10.1 FINANCE REPORT - JANUARY 2012
ORDINARY COUNCIL MINUTES - 13 MARCH 2012
File No: 2012/114
Frank Bonacci - Manager Finance Corporate Services
For Information
This finance report covers the seven month period to the 31 January 2012. At the February
Ordinary Council meeting, Council adopted the midyear Budget Review which provided revised
forecast for the second half of the 2011-12 financial year. The details within this report to the end
of January 2012 provide a Year to Date (YTD) comparison to that adopted midyear Budget
Review.
The January 2012 YTD financial position was projected to be a surplus of $2.981M in the Midyear
Budget review. The actual result at the end of January is a YTD surplus of $3.031M which is
$49.8K favourable to the YTD Mid Year Review. The key reasons for this favourability are:
• Other Revenue is $46k favourable for January due to higher levels of Quarry material sales
than forecast for the month
• User Charges are also $26.2k favourable for January. This is due to higher levels of Pool
fees ($24.5k) and waste disposal site fees ($6.0k) collected during January
• Developer Contributions are $12.4k favourable due unexpected contributions for Open
Space ($8.4k) and native tree planting ($4.0k)
• Supplementary Rates collected during January were $10k higher than anticipated
• Contractor Payments were also $30k favourable due to the delay of an instalment payment
to Council’s property valuer ($61k) which was offset additional payments of $30k for waste
collection services
• Employee Costs were $17k favourable to forecast due to the higher levels of leave (which
is fund by Balance Sheet Provisions) taken during the month of January
• The early receipt of $14k in Operating Grant funding for the Roadside Sustainability Accord
• The above favourability was offset by the delayed receipt of Operating Grants for
Emergency Management coordinator ($60k) and within Community Planning ($10k), the
power bill for Wodonga pool ($21k) forecast for February but paid in January and net extra
Other Expenses of $9k (higher levels of plant & equipment maintenance and extra plant
hire for Lake Sambell offset by delayed contributions payments within Tourism)
Council’s Profit & Loss Statement and the Business Unit Report details as at 31 st January 2012
are contained within the attached reports. As previously agreed with Council, an Exception
Report will only be provided along with quarterly finance reports and therefore no Exception
Report is included in this month’s Finance report.
Council’s Cash position as at the 31 st January 2012 is $3.4 million. This compares with a cash
position of $4.9 million for the same period last year. Details of how these funds are invested are
contained within the attached Cash & Investment Report as at 31 January 2012.
At 31 st January 2012, Year to Date Capital Works spend is $4.954M which equates to 49.5% of
the adopted Mid Year CAPEX Budget for 2011/12. As can be seen from the table below, this
compares favourably to the same time last year when $4.312M equating to 48.3% completion of
the Mid Year CAPEX Budget had been achieved at 31 st January 2011.
INTRODUCTION
The Minister has appointed the Indigo Shire Council as the Committee of Management of the
land which the Chiltern Caravan Park is situated. Council has agreed to lease the land to the
Tenant, being LR & AM Bould, pursuant to Section 17D of the Crown Land (Reserves) Act 1978.
The Tenants are now seeking to sell their business and wish to transfer the existing lease
agreement of the Chiltern Caravan Park to new Tenants, being S Clarke & B Moscrop.
Page 8
INDIGO SHIRE COUNCIL
BACKGROUND
ORDINARY COUNCIL MINUTES - 13 MARCH 2012
The existing lease commenced on 20 January 2009 for a term of 20 years with rent payable at
$500 per annum (plus GST) for the first year. Rent payable thereafter is to be set at market value
in accordance with Schedule 2 of the lease agreement. The next market valuation is due in
January 2013.
KEY IMPLICATIONS
The lease agreement allows for the transfer to new tenants provided certain conditions are met.
The conditions are as follows:
1. The cyclical management maintenance program has been carried out by the existing
tenants in accordance with Schedule 3 of the Lease agreement.
2. An inventory of buildings, structures, plant and equipment be carried out;
3. Part 12.1 requires that the Tenant seek written consent from Council (the Landlord) and
the Minister prior to transferring the lease; and
4. Part 12.2 requires
a. The Tenant seeks Council’s (the Landlord’s) consent;
b. The Tenant is not at the time in breach of the lease; and
c. The Tenant proves to the satisfaction of Council that the proposed assignee is
respectable, responsible and solvent person having the financial capacity and
trading experience necessary to enable the permitted use to be successfully
undertaken and maintained. The Tenant must submit to Council all information
reasonably required by Council including at least two references to the proposed
assignee’s business experience, at least two references as to the proposed
assignee’s financial circumstances, and a detailed statement of financial
circumstances of the proposed assignee and any proposed guarantor.
The Economic Development Officer is in the process of ensuring the maintenance program has
been carried out in accordance with the lease agreement and will endeavour to undertake an
inventory as soon as practicable. The Deed of Assignment/Transfer of Lease will be reviewed by
Council’s solicitor prior to being signed.
The Economic Development Officer has also been in contact with the proposed tenants and has
reviewed their resumes. They appear to be in a sound financial position and possess the
adequate business knowledge and skills to operate the caravan park. They are enthusiastic
about moving to the Indigo Shire.
FINANCIAL IMPLICATIONS
The costs of drawing up the transfer were at the cost of the existing tenant.
Transfer of the lease also exposes Council to risks surrounding the management of the Caravan
Park if the new tenants are not adequately suited or financially stable. This could mean costs to
Council if the Caravan Park is not suitably maintained in accordance with the lease or
management is unsatisfactory and Council is required to have the tenants removed. To ensure
this risk is mitigated, the proposed tenants are submitting Council with the following written
references:
• Bank manager;
• Accountant; and
• Business Associate.
