This finance report covers the seven month period to the 31 January 2012. At the February<br />

Ordinary <strong>Council</strong> meeting, <strong>Council</strong> adopted the midyear Budget Review which provided revised<br />

forecast for the second half of the 2011-12 financial year. The details within this report to the end<br />

of January 2012 provide a Year to Date (YTD) comparison to that adopted midyear Budget<br />

Review.<br />

The January 2012 YTD financial position was projected to be a surplus of $2.981M in the Midyear<br />

Budget review. The actual result at the end of January is a YTD surplus of $3.031M which is<br />

$49.8K favourable to the YTD Mid Year Review. The key reasons for this favourability are:<br />

• Other Revenue is $46k favourable for January due to higher levels of Quarry material sales<br />

than forecast for the month<br />

• User Charges are also $26.2k favourable for January. This is due to higher levels of Pool<br />

fees ($24.5k) and waste disposal site fees ($6.0k) collected during January<br />

• Developer Contributions are $12.4k favourable due unexpected contributions for Open<br />

Space ($8.4k) and native tree planting ($4.0k)<br />

• Supplementary Rates collected during January were $10k higher than anticipated<br />

• Contractor Payments were also $30k favourable due to the delay of an instalment payment<br />

to <strong>Council</strong>’s property valuer ($61k) which was offset additional payments of $30k for waste<br />

collection services<br />

• Employee Costs were $17k favourable to forecast due to the higher levels of leave (which<br />

is fund by Balance Sheet Provisions) taken during the month of January<br />

• The early receipt of $14k in Operating Grant funding for the Roadside Sustainability Accord<br />

• The above favourability was offset by the delayed receipt of Operating Grants for<br />

Emergency Management coordinator ($60k) and within Community Planning ($10k), the<br />

power bill for Wodonga pool ($21k) forecast for February but paid in January and net extra<br />

Other Expenses of $9k (higher levels of plant & equipment maintenance and extra plant<br />

hire for Lake Sambell offset by delayed contributions payments within Tourism)<br />

<strong>Council</strong>’s Profit & Loss Statement and the Business Unit Report details as at 31 st January 2012<br />

are contained within the attached reports. As previously agreed with <strong>Council</strong>, an Exception<br />

Report will only be provided along with quarterly finance reports and therefore no Exception<br />

Report is included in this month’s Finance report.<br />

<strong>Council</strong>’s Cash position as at the 31 st January 2012 is $3.4 million. This compares with a cash<br />

position of $4.9 million for the same period last year. Details of how these funds are invested are<br />

contained within the attached Cash & Investment Report as at 31 January 2012.<br />

At 31 st January 2012, Year to Date Capital Works spend is $4.954M which equates to 49.5% of<br />

the adopted Mid Year CAPEX Budget for 2011/12. As can be seen from the table below, this<br />

compares favourably to the same time last year when $4.312M equating to 48.3% completion of<br />

the Mid Year CAPEX Budget had been achieved at 31 st January 2011.<br />

The YTD Actual spend and completion rates for Capital Works as at 31 st January 2012 are a<br />

good indication that we are on track for another excellent year of capital works completion<br />

That the Chief Executive Officer or the person acting in the position of the Chief Executive<br />

Officer, may on behalf of <strong>Council</strong>, affix the common seal of the <strong>Council</strong> to the Deed of<br />

Assignment of Lease/Transfer of Lease for the Chiltern Caravan Park conditional to the<br />

following requirements being met:<br />

1. The cyclical management maintenance program has been carried out by the existing<br />

tenants in accordance with Schedule 3 of the Lease agreement;<br />

2. An inventory of buildings, structures, plant and equipment be carried out;<br />

3. Written consent is granted by the Minister under Part 12.1 of the Lease Agreement; and<br />

4. The requirements of Part 12.2 of the Lease Agreement.<br />

RECOMMENDATION<br />

INTRODUCTION<br />

The Minister has appointed the <strong>Indigo</strong> <strong>Shire</strong> <strong>Council</strong> as the Committee of Management of the<br />

land which the Chiltern Caravan Park is situated. <strong>Council</strong> has agreed to lease the land to the<br />

Tenant, being LR & AM Bould, pursuant to Section 17D of the Crown Land (Reserves) Act 1978.<br />

The Tenants are now seeking to sell their business and wish to transfer the existing lease<br />

agreement of the Chiltern Caravan Park to new Tenants, being S Clarke & B Moscrop.<br />

BACKGROUND<br />

The existing lease commenced on 20 January 2009 for a term of 20 years with rent payable at<br />

$500 per annum (plus GST) for the first year. Rent payable thereafter is to be set at market value<br />

in accordance with Schedule 2 of the lease agreement. The next market valuation is due in<br />

January 2013.<br />

KEY IMPLICATIONS<br />

The lease agreement allows for the transfer to new tenants provided certain conditions are met.<br />

The conditions are as follows:<br />

1. The cyclical management maintenance program has been carried out by the existing<br />

tenants in accordance with Schedule 3 of the Lease agreement.<br />

2. An inventory of buildings, structures, plant and equipment be carried out;<br />

3. Part 12.1 requires that the Tenant seek written consent from <strong>Council</strong> (the Landlord) and<br />

the Minister prior to transferring the lease; and<br />

4. Part 12.2 requires<br />

a. The Tenant seeks <strong>Council</strong>’s (the Landlord’s) consent;<br />

b. The Tenant is not at the time in breach of the lease; and<br />

c. The Tenant proves to the satisfaction of <strong>Council</strong> that the proposed assignee is<br />

respectable, responsible and solvent person having the financial capacity and<br />

trading experience necessary to enable the permitted use to be successfully<br />

undertaken and maintained. The Tenant must submit to <strong>Council</strong> all information<br />

reasonably required by <strong>Council</strong> including at least two references to the proposed<br />

assignee’s business experience, at least two references as to the proposed<br />

assignee’s financial circumstances, and a detailed statement of financial<br />

circumstances of the proposed assignee and any proposed guarantor.<br />

The Economic Development Officer is in the process of ensuring the maintenance program has<br />

been carried out in accordance with the lease agreement and will endeavour to undertake an<br />

inventory as soon as practicable. The Deed of Assignment/Transfer of Lease will be reviewed by<br />

