3. Temporary Foreign Workers Programs:-

There are some immigration programs that are just meant for the people looking

for a temporary stay in Canada while they work. These programs are there to

allow foreign workers to gain the work experience that is required for their

application for the Permanent Residency and later apply for the Citizenship of

Work Permit:-

At times when qualified Canadian citizens and Permanent Residents are not

available, this program allows Canadian employers to hire foreign nationals. Every

year, thousands of people from all over the world apply under the program and

join the Canadian workforce. The Work Permit is an official document that is


required to work legally in Canada by foreign workers. There are two types of

work permits:

Open Work Permit: An open work permit allows someone to work for any

employer in Canada (Labour Market Impact Assessment (LMIA) – NOT

required), except for an employer:

o who is listed as ineligible on the list of employers who have failed to

comply with the conditions or

o who regularly offers striptease, erotic dance, escort services or erotic

massages

Employer Specific Work Permit (Closed Work Permit): An employer-specific

work permit allows a foreign national to work according to the conditions

on their work permit, which include:

o the name of the employer they can work for

o how long they can work

o the location where they can work (if applicable)

Work Permit Application Process:-

The applicants need to have a valid offer letter from a Canadian employer, with or

without the Labor Market Impact Assessment (LMIA), in order to apply for a work

permit. The applicant has to apply for an LMIA from Employment and Social

Development, Canada (ESDC) and after they have been issued the LMIA, they can

apply for the work permit. The Work Permit has some requirements which the

applicant needs to fulfill. They are as under:

Prove to an officer that they will leave Canada when their work permit

expires.

Show that they have enough money to take care of themselves and their

family members during their stay in Canada and to return home.

Obey the law and have no record of criminal activity, police certificates

might be requested.

Not be a danger to Canada’s security.

Be in good health and have a medical exam, if needed.

Not plan to work for an employer listed with the status “ineligible” on the

list of employers who failed to comply with the conditions.

Not plan to work for an employer who, on a regular basis, offers striptease,

erotic dance, escort services, or erotic massages.

Give the officer any other support documents as requested by them.

The Work Permit comes with an expiry date and once the permit expires, the

applicant has to either leave Canada or apply for an extension.

Working without a Permit:-


There are certain circumstances in which foreign nationals can work in Canada

without a work permit. These are as under:

Business Visitors who do not intend to enter the Canadian labor market

such as after-sales service providers, the board of director meetings,

employees of short-term temporary residents, employees of foreign

companies.

Foreign representatives and their family members who are accredited by

the Department of Foreign Affairs and International Trade (DFAIT). Family

members of foreign representatives must receive a ‘no objection letter’ by

the Protocol Department of DFAIT in order to work without a work permit.

If there is a labor shortage for the occupation in the area where the job is

located.

Military personnel and their family members who are visitors as per the

Visiting Forces Act. Military personnel is also exempted from Temporary

resident visa or eTA and related documents. But their family members

require TRV or eTA and other documents but are exempted from work

permit requirements.

Foreign Government Officers on international exchange work for a

department or agency in either the federal or provincial government(s).

American Cross-Border Maritime Law Enforcement Officers who work on

both sides of the Canada-US border.

In-Flight Security Officers are designated by foreign governments to enforce

safety on foreign aircraft but require TRV or eTA.

On-Campus Employment/ Off-Campus Employment if authorized by study

permit for an international student.

Performing artists who are not in an employment relationship with

Canadian business and part of foreign production and meet some

additional requirements.

Athletes and Team members of a foreign-based team or Canadian amateur

team.

News Reporters, Media Crews who are employees of a foreign news

company for the purpose of reporting on events in Canada.

Public Speakers who are making a speech or delivering a paper at dinner,

graduation, convention, or similar function, or as a commercial speaker or

seminar leader delivering a seminar that lasts no longer than five days.

Convention Organizers who are executive or members of the administrative

staff of organizing committee.

Clergy work

Judges, Referees, and Similar Officials sat an international amateur sports

competition, an international cultural or artistic event or competition, or an

animal or agricultural competition.


Examiners and Evaluators of research proposals or university projects,

programs, or theses.

Expert Witnesses and Investigators before a federal or provincial regulatory

body, a tribunal or a court of law.

Health Care Students for the primary purpose of acquiring training, if they

have written approval from the body that regulates that field.

