FOREWORD<br />

A. REGIONAL DIRECTOR’S REPORT<br />

MGB – <strong>10</strong>’s Annual Accomplishment for CY 2008 attained an overall of<br />

128% despite the number of resignations of our personnel to seek greener<br />

pastures, <strong>and</strong> the moratorium on the filling-up of positions. Reported<br />

activities that have more than <strong>10</strong>0% accomplishment are client-dependent.<br />

The year’s accomplishments include the following Major Plans <strong>and</strong><br />

Implemented Programs:<br />

1. CREATION OF THE REGIONAL MINERALS DEVELOPMENT<br />

COUNCIL (RMDC)<br />

In line with the Executive Order No. 469 on the creation of the Minerals<br />

Development Council, the RMDC was created on May 6, 2008. The<br />

organizational meeting was attended by the members-representative from<br />

various National Government Agencies, Local Government Units, <strong>and</strong><br />

large scale <strong>and</strong> small scale mining companies with a common agenda of<br />

instituting a minerals industry that is environment-friendly, <strong>and</strong> an industry<br />

that promotes equal wealth distribution.<br />

The RMDC-<strong>10</strong> was able to conduct three (3) regular meetings after its<br />

establishment in May 6, 2008. Moreover, the council endorsed two<br />

resolutions for the consideration of MDC, such as Resolution No. 01,<br />

Series of 2008 entitled “Resolution To Support The Intention Of The<br />

League of Provinces of The Philippines (LPP) In The Harmonization of the<br />

Local Government Code & The Small Scale Mining Laws <strong>and</strong> for the<br />

Minerals Development Council to Clearly Define Functions, Enforcement<br />

Power & Authority of LGU’s Relative to Illegal Small Scale Activities”, <strong>and</strong><br />

Resolution No. 2, Series of 2008 or the “Resolution To Present Plaque of<br />

Appreciation/Gratitude to the Honorable Governor of Misamis Occidental<br />

<strong>and</strong> Holcim Philippines Manufacturing Corporation For Their Support to the<br />

Regional Minerals Development Council-<strong>10</strong>.” The first regular meeting was<br />

hosted by the Governor of Misamis Occidental <strong>and</strong> at the same time the<br />

President, League of Provinces of the Philippines (LPP). The second<br />

meeting was held at Holcim, Lugait plant where the members of RMDC-<strong>10</strong><br />

were able to observe the responsible mining practices of the aforesaid<br />

cement plant <strong>and</strong> quarry.<br />

One of the highlights in the activities of RMDC-<strong>10</strong> for year 2008 was the<br />

creation of the Technical Working Group (TWG) composed of MGB-<strong>10</strong>,<br />

4thID, PNP-<strong>10</strong>, DILG-<strong>10</strong>, BLGF-<strong>10</strong>, BOC, PIA-<strong>10</strong>, DTI-<strong>10</strong>, DOLE-<strong>10</strong>, LCP,<br />

LMBP-Mis. Or. Chapter, LMBP-CDO Chapter <strong>and</strong> NBI-<strong>10</strong>. The TWG is to<br />

primarily act on certain issues relative the proliferation of illegal transport of<br />

mineral commodities which has a negative effect on potential revenues of<br />

the concerned LGU’s.<br />

2. CREATION AND LAUNCHING OF MGB – <strong>10</strong> WEBSITE<br />

Pursuant to the thrust of Hon. Secretary Jose L. Atienza, Jr. to include<br />

Education, Information <strong>and</strong> Communication (IEC) campaign as one of his<br />

priority programs for 2008 <strong>and</strong> to complement on the current plans <strong>and</strong><br />

programs of MGB – <strong>10</strong>, <strong>and</strong> on the present status of the mining industry in<br />

the Region, the MGB – <strong>10</strong> Website (www.mgb<strong>10</strong>.com) was created <strong>and</strong><br />

formally launched on July 8, 2008.<br />

3. PROMOTION OF MINING INVESTMENTS<br />

MGB – <strong>10</strong> aims to deliver:<br />

a. Assistance to mining rights applicants in complying with the<br />

requirements of their mining applications<br />

b. Identification of other potential mineral resources, <strong>and</strong> investigation <strong>and</strong><br />

characterization of the mineral deposits of active small scale mining<br />

areas within the Region particularly in the provinces of Misamis<br />

Oriental <strong>and</strong> Bukidnon with an aggregate area of 2,700 hectares<br />

c. Preparation of tenement maps <strong>and</strong> geologic/mineral resources maps<br />

for prospective mining investors<br />

d. Issuance of Certificates of Accreditation <strong>and</strong> Ore Transport Permits to<br />

mineral traders, dealers, small-scale miners, etc.<br />

4. IDENTIFICATION AND EVALUATION OF AREAS FOR<br />

PEOPLE’S SMALL SCALE MINING OR “MINAHANG BAYAN”<br />

Identification <strong>and</strong> evaluation of mineralized areas whether they are<br />

technically <strong>and</strong> economically viable for small scale mining before the<br />

Provincial/City Mining Regulatory Board (P/CMRB) declares the same as<br />

“Minahang Bayan” pursuant to R.A. No. 7076 otherwise known as the<br />

People’s Small Scale Mining Act of 1991. To date, the MGB – <strong>10</strong> in<br />

coordination with LGU – Opol, Misamis Oriental is in the process of<br />

identifying a small scale chromite mining at Brgy. Awang, Opol, Misamis<br />

Oriental with the hope of generating local employment opportunities <strong>and</strong><br />

providing the local government of additional income from taxes, fees,<br />

royalties, <strong>and</strong> related business transactions.<br />

5. GEOLOGIC HAZARDS ASSESSMENT AND IDENTIFICATION<br />

In line with one of the current thrust of the <strong>Bureau</strong>, MGB – <strong>10</strong> conducted<br />

assessment <strong>and</strong> identification of geologic hazard zones (flood, l<strong>and</strong>slide<br />

prone areas) in forty-five (45) Barangays of ten (<strong>10</strong>) Municipalities of the<br />

Region. Results of the assessment were provided to the concerned LGUs<br />

together with appropriate mitigating <strong>and</strong> preventive measures.<br />