<strong>Council</strong>’s solicitor prior to being signed.<br />

The Economic Development Officer has also been in contact with the proposed tenants and has<br />

reviewed their resumes. They appear to be in a sound financial position and possess the<br />

adequate business knowledge and skills to operate the caravan park. They are enthusiastic<br />

about moving to the <strong>Indigo</strong> <strong>Shire</strong>.<br />

FINANCIAL IMPLICATIONS<br />

The costs of drawing up the transfer were at the cost of the existing tenant.<br />

Transfer of the lease also exposes <strong>Council</strong> to risks surrounding the management of the Caravan<br />

Park if the new tenants are not adequately suited or financially stable. This could mean costs to<br />

<strong>Council</strong> if the Caravan Park is not suitably maintained in accordance with the lease or<br />

management is unsatisfactory and <strong>Council</strong> is required to have the tenants removed. To ensure<br />

this risk is mitigated, the proposed tenants are submitting <strong>Council</strong> with the following written<br />

references:<br />

• Bank manager;<br />

• Accountant; and<br />

• Business Associate.<br />

The proposed tenants also submitted a summary of their financial position as part of the transfer<br />

process. Their financial position, as detailed in their statement of financial position reviewed by<br />

the Economic Development Officer, is more than adequate to run the Caravan Park.<br />

CONCLUSION<br />

Approval of this report is essential to expedite the sale process for the existing tenants to ensure<br />

that their sale does not fall through as a result of <strong>Council</strong> processes. Settlement is proposed for<br />

30 April 2012. The recommended delegation allows for the transfer process to continue, whilst<br />

still ensuring that <strong>Council</strong>’s requirements are met.<br />

abovementioned land to Parks Victoria.<br />

INTRODUCTION<br />

Parks Victoria has requested a new 15 year lease of the abovementioned land for the use of its<br />

Parks Victoria Works Depot. Due to the term of the lease being greater than 10 years provisions<br />

under Section 190 of the Local Government Act apply.<br />

“<strong>Council</strong> must at least four weeks before the lease is made publish a notice of the proposed<br />

lease. A person has a right to make a submission under section 223 of the proposed lease.”<br />

BACKGROUND<br />

The original Lease Agreement from <strong>Council</strong> to Parks Victoria commenced in 2002 for 3 years with<br />

2 further terms of 3 years each. These options were exercised and therefore the lease expired on<br />

1 November 2011.<br />

The subject land has been re-surveyed to omit a designated area for <strong>Council</strong> pound facilities<br />

should they be required in the future. A new valuation has also been obtained to ensure current<br />

market value for the rental.<br />

KEY IMPLICATIONS<br />

The new lease agreement will allow for the continued relationship between <strong>Council</strong> and Parks<br />

Victoria. If approved a draft lease document will be prepared by <strong>Council</strong>’s Solicitors and provided<br />

to Parks Victoria for approval.<br />

CONCLUSION<br />

The new Lease arrangement will provide a long term arrangement between <strong>Council</strong> and Parks<br />

Victoria for the use of the land at its former Beechworth Depot site.<br />

C59 to the <strong>Indigo</strong> Planning Scheme which will transfer the responsibility for the issuing of<br />

Planning Certificates to the Minister for Planning and the Department of Planning and<br />

Community Development (DPCD).<br />

That <strong>Council</strong> resolve to request that the Minister for Planning adopt and approve Amendment<br />

C59 to the <strong>Indigo</strong> Planning Scheme which will transfer the responsibility for the issuing of<br />

Planning Certificates to the Minister for Planning and the Department of Planning and<br />

Community Development (DPCD).<br />

INTRODUCTION<br />

<strong>Indigo</strong> <strong>Shire</strong> <strong>Council</strong> presently is responsible for issuing planning certificates for properties within<br />

the <strong>Shire</strong>. A planning certificate contains information about how the planning scheme affects a<br />

property on a given date. Information on the certificate may include zoning of the land and overlay<br />

planning controls, reservations that affect the land, classified roads abutting the land and<br />

proposals contained in an exhibited amendment to the planning scheme. An application for a<br />

planning certificate is generally made upon the sale of a parcel/ parcels of land, and there are a<br />

limited range of applicants – generally solicitors or conveyancing firms.<br />

The issuing of planning certificates is a relatively minor function of statutory planning, however it<br />

is a function that can be taken over by the Minister for Planning and the Department of Planning<br />

and Community Development.<br />

This report makes the recommendation that the issuing of Planning Certificates that the issuing of<br />

Planning Certificates is better placed with the Minister for Planning and the Department of<br />

Planning and Community Development.<br />

BACKGROUND<br />

The responsibility for issuing planning certificates has rested with <strong>Indigo</strong> <strong>Shire</strong> <strong>Council</strong> since the<br />

introduction of the new format planning schemes in 1999, when the default approach at the time<br />

was to vest the responsibility with the council.<br />

The process of producing a planning certificate is a relatively simple one, requiring an application<br />

to be made and the certificate then produced manually by planning staff. However, in terms of a<br />

cost-benefit analysis, there is little benefit to <strong>Council</strong>.<br />

The statutory fee received for the certificate is nominal, and while all measures are taken to<br />

ensure the information contained within the certificate is accurate, it is nonetheless a manual<br />

process with a potential for error and associated risk.<br />

Given a planning certificate often informs a purchaser of land, if the information were to be<br />

incorrect it could result in <strong>Council</strong> being liable for any expenses incurred by the purchaser.<br />

