FRACTIONAL OWNERSHIP IN A PROPERTY

Fractional ownership is not new in property, it is well known

in many European countries where luxury vacation houses

are located in such places as Portugal, Spain, Monaco, etc.

The value of such investments can vary from a few hundred

US dollars to millions of US dollars. With certain sized

investments, it would be hard for small retail investors to

access the property, and with the nature vacation houses

where it is not only used for personal leisure but also to rent

it out with expected returns on investment. Therefore,

without fractional ownership this class of asset is traditionally

limited to sophisticated investors only.

Fractional ownership is an opportunity in which a group of

like-minded people own a residential or commercial property

together and become fractional owners. Purchasing the

asset and dividing the expensive cost into multiple parts

allows people to participate in new opportunities at a fraction

of the cost usually required. In other words, it is a bit like

crowdfunded investments. Traditional fractional ownership

can vary but examples exist in 50%, 25% and smaller

fractions. It is very common to bring friend(s) to purchase an

asset such as a vacation house, luxury car, luxury yacht and

share the ownership in the asset through the legal registration.

Not only the asset is shared but also the costs of renovating,

furnishing and outfitting the property are shared. All

parties can have a separate agreement which defines the

right of the use and the right to earn rental income under the

Civil and Commerce Code of contractual parties' juristic

country. The interval of personal usage or the right of investment

return can be weekly, quarterly or on a semi-annual

basis upon the consensus of all owners and it commonly

rotates the right every year so that all owners have the different

interval throughout the life of the ownership.

For Thailand, fractional ownership can be registered at the

local land office where the property locates. The registration is

under "Joint Tenant" or "Joint Owner'', depending on the asset

class whether it is leasehold or freehold respectively. However,

the challenge is only when any fraction wishes to transfer

the right to the other. This requires the consensus from all

owners of the asset to agree and to present at the land office

to re-register the ownership with the new fraction owner.

Nowadays the fractionalized ownership is going to the next

level with blockchain technology. In the other words it called

"Tokenization" of the asset or "Asset Backed Tokenization"

or "Security Token Offering (STO)" which have been

released to the market recently. With this approach, it can

attract the new generation of investors who do not have big

savings or large cash deposits to invest into property assets

or are familiar with the Cryptocurrency market. The token

can represent the ownership right of the asset and other

rights which are specified in the White Paper. It can be a

range of the rights that token holder can exercise, depending

on the issuer of the Token, such as dividend, rental

return, voting right, share of the company, etc. Recently

most of the investors in Cryptocurrency market have experienced

and have a significant loss from market fluctuation.

The coins or tokens which have no fundamental principal

backing become less attractive than the asset backed token.

The benefits of fractional ownership are the following:

1. Investment cost: It gives a liquidity to the asset with lower

acquisition costs so it is affordable by smaller investors.

2. Maintenance: The asset is utilized without leaving vacant

for weeks during the year. By sharing ownership, the property

will be opened up at regular intervals like opening or closing

windows and doors, running the water, turning on the air condition.

All of these are essential to maintaining the property.

3. Shared burden: All costs relate to maintenance, annual

property tax, community fee, contribution to sinking fund are

shared to all owners.

4. Rental income: Upon agreement among the owners, if it

permits to allow the fraction owner to rent it out during individual

ownership interval, the fraction owner will have a potential

income from the rent.