6. MONITORING ON THE STRICT IMPLEMENTATION OF THE<br />

ANNUAL SOCIAL DEVELOPMENT AND MANAGEMENT<br />

PROGRAMS (ASDMP) OF OPERATING MINES<br />

The implementations of the respective ASDMP of the five (5) operating<br />

mines were strictly monitored. This activity also aimed to assess the<br />

positive impact of the programs of the stakeholders.<br />

In other small scale mining areas where there are still no social programs<br />

being implemented, Social Community Assessments (SCA) were<br />

conducted. This activity collated data on the present socio-economic<br />

status of the mining host communities, <strong>and</strong> such data will be used to<br />

formulate social programs which are appropriate in the areas.<br />

7. INFORMATION, EDUCATION AND COMMUNICATION<br />

CAMPAIGN<br />

This activity was effected mainly through lectures <strong>and</strong> forums. Aside from<br />

the MGB – <strong>10</strong>’s plans <strong>and</strong> programs of the year, best mining practices <strong>and</strong><br />

results of geohazard surveys together with appropriate preventive<br />

measures were also disseminated to the public particularly to concerned<br />

local government units.<br />

The MGB – <strong>10</strong> also conducted a ‘SALUGNAYAN” or a “PEOPLE’S HOUR<br />

PROGRAM” at the DENR – <strong>10</strong> Conference Room on October 21, 2008.<br />

The forum provided adequate information to various stakeholders of the<br />

MGB/DENR plans <strong>and</strong> programs. It was also a venue for the stakeholders<br />

to air their issues <strong>and</strong> concerns relative to environmental protection <strong>and</strong> to<br />

the sustainable development <strong>and</strong> utilization of the mineral resources.<br />

Two important papers were prepared <strong>and</strong> presented by the OIC, Regional<br />

Director <strong>and</strong> the IEC-SDMP Unit to the national fora. The first paper was<br />

entitled, Managing L<strong>and</strong>slide Risks: the Holcim Lugait Experience,<br />

presented in the Annual National Mine Safety <strong>and</strong> Environment<br />

Conference at CAP- John Hay, Baguio City on November 20, 2008. The<br />

second paper was entiled, Stakeholders Communication <strong>and</strong> Consultation<br />

presented at the forum entitled, “Communicating Responsible Mining to<br />

Mining Stakeholders” held at Bayview Park Hotel, Manila on December 11-<br />

12, 2008.<br />

B. OPERATIONS<br />

1. MINE MANAGEMENT DIVISION<br />

For the CY 2008, the Division has accomplished more than 205% of the<br />

<strong>annual</strong> target. On the promotion of mining investment as one of our<br />

country’s thrust, the Division continuously makes effort to assist mining<br />

rights applicants complying with their requirements. There were nineteen<br />

(19) approved mining rights contracts/permits monitored. There were four<br />

(4) approved exploration permits, namely Eagle Crest Mining Dev. Corp.,<br />

Cypress Mining <strong>and</strong> Development, Norte de Oro Mining <strong>and</strong> Industry<br />

Corp., <strong>and</strong> Glendale Mining <strong>and</strong> Industry Corp., <strong>and</strong> Glendale Mining <strong>and</strong><br />

Dev. Corp.; three (3) ISAG for Ceasar Casiňo, Emma Casiňo, <strong>and</strong> Rowena<br />

Tamula; four (4) MPSA for Iligan Cement Corporation (ICC) <strong>and</strong> Mindanao<br />

Portl<strong>and</strong> Cement Corporation (MPCC), Holcim Philippines Manufacturing<br />

Corporation (HPMC), <strong>and</strong> MCCI Corp. (2); five (5) MPP – Grace<br />

Construction, Winston Lao, McWealth, MCCI Corp. operated by Platinum<br />

Group Metals Corp.; three (3) treasure hunting permits for Atty. Pallugna,<br />

Pacita Panis, <strong>and</strong> Severino Salvador. Just recently, a Mineral Processing<br />

Permit (MPP) was issued to Platinum Group Metal Corporation located in<br />

Manticao, Misamis Oriental.<br />

Major activities were accomplished <strong>and</strong> even exceeded the <strong>annual</strong> target.<br />

Issuance of Ore Transport Permit (OTP) <strong>and</strong> accreditations accomplished<br />

196% of the <strong>annual</strong> target, with thirty-nine (39) OTP <strong>and</strong> ten (<strong>10</strong>)<br />

accreditations issued. On the illegal mining activities investigated, the<br />

division has already accomplished more than <strong>10</strong>0% of the <strong>annual</strong> target.<br />

These activities are clientele dependent.<br />

2. MINING ENVIRONMENT AND SAFETY DIVISION<br />

For the CY 2008, the Division’s over-all performance has accomplished<br />

<strong>10</strong>5% of the <strong>annual</strong> target activities through field inspections of the large<br />

<strong>and</strong> small scale mining operations.<br />

Environmental monitorings were conducted to evaluate, assess <strong>and</strong><br />

investigate compliance of their approved program such as Annual<br />

Environmental Protection <strong>and</strong> Enhancement Program (AEPEP).<br />

Monitoring of AEPEP includes five (5) large scale mining companies: Iligan<br />

Cement Corporation (ICC), Mindanao Portl<strong>and</strong> Cement Corporation<br />

(MPCC), Holcim Philippines Manufacturing Corporation (HPMC), MCCI<br />

Corporation operated by Platinum Group Metals Corporation (PGMC), <strong>and</strong><br />

PGMC – Manticao.<br />

For the Mine Safety <strong>and</strong> Health Section, compliance monitoring of Safety<br />

<strong>and</strong> Occupational Health Program of large scale mining companies were<br />

conducted. This includes monitoring of mechanical <strong>and</strong> electrical<br />

installations as well as processing <strong>and</strong> issuance of permits.<br />

For the SDMP, internal <strong>and</strong> external monitoring were conducted regularly<br />

on three (3) large scale quarries <strong>and</strong> cement plants (HPMC, ICC <strong>and</strong><br />

MPCC) as well as two (2) processing plants (MCCI – PGMC <strong>and</strong> PGMC –<br />

Manticao) <strong>and</strong> one (1) ISAG Mingkaadlaw Resources Development<br />