In addition, the preparation of planning certificates reduces time for staff resources to be better<br />

spent on more important statutory planning functions, such as planning permits.<br />

In shifting the responsibility for the issuing of Planning Certificates to the Minister for Planning, the<br />

process will be more streamlined for applicants in that it is a web-based process with quicker<br />

turnaround times.<br />

KEY IMPLICATIONS<br />

The main implication of removing the responsibility for issuing planning certificates from <strong>Council</strong><br />

is an amendment to the schedule to Clause 61.01 of the <strong>Indigo</strong> Planning Scheme. The<br />

amendment would result in section 3.0 of the schedule reading as follows:<br />

‘Person or responsible authority for issuing planning certificates: Minister for Planning’<br />

RISK MANAGEMENT<br />

In terms of risk management, the amendment would remove an element of risk from the statutory<br />

planning processes (see discussion above).<br />

This proposed planning scheme amendment will assist with the achievement of the key strategic<br />

COMMUNICATION<br />

Once approved by the Minister for Planning, communication of the change to the planning<br />

certificate process will be carried out to those parties who regularly apply for certificates.<br />

CONCLUSION<br />

Shifting responsibility for the issuing of planning certificates to the Minister for Planning will free<br />

up <strong>Council</strong> resources to better concentrate on other statutory planning tasks and remove an<br />

element of risk currently inherent in the process. In addition, it will result in a more streamlined<br />

INTRODUCTION<br />

Through continuous monitoring of the ordinance and maps that make up the <strong>Indigo</strong> Planning<br />

Scheme, a number of mapping and typographical errors and omissions have come to light over a<br />

period of time since the last mapping errors amendment in 2008. It is considered appropriate to<br />

have these rectified via a Ministerial Amendment at the present time.<br />

BACKGROUND<br />

The Minister for Planning can consider making minor corrections to the planning scheme in a<br />

limited number of situations, including where the mechanisms of the planning process have<br />

created a situation that is clearly in error. From time to time issues are picked up whereby it is<br />

apparent an error has occurred, whether it is in the mapping of a zone or overlay, or clerical error<br />

in the text of the planning scheme.<br />

If the Minister for Planning consents to conducting the amendment, the usual requirement of a<br />

planning scheme amendment can be waived if the Minister considers that compliance with the<br />

requirements is not warranted.<br />

The list of mapping and clerical errors and omssions proposed to be included as part of this<br />

amendment is included at Attachment 1.<br />

KEY IMPLICATIONS<br />

Key implications of the proposed amendment will be that identified irregularities and errors in the<br />

The <strong>Indigo</strong> <strong>Shire</strong> <strong>Council</strong> Arts Strategic Plan 2012 – 2016 has been developed as an important<br />

tool for <strong>Council</strong> and the community to guide the development of the arts in the <strong>Shire</strong>. The purpose<br />

of this report is to present the final draft of the document to <strong>Council</strong> for adoption.<br />

BACKGROUND<br />

The <strong>Indigo</strong> <strong>Shire</strong> <strong>Council</strong> Arts Strategic Plan 2007 – 2010 was reviewed and assessed by the Arts<br />

and Culture Advisory Committee (ACAC) and <strong>Council</strong> officers specifically around what actions<br />

had been achieved, what were the ongoing objectives, and what actions were no longer a priority<br />

in the Plan. A working document was produced reflecting the outcomes from this analysis.<br />

From this working document, key areas of focus were identified for the future of arts in the shire.<br />

Some of the objectives and actions from the previous Plan were carried over, and many new<br />

objectives were developed for inclusion in the first Draft of the new Plan.<br />

The first Draft was forwarded to the ACAC, community arts organisations within the shire and<br />

other interested individuals. Murray Arts also facilitated a planning workshop for the Arts<br />

Strategic Plan where participants were invited to think about the future of arts in <strong>Indigo</strong> <strong>Shire</strong>, and<br />

how the goals might be achieved. Following the workshop, held in May 2011, the thoughts and<br />

comments from the arts community were collected and collated and the second draft of the<br />

Strategic Plan was developed.<br />

The second draft was presented at a <strong>Council</strong> Briefing in November 2011 and then made available<br />

to the wider community for their feedback and comments. No comments were received. The final<br />

draft of the Arts Strategic Plan 2012 – 2016 is attached to this report which recommends its<br />

adoption.<br />

The final Plan does not pose any substantial risks to <strong>Indigo</strong> <strong>Shire</strong> <strong>Council</strong> or the community.<br />

However, it is important that the community are engaged and are given appropriate opportunity<br />

to, where appropriate, be a part of the actions and initiatives in the Plan when they are being<br />

implemented. Each action will be subject to a risk assessment prior to its implementation to<br />

ensure if there are risks involved, they are identified and managed before implementation of the<br />

action.<br />

FINANCIAL IMPLICATIONS<br />

The Plan includes a number of priorities which, if implemented, may have financial implications<br />

for <strong>Council</strong> and the community. It will be <strong>Council</strong>'s role, in conjunction with the ACAC and the arts<br />

community, to assist in the implementation of these actions, subject to appropriate budget<br />

processes. It is anticipated that a significant proportion of <strong>Council</strong>’s Arts and Cultural<br />

Development Officer’s time will be spent either directly or indirectly implementing the Actions from<br />

an adopted Arts Strategic Plan.<br />

a motion “To name the Pavilion the “Nelson McIntosh Pavilion”. This, in effect, means that the<br />

