2.1 ABOUT THE TERRITORY:<br />

a) INTRODUCTION<br />

The Union Territory <strong>of</strong> <strong>Dadra</strong> <strong>and</strong> <strong>Nagar</strong> Haveli is situated on the<br />

Western coast <strong>of</strong> India between the parallels <strong>of</strong> 20°–0° <strong>and</strong> 20° -25° <strong>of</strong> latitude<br />

North <strong>and</strong> between the meridian 72°- 50 °<strong>and</strong> 73°- 15° <strong>of</strong> longitude East. Its<br />

population is 342853 as per 2011- Census data. It has an area <strong>of</strong> 491 Sq. km<br />

<strong>and</strong> comprises <strong>of</strong> two enclaves, viz. (1) <strong>Dadra</strong> <strong>and</strong> (2) <strong>Nagar</strong> Haveli, having 72<br />

villages. Silvassa the capital <strong>of</strong> this U.T. <strong>and</strong> village Amli together now<br />

constitute the Municipal Area under the Silvassa Municipal Council. The<br />

territory is surrounded by Valsad District <strong>of</strong> Gujarat on West, North <strong>and</strong> East<br />

<strong>and</strong> by Thana district <strong>of</strong> Maharashtra on South <strong>and</strong> South-East. It has hilly<br />

terrain especially towards the North-East <strong>and</strong> East where it is surrounded by<br />

ranges <strong>of</strong> Sahyadri Mountains. The terrain is intersected by the River<br />

Damanganga <strong>and</strong> its three tributaries namely Kolak, Piparia & Sakartod. The<br />

River rises in the Ghats 64 Km. from the Western coast <strong>and</strong> discharges itself in<br />

the Arabian Sea at the port <strong>of</strong> Daman. The climate is moderate though hot<br />

during summer.<br />

The nearest Railway Station is Vapi which is about 18 Kms from<br />

Silvassa. The UT is linked with National highway No.8 at a distance <strong>of</strong><br />

approximately 12 Km. from Silvassa.<br />

The capital city <strong>of</strong> the Union Territory, Silvassa is in close proximity<br />

with three major cities viz.., Mumbai at a distance <strong>of</strong> 160 Kms towards the<br />

South; Surat at a distance <strong>of</strong> 140 Kms towards North; <strong>and</strong> Nasik at a distance <strong>of</strong><br />

140 Kms towards East. (Refer Diagram below)<br />

b) THE PURPOSE OF THE PROJECT:<br />

The territory since its liberation in 1954 has grown primarily due to the<br />

vibrant culture <strong>of</strong> the Tribal’s <strong>and</strong> the several tourist attractions. Further in the<br />

mid 90’s, the GoI had declared tax holiday due to which industrialization started<br />

taking place <strong>and</strong> the population also started increasing tremendously. As on date<br />

the population <strong>of</strong> the territory is around 3.50 lakhs. There has been an ever<br />

increasing dem<strong>and</strong> <strong>for</strong> exp<strong>and</strong>ing the Medical facility in the U.T. As on date the<br />

civil hospital <strong>of</strong> <strong>Dadra</strong> <strong>and</strong> <strong>Nagar</strong> Haveli caters with 241 beds <strong>and</strong> is proposed<br />

to increase further to another 208, there<strong>for</strong>e making a total bed capacity <strong>of</strong> 449.<br />

The U.T has also another sub district hospital with a present bed capacity <strong>of</strong> 50<br />

which is also proposed to be enhanced to a 100 bedded hospital. Further<br />

considering the OPD inflow the same is overwhelming as per the bed<br />

occupancy which is 120%. With such a huge level <strong>of</strong> hospital being established<br />

in the territory there is no Medical College nearby which can give benefit to not<br />

only the local population but also to the nearby surrounding areas. At present<br />

the nearest Medical College is located at a distance <strong>of</strong> more than 150 Kms. The<br />

biggest hospital in between Surat <strong>and</strong> Mumbai is Shri Vinoba Bhave Civil<br />

Hospital, Silvassa which can justify as an attachment to the medical college.<br />

1. ABOUT THE HOSPITAL:<br />

Shri Vinoba Bhave Civil Hospital, Silvassa is the only specialty<br />

hospital between Surat <strong>and</strong> Mumbai, which is catering not only to entire<br />

population <strong>of</strong> <strong>Dadra</strong> & <strong>Nagar</strong> Haveli but also to all the adjoining areas <strong>of</strong><br />

Gujarat <strong>and</strong> Maharashtra <strong>for</strong> its curative, preventive <strong>and</strong> rehabilitation needs.<br />

Shri Vinoba Bhave Civil Hospital, Silvassa was started in 1952 <strong>and</strong> it has<br />

gradually grown to the present 231 bedded hospital with a State <strong>of</strong> Art Accident<br />

Prevention cum Trauma <strong>and</strong> Emergency Medical Services, 16 bedded Intensive<br />

Care Unit <strong>and</strong> 5 ultra modern Operation Theatres with 4 bedded casualties.<br />

There has been lot <strong>of</strong> pressure due to increase in the patient load which can be<br />

There has been growing dem<strong>and</strong> from the people <strong>of</strong> <strong>Dadra</strong> & <strong>Nagar</strong><br />