Page 9
INDIGO SHIRE COUNCIL
ORDINARY COUNCIL MINUTES - 13 MARCH 2012
The proposed tenants also submitted a summary of their financial position as part of the transfer
process. Their financial position, as detailed in their statement of financial position reviewed by
the Economic Development Officer, is more than adequate to run the Caravan Park.
CONCLUSION
Approval of this report is essential to expedite the sale process for the existing tenants to ensure
that their sale does not fall through as a result of Council processes. Settlement is proposed for
30 April 2012. The recommended delegation allows for the transfer process to continue, whilst
still ensuring that Council’s requirements are met.
RECOMMENDATION
Unanimously Carried
That Council approve the Public Notice advising of their intention to Lease the
abovementioned land to Parks Victoria.
INTRODUCTION
Parks Victoria has requested a new 15 year lease of the abovementioned land for the use of its
Parks Victoria Works Depot. Due to the term of the lease being greater than 10 years provisions
under Section 190 of the Local Government Act apply.
“Council must at least four weeks before the lease is made publish a notice of the proposed
lease. A person has a right to make a submission under section 223 of the proposed lease.”
BACKGROUND
The original Lease Agreement from Council to Parks Victoria commenced in 2002 for 3 years with
2 further terms of 3 years each. These options were exercised and therefore the lease expired on
1 November 2011.
The subject land has been re-surveyed to omit a designated area for Council pound facilities
should they be required in the future. A new valuation has also been obtained to ensure current
market value for the rental.
KEY IMPLICATIONS
The new lease agreement will allow for the continued relationship between Council and Parks
Victoria. If approved a draft lease document will be prepared by Council’s Solicitors and provided
to Parks Victoria for approval.
Unanimously Carried
RECOMMENDATION
That Council resolve to request that the Minister for Planning adopt and approve Amendment
C59 to the Indigo Planning Scheme which will transfer the responsibility for the issuing of
Planning Certificates to the Minister for Planning and the Department of Planning and
Community Development (DPCD).
INTRODUCTION
Indigo Shire Council presently is responsible for issuing planning certificates for properties within
the Shire. A planning certificate contains information about how the planning scheme affects a
property on a given date. Information on the certificate may include zoning of the land and overlay
planning controls, reservations that affect the land, classified roads abutting the land and
proposals contained in an exhibited amendment to the planning scheme. An application for a
planning certificate is generally made upon the sale of a parcel/ parcels of land, and there are a
limited range of applicants – generally solicitors or conveyancing firms.
The issuing of planning certificates is a relatively minor function of statutory planning, however it
is a function that can be taken over by the Minister for Planning and the Department of Planning
and Community Development.
This report makes the recommendation that the issuing of Planning Certificates that the issuing of
Planning Certificates is better placed with the Minister for Planning and the Department of
Planning and Community Development.
BACKGROUND
The responsibility for issuing planning certificates has rested with Indigo Shire Council since the
introduction of the new format planning schemes in 1999, when the default approach at the time
was to vest the responsibility with the council.
Page 13
INDIGO SHIRE COUNCIL
ORDINARY COUNCIL MINUTES - 13 MARCH 2012
The process of producing a planning certificate is a relatively simple one, requiring an application
to be made and the certificate then produced manually by planning staff. However, in terms of a
cost-benefit analysis, there is little benefit to Council.
The statutory fee received for the certificate is nominal, and while all measures are taken to
ensure the information contained within the certificate is accurate, it is nonetheless a manual
process with a potential for error and associated risk.
Given a planning certificate often informs a purchaser of land, if the information were to be
incorrect it could result in Council being liable for any expenses incurred by the purchaser.
In addition, the preparation of planning certificates reduces time for staff resources to be better
spent on more important statutory planning functions, such as planning permits.
In shifting the responsibility for the issuing of Planning Certificates to the Minister for Planning, the
process will be more streamlined for applicants in that it is a web-based process with quicker
turnaround times.
KEY IMPLICATIONS
The main implication of removing the responsibility for issuing planning certificates from Council
is an amendment to the schedule to Clause 61.01 of the Indigo Planning Scheme. The
amendment would result in section 3.0 of the schedule reading as follows:
‘Person or responsible authority for issuing planning certificates: Minister for Planning’
RISK MANAGEMENT
In terms of risk management, the amendment would remove an element of risk from the statutory
planning processes (see discussion above).
FINANCIAL IMPLICATIONS
There would be no financial implications as a result of the amendment. The Minister for Planning
would prepare and approve the amendment.
POLICY IMPLICATIONS
COUNCIL PLAN
This proposed planning scheme amendment will assist with the achievement of the key strategic
objectives, as set out in the Council Plan 2011-2014, specifically by allowing more resources to
be directed at achieving these objectives.
COMMUNICATION
Once approved by the Minister for Planning, communication of the change to the planning
certificate process will be carried out to those parties who regularly apply for certificates.
CONCLUSION
Shifting responsibility for the issuing of planning certificates to the Minister for Planning will free
up Council resources to better concentrate on other statutory planning tasks and remove an
element of risk currently inherent in the process. In addition, it will result in a more streamlined
process for the applicant with a quicker turnaround time.
11.2 INDIGO PLANNING SCHEME AMENDMENT C58 - MAPPING ERRORS
Moved: Cr Murdoch
Indigo Planning Scheme to correct various mapping and typographical errors.
RECOMMENDATION
Unanimously Carried
That Council request the Minister for Planning to adopt and approve Amendment C58 to the
Indigo Planning Scheme to correct various mapping and typographical errors.
