<br />
• in Australia, you must be in Australia at the time your temporary visa is granted. You may be either in<br />
or outside Australia when the permanent visa is granted; or<br />
• outside Australia, you must be outside Australia when the temporary visa is granted. You may be<br />
either in or outside Australia when the permanent visa is granted.<br />
If you have applied in Australia, you must ensure that, before you travel outside Australia, you have a<br />
visa to return. Otherwise, you may not be able to return to Australia and, if your partner category visa<br />
application is refused while you are outside Australia, you may not have a right <strong>of</strong> review.<br />
Bridging visas<br />
If you apply for a partner category visa in Australia, you will usually be eligible for a bridging visa. A<br />
bridging visa keeps you lawfully in Australia in the event that:<br />
• your current visa ceases before a decision is made by the department on your partner category visa<br />
application; and/or<br />
• your partner category visa application is refused and you apply for merits review <strong>of</strong> the decision.<br />
If you wish to travel overseas while your partner category visa application is being considered, you may<br />
need to apply for a specifi c bridging visa to allow you to travel overseas and then return to Australia.<br />
To be granted such a bridging visa, you will have to provide reasons for the travel and then the travel<br />
component <strong>of</strong> the visa will be tailored accordingly.<br />