(MRD). Internal SDMP monitoring was conducted monthly by the<br />

respective company’s CRO <strong>and</strong> Barangay Based Technical Working<br />

Group (BBTWG) or the Barangay Social Development Advisory Council<br />

(BSDAC), while external monitoring was conducted quarterly by this office.<br />

Likewise, monitoring <strong>and</strong> assessment of water quality assessment in the<br />

four (4) major rivers (Iponan, M<strong>and</strong>ulog, Bigaan <strong>and</strong> Tagoloan) that are<br />

affected by operating mines were regularly conducted every quarter within<br />

the year.<br />

3. GEOSCIENCES DIVISION<br />

The <strong>Geosciences</strong> Division has accomplished 128% of its <strong>annual</strong> target.<br />

Since the Cherry Hill L<strong>and</strong>slide event, the geologic hazard identification<br />

<strong>and</strong> mapping has become on the Division’s top priorities. For CY 2008, the<br />

Division has conducted geohazard assessment on ten (<strong>10</strong>) municipalities<br />

namely: Talisayan, Balingoan, Binuangan, Sugbongcogon, Kinoguitan,<br />

San Fern<strong>and</strong>o, Manolo Fortich, Lagonglong, Lantapan, <strong>and</strong> Salay. This<br />

<strong>cover</strong>ed eighty-nine (89) barangays.<br />

Aside from geohazard mapping, assessment of Solid Waste Disposal Sites<br />

was also undertaken. A total of six (6) sites were assessed, four (4) in<br />

Maramag, Bukidnon <strong>and</strong> two (2) in Sultan Naga Dimaporo, Lanao del<br />

Norte. Of the four (4) sites assessed in Maramag, Bukidnon only one (1)<br />

site was identified suitable for this purpose whereas two (2) sites in Sultan<br />

Naga Dimaporo were both deemed unsuitable as a l<strong>and</strong>fill site.<br />

For the Groundwater Resources vulnerability, the division has<br />

accomplished one (1) making up <strong>10</strong>0% of the <strong>annual</strong> target. Coverage<br />

area was the Gitagum Municipality, Misamis Oriental.<br />

Geologic Quadrangle Mapping has accomplished 30,000 has. of area<br />

surveyed making up <strong>10</strong>0% of the <strong>annual</strong> target.<br />

Preparation of Geohazard Identification Report (GIR) for subdivisions <strong>and</strong><br />

housing projects, emergency geohazard assessment, investigation of small<br />

scale mining activities, ore transport verification, megascopic analysis of<br />

samples <strong>and</strong> issuance of certification of samples for shipment/transport<br />

were also among the activities carried out by the Division.<br />

GENERAL ADMINISTRATION AND SUPPORT SERVICES<br />

Over-all performance of physical accomplishment is 128% of the <strong>annual</strong><br />

target.<br />

Annual total budget for Personnel Services (PS) is sixteen million nine<br />

hundred twenty-nine thous<strong>and</strong> pesos (Php 16,929,000.00) which includes<br />

the RLIP, while the Maintenance <strong>and</strong> Other Operating Expenditures<br />

(MOOE) is four million five hundred forty-four thous<strong>and</strong> pesos (Php<br />

4,544,000.00). Total allotment for CY 2008 is twenty-one million four<br />

hundred seventy-three thous<strong>and</strong> pesos (Php 21,473,000.00).<br />

Actual fund utilized from January to December is <strong>10</strong>0% of the allotted<br />

<strong>annual</strong> budget for CY 2008.<br />

A. MINERAL LANDS ADMINISTRATION<br />

A.1 MINING INDUSTRY DEVELOPMENT PROGRAM<br />

1. Monitor/Audit of Approved Mining Contracts/Permits<br />

Target – Eighteen (18)<br />

A total of nineteen (19) approved mining rights <strong>and</strong> permit areas were<br />

monitored. Of the nineteen (19) permit areas, four (4) are Mineral<br />

Production <strong>and</strong> Sharing Agreements (MPSAs). Two of these MPSAs are<br />

that of Iligan Cement Corporation (ICC) (MPSA <strong>10</strong>4-98XII), <strong>and</strong><br />

Mindanao Portl<strong>and</strong> Cement Corporation (MPSA-031-95-XII) were<br />

monitored as to compliance of their approved work programs. ICC is<br />

operating the quarry/permit area of MPCC through an accredited<br />

contractor, ANSECA-ACELCO. The permit area of Mindanao Cement<br />

Corporation <strong>and</strong> Iligan Cement Corporation are located adjacent to each<br />

other in Kiwalan, Iligan City. The other two MPSAs monitored are MPSA-<br />

047-XII <strong>and</strong> MPSA-039-X, both of HOLCIM Philippines Manufacturing<br />

Corporation – Lugait Plant.<br />

Monitoring was also conducted on the following:<br />

For CY 2008, five (5) permit areas were monitored for AEPEP. These<br />

are Holcim Philippines Manufacturing Corporation (HPMC)-Lugait Plant,<br />

Iligan Cement Corporation (ICC), Mindanao Portl<strong>and</strong> Cement<br />

Corporation (MPCC), Maria Cristina Chemicals, Inc. (MCCI) operated by<br />

Platinum Group Metals Corporation (PGMC), <strong>and</strong> PGMC - Manticao.<br />

MESD accomplished <strong>10</strong>0% of its <strong>annual</strong> target.<br />

On the other h<strong>and</strong>, SDMP monitored five (5) areas, which are HPMC-<br />

Lugait Plant; ICC/MPCC; MCCI operated by PGMC; PGMC – Manticao;<br />

<strong>and</strong> Mingkaadlaw Resources Development (ISAG).<br />

SDMP accomplished <strong>10</strong>0% of its <strong>annual</strong> target.<br />

Social Development <strong>and</strong> Management Program (SDMP)<br />

The projects implemented through SDMP are being monitored quarterly.<br />

There were five (5) mining companies targeted for monitoring every<br />

quarter. These five (5) mining companies are the following: HPMC –<br />

Lugait Plant, ICC/MPCC, MCCI operated by PGMC, PGMC- Manticao,<br />

<strong>and</strong> Mingkaadlaw Resources Development Corporation-ISAG. Thus,<br />