INTRODUCTION
Through continuous monitoring of the ordinance and maps that make up the Indigo Planning
Scheme, a number of mapping and typographical errors and omissions have come to light over a
period of time since the last mapping errors amendment in 2008. It is considered appropriate to
have these rectified via a Ministerial Amendment at the present time.
BACKGROUND
The Minister for Planning can consider making minor corrections to the planning scheme in a
limited number of situations, including where the mechanisms of the planning process have
created a situation that is clearly in error. From time to time issues are picked up whereby it is
apparent an error has occurred, whether it is in the mapping of a zone or overlay, or clerical error
in the text of the planning scheme.
If the Minister for Planning consents to conducting the amendment, the usual requirement of a
planning scheme amendment can be waived if the Minister considers that compliance with the
requirements is not warranted.
The list of mapping and clerical errors and omssions proposed to be included as part of this
amendment is included at Attachment 1.
KEY IMPLICATIONS
Key implications of the proposed amendment will be that identified irregularities and errors in the
planning scheme and associated mapping will be rectified.
Page 15
INDIGO SHIRE COUNCIL
RISK MANAGEMENT
ORDINARY COUNCIL MINUTES - 13 MARCH 2012
From a risk management perspective, the correction of identified errors is positive in that the
potential for incorrect information to be relayed based on the current information will be removed.
FINANCIAL IMPLICATIONS
There are no financial implications as a result of the proposed amendment. As part of a
Ministerial amendment normal fees for preparing and approving the amendment are waived.
POLICY IMPLICATIONS
COUNCIL PLAN
This amendment will assist with the achievement of the key strategic objective ‘Promote and
Manage Sustainable Development’, as set out in the Council Plan 2011-2014, specifically by
contributing to the strategy: ‘Ensure our Land Use Planning Scheme meets the objectives of
sustainable growth, protection of our built and natural environment and reflects community
aspirations’ and associated action: ‘Review the Municipal Strategic Statement and Indigo
Planning Scheme and amend the Indigo Planning Scheme where appropriate. ’
COMMUNICATION
Communication will be undertaken with any affected land owners.
CONCLUSION
Amendment C58 to the Indigo Planning Scheme aims to correct errors and anomalies which have
been identified in the ordinance to the Planning Scheme and associated mapping. These errors
and anomalies come to light from time to time through the everyday administration of the
Planning Scheme, and when there are a large number of them on the list, it is considered
appropriate to set about correcting them via a planning scheme amendment.
RECOMMENDATION
That Council adopt the Indigo Shire Council Arts Strategic Plan 2012 – 2016.
INTRODUCTION
Unanimously Carried
The Indigo Shire Council Arts Strategic Plan 2012 – 2016 has been developed as an important
tool for Council and the community to guide the development of the arts in the Shire. The purpose
of this report is to present the final draft of the document to Council for adoption.
BACKGROUND
The Indigo Shire Council Arts Strategic Plan 2007 – 2010 was reviewed and assessed by the Arts
and Culture Advisory Committee (ACAC) and Council officers specifically around what actions
had been achieved, what were the ongoing objectives, and what actions were no longer a priority
in the Plan. A working document was produced reflecting the outcomes from this analysis.
From this working document, key areas of focus were identified for the future of arts in the shire.
Some of the objectives and actions from the previous Plan were carried over, and many new
objectives were developed for inclusion in the first Draft of the new Plan.
The first Draft was forwarded to the ACAC, community arts organisations within the shire and
other interested individuals. Murray Arts also facilitated a planning workshop for the Arts
Strategic Plan where participants were invited to think about the future of arts in Indigo Shire, and
how the goals might be achieved. Following the workshop, held in May 2011, the thoughts and
comments from the arts community were collected and collated and the second draft of the
Strategic Plan was developed.
The second draft was presented at a Council Briefing in November 2011 and then made available
to the wider community for their feedback and comments. No comments were received. The final
draft of the Arts Strategic Plan 2012 – 2016 is attached to this report which recommends its
adoption.
KEY IMPLICATIONS
ORDINARY COUNCIL MINUTES - 13 MARCH 2012
The Arts Strategic Plan 2012 – 2016 will be an important planning and guiding document for
Council and the community into the future. The Plan identifies 6 key focus areas:
Access and Participation
Communication and Promotion
Identity
Collaboration
Leadership and Development
Resources and Infrastructure
Each of these focus areas has a set of Objectives, Actions and Timelines. These Actions will be
implemented by Council officers in partnership with the arts community with the ACAC providing
advice and feedback to Council on its implementation.
RISK MANAGEMENT
The final Plan does not pose any substantial risks to Indigo Shire Council or the community.
However, it is important that the community are engaged and are given appropriate opportunity
to, where appropriate, be a part of the actions and initiatives in the Plan when they are being
implemented. Each action will be subject to a risk assessment prior to its implementation to
ensure if there are risks involved, they are identified and managed before implementation of the
action.
FINANCIAL IMPLICATIONS
The Plan includes a number of priorities which, if implemented, may have financial implications
for Council and the community. It will be Council's role, in conjunction with the ACAC and the arts
community, to assist in the implementation of these actions, subject to appropriate budget
processes. It is anticipated that a significant proportion of Council’s Arts and Cultural
Development Officer’s time will be spent either directly or indirectly implementing the Actions from
an adopted Arts Strategic Plan.
LEGAL/COUNCIL PLAN/POLICY IMPACT
COUNCIL PLAN
The development of the Draft Indigo Shire Arts Strategic Plan 2012 – 2016 is consistent with the
following Council Plan objectives:
Objective 2.6 Maintain and enhance our parks, gardens and open spaces
Objective 3.4 Maintain a broad and diverse cross section of ages and cultures within our
communities
Objective 3.6 Support our Festivals and events
Objective 4.6 Enhance the health and wellbeing of the community
Objective 4.8 Empowering our communities
ORDINARY COUNCIL MINUTES - 13 MARCH 2012
CONCLUSION
The final draft of the Indigo Shire Council Arts Strategic Plan has been developed in consultation
with the ACAC, local arts organisations and Council officers. The broader community has also
had the opportunity to provide feedback and comment on the Plan. It is now considered
appropriate to present the final draft of the Plan for adoption by Council.