Haveli <strong>for</strong> exp<strong>and</strong>ing the health care <strong>and</strong> to have an available, accessible <strong>and</strong><br />

af<strong>for</strong>dable specialty <strong>and</strong> super specialty hospital. Illiteracy hinders preventive<br />

health management measures <strong>and</strong> follow up which make it necessary to have<br />

treatment services that are people centric. The health care infrastructure<br />

indicates that there is lacuna in both human resource <strong>and</strong> infrastructure level.<br />

The population <strong>of</strong> <strong>Dadra</strong> & <strong>Nagar</strong> Haveli is approximately 3.50 lacs (which<br />

includes the resident population <strong>and</strong> the floating population) <strong>and</strong> the indoor bed<br />

requirement as per WHO norms is 5 beds <strong>for</strong> every 1000 population, National<br />

st<strong>and</strong>ard is 0.7 beds per 1000 population <strong>and</strong> in Delhi it is 2.08 beds per 1000<br />

population. The requirement <strong>of</strong> beds as per WHO norms is 2000 beds, as per<br />

National norms 280 beds <strong>and</strong> as per Delhi norms 832 beds.<br />

As per the norms <strong>of</strong> WHO the bed population ratio is to be improved <strong>and</strong><br />

there is already a plan to increase the bed strength <strong>of</strong> the Civil Hospital by 208<br />

beds, thereby increasing the total bed capacity to 449 which shall become one<br />

bed per thous<strong>and</strong> population. Also there is a move to upgrade the Community<br />

Health Centre, Khanvel into a 100 bedded sub-district hospital.<br />

Parallel to the creation <strong>of</strong> medical infrastructure, medical educational<br />

needs <strong>of</strong> the region are also to be taken care <strong>of</strong>. Since the treatment facility <strong>and</strong><br />

infrastructure development is being taken care <strong>of</strong> on the one h<strong>and</strong>, the human<br />

resource development shall need to also improve on the other h<strong>and</strong>. This shall<br />

enhance the quality <strong>of</strong> input in the U.T <strong>and</strong> it can be beneficial to the Country in<br />

near future.<br />

Considering all the above facts it was decided to open a Medical<br />

College within the territory so that the above mentioned objectives can be<br />

achieved. The administration has allocated 15 acres <strong>of</strong> l<strong>and</strong> in the nearby<br />

vicinity.<br />

(1B) Concept report:<br />

* The consultant will prepare design concept report separately <strong>for</strong> each<br />

discipline such as Architecture, Civil/structure, PHE/Services, Electrical<br />

<strong>and</strong> HVAC <strong>and</strong> submit it <strong>for</strong> approval <strong>of</strong> the <strong>Tender</strong> Inviting Agency.<br />

The concept report shall be finalized considering the comments<br />

For the buildings already listed in the project scope the working drawings<br />

are to be prepared. It is to be clearly understood that the number <strong>of</strong><br />

drawings cannot be limited to any fixed number <strong>for</strong> the detailed/ execution<br />

stage & the appropriate number <strong>of</strong> drawings shall have to be made as per<br />

project requirements & following good engineering practices.<br />

* This shall include preparation <strong>of</strong> detailed working drawings, getting<br />

comments from the <strong>Tender</strong> Inviting Agency & finalization <strong>of</strong> the<br />

drawings on the basis <strong>of</strong> the comments.<br />

* Based on requirement <strong>of</strong> the <strong>Tender</strong> Inviting Agency regarding<br />

architectural drawings & master layout plan, the consultant shall develop<br />

& draft the detailed construction drawings I.e., plans, sections, elevations<br />

& reflected ceiling plans building wise to the scale <strong>of</strong> 1:100, 1:50 <strong>for</strong> the<br />

areas as required <strong>for</strong> toilets, staircases, ramps, reception lobbies etc.<br />

This shall be done in consultation with & under guidance <strong>of</strong> <strong>Tender</strong><br />

Inviting Agency.<br />

* Wall sections at various locations as indicated <strong>for</strong> internal & external<br />

walls <strong>of</strong> each building at 1:25 scale shall be prepared, indicating the<br />

material <strong>of</strong> finishes & their colors. The external wall sections will include<br />

elevations <strong>of</strong> the portions <strong>of</strong> the building in 1:50, 1:25 or any relevant<br />

scale indicating grooving patterns besides the material & colour <strong>of</strong><br />

building.<br />

* Schedule <strong>of</strong> finishes indicating the materials & color shall be prepared<br />

<strong>for</strong> each building <strong>of</strong> the complex on the basis <strong>of</strong> room coding &<br />

nomenclature.<br />

* Preparation <strong>of</strong> reflected ceiling plans <strong>for</strong> each room/ space indicating all<br />

ceiling mounted fixtures & equipments, lighting fixtures, air diffusers,<br />

sprinkler heads etc. in the areas / blocks specified by the <strong>Tender</strong> Inviting<br />

Agency.<br />

* Preparation <strong>of</strong> furniture/ equipment layout <strong>for</strong> all rooms in consultation<br />

with <strong>Tender</strong> Inviting Agency.<br />

* Identification <strong>of</strong> all fixtures, fittings, computer terminals, computer<br />

closet, plug points, switches & efficient space planning in relation to<br />

these wherever required.<br />

* Designing <strong>of</strong> signage <strong>for</strong> the entire institute.<br />

