FOREWORD
A. REGIONAL DIRECTOR’S REPORT
MGB – 10’s Annual Accomplishment for CY 2008 attained an overall of
128% despite the number of resignations of our personnel to seek greener
pastures, and the moratorium on the filling-up of positions. Reported
activities that have more than 100% accomplishment are client-dependent.
The year’s accomplishments include the following Major Plans and
Implemented Programs:
1. CREATION OF THE REGIONAL MINERALS DEVELOPMENT
COUNCIL (RMDC)
In line with the Executive Order No. 469 on the creation of the Minerals
Development Council, the RMDC was created on May 6, 2008. The
organizational meeting was attended by the members-representative from
various National Government Agencies, Local Government Units, and
large scale and small scale mining companies with a common agenda of
instituting a minerals industry that is environment-friendly, and an industry
that promotes equal wealth distribution.
The RMDC-10 was able to conduct three (3) regular meetings after its
establishment in May 6, 2008. Moreover, the council endorsed two
resolutions for the consideration of MDC, such as Resolution No. 01,
Series of 2008 entitled “Resolution To Support The Intention Of The
League of Provinces of The Philippines (LPP) In The Harmonization of the
Local Government Code & The Small Scale Mining Laws and for the
Minerals Development Council to Clearly Define Functions, Enforcement
Power & Authority of LGU’s Relative to Illegal Small Scale Activities”, and
Resolution No. 2, Series of 2008 or the “Resolution To Present Plaque of
Appreciation/Gratitude to the Honorable Governor of Misamis Occidental
and Holcim Philippines Manufacturing Corporation For Their Support to the
2
Regional Minerals Development Council-10.” The first regular meeting was
hosted by the Governor of Misamis Occidental and at the same time the
President, League of Provinces of the Philippines (LPP). The second
meeting was held at Holcim, Lugait plant where the members of RMDC-10
were able to observe the responsible mining practices of the aforesaid
cement plant and quarry.
One of the highlights in the activities of RMDC-10 for year 2008 was the
creation of the Technical Working Group (TWG) composed of MGB-10,
4thID, PNP-10, DILG-10, BLGF-10, BOC, PIA-10, DTI-10, DOLE-10, LCP,
LMBP-Mis. Or. Chapter, LMBP-CDO Chapter and NBI-10. The TWG is to
primarily act on certain issues relative the proliferation of illegal transport of
mineral commodities which has a negative effect on potential revenues of
the concerned LGU’s.
2. CREATION AND LAUNCHING OF MGB – 10 WEBSITE
Pursuant to the thrust of Hon. Secretary Jose L. Atienza, Jr. to include
Education, Information and Communication (IEC) campaign as one of his
priority programs for 2008 and to complement on the current plans and
programs of MGB – 10, and on the present status of the mining industry in
the Region, the MGB – 10 Website (www.mgb10.com) was created and
formally launched on July 8, 2008.
3. PROMOTION OF MINING INVESTMENTS
MGB – 10 aims to deliver:
a. Assistance to mining rights applicants in complying with the
requirements of their mining applications
b. Identification of other potential mineral resources, and investigation and
characterization of the mineral deposits of active small scale mining
areas within the Region particularly in the provinces of Misamis
Oriental and Bukidnon with an aggregate area of 2,700 hectares
c. Preparation of tenement maps and geologic/mineral resources maps
for prospective mining investors
3
d. Issuance of Certificates of Accreditation and Ore Transport Permits to
mineral traders, dealers, small-scale miners, etc.
4. IDENTIFICATION AND EVALUATION OF AREAS FOR
PEOPLE’S SMALL SCALE MINING OR “MINAHANG BAYAN”
Identification and evaluation of mineralized areas whether they are
technically and economically viable for small scale mining before the
Provincial/City Mining Regulatory Board (P/CMRB) declares the same as
“Minahang Bayan” pursuant to R.A. No. 7076 otherwise known as the
People’s Small Scale Mining Act of 1991. To date, the MGB – 10 in
coordination with LGU – Opol, Misamis Oriental is in the process of
identifying a small scale chromite mining at Brgy. Awang, Opol, Misamis
Oriental with the hope of generating local employment opportunities and
providing the local government of additional income from taxes, fees,
royalties, and related business transactions.