2. Request Officers to prepare a ‘Place and Street Naming Policy’ for future requests to
name public infrastructure and facilities, for consideration at a future meeting.
RECOMMENDATION
Unanimously Carried
That Council
1. Supports the recommendation from the Yackandandah Sportspark Committee of
Management and officially names the Yackandandah Sportspark Pavilion the “Nelson
McIntosh Pavilion.”
2. Request Officers to prepare a ‘Place Naming Policy’ for future requests to name public
infrastructure and facilities, for consideration at a future meeting.
INTRODUCTION
The Yackandandah Sportspark Committee of Management, to recognise the volunteer support
and contributions of Nelson McIntosh to the Yackandandah community over many years, passed
a motion “To name the Pavilion the “Nelson McIntosh Pavilion”. This, in effect, means that the
Yackandandah Sportspark facility would still be known as the Yackandandah Sportspark but the
newly constructed multipurpose pavilion would be named “Nelson McIntosh Pavilion” if the
recommendation in this report is endorsed.
BACKGROUND
The completion of the Yackandandah Sportspark Multipurpose Facility was the final major stage
in a project that commenced over 15 years ago. Instrumental in the initial transportation of the
steel framework that formed the basis of the new facility, Nelson McIntosh, along with many other
volunteers, provided volunteer labour and inkind support to complete Stage 1 of the project.
Nelson has continued this support to the local Yackandandah community and in particular to the
Sportspark playing a big part in how it looks today.
The Yackandandah Sportspark Committee of Management, to recognise the input of Nelson over
many years, passed a motion “To name the Pavilion the “Nelson McIntosh Pavilion”. The
Committee were clear in the Minutes from the meeting that the Yackandandah Sportspark facility
would still be known as the Yackandandah Sportspark but the newly constructed multipurpose
pavilion would be named to recognise Nelson McIntosh.
Page 20
INDIGO SHIRE COUNCIL
ORDINARY COUNCIL MINUTES - 13 MARCH 2012
It has previously been noted that we have no policy to guide these decisions and that a policy
needs to be developed by Council. Given that this issue has been under discussion and in the
public eye for some time, it was viewed as important it be formally considered.
KEY IMPLICATIONS
The proposed naming of the Pavilion is due recognition for a local volunteer who has contributed
to the development of the Sportspark over many years. However, as there hasn’t been any
formalised community consultation, there may be some in the community that may disagree with
the decision. Any comments or feedback on the proposed decision would need to be managed in
a consistent manner.
It is the intention of the Committee, subject to the endorsement of this recommendation by
Council, to install signage on the building entrance to the Sportspark pavilion. This signage would
require approval by Council.
FINANCIAL IMPLICATIONS
There are no financial implications for Council.
LEGAL/COUNCIL PLAN/POLICY IMPACT
COUNCIL PLAN
The recommendation is consistent with the following Council Plan objectives:
Objective 4.6 Enhance the health and wellbeing of the community
Objective 4.8 Empowering our communities
CONCLUSION
The Yackandandah Sportspark Committee of Management passed a motion to recognise the
contributions of Nelson McIntosh by naming the recently completed Sportspark Multipurpose
Pavilion the “Nelson McIntosh Pavilion”. This report recommends that the Sportspark
Committee’s motion is endorsed.
RECOMMENDATION
That Council adopt the Infrastructure Design Manual ‘in principle’ to allow the Major Projects
and Programs Department to undertake further meetings with the IDM Group and consultation
with key stakeholders with the view of presenting the Infrastructure Design Manual for formal
adoption in the future.
INTRODUCTION
The Infrastructure Design Manual (IDM) is a document utilised by Victorian Regional and Rural
Councils for the setting of engineering standards for development and subdivisions. The Major
Projects and Programs Department is responsible for this role within Council. This function is
often subject to dispute between Council and developers over the engineering standards and the
accuracy of the wording and appropriateness of the development conditions. This document will
reduce the frequency of these disputes and improve the standard of engineering infrastructure
that ultimately becomes the responsibility of Council.
BACKGROUND
The IDM was originally prepared by the cities of Greater Bendigo and Greater Shepparton and
the Shire of Campaspe. Their joint initiative was one that recognised the benefits of municipalities
working together towards consistent requirements and standards for the design and development
of infrastructure. The first version of the IDM came into use in October 2007. The manual is a
living document and is revised and amended from time to time. A version 4 is currently in draft
form.
Page 22
INDIGO SHIRE COUNCIL
ORDINARY COUNCIL MINUTES - 13 MARCH 2012
The benefits derived from having a common IDM across municipalities are:
• Sharing financial and human resources to produce an Infrastructure Design Manual that
will satisfy the requirements of each of the municipalities
• Developing more consistency amongst design requirements for Consultants and
developers working in the participating municipalities
• Providing a better defence at the Victorian Civil Appeals Tribunal (VCAT) when the design
requirements have been developed and adopted by a number of municipalities
• Sharing of ideas and practices helps the municipalities to adopt the best practice of each
• Clearly documenting Indigo Shire Council’s requirements for the design and development
of infrastructure
The IDM Group carried out a presentation of the Manual at the Council office in Yackandandah
where representatives of the IDM group explained the IDM and answered questions from local
Council officers. At this time, Indigo Shire engineers presented to the Group a list of identified
issues regarding the manual. This list is attached as Appendix 2 to this report.