* Detail drawings <strong>for</strong> Road layout, L<strong>and</strong>scape <strong>and</strong> horticulture.<br />

* Wherever required all aspects <strong>of</strong> interior works including identification<br />

& provision <strong>of</strong> furniture, fixtures, acoustics shall be detailed by the<br />

consultant.<br />

* Preparation <strong>of</strong> service drawings which shall completely co-ordinate<br />

services <strong>of</strong> P.H.E., electrical <strong>and</strong> site layout etc <strong>for</strong> internal <strong>and</strong> external.<br />

2) Scope <strong>of</strong> work <strong>for</strong> Civil/Structural<br />

Structural design & drawings shall cover the following scope & items <strong>of</strong> work.<br />

1. Thorough study <strong>of</strong> the architectural drawings & input to the architectural<br />

drawings considering the requirements <strong>of</strong> the structural system.<br />

2. Commented <strong>and</strong> approved Architecture drawings from <strong>Tender</strong> Inviting<br />

Agency to be taken up <strong>for</strong> starting the Structural work, a copy <strong>of</strong> the<br />

same to be submitted with the final Structure drawings.<br />

3. All drawings <strong>of</strong> civil/structural shall be vetted by IIT, Mumbai or any-<br />

other IIT. However the fees payable to these institutes shall be borne by<br />

<strong>Tender</strong> Inviting Agency. The consultant shall recruit his engineer from<br />

time to time as required <strong>for</strong> discussions/ coordination with concerned<br />

<strong>of</strong>ficials, incorporate their comments appropriately to their satisfaction &<br />

ensure to produce a design worthy <strong>of</strong> approval from IIT. Total<br />

responsibility in this regard shall be borne by the consultant.<br />

4. Structure design Basis Report viz. the assumptions to be made in<br />

Structure analysis <strong>and</strong> Design, to be approved from Executive Engineer,<br />

PWD, DNH, Silvassa be<strong>for</strong>e start <strong>of</strong> the work.<br />

5. Structural System to be worked out in close co-ordination with Executive<br />

Engineer, PWD, DNH <strong>and</strong> the <strong>Tender</strong> Inviting Agency <strong>and</strong> the same to<br />

be approved be<strong>for</strong>e start <strong>of</strong> Space Frame Analysis.<br />

6. Similar coordination with other disciplines (Electrical, HVAC, PHE) by<br />

way <strong>of</strong> study <strong>of</strong> their drawings critically & recording the constraints/<br />

special requirements <strong>of</strong> the structural elements sizes/ cutouts/ inserts etc.<br />

7. Conclusion on detailed framing plans, structural system <strong>for</strong> foundations<br />

& superstructure. The structural system has to be worked out so as to<br />

achieve an economical <strong>and</strong> safe design keeping in view the Serviceability<br />

requirements.<br />

8. Loads- Complete description <strong>of</strong> Basic loads, member loads, Earthquake<br />

<strong>and</strong> wind loads including load combinations. This shall also include any<br />

special loads like equipment loads, dynamic loads etc. For water<br />

containing structures, hydraulic pressures to be considered appropriately.<br />

9. STAAD analysis modeling the building as appropriate space frame(s) –<br />

The structural elements shall be accordingly sized to obtain the optimal<br />

designs based on the criteria as decided & approved by <strong>Tender</strong> Inviting<br />

Agency. Appropriate checks <strong>for</strong> deflections <strong>of</strong> structure as well as the<br />

individual members so as to restrict the same within permissible codal<br />

limits. Only Space Frame modeled with Dynamic Input & Analysis will<br />

be considered.<br />

10. Complete structural designs <strong>of</strong> all elements <strong>of</strong> sub & super structure.<br />

This shall include the designs <strong>of</strong> beams, columns, slabs, footings/ rafts -<br />

so that the design in<strong>for</strong>mation can be readily converted into the detailed<br />

execution drawing. Each <strong>of</strong> the Structural drawings shall include a table<br />

showing the quantity <strong>of</strong> steel used bar dia wise <strong>and</strong> quantity <strong>of</strong> RCC used<br />

on that particular drawing. A separate sheet shall be submitted to keep<br />

track <strong>of</strong> the various major items qtys as the drawings progress floorwise<br />

i.e., the items <strong>of</strong> RCC, steel, shuttering, brickwork, flooring (category-<br />

wise), external finish quantities used to be submitted periodically.<br />

11. Detailed execution drawings as well as any revisions there in arising out<br />

<strong>of</strong> site constraints or any other requirements like changes in the other<br />

discipline drawings.<br />

12. Wherever the construction planning has to be specifically suited to<br />

certain design requirements, the sequence <strong>of</strong> construction shall also be<br />

identified appropriately.<br />

13. All responsibilities concerning with the stability <strong>of</strong> Structure,<br />

Structure drawings, compatibility with Architecture drawings, etc.<br />

lies with consultant Organization. A Structural Stability Certificate<br />

in line with departments requirements/project requirement is also to<br />

be furnished by the consultant.<br />

14. Final approved drawings, in principle, from Executive Engineer,<br />

PWD, DNH, Silvassa to be signed by two Structural Engineers <strong>of</strong><br />

consultant Organization be<strong>for</strong>e <strong>for</strong>warding the same to <strong>Tender</strong><br />

