Agile policymaking through<br />

compulsory regulatory sandboxing<br />

The current approach of impact<br />

assessments, ‘better regulation’, and a<br />

‘competitiveness check’ is not delivering<br />

legislation that will help us reach our<br />

Digital Decade goals.<br />

All proposed rules, particularly<br />

complex digital files, should undergo<br />

pre-regulation sandboxing to<br />

assess whether they are fit for<br />

purpose, contribute to European<br />

competitiveness, and to see if there<br />

are any overlaps with existing laws.<br />

<strong><strong>DIGITAL</strong><strong>EUROPE</strong></strong> road-tested this<br />

pre-regulatory sandbox for the AI Act<br />

with 9 European scale-ups and SMEs. 9<br />

Policy sandboxing should take place<br />

before the legislative process so that<br />

issues identified can be tackled before<br />

proposals are put forward and to<br />

provide real-world data and insights<br />

to assist policymakers in reaching their<br />

final agreements.<br />

After the regulation is in place, all<br />

companies in Europe should be<br />

granted the freedom to experiment<br />

and test innovative technologies,<br />

products, and services within a<br />

regulatory sandbox framework.<br />

Existing post-regulation sandboxes in<br />

sectors such as financial services and<br />

autonomous driving offer valuable<br />

examples. Companies which complete<br />

the sandboxing process should benefit<br />

from a presumption of conformity with<br />

key regulatory requirements.<br />

Lessons learnt from sandboxing<br />

must be acted upon, with review<br />

mechanisms in place to adjust the<br />

legislation or the way it is being<br />

implemented without reopening the<br />

whole law again.<br />