SDMP accomplished <strong>10</strong>0% of its target.<br />

For CY 2008, we have evaluated five (5) ASDMP documents of the<br />

above mentioned companies. The programs/projects of each community<br />

are being identified by the different key stakeholders of the community.<br />

Each project component for livelihood, health education, infrastructure<br />

<strong>and</strong> environmental protection has a designated committee composing the<br />

Barangay-Based Technical Working (BBTWG) or Barangay Social<br />

Advisory Council (BSDAC). The Barangay Captain of each mining<br />

community served as the chair of the BBTWG/BSDAC. The BBTWG or<br />

BSDAC prioritized the identified projects <strong>and</strong> endorsed the same to the<br />

SDMP Committee for deliberation. The ASDMP document containing the<br />

prioritized projects <strong>and</strong> other information are then consolidated by the<br />

company <strong>and</strong> submitted to this Office for re-evaluation <strong>and</strong> approval.<br />

In the process of evaluation of the 5 – year <strong>and</strong> Annual SDMP<br />

documents, a third party composed of various stakeholders <strong>and</strong> partners<br />

in implementing the SDMP projects were created <strong>and</strong> operationalized.<br />

This executive body is named ComRel Committee for HPMC <strong>and</strong> SDMP<br />

Committee for the four (4) companies. It is part of the review committee<br />

to evaluate, deliberate, scrutinize <strong>and</strong> finally recommend for approval to<br />

MGB – <strong>10</strong> the SDMP document of the company.<br />

The SDMP Committee (ComRel or SDC) is composed of the MGB<br />

Regional Director as the Chair; City/Municipal Mayor; barangay captains<br />

of the respective mining communities who are the BBTWG/BSDAC<br />

chairs; representatives from different government-lined agencies such as<br />

DOH, TESDA, DA, CDLO, DepEd, DTI, DSWD, City/Municipal<br />

Engineering Office <strong>and</strong> CPDO/MPDO; the Plant Manager; ComRel<br />

Manager/CRO; CRO assistant; MGB Chief, IEC-SDMP <strong>and</strong> CAO.<br />

During the Annual Mine Safety Conference held in Baguio City on<br />

November 19-22, the SDMP Committees joined MGB – <strong>10</strong> as part of the<br />

continuing IEC campaign for our partners in the development of our<br />

mining community.<br />

HPMC – Lugait Plant:<br />

The 2008 Annual Social Development & Management Program (ASDMP)<br />

was prepared by the Barangay-Based Technical Working Group<br />

(BBTWG) composed of 5 barangays, had undergone the deliberation <strong>and</strong><br />

critiquing process by the COMREL Committee on January 29, 2008 <strong>and</strong><br />

was submitted to MGB-<strong>10</strong> on February 07, 2008 for final review,<br />

evaluation <strong>and</strong> approval.<br />

After complying the lacking requirements <strong>and</strong> minor revision by the<br />

company, the Annual SDMP Certificate of Approval was signed by OIC,<br />

RD Juanito A. Manzano, Jr. of MGB-<strong>10</strong> <strong>and</strong> conformed by Engr. Lorenzo<br />

D. Pendang, VP for Operations of Holcim Philippines Manufacturing<br />

Corporation- Lugait Plant on April 14, 2008 at Holcim Training Center,<br />

Sitio Mapalad, Iligan City.<br />

For the year, this office has conducted the four (4) quarterly monitorings,<br />

consultations <strong>and</strong> audits, both in the company <strong>and</strong> community level.<br />

The objectives of the quarterly activity are to monitor, gather charge<br />

invoice/official receipts, delivery receipts, evaluate/validate the project<br />

implementation status <strong>and</strong> settle issues <strong>and</strong> concerns affecting the<br />

The company implemented Bigasan Project in Brgy Bonbonon for Puroks<br />

2, 5 <strong>and</strong> 7. Six sacks of rice, 5 sacks corn <strong>and</strong> 3 weighing scales were<br />

turned-over to the three puroks/livelihood groups on November 26, 2008.<br />

Health:<br />

Major accomplishment of the company was the free medical <strong>and</strong> dental<br />

clinics <strong>and</strong> provision of medicines in the communities of Dalipuga,<br />

Acmac, Sta. Filomena, Bunawan <strong>and</strong> Bonbonon, all of Iligan City <strong>and</strong> in<br />

Paniangan, Misamis Oriental. The said activities were in coordination<br />

with the City Health office of Iligan City.<br />

Infrastructure:<br />

Water drilling project in Barangay Kiwalan as identified during trhe<br />

conduct of georesistivity survey is already <strong>10</strong>0% completed with a total<br />

cost of P1,445,670.08. It was already operational <strong>and</strong> was turned-over to<br />

the community on August 9, 2008.<br />

In Barangay Dalipuga, 60 lengths pvc pipes were turned-over for water<br />

system development in the community. Another infrastructure project<br />

was also implemented in Barangay Acmac, such as construction of<br />

drainage canal, provision of elecrtical materials for street lights <strong>and</strong><br />

fabrication of boxing ring.<br />

Generally, the company has implemented 72% of the total allocated<br />

projects for year 2008. A capability-building workshop for the Barangay<br />

Social Development Councils of the 7 host <strong>and</strong> neighboring mining<br />

communities was also conducted for three days at Naawan Beach Resort<br />

on October 28-31, 2008.<br />

MCCI – Operated by PGMC:<br />

This plant has a similar situation with its sister company but has<br />

additional concern on the environmental issues from their communities.<br />

The company made a very good accomplishment in the area of<br />

education <strong>and</strong> health, although to date their 5-year SDMP was not yet<br />

submitted for this Office evaluation <strong>and</strong> approval.<br />

The company was able to assist 18 TESDA scholars <strong>and</strong> sustain the<br />

needs of 27 High School <strong>and</strong> 91 elementary SDMP scholars. It has also<br />

conducted medical <strong>and</strong> dental mission as well as provided medicines to<br />