Inviting Agency.<br />

15. Approval & clearance from Executive Engineer, PWD, DNH,<br />

Silvassa shall be obtained <strong>for</strong> all the designs & drawings.<br />

Relevant codes (latest), st<strong>and</strong>ards & the prevailing good engg. practices shall<br />

be followed in carrying out the above work. Details/References (<strong>of</strong> same) shall<br />

be furnished so as to facilitate the checking <strong>of</strong> design calculations etc. National<br />

Building Code, All Disaster management protocols, proposal <strong>for</strong> Environmental<br />

3) Scope <strong>of</strong> Work <strong>for</strong> PHE/Fire Fighting & other Services: This will<br />

a) Roads<br />

include following sub parts.<br />

1. Planning <strong>and</strong> designing road layout – Alternative road layout in order to<br />

minimize cost <strong>and</strong> Finding co-ordinates <strong>of</strong> road center line at the interval<br />

<strong>of</strong> not more than 20 m on straight line <strong>and</strong> at all junctions, curve, turning<br />

points.<br />

2. Alternative road layout to optimize cost <strong>of</strong> excavation <strong>and</strong> filling keeping<br />

in view the better serviceability.<br />

3. L-section showing chain age, Ground level, <strong>for</strong>mation level, depth <strong>of</strong> cut,<br />

depth <strong>of</strong> fill, longitudinal slope, location <strong>of</strong> culvert etc.<br />

4. Design <strong>of</strong> typical road cross in cutting, filling. Depth, camber design etc.<br />

5. Design <strong>of</strong> horizontal curve, vertical curve, super elevation, retaining<br />

wall, culverts <strong>and</strong> any other works related to road work.<br />

6. Planning <strong>and</strong> designing road drainage system.<br />

b) Water Supply<br />

1. Identification <strong>of</strong> different source <strong>of</strong> water <strong>and</strong> their potential to deliver<br />

river, bore well, rain water etc.<br />

2. Assessment <strong>of</strong> water requirement <strong>for</strong> each buildings <strong>and</strong> facilities.<br />

3. Planning <strong>and</strong> designing <strong>of</strong> internal water supply system <strong>for</strong> each<br />

building. Calculation <strong>of</strong> fixtures unit, size <strong>of</strong> riser, down take <strong>and</strong><br />

horizontal pipe. Head loss, Pressure check at delivery point. Storage<br />

4. Planning <strong>and</strong> designing <strong>of</strong> external water supply system –rising<br />

main/gravity <strong>and</strong> branch pipe. Design should be done using s<strong>of</strong>tware<br />

package-Preferable LOOP/ BRANCH developed by UNDP or<br />

equivalent.<br />

5. Design <strong>of</strong> underground storage tanks cum pump house.<br />

details <strong>and</strong> plan view, <strong>and</strong> supporting details <strong>of</strong> equipments <strong>and</strong><br />

plumbing fitting & fixtures along with locations, legends, notes etc.<br />

c) Sewerage System<br />

1. Planning <strong>and</strong> designing <strong>of</strong> internal sewerage system. Size, slope <strong>and</strong><br />

specification <strong>of</strong> soil pipe, waste pipe, vent pipe . Details <strong>of</strong> sunken<br />

areaco- ordination with structural drawings <strong>for</strong> beam/slab sleeve details.<br />

Details <strong>of</strong> Floor trap, floor drain, FCO. <strong>and</strong> plumbing system .<br />

2. Assessment <strong>of</strong> sewage discharge from each building. Design <strong>of</strong> external<br />

e) Fire Fighting System<br />

1. Identify minimum requirement <strong>of</strong> fire fighting system as per latest<br />

building bylaws <strong>and</strong> NBC, also considering the local authority<br />

guidelines.<br />

2. Design <strong>of</strong> internal/external fire fighting system including main fire ring,<br />

yard hydrant, fire tank, pumping system <strong>and</strong> all other items required as<br />

per latest by laws.<br />

3. Design <strong>of</strong> internal fire fighting system such as wet riser, down comer,<br />

first aid hose reel, sprinkler system <strong>and</strong> all other accessories as per latest<br />

code.<br />

4) Scope <strong>of</strong> work <strong>for</strong> HVAC:<br />

This shall include checking <strong>of</strong> the contractor/ vendor drawings based<br />

upon the already submitted scheme <strong>of</strong> HVAC systems. The drawings shall have<br />

to be fully commented & returned to <strong>Tender</strong> Inviting Agency which shall need<br />

further review after the vendor has incorporated the observations. It shall be<br />

ensured that the vendor drawings become complete in all respects with total<br />

details availability being ensured.<br />

5) Electricity:<br />

This shall include Electrical Substation, requirement <strong>of</strong> generators, street<br />

lighting, underground cabling, electrical panels, internal lightings <strong>and</strong><br />

decorative lightning where required. This should follow the LEED Concept.<br />

(4) Completion Drawings <strong>and</strong> Final Approval Stage<br />

<strong>Tender</strong>er shall supply the conceptual architectural plans, which after<br />

approval from the <strong>Tender</strong> Inviting Agency, the tenderer shall prepare the all<br />

completion drawings as per building bye laws/norms <strong>and</strong> obtain its approval<br />

3. PRE QUALIFYING CRITERIA<br />

Following is the pre qualification criteria <strong>for</strong> the tenderers:<br />