5. GEOLOGIC HAZARDS ASSESSMENT AND IDENTIFICATION
In line with one of the current thrust of the Bureau, MGB – 10 conducted
assessment and identification of geologic hazard zones (flood, landslide
prone areas) in forty-five (45) Barangays of ten (10) Municipalities of the
Region. Results of the assessment were provided to the concerned LGUs
together with appropriate mitigating and preventive measures.
6. MONITORING ON THE STRICT IMPLEMENTATION OF THE
ANNUAL SOCIAL DEVELOPMENT AND MANAGEMENT
PROGRAMS (ASDMP) OF OPERATING MINES
The implementations of the respective ASDMP of the five (5) operating
mines were strictly monitored. This activity also aimed to assess the
positive impact of the programs of the stakeholders.
In other small scale mining areas where there are still no social programs
being implemented, Social Community Assessments (SCA) were
conducted. This activity collated data on the present socio-economic
4
status of the mining host communities, and such data will be used to
formulate social programs which are appropriate in the areas.
7. INFORMATION, EDUCATION AND COMMUNICATION
CAMPAIGN
This activity was effected mainly through lectures and forums. Aside from
the MGB – 10’s plans and programs of the year, best mining practices and
results of geohazard surveys together with appropriate preventive
measures were also disseminated to the public particularly to concerned
local government units.
The MGB – 10 also conducted a ‘SALUGNAYAN” or a “PEOPLE’S HOUR
PROGRAM” at the DENR – 10 Conference Room on October 21, 2008.
The forum provided adequate information to various stakeholders of the
MGB/DENR plans and programs. It was also a venue for the stakeholders
to air their issues and concerns relative to environmental protection and to
the sustainable development and utilization of the mineral resources.
Two important papers were prepared and presented by the OIC, Regional
Director and the IEC-SDMP Unit to the national fora. The first paper was
entitled, Managing Landslide Risks: the Holcim Lugait Experience,
presented in the Annual National Mine Safety and Environment
Conference at CAP- John Hay, Baguio City on November 20, 2008. The
second paper was entiled, Stakeholders Communication and Consultation
presented at the forum entitled, “Communicating Responsible Mining to
Each project component for livelihood, health education, infrastructure
and environmental protection has a designated committee composing the
Barangay-Based Technical Working (BBTWG) or Barangay Social
Advisory Council (BSDAC). The Barangay Captain of each mining
community served as the chair of the BBTWG/BSDAC. The BBTWG or
BSDAC prioritized the identified projects and endorsed the same to the
SDMP Committee for deliberation. The ASDMP document containing the
prioritized projects and other information are then consolidated by the
company and submitted to this Office for re-evaluation and approval.
In the process of evaluation of the 5 – year and Annual SDMP
documents, a third party composed of various stakeholders and partners
in implementing the SDMP projects were created and operationalized.
This executive body is named ComRel Committee for HPMC and SDMP
Committee for the four (4) companies. It is part of the review committee
to evaluate, deliberate, scrutinize and finally recommend for approval to
MGB – 10 the SDMP document of the company.
The SDMP Committee (ComRel or SDC) is composed of the MGB
Regional Director as the Chair; City/Municipal Mayor; barangay captains
of the respective mining communities who are the BBTWG/BSDAC
Infrastructure:
Water drilling project in Barangay Kiwalan as identified during trhe
conduct of georesistivity survey is already 100% completed with a total
cost of P1,445,670.08. It was already operational and was turned-over to
the community on August 9, 2008.
In Barangay Dalipuga, 60 lengths pvc pipes were turned-over for water
system development in the community. Another infrastructure project
was also implemented in Barangay Acmac, such as construction of
drainage canal, provision of elecrtical materials for street lights and
fabrication of boxing ring.
