By July 2024, the Australian government plans to phase<br />
out the so-called "Business Innovation and Investment<br />
subclass 188 visa" (BIIP) and replace it with a new<br />
National Innovation Visa.<br />
As the allocation of visas for global talent will be<br />
reduced, applications are likely to be more<br />
competitive in the future.<br />
With the "National Innovation Visa Program", the<br />
government intends to consolidate the objectives of<br />
the BIIP and <strong>Global</strong> Talent Visa programs by setting<br />
more targeted criteria that should lead to better<br />
economic outcomes for Australia.<br />

Ireland: Updating the employment status for partners of certain employment permit holders<br />
Irland: Aktualisierung des Beschäftigungsstatus für Partner bestimmter Inhaber einer<br />
Arbeitsbewilligung<br />
Recently, Irish authorities have announced that eligible<br />
spouses and partners of holders of certain work<br />
permits will now automatically be entitled to employment<br />
without the need for a separate permit.<br />
Detailed information on the announcement can be<br />
found here.<br />
Key points:<br />
The Minister for Justice announced that eligible spouses<br />
and partners of people in the following categories<br />
will benefit from the new scheme:<br />
General Employment Permit<br />
Irish employment authorization for intra-corporate<br />
transferees<br />
There is a temporary administrative arrangement that<br />
allows eligible spouses and partners who were<br />
previously granted Stamp 3 as the spouse of a GEP or<br />
ICT permit holder (on a family reunion basis) to now be<br />
deemed to be registered with a Stamp 1G permit. With<br />
Stamp 1G, they can automatically work without having<br />
to obtain a work permit.<br />
Background:<br />
The application process for family reunion and for<br />
those wishing to bring family members to Ireland<br />
remains unchanged.<br />
When eligible spouses and civil partners renew their<br />
current Stamp 3 permit, a new Irish residence permit<br />
with Stamp 1G conditions will be issued.<br />
For those who are eligible and currently hold a Stamp<br />
3, a new IRP card is not required to take up<br />
employment; these individuals can prove their<br />
eligibility with a letter of termination presented in<br />
conjunction with a current IRP card bearing a Stamp 3.<br />

Der Justizminister kündigte an, dass berechtigte Ehegatten<br />
und Partner von Personen der folgenden Kategorien<br />
von der neuen Regelung profitieren werden:<br />
Allgemeine Beschäftigungserlaubnis<br />
Irische Beschäftigungserlaubnis für konzernintern<br />
versetzte Arbeitnehmer<br />
Es gibt eine vorübergehende Verwaltungsvereinbarung,<br />
die es berechtigten Ehe- und Lebenspartnern, die<br />
bisher als Ehepartner eines GEP- oder ICT-Bewilligungsinhabers<br />
einen Stempel 3 erhalten haben (auf der<br />
Grundlage der Familienzusammenführung), ermöglicht,<br />
nun als mit einer Stempel-1G-Genehmigung registriert<br />
zu gelten. Mit dem Stempel 1G können sie automatisch<br />
arbeiten, ohne eine Arbeitserlaubnis einholen<br />
zu müssen.<br />
Hintergrund:<br />
Das Antragsverfahren für die Familienzusammenführung<br />
und für diejenigen, die Familienangehörige nach<br />
Irland nachziehen lassen möchten, bleibt unverändert.<br />
Wenn berechtigte Ehe- und Lebenspartner ihre derzeitige<br />
Stempel-3-Erlaubnis erneuern, wird eine neue<br />
irische Aufenthaltserlaubnis mit Stempel-1G-Bedingungen<br />
erteilt. Für diejenigen, die berechtigt sind und<br />
derzeit eine Stamp 3 besitzen, ist eine neue IRP-Karte<br />
nicht erforderlich, um eine Beschäftigung aufzunehmen;<br />
diese Personen können ihre Berechtigung mit<br />
einem Kündigungsschreiben nachweisen, das in Verbindung<br />
mit einer aktuellen IRP-Karte vorgelegt wird,<br />
die mit einer Stamp 3 versehen ist.<br />

Saudi Arabia: Expiry of the deadline for updating location information on the Qiwa platform<br />
Saudi-Arabien: Ablauf der Frist für die Aktualisierung der Standortinformationen auf der<br />
Qiwa-Plattform<br />
The Ministry of Human Resources and Social Development<br />
(MHRSD) requires all private sector companies<br />
to update their location on the Qiwa platform within<br />
certain deadlines depending on the size of the<br />
company.<br />
Specifically, enterprises must register with the Qiwa<br />
platform, select the location management service and<br />
provide branch location information, such as the<br />
branch address, by the following dates:<br />
or<br />
May 30, 2024 for companies with 20 or fewer<br />
employees<br />
June 30, 2024 for companies with 21 to 49<br />
employees<br />
July 30, 2024 for companies with 50 or more<br />
employees.<br />
Those companies that do not comply or comply too<br />
late will face a fine, the amount of which and possible<br />
further sanctions or consequences have not yet been<br />
announced. The initiative underscores the MHRSD's<br />
commitment to maintaining an accurate and up-todate<br />
database to promote transparency and streamline<br />
monitoring measures.<br />