1. The firm should be pr<strong>of</strong>it making <strong>and</strong> should have an annual turnover <strong>of</strong> at<br />

least 100 lakhs through pr<strong>of</strong>essional receipt during each <strong>of</strong> the last three<br />

financial years ending 31-3-2012 ending 31-3-2012<br />

2. No consortium <strong>of</strong> companies will be allowed to submit bids<br />

3. The firm should be architect led <strong>and</strong> should have adequate qualified<br />

architects, engineers, environmental experts, health care planners, etc. who have<br />

experience in similar project. An architect / architectural firm should be<br />

registered with the Council <strong>of</strong> Architect <strong>and</strong> the following Certified documents<br />

to be submitted:<br />

a) Certificate <strong>of</strong> the Registration under Council <strong>of</strong> Architecture.<br />

b) Evidence <strong>of</strong> project experience, successfully executed <strong>and</strong> completed with<br />

details <strong>of</strong> project value <strong>and</strong> firm’s role.<br />

4. Similar experience – the applicant should have provided architectural,<br />

concept/design, detailed design <strong>of</strong> engineering, <strong>and</strong> DPR <strong>for</strong> at least one multi-<br />

specialty / teaching hospital / medical college complex 500 bed/100 admissions<br />

or above during the last five years<br />

5. <strong>Consultant</strong> should be capable <strong>of</strong> employing a independent team on the<br />

project.<br />

<strong>Consultant</strong>s/ agencies working in the field <strong>of</strong> Medical Consultancy <strong>for</strong> CPWD,<br />

Railways, MES, P & T Deptt., State PWD’s, Semi Govt. Organizations <strong>and</strong><br />

Institutes or in reputed private Sector Firms who satisfy following criteria may<br />

participate :<br />

6. All the architectural work shall be h<strong>and</strong>led in-house & the Office must be<br />

located nearby <strong>Dadra</strong> & <strong>Nagar</strong> Haveli where this work would be carried<br />

out upon commencement.<br />

7. The agency shall be responsible to take approval from all the concerned<br />

statuary authorities.<br />

4. TERMS AND CONDITIONS<br />

1) The design are to be submitted in AutoCAD DWG file as well as JPG files<br />

(1024 x 768 Pixel, 72 dpi, max. 600KB)<br />

2) The participants should provide the design with a Scale <strong>of</strong> 1:100 include<br />

detail outline, mentoring room layout area, View, Section, Description <strong>of</strong> the<br />

unit/Visualization, Inspection Plan <strong>of</strong> the Outline with details <strong>of</strong> dimensions,<br />

Notes <strong>and</strong> Explanation etc.<br />

3) Each participant shall submit only one work/ design. Any participant<br />

submitting more than one design or options shall be disqualified from the<br />

competition.<br />

4) Color presentations <strong>and</strong> illustrative sketches are permitted.<br />

5) The design received after due date <strong>and</strong> time will not be taken into<br />

consideration.<br />

6) The decision <strong>of</strong> the Technical Jury/ Committee shall be final <strong>and</strong> binding.<br />

7) The designs should be neatly folded along with a s<strong>of</strong>t copy in CD. All the<br />

drawings are to be serially numbered <strong>and</strong> must be signed by the registered<br />

applicant only. The Registered applicant shall only be allowed to make a<br />

* The consultant shall submit maximum 6 running bills (each running bill<br />

to be raised after completing at least one or more <strong>of</strong> above milestones) &<br />

one final bill.<br />

* HVAC working stage drawings (fabrication drawings) will be prepared<br />

by the execution contractor (& not by consultant) <strong>and</strong> will be checked by<br />

consultant only if asked by <strong>Tender</strong> Inviting Agency.<br />

2. Invoices:<br />

For all Stages the consultant shall raise three sets <strong>of</strong> invoices:<br />

* Only after completion <strong>of</strong> the respective stages as listed in the table<br />

above.<br />

* Billing break-up as above shall be strictly followed.<br />

* No further splits <strong>of</strong> the prices shall be considered <strong>for</strong> billing purposes.<br />

3. Security deposit<br />

A Security deposit <strong>of</strong> 10% <strong>of</strong> running bills subject to a maximum <strong>of</strong> 5%<br />

<strong>of</strong> total order value will be retained. This shall be payable after 3 years <strong>of</strong> date<br />

The agency shall submit first lot <strong>of</strong> drawings (50%) within 2 months from<br />

the award <strong>of</strong> work, so that work can be started at site.<br />

2. LD <strong>for</strong> delay in completion:<br />

* LD shall be levied upon the consultant in case <strong>of</strong> delay in fulfilling the<br />

obligations under this agreement <strong>for</strong> causes solely attributable to the<br />

agency at 1% (one percent only) <strong>of</strong> the contract fee per week <strong>of</strong> delay<br />

subject to a maximum <strong>of</strong> 5% <strong>of</strong> the total contract fee.<br />

* For computing the LD amount, the period <strong>of</strong> delay on the part <strong>of</strong> the<br />

consultant shall be worked out by <strong>Tender</strong> Inviting Agency going strictly<br />

by the time schedule mentioned in this order. The agency shall be liable<br />

to pay this compensation to <strong>Tender</strong> Inviting Agency.<br />

* However, no LD shall be levied in case the delay is on account <strong>of</strong> release<br />