220 residents. A total of 18 2 nd <strong>and</strong> third degree malnourished children<br />

were rehabilitated through the Supplemental feeding Program.<br />

PGMC-Manticao:<br />

Despite of the sudden drop of the nickel price that caused the temporary<br />

shut down of the plant on the second semester of year 2008, the<br />

company was able to comply some of their important commitments for<br />

their communities. Moreover, the company was able to comply with the<br />

requirement of the 5-year SDMP, <strong>and</strong> such document was approved by<br />

this Office on September 2008.<br />

The company was able to sustain the needs of 5 college <strong>and</strong> 24 high<br />

school scholars. In April 16, 2008, 81 out-of –school youths were able to<br />

graduate from the TESDA-assisted training course on welding in<br />

coordination with the LGU of Manticao.<br />

The company spent a total of Php 168,399.00 for SDMP comprising only<br />

<strong>10</strong>% of the committed <strong>and</strong> approved amount for the year. In terms of IEC<br />

<strong>and</strong> community consultations, the company was able to accomplished<br />

73% of their target.<br />

MRD:<br />

MRD is an ISAG with permits issued by the MGB, <strong>and</strong> is located in<br />

Barangay Odiongan, Gingoog City. Its Annual SDMP was evaluated <strong>and</strong><br />

approved by this Office in July 2008. The operation is still in an “on <strong>and</strong><br />

off status” due to financial concern <strong>and</strong> limited dem<strong>and</strong> of aggregates in<br />

the area. However, it has complied religiously with the requirement of<br />

submitting its ASDMP, but compliance is below par. For the year, MRD<br />

had released Php 15,000.00 for the medicine <strong>and</strong> vitamin provision<br />

project for the host barangay.<br />

1. Treasure Hunting at Indahag<br />

The concerned Barangay Officials of Indahag, Cagayan de Oro<br />

requested this Office to conduct an investigation on the illegal treasure<br />

hunting activity of a local resident named Mr. Vidal Valledor inside his<br />

own house. The officials were very apprehensive that this activity will<br />

affect ground stability of adjacent houses. The MGB-<strong>10</strong> investigating<br />

team found out that Mr. Valledor had already stopped his treasure<br />

hunting activity prior to the investigation. However, they requested the<br />

Brgy. Officials to monitor the area <strong>and</strong> report to MGB-<strong>10</strong> when Mr.<br />

Valledor resumes his operation.<br />

2. CEKAS<br />

A boundary survey between the respective mining tenements of<br />

Evergrow Mining Corporation <strong>and</strong> CEKAS Development Corporation was<br />

conducted upon request by Evergrow when it was claiming that the SSM<br />

operation of CEKAS is within the tenement of Evergrow. The survey<br />

showed that the SSM area is within CEKAS’s tenement.<br />

3. Wolfl<strong>and</strong> Mining Corporation<br />

Workings of Eddie Talaroc were found within the Exploration Permit<br />

Application(EPA) of Wolfl<strong>and</strong> Resources, Inc.(WRI) The coordinates of<br />

his SSMP was also inside the EPA area of WRI.<br />

4. Valdehueza et. al.<br />

The boundary survey of the Valdehueza, et.al. SAG Permit area was<br />

conducted in the vicinity of Langaran River, Calamba, Misamis<br />

Occidental. The parties involved do not allow any right of way to each<br />

other, thus a stale mate operation of SAG. This was reported to the<br />

MGB-Regional Office-<strong>10</strong> for possible settlement, but was not settled as<br />

one permittee did not agree on the delineation of area boundaries as per<br />

result of MGB-<strong>10</strong> survey, thus this issue was reverted to the Governor’s<br />

Office for resolution.<br />

5. CEKAS<br />

The company was found to use explosives <strong>and</strong> sophisticated equipment<br />

in their small-scale mining operation <strong>and</strong> was advised to stop such<br />

practice as it is in violation of the provisions of the small-scale mining law.<br />

6. Illegal Mining Activities of a certain British National<br />

The alleged complaint has no basis <strong>and</strong> all permittees mentioned on the<br />

report were operating in accordance with the existing terms <strong>and</strong><br />

conditions of their approved Small Scale Mining permit <strong>and</strong> there was no<br />

British National illegally operating in Maluko, Manolo Fortich, Bukidnon.<br />

7. Cancellation of Treasure Hunting Permit<br />

The site is actually situated within the PHIVIDEC Industrial Estate, but<br />

there was no treasure hunting activity observed. The Permit Holder<br />

failed to submit a quarterly activity report. The Office cancelled the THP-<br />

2007-0001-X effective July 25, 2008.<br />

8. Datu Malitbog<br />

The small-scale chromite mining operation has no permit issued by the<br />

LGU-Bukidnon in San Luis, Bukidnon <strong>and</strong> that local officials concerned<br />

should stop the illegal small-scale mining operation.<br />

9. Treasure Hunting<br />

There is no activity within the area of complaint. The area must be<br />

closely monitored by the agencies concerned in Brgy. Bangcud,<br />

Malaybalay City, Province of Bukidnon.<br />

<strong>10</strong>. Datu Guilang-Guilang<br />

The Exploration Permit Application of Verdant Vale Mining Company has<br />

not yet been approved. It is recommended that the exploration activities<br />

be stopped by concerned agencies in Brgy. Guilang-Guilang, Manolo<br />

Fortich, Bukidnon.<br />

11. Elenita Casas (SSMP)<br />

The Permit Holder should implement an appropriate Environmental<br />

Management Plan in order to mitigate the environmental degradation<br />

brought about by the mining operation. There is no activity in the area<br />

during the investigation in Brgy. Tuod, Manticao, Misamis Oriental.<br />

NGO, Indigenous People <strong>and</strong> different DENR Sectoral representatives.<br />

The forum was also attended by MGB-<strong>10</strong> OIC Regional Director Juanito<br />

A. Manzano, Jr., Mine Management Division Chief, Engr. Rodante B.<br />

Felina, Mining Environment <strong>and</strong> Safety Division Chief, Engr. Paul C.<br />

Simplified Community Assessment (SCA)<br />

The conduct of SCA is in adherence to the provision of Sec. 4 of RA No.<br />

7076, otherwise known as an “Act creating a peoples Small-Scale Mining<br />

Program <strong>and</strong> for other Purposes” <strong>and</strong> Sec. 134, Chapter XIV of the<br />