Civil Aviation Inspectors of a national aeronautical authority conducting

inspections of the flight operation procedures or cabin safety of a

commercial air carrier operating international flights.

Aviation or Accident Investigators participating in an aviation accident or

incident investigation conducted under the Canadian Transportation

Accident Investigation and Safety Board Act.

A crew member of a foreign-owned means of transportation that is not

registered in Canada and is engaged primarily in international

transportation.

Emergency Service providers need to work for the protection or

preservation of life or property.

People on implied status.

The people working without a work visa will require an eTA or a Temporary

Resident Visa to enter Canada on a temporary basis.

4. Temporary Visit Visa:-

With beautiful landscapes and a vast diversity, Canada is a gorgeous country to

plan a holiday. Hundreds of thousands of people from around the world choose

this country as their exploration destination and many of them also come in to

visit their friends and families who reside in Canada.


Most of the visitors require either a temporary visitor visa (TRV) or an electronic

travel authorization (eTA) to visit Canada. There are some requirements which

every applicant must fulfill in order to be eligible for TRV or eTA.

The aforementioned two programs are designed for people who are going to be

in the country for a short while. These programs are not meant for a permanent

Business Visitors:-

Canada has become a hotspot for business travelers. Just within the last few

years, the country has developed a special bonding with international

businessmen and investors who are looking to either establish or enhance their

business in Canada and take advantage of the interconnected North American

market and a growing Canadian economy.

For the businesses who are looking to not enter the Canadian labor market and

just want to be indirectly involved with the growing economy of the country, the

immigration office issues a Temporary Resident Visa or an Electronic Travel

Authorization, depending on the country of origin. These visitors are known as

business visitors and they do not require a work permit to enter Canada and

conduct their business there.

In order to fulfill the requirements under this program, a business visitor must:

Prove that their company’s main source of income and main place of

business is outside Canada.

Prove that their remuneration is compensated from the source which is

Have a valid passport for the entire stay and strong ties to their country of

Prove that their planned visit is for short term and temporary in nature and

they intend to leave at the end of their stay.

Prove that they do not plan to enter the Canadian labour market.

Prove that visit is solely for international business activities.

Meet other requirements to issue a temporary resident visa (TRV) or

electronic travel authorization (eTA)

Someone planning to attend a business meeting with the representatives of

Canadian companies engaged in business in their home country.


Someone in the process of establishing and expanding their business in

Canada and is visiting for critical observations of future sites.

Someone attending business conferences, conventions, fairs, etc.

Someone visiting Canada to buy Canadian goods or services on behalf of a

foreign entity.

Someone visiting to take orders for goods or services.

Someone providing after-sales service, excluding hands-on work in the

construction trades.

Someone being trained by a Canadian parent company for work outside of

Canada.

Someone training employees of a Canadian subsidiary of a foreign

company.

Someone looking to understand the requirements of a Canadian company

that has invited them to advance their training regarding operations, sales,

or functioning of their products.

5. Family Class Immigration:-

Already have a family member or relative who is a Permanent Resident or Citizen

of Canada? There are immigration programs offered by the Government of

Canada that allow you to be a sponsored member and immigrate to Canada so

that you can be with your family member.

There are many programs under the Family Class Immigration like the

Spouse/Common Law Partner/ Conjugal Partner Sponsorship, Dependent Child

Sponsorship, Parent or Grandparent Sponsorship, Other Relative Sponsorship,

and Orphaned Child Sponsorship.

Every program under this category has its own eligibility criteria and the applicant

as well as the sponsor has to fulfill the requirements of the programs in order to

allow the applicant to apply and be eligible.


After a few years, the applicants (sponsored individuals) will have the opportunity

to apply for Permanent Residency and then consequently the Citizenship of

Canada as well.

Dependent Children Sponsorship:-

The current Canadian laws allow the Citizens of Canada, Registered Indians, and

Permanent Residents of Canada to sponsor their dependent children under the

Family Class Immigration program. For a child to be considered as a dependant

sponsor, he/she must fulfill the following criteria:

They are under 22 years old, and

They do not have a spouse or common-law partner.

If the child is above 22 years old, they can be considered under the program but

only if they fall under one of the following categories:

They have been dependant on their parents financially since before they

were 22 years old.

They are unable to provide for themselves financially because of a mental

or physical condition.