<strong>of</strong> design input to the consultant from <strong>Tender</strong> Inviting Agency side. In<br />

such cases the time schedule shall be reworked & a suitable extension <strong>of</strong><br />

in time granted <strong>for</strong> work completion. NO EXTRA PRICE SHALL BE<br />

PAYABLE BY TENDER INVITING AGENCY TO THE<br />

7. GENERAL CONDITIONS OF CONTRACT<br />

The General conditions <strong>of</strong> Contract are as under:-<br />

1. Delay <strong>and</strong> Extension:<br />

If the work is delayed by <strong>for</strong>ce majeure or any other cause which in the<br />

absolute discretion <strong>of</strong> the employer is beyond the agency's control, they shall<br />

immediately upon the happening <strong>of</strong> such event contributing to delays give<br />

notice there<strong>of</strong> in writing to the employer but shall nevertheless use constantly<br />

their best endeavors to prevent or make good the delay <strong>and</strong> shall do all that may<br />

be reasonably required to the satisfaction <strong>of</strong> <strong>Tender</strong> Inviting Agency to proceed<br />

with the work. Request <strong>for</strong> extension <strong>of</strong> time shall be made by the agency in<br />

writing within 7 days <strong>of</strong> the happening <strong>of</strong> the event causing delay. The agency<br />

shall also indicate with any such request, the period <strong>for</strong> which extension is<br />

required. In any such case <strong>Tender</strong> Inviting Agency may give a fair <strong>and</strong><br />

reasonable extension <strong>of</strong> time <strong>for</strong> completion <strong>of</strong> individual items <strong>of</strong> groups <strong>and</strong><br />

items <strong>of</strong> work <strong>for</strong> which separate period <strong>of</strong> completion are specified in the<br />

contract as a whole, but it shall be the sole discretion <strong>of</strong> the employer to grant <strong>of</strong><br />

refuse such extension. The decision <strong>of</strong> <strong>Tender</strong> Inviting Agency in regard to the<br />

extension will be communicated to the agency in writing within a reasonable<br />

time but no compensation or any extra amount shall be paid <strong>for</strong> such extensions<br />

granted by <strong>Tender</strong> Inviting Agency.<br />

RISK PREJUDICE CLAUSES<br />

2. Arbitration:<br />

If at any time any doubt, question, dispute or difference whatsoever, shall arise<br />

between the agency <strong>and</strong> <strong>Tender</strong> Inviting Agency upon or in relating to or in<br />

connection with this contract, either <strong>of</strong> the parties may give the other notice in<br />

writing <strong>of</strong> the existence <strong>of</strong> such doubt, question, dispute or difference <strong>and</strong> the<br />

same shall be referred to the Secretary Health, DNH, Silvassa or his nominee as<br />

Sole Arbitrator in accordance with the latest Indian Arbitration Act, later<br />

amendments, if, any. The decision <strong>of</strong> the sole arbitrator thereon shall be final,<br />

conclusive <strong>and</strong> binding upon the parties to dispute. The party invoking<br />

arbitration shall specify the dispute or disputes to be referred to the arbitration<br />

under the clause together with the amount or amounts claimed in respect <strong>of</strong> each<br />

<strong>of</strong> dispute.<br />

3. Jurisdiction <strong>of</strong> Court:<br />

All disputes arising out <strong>of</strong> the contract shall have the jurisdiction <strong>of</strong> courts <strong>of</strong> the<br />

Union Territory <strong>of</strong> <strong>Dadra</strong> & <strong>Nagar</strong> Haveli only.<br />

4. Termination <strong>of</strong> Contract:<br />

The <strong>Tender</strong> Inviting Agency reserves the right to terminate, or postpone the<br />

work <strong>for</strong> good <strong>and</strong> sufficient cause <strong>and</strong> shall give 30 days prior notice in writing<br />

to the agency (<strong>Tender</strong> Inviting Agency being sole judge <strong>for</strong> the same). The<br />

agency shall be paid <strong>for</strong> the useful work done up to the date <strong>of</strong> termination.<br />

<strong>Tender</strong> Inviting Agency shall determine the credit to be given to the agency <strong>for</strong><br />

the value <strong>of</strong> the work executed by the agency. The agency shall give <strong>Tender</strong><br />

Inviting Agency all the data, compiled report, drawings etc. prepared by them<br />

till the date <strong>of</strong> termination be<strong>for</strong>e the final dues are paid to the agency. Even<br />

after the termination <strong>of</strong> agreement, the agency shall continue to cooperate with<br />

<strong>Tender</strong> Inviting Agency to such a reasonable extent as may be necessary to<br />

clarify or explain any reports or recommendations in documents or detailing<br />

made by them.<br />

5. Breach <strong>of</strong> Trust:<br />

Unless otherwise directed by <strong>Tender</strong> Inviting Agency specifically, the<br />

agency shall not contact directly or indirectly the client or any other authorities<br />

connected with the project. Non compliance <strong>of</strong> this clause shall be treated as<br />

breach <strong>of</strong> trust resulting in the termination <strong>of</strong> contract between <strong>Tender</strong> Inviting<br />

Agency <strong>and</strong> the agency <strong>for</strong>thwith without any prior notice to him. In such event,<br />

no job will be entrusted to him in future by <strong>Tender</strong> Inviting Agency.<br />