Yackandandah Sportspark facility would still be known as the Yackandandah Sportspark but the<br />

newly constructed multipurpose pavilion would be named “Nelson McIntosh Pavilion” if the<br />

recommendation in this report is endorsed.<br />

BACKGROUND<br />

The completion of the Yackandandah Sportspark Multipurpose Facility was the final major stage<br />

in a project that commenced over 15 years ago. Instrumental in the initial transportation of the<br />

steel framework that formed the basis of the new facility, Nelson McIntosh, along with many other<br />

volunteers, provided volunteer labour and inkind support to complete Stage 1 of the project.<br />

Nelson has continued this support to the local Yackandandah community and in particular to the<br />

Sportspark playing a big part in how it looks today.<br />

The Yackandandah Sportspark Committee of Management, to recognise the input of Nelson over<br />

many years, passed a motion “To name the Pavilion the “Nelson McIntosh Pavilion”. The<br />

Committee were clear in the <strong>Minutes</strong> from the meeting that the Yackandandah Sportspark facility<br />

would still be known as the Yackandandah Sportspark but the newly constructed multipurpose<br />

pavilion would be named to recognise Nelson McIntosh.<br />

It has previously been noted that we have no policy to guide these decisions and that a policy<br />

needs to be developed by <strong>Council</strong>. Given that this issue has been under discussion and in the<br />

public eye for some time, it was viewed as important it be formally considered.<br />

KEY IMPLICATIONS<br />

The proposed naming of the Pavilion is due recognition for a local volunteer who has contributed<br />

to the development of the Sportspark over many years. However, as there hasn’t been any<br />

formalised community consultation, there may be some in the community that may disagree with<br />

the decision. Any comments or feedback on the proposed decision would need to be managed in<br />

a consistent manner.<br />

It is the intention of the Committee, subject to the endorsement of this recommendation by<br />

<strong>Council</strong>, to install signage on the building entrance to the Sportspark pavilion. This signage would<br />

require approval by <strong>Council</strong>.<br />

INTRODUCTION<br />

The Infrastructure Design Manual (IDM) is a document utilised by Victorian Regional and Rural<br />

<strong>Council</strong>s for the setting of engineering standards for development and subdivisions. The Major<br />

Projects and Programs Department is responsible for this role within <strong>Council</strong>. This function is<br />

often subject to dispute between <strong>Council</strong> and developers over the engineering standards and the<br />

accuracy of the wording and appropriateness of the development conditions. This document will<br />

reduce the frequency of these disputes and improve the standard of engineering infrastructure<br />

that ultimately becomes the responsibility of <strong>Council</strong>.<br />

BACKGROUND<br />

The IDM was originally prepared by the cities of Greater Bendigo and Greater Shepparton and<br />

the <strong>Shire</strong> of Campaspe. Their joint initiative was one that recognised the benefits of municipalities<br />

working together towards consistent requirements and standards for the design and development<br />

of infrastructure. The first version of the IDM came into use in October 2007. The manual is a<br />

living document and is revised and amended from time to time. A version 4 is currently in draft<br />

form.<br />

The benefits derived from having a common IDM across municipalities are:<br />

• Sharing financial and human resources to produce an Infrastructure Design Manual that<br />

will satisfy the requirements of each of the municipalities<br />

• Developing more consistency amongst design requirements for Consultants and<br />

developers working in the participating municipalities<br />

• Providing a better defence at the Victorian Civil Appeals Tribunal (VCAT) when the design<br />

requirements have been developed and adopted by a number of municipalities<br />

• Sharing of ideas and practices helps the municipalities to adopt the best practice of each<br />

• Clearly documenting <strong>Indigo</strong> <strong>Shire</strong> <strong>Council</strong>’s requirements for the design and development<br />

of infrastructure<br />

The IDM Group carried out a presentation of the Manual at the <strong>Council</strong> office in Yackandandah<br />

where representatives of the IDM group explained the IDM and answered questions from local<br />

<strong>Council</strong> officers. At this time, <strong>Indigo</strong> <strong>Shire</strong> engineers presented to the Group a list of identified<br />

issues regarding the manual. This list is attached as Appendix 2 to this report.<br />

The group has responded to the issues by including the following clauses in the version four draft:<br />

1.6 Compliance<br />

The <strong>Council</strong>s using this Manual will make every endeavour to follow the requirements of this<br />

Manual unless there are circumstances that exist that make it impractical or unreasonable to<br />

follow the requirements of this Manual e.g. (new provisions)<br />

• Renewing an existing asset which does not comply with the standards specified in this<br />

Manual.<br />

• Where the protection of native vegetation or the existing streetscape make it impractical to<br />

adopt the IDM standards<br />

• Where the adoption of the IDM standards would result in detriment to the neighbourhood<br />

character of an area.<br />

1.7 Innovation and Advances in Technology (new clause)<br />

<strong>Council</strong>s may give consideration to adopting and approving innovative solutions and using new<br />

technologies where it can be demonstrated to the satisfaction of the <strong>Council</strong> that the objectives of<br />

the relevant clauses of the IDM have been satisfied even though the specific technical provisions<br />

have not been met.”<br />

The IDM technical group is constantly considering changes to the IDM and approximately every 6<br />

to 12 months there is a new revision released. As new <strong>Council</strong>s come on board new matters will<br />

be brought forward for consideration and decided upon and then there will be a new version<br />

released.<br />

The recent changes proposed to the IDM as listed above should ensure that where there is<br />

neighbourhood character issues e.g. a small town has narrow seals, no footpaths and no kerb<br />

and channel then it is possible for that <strong>Council</strong> to cite neighbourhood character as the reason for<br />

setting lower standards than is normal for the IDM. Further there is also an out where native<br />

vegetation or streetscapes make it impractical to adopt certain street widths would allow <strong>Indigo</strong><br />

<strong>Shire</strong> to adopt lesser standards.<br />

KEY IMPLICATIONS<br />

Legislative<br />

The IDM is not currently identified in any Victorian Government Legislation including the <strong>Indigo</strong><br />