The group has responded to the issues by including the following clauses in the version four draft:
1.6 Compliance
The Councils using this Manual will make every endeavour to follow the requirements of this
Manual unless there are circumstances that exist that make it impractical or unreasonable to
follow the requirements of this Manual e.g. (new provisions)
• Renewing an existing asset which does not comply with the standards specified in this
Manual.
• Where the protection of native vegetation or the existing streetscape make it impractical to
adopt the IDM standards
• Where the adoption of the IDM standards would result in detriment to the neighbourhood
character of an area.
1.7 Innovation and Advances in Technology (new clause)
Councils may give consideration to adopting and approving innovative solutions and using new
technologies where it can be demonstrated to the satisfaction of the Council that the objectives of
the relevant clauses of the IDM have been satisfied even though the specific technical provisions
have not been met.”
The IDM technical group is constantly considering changes to the IDM and approximately every 6
to 12 months there is a new revision released. As new Councils come on board new matters will
be brought forward for consideration and decided upon and then there will be a new version
released.
The recent changes proposed to the IDM as listed above should ensure that where there is
neighbourhood character issues e.g. a small town has narrow seals, no footpaths and no kerb
and channel then it is possible for that Council to cite neighbourhood character as the reason for
setting lower standards than is normal for the IDM. Further there is also an out where native
vegetation or streetscapes make it impractical to adopt certain street widths would allow Indigo
Shire to adopt lesser standards.
Page 23
INDIGO SHIRE COUNCIL
ORDINARY COUNCIL MINUTES - 13 MARCH 2012
KEY IMPLICATIONS
Legislative
The IDM is not currently identified in any Victorian Government Legislation including the Indigo
Shire Planning Scheme. The IDM would be a support document for meeting the requirements of
Clause 56 of the Planning Scheme (subdivision site and context description and design
response). The IDM would also assist officers in meeting the requirements of the Subdivision Act
1988, Part 3
Regulatory
The IDM is not currently identified in any Victorian Government regulations.
Environment
The IDM sets out objectives and requirements to be met by consultants and contractors engaged
by the developer for environmental management during construction to ensure all appropriate
steps are taken to minimise any detrimental impact on the environment.
The IDM encourages environmentally sustainable landscape design to conserve water and
energy and reduce waste. Water sensitive urban design is required to be incorporated into urban
drainage design.
RISK MANAGEMENT
The adoption of the IDM will mitigate risk related to the specification, construction, and approval
of engineering infrastructure for development within Indigo Shire Council. A more consistent set
of standards and guidance for Council Development Engineers will result in a reduction of
disputes between developers and Council.
FINANCIAL IMPLICATIONS
The financial implications of the adoption of the IDM are an annual maintenance fee of $2,000
and a joining fee of $4,000 paid to the IDM Group. The adoption of the IDM will reduce the
financial cost to Council by reducing the requirement to spend time updating design standards
and standard drawings. There are also the benefits of more consistent design standards and
conditions for Consultants and Developers reducing the time spent by Council planning and
engineering staff in the preparation of planning permits.
POLICY IMPLICATIONS
Adoption of the Manual will require revision and updating of current engineering design standards
and standard drawings. The revision of Indigo Shire Council’s adopted road hierarchy standards
will be necessary. This revision will make road standards consistent with Ausroads Guidelines,
the standard adopted by Vic Roads and municipalities across Australia.
COMMUNICATION
Prior to adoption of the IDM, key internal and external stakeholders will be consulted.
CONCLUSION
The adoption ‘in principle’ of the Infrastructure Design Manual will allow the Major Projects and
Programs Department to undertake further meetings with the IDM Group and consultation with
key stakeholders with the view to moving towards formal adoption of the Infrastructure Design
Manual.
That Council does not replace the pedestrian bridge across Commissioners Creek into the
Yackandandah Holiday Park.
RECOMMENDATION
Unanimously Carried
That Council removes the pedestrian bridge across Commissioners Creek into the
Yackandandah Holiday Park.
INTRODUCTION
The current lessees of the Yackandandah Holiday Park have experienced significant issues due
to the ease of access provided by the Church Street pedestrian bridge from the local residential
area into the privately leased environs of the Yackandandah Holiday Park.
The bridge itself is a makeshift structure that may have been constructed by others and presents
significant risk issues to the public who may use it. The bridge is listed in Council’s Bridge Asset
Register with a nominal current value of $3,481 (written down value).
BACKGROUND
The managers and lessees of the Yackandandah Holiday Park approached Council officers in the
latter part of 2011 to outline that the Commissioners Creek pedestrian bridge was causing
significant issues in the management of the Park.
These issues are outlined in a letter from the managers/ lessees dated 23 January 2012 and
include the following:
• the bridge is in a hazardous and dilapidated state
• the public have used the bridge to access their leased property and dump rubbish into their
skip bins
• the public have used the bridge to access their leased property and amenities. This has
resulted in damage to Holiday Park facilities, including vandalism of the manager’s private
Christmas decorations.
The lessees erected a fence barricade on their leased land restricting access to the Holiday Park
bridge in December 2011. The barricade was attached with notice as follows:
Due to the continual illegal dumping of rubbish, un-authorised use of Park facilities and repeated
thefts from guests and Management, this is no longer a thoroughfare.
Page 25
INDIGO SHIRE COUNCIL
ORDINARY COUNCIL MINUTES - 13 MARCH 2012
This is Privately Leased Land and Park Management reserves the right to refuse entry to any
unauthorised persons and any breach can result in prosecution.
The bridge has also failed to meet OH&S requirements and therefore will be removed as soon as
possible.
Any queries or complaints can be resolved with Park Management.
