COUNTY COMMISSIONERS<br />
Minutes <strong>of</strong> the Meeting <strong>of</strong> 27 June 2012. The meeting took place in the Public Safety Facility<br />
Community Room, 4 Fairgrounds Road, <strong>Nantucket</strong>, MA 02554. Members <strong>of</strong> the Commission<br />
present were Rick Atherton, Robert DeCosta, Bruce D. Miller, Patricia Roggeveen, and Whiting<br />
Willauer. Chairman Atherton called the meeting to order at 9:04 PM following a meeting <strong>of</strong> the<br />
Board <strong>of</strong> Selectmen.<br />
I. ANNOUNCEMENTS<br />
None.<br />
II. PUBLIC COMMENT<br />
Arthur Gasbarro suggested the <strong>Town</strong> establish a <strong>Town</strong> impound lot at its industrial land near the<br />
Airport.<br />
III. NEW BUSINESS<br />
None.<br />
IV. APPROVAL <strong>OF</strong> MINUTES, WARRANTS AND PENDING CONTRACTS<br />
1. Approval <strong>of</strong> Minutes <strong>of</strong> 23 May 2012 at 6:00 PM. The minutes were approved by the unanimous<br />
consent <strong>of</strong> the meeting.<br />
2. Approval <strong>of</strong> Payroll and Treasury Warrants for June 2012. The payroll and treasury warrants for<br />
June 2012 were approved by the unanimous consent <strong>of</strong> the meeting.<br />
V. PUBLIC HEARINGS<br />
1. Public Hearing to Consider Discontinuance and Abandonment <strong>of</strong> 1958 Layout <strong>of</strong> a Portion <strong>of</strong><br />
Tristram Avenue Known as West Tristram Avenue Located from a Line Extending the Western<br />
Sideline <strong>of</strong> North Swift Rock Road across Tristram Avenue, Known as the Western Sideline <strong>of</strong> East<br />
Tristram Avenue, West to its Termination at the Mean Low Water Mark <strong>of</strong> <strong>Nantucket</strong> Sound<br />
(Continued from 28 March 2012; 23 May 2012). Chairman Atherton reopened the public hearing.<br />
As there was no public comment, Chairman Atherton closed the public hearing. Mr. DeCosta<br />
moved to discontinue and abandon the 1958 layout <strong>of</strong> a portion <strong>of</strong> Tristram Avenue known as West<br />
Tristram Avenue located from a line extending the western sideline <strong>of</strong> North Swift Rock Road<br />
across Tristram Avenue, known as the western sideline <strong>of</strong> East Tristram Avenue, west to its<br />
termination at the mean low water mark <strong>of</strong> <strong>Nantucket</strong> Sound, as presented; Ms. Roggeveen<br />
seconded. All in favor, so voted.<br />
2. Public Hearing to Consider Layout and Acceptance <strong>of</strong> a New Road to be Known as Duck Pond<br />
Lane and License to Use a Portion <strong>of</strong> Washington Street Adjacent to 121 Washington Street<br />
(Continued from 28 March 2012; 23 May 2012). Chairman Atherton reopened the public hearing.<br />
Attorney Richard Glidden, representing abutter Kenneth Aguiar, spoke in favor <strong>of</strong> the Duck Pond<br />
Lane. Chairman Atherton closed the public hearing. Ms. Roggeveen moved to approve the layout<br />
and acceptance <strong>of</strong> a new road to be known as Duck Pond Lane, as presented; Mr. DeCosta<br />
seconded. All in favor, so voted. Planning Director Andrew Vorce reviewed the proposed license.<br />
Mr. DeCosta moved to approve a license between the <strong>Town</strong> and Mr. Aguiar as presented; Ms.<br />
Roggeveen seconded. All in favor, so voted.<br />

3. Public Hearing to Consider the Alteration <strong>of</strong> 1955 Taking and Layout <strong>of</strong> Lower Pleasant Street by<br />