DENR Administrative Order 96-40. It is a way of determining the existing<br />

socio-economic, political <strong>and</strong> environmental conditions of the subject<br />

community. The data generated will guide MGB-<strong>10</strong> to come up with an<br />

informed decision.<br />

For the year 2008, two (2) SCA’s were conducted in two different areas in<br />

the region. One, in the Municipality of Opol <strong>cover</strong>ing three barangays,<br />

namely : Barangays Limonda, Cauyonan <strong>and</strong> Nangcaon, while the other<br />

one, was in Barangay Digkilaan , Iligan City. The SCA’s were conducted<br />

in compliance with MC 2007-07 of two small-scale mining companies,<br />

CEED Mining <strong>and</strong> Exploration Inc. <strong>and</strong> Ms Elaine Bartolome small-scale<br />

mining project, all for copper ore extractions.<br />

Mining Forest Program<br />

The assessment of the Mining Forest Program of the two (2) mining<br />

companies of Holcim Philippines Manufacturing Corporation (HPMC) -<br />

Lugait Plant, Misamis Oriental <strong>and</strong> the unified Iligan Cement Corporation<br />

<strong>and</strong> Mindanao Portl<strong>and</strong> Cement Corporation situated at Brgy. Kiwalan,<br />

Iligan City, made up <strong>10</strong>0% accomplishment based on the <strong>annual</strong> 2008<br />

target.<br />

This year, HPMC has newly planted 32,402 seedlings <strong>cover</strong>ing 29<br />

hectares through the Community-Based Reforestation Program <strong>and</strong> is<br />

maintaining an aggregate area of 1<strong>10</strong> hectares with various endemic,<br />

exotic trees, ornamental plants <strong>and</strong> fruit bearing trees. The survival rate<br />

of the newly planted trees is 98.43 percent compared to ICC/MPCC<br />

which is less than 50% due to irregular maintenance.<br />

ICC/MPCC had recently planted 340 seedlings <strong>and</strong> replaced the dead<br />

spots with 580 seedlings. They have a total seedling stocks of 2,682 of<br />

Mahogany, Jackfruit, Narra, Molave <strong>and</strong> Sibukaw species.<br />

HPMC - Lugait Plant on the other h<strong>and</strong>, have ample remaining seedlings<br />

stocks in their nursery, after planting 15,895 of both endemic <strong>and</strong> exotic<br />

species.<br />

A.4 COMMUNICATION PLAN FOR MINERALS DEVELOPMENT<br />

1. Conduct Awareness <strong>and</strong> Advocacy on Mineral Resources <strong>and</strong><br />

<strong>Geosciences</strong> (MRGS)<br />

The <strong>annual</strong> regular target for the IEC was <strong>10</strong>0% accomplished, with<br />

numerous intervening as the year 2008 being declared by the Hon. Sec.<br />

Joselito L. Atienza as the IEC year. Highlights of the accomplishments<br />

are interpersonal IEC with tribal communities in small scale mining areas<br />

<strong>and</strong> LGUs on the three (3) pillars of responsible mining, the clarificatory<br />

guidelines on small scale mining <strong>and</strong> process flow in acquiring the Ore<br />

Transport Permit (OTP).<br />

Stakeholder’s Forum<br />

Target – Four (4)<br />

MGB-<strong>10</strong> with its objective of educating, informing <strong>and</strong> consulting the<br />

tribal communities <strong>and</strong> barangay LGU’s of Opol, Misamis Oriental has<br />

conducted stakeholders forum at the Local Training Institute in Taboc,<br />

Opol last June 23, 2008.<br />

The said forum was attended by the Municipal Mayor of Opol, the<br />

Honorable Dixon Yasay, Opol LGU staff, different tribal communities<br />

along with their chieftains <strong>and</strong> barangay officials.<br />

The stakeholders’ forum started with a brief lecture on the provision of<br />

EO. 270, Responsible Mining Practices for Sustainable Development <strong>and</strong><br />

Clarificatory Guidelines on Small Scale Mining. After the lectures was an<br />

open forum wherein the different tribal datus/communities poured-in their<br />

concerns, query on SSMP provisions specifically those governing the<br />

rights of Indigenous People. OIC-Regional Director Juanito A. Manzano,<br />

Jr. took the floor in addressing the issues <strong>and</strong> concerns raised during the<br />

said open forum.<br />

Another stakeholders’ forum for concerned tribal leaders was conducted<br />

in Barangay Limonda, Opol, Misamis Oriental in May 22, 2008. In<br />

attendance were tribal leaders, representatives from Barangay Councils<br />

of both Barangays Mahayahay in Manticao <strong>and</strong> Limonda, Opol,<br />

representative from the mining sectors <strong>and</strong> ECOWEB, an NGO for the<br />

Indigenous People from Iligan City.<br />

Prior the forum, lectures on the pillars of responsible mining (Economic<br />

Promotion, Environmental Protection, Social Equity), important provisions<br />

of the small scale mining with emphasis on undertakings not allowed by<br />

law, i.e. the use of heavy equipment, blasting, use of mercury, hydraulic<br />

mining method <strong>and</strong> unsafe practices in underground mining were<br />

conducted in the local dialect. An open forum was conducted after the<br />

lectures <strong>and</strong> concerns on the safety of workers, use of heavy equipment,<br />

road damage <strong>and</strong> illegal mining operations among others were raised<br />

<strong>and</strong> properly addressed during the open forum.<br />

Tarpaulins on responsible mining were exhibited/displayed in the venue<br />

for viewing of forum participants.<br />

The said activities accomplish 125% of the <strong>annual</strong> target.<br />

Groups Participated:<br />

MGB-<strong>10</strong> attended a Focus Group Discussion thru an invitation letter from<br />

the Environmental Science for Social Change (ESSC) a non-government<br />

entity based in Malaybalay City. The forum was attended by church<br />

group representatives, academe, LGU officials, DENR-<strong>10</strong> Malaybalay<br />