Apologies for inconveniences to those not responsible.
In the two month period following the barricading, Council has received two concerns raised by
the community:
1. A customer service enquiry asking why the bridge had been fenced
2. A verbal complaint asking why the residents had not been advised and the reason it had
been closed.
There are several options for the bridge moving forward. These include:
• leave the bridge barricaded so there is no ready access into the Holiday Park
• remove the bridge to eliminate the OH&S risk it currently presents and the problematic
access point it provides to the Yackandandah Holiday Park
• re-negotiate the lease with the leasee to allow the use of the park for local residential
access, replace the bridge with a new OH&S compliant structure, and then re-open the
bridge to the community.
KEY IMPLICATIONS
The key implications are:
• the bridge is in a dilapidated state and does not provide adequate safeguards (i.e. hand
railing) to protect those who may use it. The bridge is an OH&S risk to Council
• the Holiday Park lessees cannot effectively manage/ control the leased land if the bridge
remains accessible from the Church Street area to the Holiday Park
• local residents who may have traditionally used the bridge as a shortcut no longer have
access via the bridge and through the Holiday Park
• re-negotiation of the lease to provide for public access through the park would be a difficult
outcome to achieve. A leasee may not be interested in leasing property that they cannot
fully manage and control.
FINANCIAL IMPLICATIONS
The pedestrian bridge is on Council’s Bridge Asset Register with a replacement value of $9,282
and a written down value of $3,481.
The cost to remove and dispose of the bridge is $2,000 (estimated). The cost to replace the
current dilapidated structure in its current position with a new modern equivalent is an estimated
$16,000.
POLICY IMPLICATIONS
The relevant Council Plan objective associated with the bridge is:
Objective 4.2: Provide a safe environment for our community
With the associated strategy to: Provide Safe Facilities.
Page 26
INDIGO SHIRE COUNCIL
COMMUNICATION
ORDINARY COUNCIL MINUTES - 13 MARCH 2012
Council has not communicated with the local community to date concerning removal or
barricading of the pedestrian bridge. The Yackandandah Holiday Park management has dealt
with the issue as lessees/ managers of the property.
However, the bridge and Holiday Park permanent buildings are Council assets, with what
ultimately happens to the bridge (whether removed or replaced) a Council issue. Any direction
taken with the bridge and the rationale for this direction will need to be communicated to the local
community via a letter drop or similar.
CONCLUSION
The two major issues with the Yackandandah Holiday Park pedestrian bridge are (1) its unsafe
state, and (2) the uncontrolled access it provides from Church Street to the Yackandandah
Holiday Park privately leased property.
Removing the currently barricaded bridge will address both these issues and is the recommended
action from this report.
Any action taken with the bridge will require active communication with local residents on the
bridge’s status in the form of a letter drop or similar.
Risk Management
ORDINARY COUNCIL MINUTES - 13 MARCH 2012
To determine the best value for money, a panel of experienced Council officers in accordance
with the Indigo Shire Council Procurement Policy 2009 and Conditions of Tender assessed the
tenders. Tenders were assessed on price, relevant experience, alignment of tenders with project
objectives and scope, mobilisation, litigious and claims risk, and evidence of sound Occupational
Health and Safety (OH&S) procedures.
Value for Money in procurement is about selecting the supply of goods, services and works taking
into account both cost and non-cost factors including: contributions to the advancement of
Council’s priorities, non-cost factors such as fitness for purpose, quality service and support; and
cost-related factors including whole of life costs and transaction costs associated with acquiring,
using, holding, maintaining and disposing of the goods, services or works.
The contractor is to follow OH&S requests stipulated in the contract and a Risk Assessment is
required prior to commencing the work including the development of appropriate control
measures for review by the Contract Manager as per contract requirements.
Legislative
The tender has been conducted in accordance with requirements of Indigo Shire Council’s
RECOMMENDATION
Unanimously Carried
That Council adopt the Draft Drainage Asset Management Plan and advertise for submissions
from the community on the draft plan.
INTRODUCTION
Asset management plans detail how Council intend to manage their assets over the medium to
long term.
The formulation and adoption of asset management plans for Council’s major asset types is
necessary to establish a framework for a core level of asset management within Council. Further
to Council’s adoption of asset management plans for buildings, bridges, roads, and pathways in
2011, this report provides details on drainage assets, being the last of the asset management
plans required for core competency. The formulation and adoption of these five asset
management plans are significant actions outlined in Indigo Shire’s Asset Management Strategy
adopted in December 2010 and reviewed in October 2011.
BACKGROUND
A major part of Council’s resources are expended on maintaining, renewing and creating new
assets. The degree and way in which council’s assets are managed are key in determining the
financial position and long term sustainability of a council.
The MAV Regional Asset Management & Service Program has seen the formation of five state
regional asset management (AM) groups charged with developing and implementing regional
action plans to improve asset management practices. The target measure for the North East
Regional Group, of which Indigo Shire is a part of, is to meet 100% score on the core asset
management standards by December 2012. The core standards are defined within the National
Asset Management Assessment Framework (NAMAF) which is the adopted reporting tool to
measure a Councils asset management performance. The formulation and adoption of asset
management plans covering 90% plus of Council’s infrastructure asset value is an integral part of
the NAMAF and the North East Regional Group’s action plan to achieve a core competency level.
Page 31
INDIGO SHIRE COUNCIL
ORDINARY COUNCIL MINUTES - 13 MARCH 2012
The International Infrastructure Management Manual (IPWEA, 2006) Appendix A: Asset
Management Plan Structure has dictated the structure of these draft asset management plans,
with the underlying aim of achieving 100% core standard in the national asset framework
assessment areas. The formulated drafts seek to keep the document as brief and simple as
practical, whilst fulfilling the required national asset framework requirements.