<strong>Shire</strong> Planning Scheme. The IDM would be a support document for meeting the requirements of<br />

Clause 56 of the Planning Scheme (subdivision site and context description and design<br />

response). The IDM would also assist officers in meeting the requirements of the Subdivision Act<br />

1988, Part 3<br />

Regulatory<br />

The IDM is not currently identified in any Victorian Government regulations.<br />

Environment<br />

The IDM sets out objectives and requirements to be met by consultants and contractors engaged<br />

by the developer for environmental management during construction to ensure all appropriate<br />

steps are taken to minimise any detrimental impact on the environment.<br />

The IDM encourages environmentally sustainable landscape design to conserve water and<br />

energy and reduce waste. Water sensitive urban design is required to be incorporated into urban<br />

drainage design.<br />

RISK MANAGEMENT<br />

The adoption of the IDM will mitigate risk related to the specification, construction, and approval<br />

of engineering infrastructure for development within <strong>Indigo</strong> <strong>Shire</strong> <strong>Council</strong>. A more consistent set<br />

of standards and guidance for <strong>Council</strong> Development Engineers will result in a reduction of<br />

disputes between developers and <strong>Council</strong>.<br />

FINANCIAL IMPLICATIONS<br />

The financial implications of the adoption of the IDM are an annual maintenance fee of $2,000<br />

and a joining fee of $4,000 paid to the IDM Group. The adoption of the IDM will reduce the<br />

financial cost to <strong>Council</strong> by reducing the requirement to spend time updating design standards<br />

and standard drawings. There are also the benefits of more consistent design standards and<br />

conditions for Consultants and Developers reducing the time spent by <strong>Council</strong> planning and<br />

engineering staff in the preparation of planning permits.<br />

POLICY IMPLICATIONS<br />

Adoption of the Manual will require revision and updating of current engineering design standards<br />

and standard drawings. The revision of <strong>Indigo</strong> <strong>Shire</strong> <strong>Council</strong>’s adopted road hierarchy standards<br />

will be necessary. This revision will make road standards consistent with Ausroads Guidelines,<br />

the standard adopted by Vic Roads and municipalities across Australia.<br />

COMMUNICATION<br />

Prior to adoption of the IDM, key internal and external stakeholders will be consulted.<br />

CONCLUSION<br />

The adoption ‘in principle’ of the Infrastructure Design Manual will allow the Major Projects and<br />

Programs Department to undertake further meetings with the IDM Group and consultation with<br />

INTRODUCTION<br />

The current lessees of the Yackandandah Holiday Park have experienced significant issues due<br />

to the ease of access provided by the Church Street pedestrian bridge from the local residential<br />

area into the privately leased environs of the Yackandandah Holiday Park.<br />

The bridge itself is a makeshift structure that may have been constructed by others and presents<br />

significant risk issues to the public who may use it. The bridge is listed in <strong>Council</strong>’s Bridge Asset<br />

Register with a nominal current value of $3,481 (written down value).<br />

BACKGROUND<br />

The managers and lessees of the Yackandandah Holiday Park approached <strong>Council</strong> officers in the<br />

latter part of 2011 to outline that the Commissioners Creek pedestrian bridge was causing<br />

significant issues in the management of the Park.<br />

These issues are outlined in a letter from the managers/ lessees dated 23 January 2012 and<br />

include the following:<br />

• the bridge is in a hazardous and dilapidated state<br />

• the public have used the bridge to access their leased property and dump rubbish into their<br />

skip bins<br />

• the public have used the bridge to access their leased property and amenities. This has<br />

resulted in damage to Holiday Park facilities, including vandalism of the manager’s private<br />

Christmas decorations.<br />

The lessees erected a fence barricade on their leased land restricting access to the Holiday Park<br />

bridge in December 2011. The barricade was attached with notice as follows:<br />

Due to the continual illegal dumping of rubbish, un-authorised use of Park facilities and repeated<br />

thefts from guests and Management, this is no longer a thoroughfare.<br />

This is Privately Leased Land and Park Management reserves the right to refuse entry to any<br />

unauthorised persons and any breach can result in prosecution.<br />

The bridge has also failed to meet OH&S requirements and therefore will be removed as soon as<br />

possible.<br />

Any queries or complaints can be resolved with Park Management.<br />

Apologies for inconveniences to those not responsible.<br />

In the two month period following the barricading, <strong>Council</strong> has received two concerns raised by<br />

the community:<br />

1. A customer service enquiry asking why the bridge had been fenced<br />

2. A verbal complaint asking why the residents had not been advised and the reason it had<br />

been closed.<br />

There are several options for the bridge moving forward. These include:<br />

• leave the bridge barricaded so there is no ready access into the Holiday Park<br />

• remove the bridge to eliminate the OH&S risk it currently presents and the problematic<br />

access point it provides to the Yackandandah Holiday Park<br />

• re-negotiate the lease with the leasee to allow the use of the park for local residential<br />

access, replace the bridge with a new OH&S compliant structure, and then re-open the<br />

bridge to the community.<br />

KEY IMPLICATIONS<br />

The key implications are:<br />

• the bridge is in a dilapidated state and does not provide adequate safeguards (i.e. hand<br />

railing) to protect those who may use it. The bridge is an OH&S risk to <strong>Council</strong><br />

• the Holiday Park lessees cannot effectively manage/ control the leased land if the bridge<br />

remains accessible from the Church Street area to the Holiday Park<br />

• local residents who may have traditionally used the bridge as a shortcut no longer have<br />

access via the bridge and through the Holiday Park<br />

• re-negotiation of the lease to provide for public access through the park would be a difficult<br />

outcome to achieve. A leasee may not be interested in leasing property that they cannot<br />

fully manage and control.<br />

FINANCIAL IMPLICATIONS<br />

The pedestrian bridge is on <strong>Council</strong>’s Bridge Asset Register with a replacement value of $9,282<br />

and a written down value of $3,481.<br />

The cost to remove and dispose of the bridge is $2,000 (estimated). The cost to replace the<br />

current dilapidated structure in its current position with a new modern equivalent is an estimated<br />