Releasing a Portion <strong>of</strong> Parcel 1 from said Layout and Taking as it Affects Property at 69 Pleasant<br />
Street, Assessor’s Map 55, Parcel 39 (Continued from 28 March 2012; 23 May 2012; To be<br />
Continued to 25 July 2012). Mr. DeCosta moved to continue the public hearing to 25 July 2012;<br />
Ms. Roggeveen seconded. All in favor, so voted.<br />
VI. <strong>OF</strong>FICIAL BUSINESS<br />
1. <strong>Town</strong> <strong>of</strong> <strong>Nantucket</strong>: Request for Acceptance <strong>of</strong> $80,348.55 for Hummock Pond Road Bicycle<br />
Path Right <strong>of</strong> Way Damage Awards. Mr. Miller moved to accept $80,348.55 from the <strong>Town</strong> for<br />
Hummock Pond Road bicycle path right <strong>of</strong> way damage awards; Mr. Willauer seconded. All in<br />
favor, so voted.<br />
2. Planning Office: Request for Action on Order <strong>of</strong> Taking by Eminent Domain for the Hummock<br />
Pond Road Bicycle Path for a Permanent Easement for Construction and Use for Bicycle Path<br />
Purposes as Shown as “E-1” on Plan Entitled “Easement Plan Located in <strong>Nantucket</strong>,<br />
Massachusetts,” Dated December 13, 2011, Revised through March 27, 2012, Prepared by<br />
Vanesse Hangen Brustlin, Inc., and Recorded with <strong>Nantucket</strong> County Registry <strong>of</strong> Deeds as Plan<br />
No. 31 <strong>of</strong> 2012; and, Temporary Easements for Construction and Use for Bicycle Path Purposes as<br />
Shown on Plan as “ROE-1b” and “ROE-1c” Pursuant to Authority <strong>of</strong> MGL Chapter 79 and Article I,<br />
Section 1.3 <strong>of</strong> <strong>Nantucket</strong> County Charter, St. 1996, c. 290, § 4. Ms. Roggeveen moved to approve<br />
the Order <strong>of</strong> Taking by Eminent Domain for the Hummock Pond Road bicycle path as presented;<br />
Mr. Miller seconded. All in favor, so voted.<br />
3. Bartlett Farm LLC: Request for Acceptance <strong>of</strong> Temporary Non-Exclusive Wetlands Replication<br />
Easement in Gross in, on and under a Portion <strong>of</strong> Property Located at 124 Hummock Pond Road<br />
Shown as “ROE-22d” on Plan Entitled “Easement Plan Located in <strong>Nantucket</strong>, Massachusetts,”<br />
Dated December 13, 2011, Revised through March 27, 2012, Prepared by Vanesse Hangen<br />
Brustlin, Inc., and Recorded with <strong>Nantucket</strong> County Registry <strong>of</strong> Deeds as Plan No. 31 <strong>of</strong> 2012 in<br />
Connection with Hummock Pond Road Bicycle Path. Ms. Roggeveen moved to accept the<br />
wetlands replication easement in connection with the Hummock Pond Road bicycle path as<br />
presented; Mr. Miller seconded. All in favor, so voted.<br />
4. County Manager: Review <strong>of</strong> Cape and Islands License Plate Fund. County Manager C.<br />
Elizabeth Gibson reviewed the Cape and Islands License Plate Fund, including its history, the fund<br />
revenue from 2009 – 2012, and revenue expenditures. Ms. Gibson answered questions from the<br />
Commission. Ms. Gibson reviewed potential future uses if the fund in FY 2013, including Fourth <strong>of</strong><br />
July cleanup. Assistant County Manager Gregg Tivnan answered questions regarding the wind<br />
turbine and the <strong>Nantucket</strong> Energy Office, as there were expenses for these two which were paid<br />
out <strong>of</strong> the fund.<br />

The meeting was unanimously adjourned at 9:22 PM.<br />