<strong>and</strong> indigenous peoples group. The said forum was anchored on the<br />

theme “Securing the Ecological Services of Bukidnon” which was held<br />

at the Pines Hotel, Malaybalay City in May 7, 2008.<br />

Prior to the above mentioned activity, in January 28, 2008, another focus<br />

group discussion (FGD) was held at the St. Michaels College Mini Hotel<br />

in Iligan City. MGB-<strong>10</strong> attended the said forum along with a total of thirty<br />

five (35) key persons from the concerned barangays of Buruun <strong>and</strong><br />

Kiwalan, Iligan City, Department of Trade <strong>and</strong> Industry <strong>and</strong> other<br />

government sector. The said activity was conducted in relation to the<br />

Social Impact assessment of the 5-year SDMP implementation of Maria<br />

Cristina Chemical Incorporated <strong>and</strong> initial planning for the next 5-year<br />

SDMP.<br />

Radio/TV Guestings<br />

Target – Twelve (12)<br />

There were five (5) radio guestings conducted by MGB-<strong>10</strong> personnel thru<br />

invitations from Moms Radio over ‘Mother Nature“ <strong>and</strong> “Moms Haven”<br />

Radio programs. The said programs are environment related that<br />

focuses mainly on environmental protection. There were several radio<br />

plugging <strong>and</strong> live interviews by radio station DXCO. Another radio<br />

guesting was during the “Katilingbanong Kinaiyahan” program hosted by<br />

RPAO – DENR -<strong>10</strong> which was aired at DXIM, Radyo ng Bayan.<br />

In response to the need for the conduct of Information, Education <strong>and</strong><br />

Communication (IEC) campaign relative to the potential geohazard within<br />

the Region, lectures were conducted to different cities <strong>and</strong> municipalities.<br />

The MGB – <strong>10</strong> in partnership with the Regional <strong>and</strong> City Disaster<br />

Coordinating Councils (RDCC/CDCCs) conducted lectures in three (3)<br />

different cities to complement the geohazard mapping in the assessed<br />

areas relative to the findings <strong>and</strong> results of the geohazard survey. These<br />

cities include Cagayan de Oro in Misamis Oriental, Valencia in Bukidnon,<br />

<strong>and</strong> Oroquieta in Misamis Occidental.<br />

The lecture <strong>and</strong> presentation of results were conducted during the joint<br />

RDCC/CDCC meeting in Cagayan de Oro City <strong>and</strong> Oroquieta City on<br />

February 15 <strong>and</strong> June 27, 2008 respectively. In Valencia City, it was<br />

presented during the Disaster Management Seminar-Workshop on June<br />

4, 2008. The activities were attended by the different barangay councils<br />

<strong>and</strong> city councils as well as other representatives from different<br />

government agencies such as DSWD, Philvocs, PAGASA, DOH, Red<br />

Cross, <strong>and</strong> other respective agencies.<br />

The lecture series aimed to disseminate information regarding<br />

geohazards, safety measures <strong>and</strong> results of the assessment of the areas<br />

by the MGB not only to the city level but also to the barangay level which<br />

is the main unit of the Local Government in times of disaster. Posters<br />

<strong>and</strong> other IEC paraphernalia such as leaflets <strong>and</strong> CDs were also<br />

distributed during the activities.<br />

Assessment of Solid Waste Disposal Sites<br />

L<strong>and</strong>fill Site Suitability Assessment was conducted in six (6) sites: four<br />

(4) in Maramag, Bukidnon <strong>and</strong> two (2) in Sultan Naga Dimaporo, Lanao<br />

del Norte.<br />

The proposed sites in Maramag, Bukidnon are located in (1) Purok 4, <strong>and</strong><br />

(2) Purok 6 of Brgy. Panadtalan; (3) Brgy. San Roque; <strong>and</strong> (4) So.<br />

Sabacan, Brgy. Panadtalan. Of the four sites assessed, two were<br />

identified suitable as a l<strong>and</strong>fill site. These are Purok 6 <strong>and</strong> So. Sabacan,<br />

both of Brgy. Panadtalan. However, there were certain circumstances<br />

that the property in Purok 6 could not be acquired by the local<br />

government of Maramag which leaves only So. Sabacan as the<br />

alternative site.<br />

In Sultan Naga Dimaporo, Lanao del Norte, the proposed sites are<br />

located in (1) So. Palomaria, Brgy. Poblacion <strong>and</strong> (2) Bgry. Sugod. Both<br />

sites were deemed unsuitable as solid waste disposal site.<br />

For CY 2008, the <strong>Geosciences</strong> Division has conducted mineral resources<br />

assessments on the northern extension of Pantaron Mountain Range<br />

located in San Fern<strong>and</strong>o, Bukidnon along the provincial boundary<br />

between Davao. This activity was undertaken under the on-going<br />

mineral reservation project which has <strong>cover</strong>ed 2,773 hectares <strong>and</strong><br />

focuses on evaluation of nickeliferous laterite development in the area.<br />

The year 2008 saw the active participation of MGB-<strong>10</strong> in two GAD congresses.<br />

The first was the GAD Congress on “DENR GADaptation to Climate Change”,<br />

held in Clark, Pampanga on November 19-21, 2008. The congress came up<br />

with the DENR-GAD Action Plan on Climate Change per sector, with an action<br />

plan on Geohazard activity <strong>and</strong> IEC campaign, for the mines/geohazards sector.<br />

Part of the congress was the Business Meeting wherein items discussed<br />

included the 2008 GAD accomplishments <strong>and</strong> issues <strong>and</strong> concerns. Another<br />

congress attended was the 5 th National MGB GAD Conference held in San<br />

Mateo, Rizal on November 25-28, 2008. The conference identified Geohazard<br />

mapping <strong>and</strong> assessment, IEC on Geohazards <strong>and</strong> Disaster<br />

Preparedness/Climate Change, <strong>and</strong> the SDMP, as MGB projects/activities to be<br />

mainstreamed. GAD issues <strong>and</strong> concerns <strong>and</strong> proposed<br />

solutions/recommendations were also discussed.<br />

As part of the government’s Disaster Preparedness Program <strong>and</strong> as an active<br />

member of the Regional Disaster Coordinating Council-<strong>10</strong>, training-workshops<br />

were conducted: 1) Disaster preparedness operation training <strong>and</strong> information<br />

campaign to commissioned <strong>and</strong> non-commissioned female <strong>and</strong> male police<br />

officers of the Police Regional Office-<strong>10</strong>; 2) Disaster management trainingworkshop<br />

to female <strong>and</strong> male barangay officials of the municipalities of<br />