$16,000.<br />

POLICY IMPLICATIONS<br />

The relevant <strong>Council</strong> Plan objective associated with the bridge is:<br />

<strong>Council</strong> has not communicated with the local community to date concerning removal or<br />

barricading of the pedestrian bridge. The Yackandandah Holiday Park management has dealt<br />

with the issue as lessees/ managers of the property.<br />

However, the bridge and Holiday Park permanent buildings are <strong>Council</strong> assets, with what<br />

ultimately happens to the bridge (whether removed or replaced) a <strong>Council</strong> issue. Any direction<br />

taken with the bridge and the rationale for this direction will need to be communicated to the local<br />

community via a letter drop or similar.<br />

CONCLUSION<br />

The two major issues with the Yackandandah Holiday Park pedestrian bridge are (1) its unsafe<br />

state, and (2) the uncontrolled access it provides from Church Street to the Yackandandah<br />

Holiday Park privately leased property.<br />

Removing the currently barricaded bridge will address both these issues and is the recommended<br />

action from this report.<br />

Any action taken with the bridge will require active communication with local residents on the<br />

bridge’s status in the form of a letter drop or similar.<br />

INTRODUCTION<br />

The State Government on the 30th June 2011 advised that <strong>Indigo</strong> <strong>Shire</strong>, along with forty other<br />

<strong>Council</strong>s, were eligible to seek up to $1M each, per year for the next 4 years under the Victorian<br />

Government’s Country Roads and Bridges Initiative. A report to <strong>Council</strong> outlined the<br />

recommended allocation of funds for the 4 year period with $670,000 to be allocated to rural<br />

roads resheeting in 2011-12. The scope and schedule of works for the tender has been<br />

determined from <strong>Council</strong>s asset database and officer inspections of rural gravel roads. The<br />

tender called for fixed, lump sum prices, with a schedule of rates for variation purposes.<br />

BACKGROUND<br />

The tender was advertised on the <strong>Indigo</strong> <strong>Shire</strong> Website for the period of 3/02/2012 to 24/02/2012<br />

and in the Border Mail and on Saturday 4/02/2012 and Saturday 11/02/2012. The tender<br />

To determine the best value for money, a panel of experienced <strong>Council</strong> officers in accordance<br />

with the <strong>Indigo</strong> <strong>Shire</strong> <strong>Council</strong> Procurement Policy 2009 and Conditions of Tender assessed the<br />

tenders. Tenders were assessed on price, relevant experience, alignment of tenders with project<br />

objectives and scope, mobilisation, litigious and claims risk, and evidence of sound Occupational<br />

Health and Safety (OH&S) procedures.<br />

Value for Money in procurement is about selecting the supply of goods, services and works taking<br />

into account both cost and non-cost factors including: contributions to the advancement of<br />

<strong>Council</strong>’s priorities, non-cost factors such as fitness for purpose, quality service and support; and<br />

cost-related factors including whole of life costs and transaction costs associated with acquiring,<br />

using, holding, maintaining and disposing of the goods, services or works.<br />

The contractor is to follow OH&S requests stipulated in the contract and a Risk Assessment is<br />

required prior to commencing the work including the development of appropriate control<br />

measures for review by the Contract Manager as per contract requirements.<br />

Legislative<br />

The tender has been conducted in accordance with requirements of <strong>Indigo</strong> <strong>Shire</strong> <strong>Council</strong>’s<br />

Procurement Policy and Section 186 of the Local Government Act 1989.<br />

Environmental<br />

INTRODUCTION<br />

Asset management plans detail how <strong>Council</strong> intend to manage their assets over the medium to<br />

long term.<br />

The formulation and adoption of asset management plans for <strong>Council</strong>’s major asset types is<br />

necessary to establish a framework for a core level of asset management within <strong>Council</strong>. Further<br />

to <strong>Council</strong>’s adoption of asset management plans for buildings, bridges, roads, and pathways in<br />

2011, this report provides details on drainage assets, being the last of the asset management<br />

plans required for core competency. The formulation and adoption of these five asset<br />

management plans are significant actions outlined in <strong>Indigo</strong> <strong>Shire</strong>’s Asset Management Strategy<br />

adopted in December 2010 and reviewed in October 2011.<br />

BACKGROUND<br />

A major part of <strong>Council</strong>’s resources are expended on maintaining, renewing and creating new<br />

assets. The degree and way in which council’s assets are managed are key in determining the<br />

financial position and long term sustainability of a council.<br />

The MAV Regional Asset Management & Service Program has seen the formation of five state<br />

regional asset management (AM) groups charged with developing and implementing regional<br />

action plans to improve asset management practices. The target measure for the North East<br />

Regional Group, of which <strong>Indigo</strong> <strong>Shire</strong> is a part of, is to meet 100% score on the core asset<br />

management standards by December 2012. The core standards are defined within the National<br />

Asset Management Assessment Framework (NAMAF) which is the adopted reporting tool to<br />

measure a <strong>Council</strong>s asset management performance. The formulation and adoption of asset<br />

management plans covering 90% plus of <strong>Council</strong>’s infrastructure asset value is an integral part of<br />

the NAMAF and the North East Regional Group’s action plan to achieve a core competency level.<br />

The International Infrastructure Management Manual (IPWEA, 2006) Appendix A: Asset<br />

Management Plan Structure has dictated the structure of these draft asset management plans,<br />

with the underlying aim of achieving 100% core standard in the national asset framework<br />

assessment areas. The formulated drafts seek to keep the document as brief and simple as<br />

practical, whilst fulfilling the required national asset framework requirements.<br />