The Draft Drainage Asset Management Plan has been compiled and documented by Council’s
asset unit, with 100’s of man-hours spent in the recollection and compilation of urban drainage
asset data across each of Indigo’s townships to provide a firm data basis for the plan.
Council’s Asset Management Strategy targets the adoption of a drainage asset management plan
by April 2012.
Further to consideration of the draft plan at the February 28 th Council briefing, the draft plan has
been amended in accord with Councillor and officer comments. Comments incorporated include:
• Clarification around heritage open drains/ gutters (p. 20)
• Incorporation of increasing maintenance costs associated with retention basin and wetland
structures (p. 6, 29, 34)
• Enhancement of Appendix A: Drainage Register readability.
The Draft Drainage Asset Management Plan is now proposed for consideration of its adoption,
followed by advertisement for submissions from the community in the March-April period 2012.
KEY IMPLICATIONS
The Federal Government has outlined that councils need to improve their asset and financial
management. The key implications in Council not achieving core asset management practice are:
• potentially poor and unsustainable management of the community’s assets, and;
• infrastructure funding from government bodies potentially being put at risk by a lack of
demonstration of good asset management practice.
The formulation and adoption of Council’s asset management plans are critical building blocks on
the pathway to achieving core asset management by December 2012, as detailed in Councils
Asset Management Strategy and the North East Regional Group’s action plan.
RISK MANAGEMENT
The risk management implications for drainage assets are outlined in the Draft plan in section 5.2
Risk Management Plan. The risk management issues identified are largely drawn from Council’s
Risk Register.
FINANCIAL IMPLICATIONS
Asset management plans seek to identify and document the costs associated with maintenance,
renewal and planned new or upgrade works associated with an asset (refer sections 5. Lifecycle
Management Plan and 6. Financial Summary of the Draft plan). The adoption of an asset
management plan by Council is the recognition of the long term costs associated with that asset,
and not necessarily a commitment to fund those identified long term costs.
The way in which Council seeks to fund long term asset costs is integral to Council’s Long Term
Financial Plan. Financial information from each asset management plan is to be included in the
formulation of the Long Term Financial Plan. The Long Term Financial Plan is a key part of
Council’s Asset Management Strategy and is scheduled for completion in 2012.
Page 32
INDIGO SHIRE COUNCIL
ORDINARY COUNCIL MINUTES - 13 MARCH 2012
There are long term financial implications including appropriate staffing and software
improvements that will be required to support and maintain a core standard of asset management
practice within Council.
An improvement plan is included in Section 8 of the Draft Drainage Asset Management Plan to
detail proposed short term plan improvements, including an estimate of resourcing required.
LEGAL/COUNCIL PLAN/POLICY IMPACT
COUNCIL PLAN
This Drainage Asset Management Plan will assist with the achievement of the key strategic
objectives:
Objective 2.2: Improve the quality and maximise the long-term sustainability of the built
environment: Ensure that Council’s asset management practices are clearly defined and in
accordance with a strong Asset Management Policy and Strategy.
Objective 2.3: Manage and maintain to a high standard assets critical to our economic prosperity:
Identify critical assets and prioritise actions.
Objective 2.9: Ensure flood management structures and strategies minimise flooding to our
residents properties: Identify flood sites and remedial works.
As set out in the Council Plan 2011-2014.
CONCLUSION
The Council Plan outlines the goal to ensure that Council’s asset management practices are
clearly defined and in accordance with a strong Asset Management Policy and Strategy. Further
to Council adopting an Asset Management Strategy in December 2010, the formulation and
adoption of a Drainage Asset Management Plan forms the last asset management plan action
within this strategy.
The consideration of this Draft plan for adoption forms the next step toward achieving the defined
Council Plan objectives and the journey towards a core standard in Council’s asset management
practices by December 2012.
(c) Authorise the signing and sealing of a contract for provision of temporary office
facilities within approved budget parameters in (a) above.
INTRODUCTION
Construction of new Shire Offices at Yackandandah and Beechworth are proposed to commence
in August 2012. During construction (15 months), most of the staff located at Yackandandah will
require alternative accommodation in order to maintain current Council services and service
levels.
BACKGROUND
Recent enquiries to providers of office facilities has highlighted that there is a lead time of around
16 weeks for fabrication and delivery of these types of buildings.
Page 39
INDIGO SHIRE COUNCIL
ORDINARY COUNCIL MINUTES - 13 MARCH 2012
It is intended that this accommodation will be provided by a combination of the existing portable
building (Community Care Services) and portable ablutions building, part of the existing High
Street main office, and additional temporary office buildings, which need to be sourced and
procured to provide an additional 270m² of office space.
This report looks at two options for procuring this accommodation.
Option 1 – Rental of temporary accommodation
This option assumes continued use of part of the existing High Street building, relocation of
existing Ardsville ablution block and Community Care portable building to Council land behind the
Star Hotel in Windham Street, supplemented by an additional 270m² of office space.
Existing furniture and equipment will be relocated as well.
Costings are being sought via a tender for rental of both new and used office buildings.
Option 2 – Purchase of temporary accommodation
The second option is essentially the same as Option 1, however Council would purchase these
outright. Whilst this is more expensive upfront, the buildings could be readily on-sold (or re-used)
at the end of the construction period, which would make this a more cost effective option overall,
over a two year period.
As also stated above, a tender process for purchase of both new and used buildings is being
undertaken.
As part of the refurbishment of the Windham Street site after the buildings are removed, car
parking would be created, in line with the original purpose for purchase of the site.
KEY IMPLICATIONS
The parameters that are required to be met with any proposal for interim office accommodation
include:
• A continued Council service point in Yackandandah to provide continuity of service to the
community.