Mitarbeitern<br />
30. Juni 2024 für Unternehmen mit 21 bis 49<br />
Mitarbeitern<br />
oder<br />
30. Juli 2024 für Unternehmen mit 50 oder mehr<br />
Mitarbeitern.<br />
Diejenigen Unternehmen, die dieser Aufforderung<br />
nicht oder zu spät nachkommen, müssen mit einer<br />
Geldstrafe rechnen, deren Höhe und mögliche weitere<br />
Sanktionen oder Konsequenzen noch nicht bekannt<br />
gegeben wurden. Die Initiative unterstreicht das Engagement<br />
des MHRSD, eine genaue und aktuelle Datenbank<br />
zu führen, um die Transparenz zu fördern und die<br />
Überwachungsmassnahmen zu rationalisieren.<br />

Part 3: "Host country approach"<br />
In our series on the remuneration approaches for secondment, we present the various approaches<br />
used in practice.<br />
After presenting the so-called "home country approach" in the first part and the "net-net approach"<br />
(balance sheet approach) in the second part, we will now look at the so-called "host country<br />
approach" in the third part.<br />
In the host country approach, the salary structure of the host country is used to determine<br />
remuneration. As a rule, the function, position in the company, level of education, age and duties<br />
are used to determine what the appropriate base salary would be. In some host countries, including<br />
Switzerland, the statutory (minimum) salary regulations must also be taken into account.<br />
The salary is usually stated as a gross salary. It is often difficult for the expatriate to work out<br />
exactly what this means for them financially.<br />
A Swiss expatriate who receives an annual salary of CHF 120,000 at home and is offered an annual<br />
gross salary of YEN 3,000,000 for an assignment in Japan may at first glance think that this sounds<br />
great. On closer inspection, however, he realises that the Japanese salary converted into CHF is only<br />
CHF 17,463. In addition, social security contributions and taxes must be deducted from this gross<br />
salary. In this case, it will be very difficult to convince the Swiss expatriate that he will go to Japan<br />
for this salary.<br />
The host country approach is simpler for the host company, as the posted worker can be easily<br />
integrated into the payroll accounting system. In addition, the posted worker can be easily<br />
integrated in the host country, as the frequently used argument that posted workers always earn<br />
much more cannot be applied in these situations.<br />
If a company has employees posted to a country from several countries, the host country approach<br />
helps to treat them equally.<br />

However, as can be seen in the example above, in practice a "pure" host country approach is often<br />
not pursued, but additional allowances or remuneration elements are granted. These include, for<br />
example, support with finding accommodation, school costs, rent, tax consultant, international<br />
health insurance, etc.<br />
What is the goal?<br />
The aim is for the expatriate to be integrated into the same salary structure as the local employees.<br />
With this approach, employees in the same country are treated equally and the expatriates can be<br />
integrated more easily in the host country.<br />
Why is this approach used?<br />
One of the main reasons is to implement the principle of equal treatment and to counteract<br />
difficulties in the integration of posted workers from abroad.<br />
In which cases should this approach be used?<br />
This approach is mainly used for expatriates who are permanently transferred and the host country<br />
generally has a higher salary level than in the home country and, from a legal perspective, this must<br />
be granted one way or another. This approach is also frequently used for postings initiated by the<br />
employee.<br />
What are the advantages and disadvantages of this approach?<br />
The advantages are the equal treatment of expatriates from different home countries combined<br />
with the equal treatment of expatriates and local employees in the host country. Administration is<br />
also comparatively easier in these cases.<br />
This approach is disadvantageous in terms of the re-patriation of the assignee, as the assignee is in<br />
a different salary structure during the assignment in the host country. This leads to both positive<br />
and negative assignments for the assignee. Another disadvantage is the persuasion work that has<br />
to be done vis-à-vis the expatriate.<br />