The Draft Drainage Asset Management Plan has been compiled and documented by <strong>Council</strong>’s<br />

asset unit, with 100’s of man-hours spent in the recollection and compilation of urban drainage<br />

asset data across each of <strong>Indigo</strong>’s townships to provide a firm data basis for the plan.<br />

<strong>Council</strong>’s Asset Management Strategy targets the adoption of a drainage asset management plan<br />

by April 2012.<br />

Further to consideration of the draft plan at the February 28 th <strong>Council</strong> briefing, the draft plan has<br />

been amended in accord with <strong>Council</strong>lor and officer comments. Comments incorporated include:<br />

• Clarification around heritage open drains/ gutters (p. 20)<br />

• Incorporation of increasing maintenance costs associated with retention basin and wetland<br />

structures (p. 6, 29, 34)<br />

• Enhancement of Appendix A: Drainage Register readability.<br />

The Draft Drainage Asset Management Plan is now proposed for consideration of its adoption,<br />

followed by advertisement for submissions from the community in the March-April period 2012.<br />

KEY IMPLICATIONS<br />

The Federal Government has outlined that councils need to improve their asset and financial<br />

management. The key implications in <strong>Council</strong> not achieving core asset management practice are:<br />

• potentially poor and unsustainable management of the community’s assets, and;<br />

• infrastructure funding from government bodies potentially being put at risk by a lack of<br />

demonstration of good asset management practice.<br />

The formulation and adoption of <strong>Council</strong>’s asset management plans are critical building blocks on<br />

the pathway to achieving core asset management by December 2012, as detailed in <strong>Council</strong>s<br />

Asset Management Strategy and the North East Regional Group’s action plan.<br />

RISK MANAGEMENT<br />

The risk management implications for drainage assets are outlined in the Draft plan in section 5.2<br />

Risk Management Plan. The risk management issues identified are largely drawn from <strong>Council</strong>’s<br />

Risk Register.<br />

FINANCIAL IMPLICATIONS<br />

Asset management plans seek to identify and document the costs associated with maintenance,<br />

renewal and planned new or upgrade works associated with an asset (refer sections 5. Lifecycle<br />

Management Plan and 6. Financial Summary of the Draft plan). The adoption of an asset<br />

management plan by <strong>Council</strong> is the recognition of the long term costs associated with that asset,<br />

and not necessarily a commitment to fund those identified long term costs.<br />

The way in which <strong>Council</strong> seeks to fund long term asset costs is integral to <strong>Council</strong>’s Long Term<br />

Financial Plan. Financial information from each asset management plan is to be included in the<br />

formulation of the Long Term Financial Plan. The Long Term Financial Plan is a key part of<br />

<strong>Council</strong>’s Asset Management Strategy and is scheduled for completion in 2012.<br />

There are long term financial implications including appropriate staffing and software<br />

improvements that will be required to support and maintain a core standard of asset management<br />

practice within <strong>Council</strong>.<br />

An improvement plan is included in Section 8 of the Draft Drainage Asset Management Plan to<br />

detail proposed short term plan improvements, including an estimate of resourcing required.<br />

This Drainage Asset Management Plan will assist with the achievement of the key strategic<br />

accordance with a strong Asset Management Policy and Strategy.<br />

Objective 2.3: Manage and maintain to a high standard assets critical to our economic prosperity:<br />

Identify critical assets and prioritise actions.<br />

Objective 2.9: Ensure flood management structures and strategies minimise flooding to our<br />

residents properties: Identify flood sites and remedial works.<br />

As set out in the <strong>Council</strong> Plan 2011-2014.<br />

CONCLUSION<br />

The <strong>Council</strong> Plan outlines the goal to ensure that <strong>Council</strong>’s asset management practices are<br />

clearly defined and in accordance with a strong Asset Management Policy and Strategy. Further<br />

to <strong>Council</strong> adopting an Asset Management Strategy in December 2010, the formulation and<br />

adoption of a Drainage Asset Management Plan forms the last asset management plan action<br />

within this strategy.<br />

The consideration of this Draft plan for adoption forms the next step toward achieving the defined<br />

<strong>Council</strong> Plan objectives and the journey towards a core standard in <strong>Council</strong>’s asset management<br />

practices by December 2012.<br />

INTRODUCTION<br />

Construction of new <strong>Shire</strong> Offices at Yackandandah and Beechworth are proposed to commence<br />

in August 2012. During construction (15 months), most of the staff located at Yackandandah will<br />

require alternative accommodation in order to maintain current <strong>Council</strong> services and service<br />

levels.<br />

BACKGROUND<br />

Recent enquiries to providers of office facilities has highlighted that there is a lead time of around<br />

16 weeks for fabrication and delivery of these types of buildings.<br />

It is intended that this accommodation will be provided by a combination of the existing portable<br />

building (Community Care Services) and portable ablutions building, part of the existing High<br />

Street main office, and additional temporary office buildings, which need to be sourced and<br />

procured to provide an additional 270m² of office space.<br />

This report looks at two options for procuring this accommodation.<br />

Option 1 – Rental of temporary accommodation<br />

This option assumes continued use of part of the existing High Street building, relocation of<br />

existing Ardsville ablution block and Community Care portable building to <strong>Council</strong> land behind the<br />

Star Hotel in Windham Street, supplemented by an additional 270m² of office space.<br />

Existing furniture and equipment will be relocated as well.<br />

Costings are being sought via a tender for rental of both new and used office buildings.<br />