6. Discussions with <strong>Tender</strong> Inviting Agency <strong>and</strong> Approvals:<br />

* AVAILABILITY: The agency shall make themselves available at<br />

reasonable notice to be present <strong>for</strong> discussion with <strong>Tender</strong> Inviting<br />

Agency. The agency shall also provide assistance, advice <strong>and</strong><br />

in<strong>for</strong>mation to <strong>Tender</strong> Inviting Agency as may be required from time to<br />

time <strong>for</strong> discussions with other agencies or <strong>Tender</strong> Inviting Agency<br />

<strong>of</strong>ficials connected with the work without any extra claim.<br />

* WEEKLY MEETINGS: The design detailer with his associates will<br />

regularly attend the <strong>Tender</strong> Inviting Agency <strong>of</strong>fice <strong>for</strong> weekly meetings<br />

on the date specified by <strong>Tender</strong> Inviting Agency till the completion <strong>of</strong> the<br />

design job in which the progress made in the works will be discussed <strong>and</strong><br />

clarifications required if any will be given. All cost incidentals to such<br />

interaction <strong>for</strong> meetings shall be to the detailer’s account <strong>and</strong> no claim<br />

shall be entertained by <strong>Tender</strong> Inviting Agency on this account.<br />

* APPROVAL OF WORK: The agency shall get approved the work done<br />

by him at every stage throughout the period from <strong>Tender</strong> Inviting<br />

Agency. However, such approval by <strong>Tender</strong> Inviting Agency shall not be<br />

deemed to absolve the agency <strong>of</strong> the total responsibility <strong>of</strong> the<br />

correctness <strong>and</strong> soundness <strong>of</strong> the work <strong>and</strong> other obligations under this<br />

contract.<br />

7. Guarantee <strong>and</strong> Liability <strong>of</strong> the Agency:<br />

* LIABILITY: The Agency shall be liable <strong>for</strong> all consequence <strong>of</strong> errors<br />

<strong>and</strong> omissions arising from errors solely attributable to agency or on the<br />

part <strong>of</strong> their employees to the extent <strong>and</strong> with the limitation specified by<br />

<strong>Tender</strong> Inviting Agency.<br />

* ASSOCIATED NECESSARY WORK: Any other items <strong>of</strong> work not<br />

mentioned specifically in the scope <strong>of</strong> work but required/felt necessary<br />

<strong>for</strong> the completion <strong>of</strong> the project as a whole in all respects shall be<br />

deemed to be included in the scope as well as in the fee quoted by the<br />

detailer <strong>and</strong> no extra claim shall be admissible on this account.<br />

8. Ownership <strong>of</strong> Documents & Copy Rights:<br />

* The copy right <strong>of</strong> all drawings, reports, calculations, BOQs, <strong>Tender</strong><br />

papers <strong>and</strong> other similar documents provided by the agency in connection<br />

with project / work shall remain vested in <strong>Tender</strong> Inviting Agency.<br />

* The agency shall not publish without the written consent <strong>of</strong> employer or<br />

use <strong>for</strong> purpose other than those <strong>for</strong> this work, the articles, designs,<br />

photographs or illustrations, related to this work / project.<br />

9. Changes or Alteration <strong>of</strong> Drawings/Designs/ Arrangement / Scheme<br />

Etc.<br />

Changes or alterations as desired by <strong>Tender</strong> Inviting Agency due to site<br />

considerations or otherwise as required during the pendency <strong>of</strong> the contract will<br />

be done by the agency under their scope <strong>of</strong> work within the Lump Sum fee<br />

already quoted <strong>and</strong> agreed upon.<br />

10. Correctness <strong>and</strong> Accuracy <strong>of</strong> Data:<br />

The agency shall be full responsible <strong>for</strong> the correctness <strong>and</strong> accuracy <strong>of</strong><br />

the data, planning, designs, drawings, specifications, bills <strong>of</strong> quantities <strong>and</strong><br />

documents furnished by them. If any inadequacy is observed in the work<br />

per<strong>for</strong>med by them, they shall at their own initiative <strong>and</strong> at no extra cost to<br />

<strong>Tender</strong> Inviting Agency take all steps necessary to remedy/rectify the said<br />

defects or inadequacies. The Detailer shall incorporate all the modification or<br />

changes as desired by the <strong>Tender</strong> Inviting Agency in the drawings, plans <strong>and</strong><br />

reports, design etc. at no extra cost to <strong>Tender</strong> Inviting Agency.<br />

11. Safety <strong>of</strong> Design:<br />

The agency shall be fully responsible <strong>for</strong> the safe designs as per national<br />

st<strong>and</strong>ards <strong>and</strong> requirements. In the absence <strong>of</strong> National St<strong>and</strong>ards, the<br />

requirement would <strong>of</strong> International st<strong>and</strong>ard.<br />

12. Per<strong>for</strong>mance Guarantee:<br />

The agency shall fully st<strong>and</strong> guarantee <strong>and</strong> indemnity the <strong>Tender</strong> Inviting<br />

Agency <strong>for</strong> the design <strong>and</strong> detailing done by them as also per<strong>for</strong>mance <strong>and</strong><br />

detailing etc. <strong>of</strong> the works. Agency shall submit guarantee to <strong>Tender</strong> Inviting<br />

