COUNTY COMMISSIONERS
Minutes of the Meeting of 27 June 2012. The meeting took place in the Public Safety Facility
Community Room, 4 Fairgrounds Road, Nantucket, MA 02554. Members of the Commission
present were Rick Atherton, Robert DeCosta, Bruce D. Miller, Patricia Roggeveen, and Whiting
Willauer. Chairman Atherton called the meeting to order at 9:04 PM following a meeting of the
Board of Selectmen.
I. ANNOUNCEMENTS
None.
II. PUBLIC COMMENT
Arthur Gasbarro suggested the Town establish a Town impound lot at its industrial land near the
Airport.
III. NEW BUSINESS
None.
IV. APPROVAL OF MINUTES, WARRANTS AND PENDING CONTRACTS
1. Approval of Minutes of 23 May 2012 at 6:00 PM. The minutes were approved by the unanimous
consent of the meeting.
2. Approval of Payroll and Treasury Warrants for June 2012. The payroll and treasury warrants for
June 2012 were approved by the unanimous consent of the meeting.
V. PUBLIC HEARINGS
1. Public Hearing to Consider Discontinuance and Abandonment of 1958 Layout of a Portion of
Tristram Avenue Known as West Tristram Avenue Located from a Line Extending the Western
Sideline of North Swift Rock Road across Tristram Avenue, Known as the Western Sideline of East
Tristram Avenue, West to its Termination at the Mean Low Water Mark of Nantucket Sound
(Continued from 28 March 2012; 23 May 2012). Chairman Atherton reopened the public hearing.
As there was no public comment, Chairman Atherton closed the public hearing. Mr. DeCosta
moved to discontinue and abandon the 1958 layout of a portion of Tristram Avenue known as West
Tristram Avenue located from a line extending the western sideline of North Swift Rock Road
across Tristram Avenue, known as the western sideline of East Tristram Avenue, west to its
termination at the mean low water mark of Nantucket Sound, as presented; Ms. Roggeveen
seconded. All in favor, so voted.
2. Public Hearing to Consider Layout and Acceptance of a New Road to be Known as Duck Pond
Lane and License to Use a Portion of Washington Street Adjacent to 121 Washington Street
(Continued from 28 March 2012; 23 May 2012). Chairman Atherton reopened the public hearing.
Attorney Richard Glidden, representing abutter Kenneth Aguiar, spoke in favor of the Duck Pond
Lane. Chairman Atherton closed the public hearing. Ms. Roggeveen moved to approve the layout
and acceptance of a new road to be known as Duck Pond Lane, as presented; Mr. DeCosta
seconded. All in favor, so voted. Planning Director Andrew Vorce reviewed the proposed license.
Mr. DeCosta moved to approve a license between the Town and Mr. Aguiar as presented; Ms.
Roggeveen seconded. All in favor, so voted.

3. Public Hearing to Consider the Alteration of 1955 Taking and Layout of Lower Pleasant Street by
Releasing a Portion of Parcel 1 from said Layout and Taking as it Affects Property at 69 Pleasant
Street, Assessor’s Map 55, Parcel 39 (Continued from 28 March 2012; 23 May 2012; To be
Continued to 25 July 2012). Mr. DeCosta moved to continue the public hearing to 25 July 2012;
Ms. Roggeveen seconded. All in favor, so voted.
VI. OFFICIAL BUSINESS
1. Town of Nantucket: Request for Acceptance of $80,348.55 for Hummock Pond Road Bicycle
Path Right of Way Damage Awards. Mr. Miller moved to accept $80,348.55 from the Town for
Hummock Pond Road bicycle path right of way damage awards; Mr. Willauer seconded. All in
favor, so voted.
2. Planning Office: Request for Action on Order of Taking by Eminent Domain for the Hummock
Pond Road Bicycle Path for a Permanent Easement for Construction and Use for Bicycle Path
Purposes as Shown as “E-1” on Plan Entitled “Easement Plan Located in Nantucket,
Massachusetts,” Dated December 13, 2011, Revised through March 27, 2012, Prepared by
Vanesse Hangen Brustlin, Inc., and Recorded with Nantucket County Registry of Deeds as Plan
No. 31 of 2012; and, Temporary Easements for Construction and Use for Bicycle Path Purposes as
Shown on Plan as “ROE-1b” and “ROE-1c” Pursuant to Authority of MGL Chapter 79 and Article I,
Section 1.3 of Nantucket County Charter, St. 1996, c. 290, § 4. Ms. Roggeveen moved to approve
the Order of Taking by Eminent Domain for the Hummock Pond Road bicycle path as presented;
Mr. Miller seconded. All in favor, so voted.
3. Bartlett Farm LLC: Request for Acceptance of Temporary Non-Exclusive Wetlands Replication
Easement in Gross in, on and under a Portion of Property Located at 124 Hummock Pond Road
Shown as “ROE-22d” on Plan Entitled “Easement Plan Located in Nantucket, Massachusetts,”
Dated December 13, 2011, Revised through March 27, 2012, Prepared by Vanesse Hangen
Brustlin, Inc., and Recorded with Nantucket County Registry of Deeds as Plan No. 31 of 2012 in
Connection with Hummock Pond Road Bicycle Path. Ms. Roggeveen moved to accept the
wetlands replication easement in connection with the Hummock Pond Road bicycle path as
presented; Mr. Miller seconded. All in favor, so voted.
4. County Manager: Review of Cape and Islands License Plate Fund. County Manager C.
Elizabeth Gibson reviewed the Cape and Islands License Plate Fund, including its history, the fund
revenue from 2009 – 2012, and revenue expenditures. Ms. Gibson answered questions from the
Commission. Ms. Gibson reviewed potential future uses if the fund in FY 2013, including Fourth of
July cleanup. Assistant County Manager Gregg Tivnan answered questions regarding the wind
turbine and the Nantucket Energy Office, as there were expenses for these two which were paid
out of the fund.

The meeting was unanimously adjourned at 9:22 PM.