• A desire to avoid further fragmentation of staff across multiple sites and towns, that can
lead to reduced service efficiencies.
• An office environment with adequate/equivalent amenity and operational ability to the
current offices.
• Financial fit within the budget.
• Minimisation of disruption to office staff and the current services provided by Council.
RISK MANAGEMENT
There are risks associated with providing an environment at the existing offices that is adversely
impacted by adjacent construction works in terms of noise, distraction and amenity. For this
reason, it is advantageous to remove as many staff as practical to an adjacent site.
FINANCIAL IMPLICATIONS
Given we are going out to the market with a tender for provision of these facilities, our cost
estimates are provided separately on a confidential attachment. Anticipated costs are in line with
those previously reported to Council at its meeting on 13 September 2011, in the Confidential
Meeting.
Page 40
INDIGO SHIRE COUNCIL
LEGAL/COUNCIL PLAN/POLICY IMPACT
ORDINARY COUNCIL MINUTES - 13 MARCH 2012
This report deals with interim accommodation only and has no policy implications.
COMMUNICATION
Once the arrangements are finalised, and prior to the site being handed over to a builder, a
structured communication program will commence.
Given that the High Street building will be maintained until very late in the project, there will be
minimal disruption to public interface.
CONCLUSION
The tender process will provide the actual data enabling the most cost effective solution to be
made on the issue of leasing versus purchasing, however, it is considered the continued use of
most of the High Street building, supplemented by temporary accommodation as outlined is the
option which provides least disruption for the community and staff, and is cost effective for
Council.
detailed report submitted for Council consideration at the April Budget Workshop
2. That the projects that were bought to the mid-year budget Rutherglen Pool Solar
Heating and the Yackandandah Shade Sail also be added to this list to be fully scoped
and detailed for the 2012/13 budget.
RECOMMENDATION
Unanimously Carried
That the Kergunyah Hall Water and Carparking Infrastructure Project be fully scoped and a
detailed report submitted for Council consideration at the April Budget Workshop meeting.
Explanatory comment
There has been conflicting totals as to the cost of this Project. There are two parts to this project
namely the securing of a water source for the Hall and the construction of additional car parking
next to the Hall. It would be of great benefit to know the costings of the Project as a whole as well
as the costings of the Kergunyah Hall Water Source Project and the Kergunyah Hall Car Park
Project as separate identities. Also I believe the Hall Committee would be willing to put in both
money and labour towards the project . This type of information would be very helpful when
budgets are being reviewed and formulated.
The Beechworth Treescape Group
Statement to accompany presentation of Petition to Indigo Shire Council
at its Meeting at Yackandandah on Tuesday 13 March 2012
by Mr Garry Jaruis, Chair, Beechwotth Treescape Group.
Mr Mayor, Councillors, CEO and Staff of the Indigo Shire Council, and others present,
I am Garry Jarvis, Chair of the Beechworth Treescape Group, and it is my responsibility
to present our Petition to you today, on behalf of one thousand two hundred and fifty-two
petitioners.
You are already aware of the existence of this group following the tabling of a letter by Cr
Gaffney on our behalf on l4 February 2012.You will also recall a statement attached to
that letter which outlined the vision of our group. lt talked of our strong desire to work
with you, our Council, to acknowledge our mutual duty of care to protect and preserve
Beechworth's beautiful heritage treescapes, avenues which inspire a sense of awe and
spirituality, a legacy from our founding fathers.
Beechworth treescapes have been uniquely beautiful for over a century. John Hawker's
Beechwotlh's Tree Study of 1986 recalled that about a century earlier, in the 1890s,
Beechworth was described as
"a town embowered in luxuriant foliage," with
"long vistas of stately trees bordering the footpaths"
Today's residents and visitors share a similar experience. They overwhelmingly love our
old trees. They want our treescapes of mature trees Ieft as heritage to future generations.
People come to live here to enjoy this beauty daily, and tourists seek this beauty as an
integral part of their holiday. Both groups contribute to the economic stability of our
region.
Our Group is inspired by level of support for our heritage treescapes by the people of
Beechworth ancl beyond. They have in significant numbers signed this Petition [pointing
to petitionl. lt states:
We, the undersigned, hereby make petition to the lndigo Shire Council,
. To cease immediately the indiscriminate felling of the beautiful mature trees that
collectively characterise the Town of Beechworth.
To undertake wide and proper consultation with Beechworth community in the
review and implementation of the Shire's Tree Management Plan as it relates to
Beechworth.
To remove mature trees only after taking into account the informed views of a
consultative working group such as that proposed by the Beechworth Treescape
Group
Chair, Garry Jarvis,T: 01 5'728 2867 E: sorsewalk@;westnet.com.au or
Secretary, Vivienne Hawey, T:03 5728 2676 E:. vivhawe@draenet.com.at
Petition Statement: 13 March 2012
We therefore urge the Council to respond to the Petition. We ask you to:
Firstly,
Stop the apparent indiscriminate felling.
lnstruct your staff to halt all removal of trees until the community has been
consulted.
Secondly
Rethink your approach to tree management.
lnstruct your staff to give priority to maintain and support our old trees, and to
further develop the free replacement aspect of your Tree Management Plan
Finally
Review your consultation process to include us.
Support your staff to begin a genuine formal consultation process for the mutual
benefit of the community and the trees we are fighting to save.
We see the potential, that in working together to ensure the future of our Beechworth
Treescapes , our Community's consultation processes will become a model for other
towns to follow, providing real and aesthetic value to people within and beyond our
borders.
lndigo has the opportun¡ty to lead and shine. Let's make this a winner for our community,
the wider population and our stunning trees.