Agency on pro <strong>for</strong>ma approved by <strong>Tender</strong> Inviting Agency.<br />

13. Code <strong>of</strong> Practice:<br />

The report, design <strong>and</strong> drawings <strong>for</strong> all works shall con<strong>for</strong>m to local<br />

building byelaws <strong>and</strong> other state regulation as well as to relevant latest Indian<br />

St<strong>and</strong>ard Specifications <strong>and</strong>/or St<strong>and</strong>ard Code <strong>of</strong> Practice. Where Indian<br />

St<strong>and</strong>ards are not available, equivalent International St<strong>and</strong>ards <strong>and</strong>/or generally<br />

accepted sound engineering practices shall be followed. Deviation from BIS<br />

recommendations <strong>and</strong> adoption <strong>of</strong> other code <strong>of</strong> practice will require prior<br />

approval <strong>of</strong> <strong>Tender</strong> Inviting Agency in writing. All reports, computations,<br />

drawings, shall be submitted in English language <strong>and</strong> in metric/SI units.<br />

14. General Conditions:<br />

1) Agency quoting <strong>for</strong> the above work shall have in-house pr<strong>of</strong>essionals <strong>for</strong><br />

all disciplines or alliance/JV with any other firm. Main architectural<br />

work to be done by main agency.<br />

2) Agency quoting <strong>for</strong> the above should have his design <strong>of</strong>fice with<br />

sufficient pr<strong>of</strong>essional staff who can take up the work efficiently.<br />

3) <strong>Consultant</strong> shall make visits to site as <strong>and</strong> when required by <strong>Tender</strong><br />

Inviting Agency subject to maximum 5 visits. The expenditure against<br />

this shall be included in consultancy fees quoted by consultant. However,<br />

if more visits are required the expenditure shall be borne by <strong>Tender</strong><br />

Inviting Agency as per terms <strong>and</strong> conditions <strong>of</strong> <strong>Tender</strong> Inviting Agency.<br />

4) <strong>Consultant</strong> shall submit 3 check prints (one each at different stage as the<br />

drawing is <strong>of</strong>fered <strong>for</strong> <strong>Tender</strong> Inviting Agency comments) <strong>of</strong> each<br />

drawing <strong>and</strong> s<strong>of</strong>t copies. The final prints shall be plotted by <strong>Tender</strong><br />

Inviting Agency as per requirement.<br />

5) The quantities <strong>of</strong> R.C.C., steel rein<strong>for</strong>cement, brick work, flooring item<br />

<strong>and</strong> external cladding/finishing shall be submitted along with detailed<br />

drawings prepared by consultants.<br />

6) The B.O.Q. as per the DSR should be prepared by the <strong>Consultant</strong>. These<br />

quantities <strong>of</strong> items should be kept in mind while detailing/designing the<br />

buildings. The consultant shall from time to time cross check to examine<br />

that the actual quantities computed from his drawings do not exceed the<br />

BoQ quantities by more than 5%, particularly <strong>for</strong> various important items<br />

(value-wise) <strong>of</strong> work.<br />

7) The agency shall submit credentials <strong>of</strong> sub-consultants at least 2 in<br />

number who has h<strong>and</strong>led this type <strong>of</strong> work which will be approved by<br />

<strong>Tender</strong> Inviting Agency. The <strong>of</strong>fer can be rejected if agency is failed to<br />

submit the same.<br />

8) An Agreement will be required to be signed by the successful tenderer<br />

<strong>for</strong> the purpose <strong>of</strong> this contract. Rates tendered/<strong>of</strong>fered in response to the<br />

concerned <strong>Tender</strong> notice shall be considered as acceptance <strong>of</strong> all above<br />

terms & conditions <strong>for</strong> the said contract <strong>for</strong> all legal purpose.<br />

9) The Amount <strong>of</strong> Earnest money will be paid by the tenderer(s) whose<br />

tenders are not accepted will be refunded to them by cheque <strong>of</strong> dem<strong>and</strong><br />

Draft (as may be convenient to the <strong>Tender</strong> Inviting Officer) drawn on any<br />

branch <strong>of</strong> State <strong>of</strong> India or its subsidiary Commercial Bank. Where this<br />

mode <strong>of</strong> payment is not possible the amount will be refunded at the cost<br />

<strong>of</strong> tenderer.<br />

8. EVALUATION CRITERIA<br />

The tenders will be in two bid system <strong>and</strong> the evaluation will be as follows:<br />

Weightage <strong>for</strong> Technical bid: 70 %<br />

Weightage <strong>for</strong> Financial Bid: 30 %<br />

Technical Bid will be evaluated under the following heads:<br />

1. Number <strong>of</strong> Similar Projects executed - 15%<br />

2. Value <strong>of</strong> total Project Cost – 15%<br />

3. Number <strong>of</strong> years <strong>of</strong> Experience in the field <strong>of</strong> Hospital Industry & Medical<br />

Education – 20%<br />

4. Capacity <strong>of</strong> Medical College Projects implemented – 15%<br />

5. Whether experience in preparing Master plan <strong>for</strong> the medical college project<br />

– 20%<br />

6. Whether similar work has been done in India <strong>and</strong> have statutory knowledge<br />

– 15%<br />