For a person to be eligible to sponsor a dependent child, they have to fulfill the

following requirements:

The sponsor must be at least 18 years old and a Canadian Citizen or a

Permanent Resident or a Registered Indian.

The sponsor and sponsored person must be in genuine relationship not in a

relationship of convenience to gain immigration status.

Canadian citizens not residing in Canada can be eligible for sponsoring their

dependent children if they can demonstrate that they will live in the

country once the dependent children become permanent residents.


The sponsor must sign an undertaking which would state that they would

provide for the basic requirements for 10 years from the day their

dependent child under 22 years of age becomes a permanent resident, or

until the child becomes 22 years old, whichever comes first. The length of

the undertaking is 3 years from the day your dependent child over 22 years

of age becomes a permanent resident.

The sponsor must NOT be on social assistance for a reason other than a

disability or in default of previous sponsorship undertakings if any or

bankrupt or in process of a bankruptcy proceeding.

The sponsor must NOT be convicted of a violent or sexual offense or

currently in jail or under a removal order (if a permanent resident).

In case of intention to live is in Quebec, certain additional requirements

must be met.

Parents or Grandparents Sponsorship

PNP Family Stream

Relative Sponsorship- Lonely Member or Orphaned Family Member

Spouse Common Law Partner Conjugal Partner Sponsorship

6. Detention, Appeals & Hearings:-

There are many immigration cases that require immediate attention. The

applicant could be in detainment at the border or in urgent need of appeal

against the decision of the Immigration or CSBA officers or at different divisions of

Immigration Refugee Board. If there are grounds for a Judicial Review, the lawyer

of the applicant can take the matter to Federal Court but that happens only after

a decision has been made that is either an error in law, an error in fact, or both.

The courts cannot substitute or impose a decision. The courts will determine

whether there are grounds for the Immigration officers to re-examine the case of

the applicant and take all the facts into account. These cases are important and

7. Refugee, Humanitarian, and Compassionate:-

Canada has provided shelter for refugees seeking protection and there are two

types of refugees, the convention refugees and the people in need of protection.

The decision is made by the Immigration and Refugee Board of Canada and the

applicants are assigned to one of the categories.

A convention refugee is one that is ousted from their country and is not able to

return to their country of citizenship or residence. The convention refugees are of

two types.

Convention Refugee Abroad Class: The claimant is outside their home

country due to a well-founded fear of persecution based upon Race,

Religion, Nationality, Membership of a particular social group, or Political

Opinion. These factors force the claimant to seek shelter outside the

country of residence. The convention Refugees in this category are

sponsored by:

o the Government of Canada (government-assisted refugees),

o a group of people or an organization (privately sponsored refugees),

or

o a mix of both (blended visa office-referred refugees.

o Asylum Class: The claimant is outside his or her home country or the

country where he or she normally lives and has been seriously

affected by civil war or armed conflict or has been denied basic

human rights on an ongoing basis. The country of asylum class

refugees can be privately sponsored.


The second type of refugee is a person in need of protection who resides

inside Canada and is not able to return to his or her country of citizenship

because of the danger of torture or risk to his or her life or a risk of cruel

and unusual treatment or punishment.

Canada has an effective refugee program that is well-aimed at providing

protection to those who need that protection. There are requirements to

meet to establish a legitimate refugee and find and then providing them

Humanitarian and Compassionate:-

There are some cases in which the applicant is not eligible for the

Permanent Residency because of a criminal past or medical inadmissibility.

Such cases can apply under the Humanitarian and Compassionate grounds

and if the circumstances of the case are unique, some exceptions can be

made.

The H&C applications are based on economic, cultural or family

establishment in Canada which is significant in nature such as a history of

stable employment, filing regular Income Tax returns, paying Taxes

regularly, investments made in Canada, future financial commitments and

management, integrated into the community through community

organizations, volunteer or other activities.

The applicant must also demonstrate that they would experience unusual

and undeserved or disproportionate hardships if they are to leave Canada.

The hardships that the applicant would face if the application is refused

include quality and amount of family support or dependency in Canada as


well as in the home country, best interests of the child when examining and

deciding the circumstances of the applicant. The best interest of the child

involved must be strongly argued under H&C applications

Permanent residency applications on H&C grounds are approved only in

exceptional circumstances where assessment is made on the information

provided by the applicant and a decision will be made based on the

personal circumstances of each individual. It takes several months to

process the H&C applications.