Option 2 – Purchase of temporary accommodation<br />

The second option is essentially the same as Option 1, however <strong>Council</strong> would purchase these<br />

outright. Whilst this is more expensive upfront, the buildings could be readily on-sold (or re-used)<br />

at the end of the construction period, which would make this a more cost effective option overall,<br />

over a two year period.<br />

As also stated above, a tender process for purchase of both new and used buildings is being<br />

undertaken.<br />

As part of the refurbishment of the Windham Street site after the buildings are removed, car<br />

parking would be created, in line with the original purpose for purchase of the site.<br />

KEY IMPLICATIONS<br />

The parameters that are required to be met with any proposal for interim office accommodation<br />

include:<br />

• A continued <strong>Council</strong> service point in Yackandandah to provide continuity of service to the<br />

community.<br />

• A desire to avoid further fragmentation of staff across multiple sites and towns, that can<br />

lead to reduced service efficiencies.<br />

• An office environment with adequate/equivalent amenity and operational ability to the<br />

current offices.<br />

• Financial fit within the budget.<br />

• Minimisation of disruption to office staff and the current services provided by <strong>Council</strong>.<br />

RISK MANAGEMENT<br />

There are risks associated with providing an environment at the existing offices that is adversely<br />

impacted by adjacent construction works in terms of noise, distraction and amenity. For this<br />

reason, it is advantageous to remove as many staff as practical to an adjacent site.<br />

FINANCIAL IMPLICATIONS<br />

Given we are going out to the market with a tender for provision of these facilities, our cost<br />

estimates are provided separately on a confidential attachment. Anticipated costs are in line with<br />

those previously reported to <strong>Council</strong> at its meeting on 13 September 2011, in the Confidential<br />

Meeting.<br />

This report deals with interim accommodation only and has no policy implications.<br />

COMMUNICATION<br />

Once the arrangements are finalised, and prior to the site being handed over to a builder, a<br />

structured communication program will commence.<br />

Given that the High Street building will be maintained until very late in the project, there will be<br />

minimal disruption to public interface.<br />

CONCLUSION<br />

The tender process will provide the actual data enabling the most cost effective solution to be<br />

made on the issue of leasing versus purchasing, however, it is considered the continued use of<br />

most of the High Street building, supplemented by temporary accommodation as outlined is the<br />

option which provides least disruption for the community and staff, and is cost effective for<br />

<strong>Council</strong>.<br />

1. the Kergunyah Hall Water and Carparking Infrastructure Project be fully scoped and a<br />

2. That the projects that were bought to the mid-year budget Rutherglen Pool Solar<br />

Heating and the Yackandandah Shade Sail also be added to this list to be fully scoped<br />

and detailed for the 2012/13 budget.<br />

RECOMMENDATION<br />

Unanimously Carried<br />

That the Kergunyah Hall Water and Carparking Infrastructure Project be fully scoped and a<br />

detailed report submitted for <strong>Council</strong> consideration at the April Budget Workshop meeting.<br />

Explanatory comment<br />

There has been conflicting totals as to the cost of this Project. There are two parts to this project<br />

namely the securing of a water source for the Hall and the construction of additional car parking<br />

next to the Hall. It would be of great benefit to know the costings of the Project as a whole as well<br />

as the costings of the Kergunyah Hall Water Source Project and the Kergunyah Hall Car Park<br />

Project as separate identities. Also I believe the Hall Committee would be willing to put in both<br />

money and labour towards the project . This type of information would be very helpful when<br />

budgets are being reviewed and formulated.<br />

Statement to accompany presentation of Petition to <strong>Indigo</strong> <strong>Shire</strong> <strong>Council</strong><br />

at its Meeting at Yackandandah on Tuesday 13 March 2012<br />

Mr Mayor, <strong>Council</strong>lors, CEO and Staff of the <strong>Indigo</strong> <strong>Shire</strong> <strong>Council</strong>, and others present,<br />

I am Garry Jarvis, Chair of the Beechworth Treescape Group, and it is my responsibility<br />

to present our Petition to you today, on behalf of one thousand two hundred and fifty-two<br />

petitioners.<br />

You are already aware of the existence of this group following the tabling of a letter by Cr<br />

Gaffney on our behalf on l4 February 2012.You will also recall a statement attached to<br />

Beechworth's beautiful heritage treescapes, avenues which inspire a sense of awe and<br />

spirituality, a legacy from our founding fathers.<br />

Beechworth treescapes have been uniquely beautiful for over a century. John Hawker's<br />

Beechwotlh's Tree Study of 1986 recalled that about a century earlier, in the 1890s,<br />

Beechworth was described as<br />

"a town embowered in luxuriant foliage," with<br />

"long vistas of stately trees bordering the footpaths"<br />

Today's residents and visitors share a similar experience. They overwhelmingly love our<br />

old trees. They want our treescapes of mature trees Ieft as heritage to future generations.<br />

People come to live here to enjoy this beauty daily, and tourists seek this beauty as an<br />

integral part of their holiday. Both groups contribute to the economic stability of our<br />

region.<br />

Our Group is inspired by level of support for our heritage treescapes by the people of<br />

Beechworth ancl beyond. They have in significant numbers signed this Petition [pointing<br />

to petitionl. lt states:<br />

We therefore urge the <strong>Council</strong> to respond to the Petition. We ask you to:<br />

Firstly,<br />

Stop the apparent indiscriminate felling.<br />

lnstruct your staff to halt all removal of trees until the community has been<br />

consulted.<br />

Secondly<br />

Rethink your approach to tree management.<br />

lnstruct your staff to give priority to maintain and support our old trees, and to<br />

further develop the free replacement aspect of your Tree Management Plan<br />

Finally<br />

Review your consultation process to include us.<br />

Support your staff to begin a genuine formal consultation process for the mutual<br />

benefit of the community and the trees we are fighting to save.<br />

We see the potential, that in working together to ensure the future of our Beechworth<br />

Treescapes , our Community's consultation processes will become a model for other<br />

towns to follow, providing real and aesthetic value to people within and beyond our<br />