Generally, the company has implemented 72% of the total allocated
projects for year 2008. A capability-building workshop for the Barangay
Social Development Councils of the 7 host and neighboring mining
communities was also conducted for three days at Naawan Beach Resort
on October 28-31, 2008.
MCCI – Operated by PGMC:
This plant has a similar situation with its sister company but has
additional concern on the environmental issues from their communities.
The company made a very good accomplishment in the area of
education and health, although to date their 5-year SDMP was not yet
submitted for this Office evaluation and approval.
The company was able to assist 18 TESDA scholars and sustain the
needs of 27 High School and 91 elementary SDMP scholars. It has also
conducted medical and dental mission as well as provided medicines to
220 residents. A total of 18 2 nd and third degree malnourished children
were rehabilitated through the Supplemental feeding Program.
17
PGMC-Manticao:
Despite of the sudden drop of the nickel price that caused the temporary
shut down of the plant on the second semester of year 2008, the
company was able to comply some of their important commitments for
their communities. Moreover, the company was able to comply with the
requirement of the 5-year SDMP, and such document was approved by
this Office on September 2008.
The company was able to sustain the needs of 5 college and 24 high
school scholars. In April 16, 2008, 81 out-of –school youths were able to
graduate from the TESDA-assisted training course on welding in
coordination with the LGU of Manticao.
The company spent a total of Php 168,399.00 for SDMP comprising only
10% of the committed and approved amount for the year. In terms of IEC
and community consultations, the company was able to accomplished
73% of their target.
MRD:
MRD is an ISAG with permits issued by the MGB, and is located in
Barangay Odiongan, Gingoog City. Its Annual SDMP was evaluated and
approved by this Office in July 2008. The operation is still in an “on and
off status” due to financial concern and limited demand of aggregates in
the area. However, it has complied religiously with the requirement of
submitting its ASDMP, but compliance is below par. For the year, MRD
had released Php 15,000.00 for the medicine and vitamin provision
project for the host barangay.
In line with the current thrust of this Office in particular, and of the agency
in general, to empower women employees to play a major role in the
conduct of IEC on responsible mining, MGB-10, WINGS had accomplished
successfully its lined-up activities for the year.
2008 is a very significant year for the MGB-10, WINGS having made
major contributions in communicating responsible mining through the
conduct of two very successful region-wide fora for LGU’s, small-scale and
large-scale miners, mineral traders, tribal communities and media. The
first forum entitled “Environmental Management and Social Responsibility
of Small-Scale Mining “ was conducted on July 30,2008 at Grand Caprice,
Limketkai Complex, Cagayan de Oro City. The second forum entitled
“NCIP Regulatory Requirements and Processes in Securing the Free and
Prior Informed Consent (FPIC) for mining projects was conducted at
48
Country Village Hotel, Carmen, Cagayan de Oro City was conducted on
October 3, 2008.
The aforementioned fora were attended by hundred participants from
various stakeholders all over the region. The fora were highlighted by the
presence of Governor Oscar Moreno of Misamis Oriental who delivered a
very inspiring Keynote Speech.
The MGB-10, WINGS was also very successful in attaining its goal to bring
21 members to Baguio City for an Educational Tour at Benguet Mining
Corporation, and join some activities of the PMSEA on November 19-22,
2008. The ladies were able to listen to a brief lecture on the history of the
company, the biggest gold-producing mining operation in the country that
started in the early 30’s. They were also able to experienced life of the
former miners in the underground and witnessed underground blasting
through simulation. To top it all, the ladies have seen the positive
contribution of mining in transforming Baguio into what it is now today-a
bustling city.
The year ended with another major activity, the gift-giving, dubbed as “The
Bundle of Joy”, for the less fortunate brothers and sisters in the small-scale
mining communities at Barangay Awang, Opol, Misamis Oriental. A total of
100 families and 70 children were benefited from the project. The ladies