Teil 3: «Gastland-Ansatz»<br />
In unserer aktuellen Serie über die Vergütungsansätze bei Entsendungen stellen wir Ihnen die<br />
verschiedenen in der Praxis angewendeten Ansätze vor.<br />
Nachdem wir im ersten Teil den sogenannten «Heimatland-Ansatz» und im zweiten Teil den «Netto-<br />
Netto-Ansatz» (Balance-Sheet Ansatz) vorgestellt haben, gehen wir jetzt im dritten Teil auf den<br />
sogenannten «Gastland-Ansatz» ein.<br />
Bei dem Gastland-Ansatz wird die Salärstruktur des Gastlandes für die Bestimmung der Vergütung<br />
verwendet. In der Regel schaut man basierend auf der Funktion, Position im Unternehmen,<br />
Ausbildungsgrad und Alter sowie Aufgaben- und Verantwortungsgebiet, welches das adäquate<br />
Basissalär wäre. In einigen Gastländern, so auch in der Schweiz, sind die gesetzlichen (Mindest-)<br />
Salärvorschriften ebenfalls mit zu berücksichtigen.<br />
Das Salär wird in der Regel als Brutto-Salär angegeben. Für den Entsandten ist es häufig schwierig<br />
daraus abzuleiten, was dies «am Ende» genau für ihn finanziell bedeutet.<br />
Ein Schweizer Entsandter, der zu Hause ein Jahressalär von CHF 120'000 erhält und für einen Einsatz<br />
in Japan ein Jahresbruttosalär von YEN 3'000'000 angeboten bekommt, empfindet möglicherweise<br />
auf den ersten, oberflächlichen Blick, dass dies ein grosszügiges Angebot sein könnte. Bei der<br />
genaueren Betrachtung sieht er allerdings, dass das angebotene japanische Jahresbruttosalär<br />
umgerechnet in Schweizer Franken lediglich CHF 17'463 ergibt. Hinzukommt, dass von diesem<br />
Brutto-Salär auch noch die Sozialversicherungsbeiträge und Steuerbeträge in Abzug gebracht<br />
werden müssen. In diesem Fall wird es sehr schwierig beziehungsweise realistischerweise nahezu<br />
unmöglich sein, den Schweizer Entsandten zu überzeugen, einem Auslandseinsatz in Japan zu<br />
diesen Salärkonditionen zuzustimmen.<br />
Für das Gastland-Unternehmen ist der «Gastland-Ansatz» einfacher, denn der Entsandte lässt sich<br />
einfach in die Lohnbuchhaltung integrieren. Zudem kann der Entsandte leicht im Gastland<br />
integriert werden, denn das häufig angebrachte Argument, dass die Entsandten immer viel mehr<br />
verdienen würden, kann in diesen Situationen nicht angebracht werden.<br />

AUS DER PRAXIS<br />
Wenn man als Unternehmen Entsandte aus mehreren Ländern in einem Land einsetzt, dann hilft<br />
der «Gastland-Ansatz» die Entsandten gleich zu behandeln.<br />
Wie im obigen Beispiel ersichtlich wird in der Praxis häufig jedoch nicht ein «reiner» «Gastland-<br />
Ansatz» verfolgt, sondern noch zusätzliche Zulagen beziehungsweise Vergütungselemente<br />
gewährt. Hierzu zählen unter anderem: Die Übernahme der Kosten für mögliche vorab «Orientation<br />
tours», die Unterstützung bei der Wohnungssuche, Schulkosten für (internationale) Schulen, Miete,<br />
Steuerberatung, internationale Krankenversicherung, etc.<br />
Was ist das Ziel dieses Ansatzes?<br />
Das Ziel ist es, dass der Entsandte in der gleichen Salärstruktur eingegliedert wird, wie die<br />
Mitarbeiter vor Ort. Bei diesem Ansatz werden die Mitarbeiter in demselben Land gleichbehandelt,<br />
und die Entsandten können dementsprechend einfacher im Gastland integriert werden.<br />
Wieso wird dieser Ansatz verwendet?<br />
Einer der Hauptgründe ist die Umsetzung des Gleichbehandlungsgedankens sowie den möglichen<br />
Schwierigkeiten bei der Integration von Entsandten aus dem Ausland entgegen zu wirken.<br />
In welchen Fällen sollte dieser Ansatz verwendet werden?<br />
Dieser Ansatz kommt vor allem bei Entsandten zur Anwendung, welche permanent transferiert<br />
werden und / oder das Gastland in der Regel ein höheres Salärniveau als im Heimatland aufweist<br />
und aus gesetzlicher Sicht dieses höhere Salärniveau dem Entsandten gewährt werden muss.<br />
Ebenfalls kommt dieser Ansatz häufig bei Entsendungen zur Anwendung, welche vom Mitarbeiter<br />
initiiert wurden.<br />
Was sind die Vor- und Nachteile dieses Ansatzes?<br />
Als Vorteile anzusehen sind die dadurch zu erreichende Gleichbehandlung der Entsandten aus<br />
verschiedenen Heimatländern, verbunden mit der Gleichbehandlung der Entsandten gegenüber<br />
lokalen Mitarbeitern im Gastland. Auch ist die Administration ist in diesen Fällen im Vergleich<br />
einfacher.<br />

Nachteilig wirkt sich dieser Ansatz in Bezug auf die Repatriierung des Entsandten aus, denn der<br />
Entsandte befindet sich während des Einsatzes im Gastland in einer anderen «Salärstruktur».<br />
Dies führt dazu, dass die Anwendung dieses Ansatzes für die Entsandten sowohl positive als auch<br />
negative Auswirkungen haben kann. Als ein weiterer Nachteil ist der Aufwand für die Überzeugungsarbeit<br />
zu nennen, welche gegenüber dem Entsandten oftmals notwendig sein wird.<br />