Cabanglasan <strong>and</strong> Damulog, both in the province of Bukidnon.<br />

Gender-related seminars were attended. One was the Gender Sensitivity<br />

Seminar conducted by the Civil Service Commission-<strong>10</strong>, <strong>and</strong> another on, Anti-<br />

Human Trafficking in Persons Act of 2004 (RA 9208), sponsored by the Gender<br />

Advocates & Women in Government Service in Region <strong>10</strong> (GA-WINGS-<strong>10</strong>).<br />

The women <strong>and</strong> men of MGB-<strong>10</strong> were commended by DENR-<strong>10</strong> RTD for<br />

Forestry Dr. Corazon B. Galinato for exemplary performance for their work at<br />

the Regional Green Philippines Program (GPP) site in Upper Kidulum, Malasag,<br />

Barangay Cugman, Cagayan de Oro City.<br />

MANAGEMENT<br />

RMDC – <strong>10</strong> Established<br />

The establishment <strong>and</strong> first organizational meeting of the Regional<br />

Minerals Development Council (RMDC) – <strong>10</strong> was held on May 6, 2008 at<br />

the Gr<strong>and</strong> Caprice, Limketkai Mall, Cagayan de Oro City. This was<br />

attended by representatives from various National Government Agencies,<br />

Local Government Unit, large <strong>and</strong> small scale mining companies, tri-media<br />

in Region – <strong>10</strong>, <strong>and</strong> the Minerals Development Council (MDC) represented<br />

by Mr. Christopher B<strong>and</strong>ojo, MDC Executive Assistant with MGB - Central<br />

Office, Ms. Rose Imperial, Information Officer. This special occasion <strong>and</strong><br />

milestone of convergence for the management of the mineral resources in<br />

the region was participated by 130 key persons from different sectors.<br />

The one-day affair was highlighted by the presence of two (2) governors,<br />

the Honorable Governor of Misamis Occidental <strong>and</strong> at the same time the<br />

President of the League of Provinces of the Philippines (LPP), Hon. Loreto<br />

Leo S. Ocampos who delivered the Keynote Address, <strong>and</strong> the Honorable<br />

Governor of Misamis Oriental, Honorable Oscar S. Moreno who gave an<br />

inspiring message. Hon. Gov. Ocampos emphasized the region’s need for<br />

a framework in mining that is environment friendly, promotes equal<br />

distribution of wealth <strong>and</strong> investor-friendly, while Hon. Gov. Moreno<br />

stressed teamwork, which according to him is the key to transparencies<br />

<strong>and</strong> growth.<br />

Regional Executive Director of DENR – <strong>10</strong>, Maximo O. Dichoso welcomed<br />

the participants <strong>and</strong> pointed out the objectives of the meeting which<br />

includes identifying issues <strong>and</strong> concerns regarding small scale mining;<br />

identify functions <strong>and</strong> authorities of the RMDC on the implementation of<br />

responsible mining <strong>and</strong> to come up with a formulation of matrix fro<br />

endorsement to the different sectors involved.<br />

The organizational meeting was presided by MGB – <strong>10</strong> OIC, Regional<br />

Director, Juanito A. Manzano, Jr. The agenda include: designation of<br />

committee <strong>and</strong> members <strong>and</strong> schedule of meetings.<br />

MGB-<strong>10</strong> Women in Government Service ( MGB-<strong>10</strong>, WINGS)<br />

In line with the current thrust of this Office in particular, <strong>and</strong> of the agency<br />

in general, to empower women employees to play a major role in the<br />

conduct of IEC on responsible mining, MGB-<strong>10</strong>, WINGS had accomplished<br />

successfully its lined-up activities for the year.<br />

2008 is a very significant year for the MGB-<strong>10</strong>, WINGS having made<br />

major contributions in communicating responsible mining through the<br />

conduct of two very successful region-wide fora for LGU’s, small-scale <strong>and</strong><br />

large-scale miners, mineral traders, tribal communities <strong>and</strong> media. The<br />

first forum entitled “Environmental Management <strong>and</strong> Social Responsibility<br />

of Small-Scale Mining “ was conducted on July 30,2008 at Gr<strong>and</strong> Caprice,<br />

Limketkai Complex, Cagayan de Oro City. The second forum entitled<br />

“NCIP Regulatory Requirements <strong>and</strong> Processes in Securing the Free <strong>and</strong><br />

Prior Informed Consent (FPIC) for mining projects was conducted at<br />

Country Village Hotel, Carmen, Cagayan de Oro City was conducted on<br />

October 3, 2008.<br />

The aforementioned fora were attended by hundred participants from<br />

various stakeholders all over the region. The fora were highlighted by the<br />

presence of Governor Oscar Moreno of Misamis Oriental who delivered a<br />

very inspiring Keynote Speech.<br />

The MGB-<strong>10</strong>, WINGS was also very successful in attaining its goal to bring<br />

21 members to Baguio City for an Educational Tour at Benguet Mining<br />

Corporation, <strong>and</strong> join some activities of the PMSEA on November 19-22,<br />

2008. The ladies were able to listen to a brief lecture on the history of the<br />

company, the biggest gold-producing mining operation in the country that<br />

started in the early 30’s. They were also able to experienced life of the<br />

former miners in the underground <strong>and</strong> witnessed underground blasting<br />

through simulation. To top it all, the ladies have seen the positive<br />

contribution of mining in transforming Baguio into what it is now today-a<br />

bustling city.<br />

The year ended with another major activity, the gift-giving, dubbed as “The<br />

Bundle of Joy”, for the less fortunate brothers <strong>and</strong> sisters in the small-scale<br />

mining communities at Barangay Awang, Opol, Misamis Oriental. A total of<br />

<strong>10</strong>0 families <strong>and</strong> 70 children were benefited from the project. The ladies<br />

distributed rice, groceries, used clothings, slippers <strong>and</strong> toys. The barangay<br />

council of Awang joined the MGB-<strong>10</strong> ladies <strong>and</strong> the OIC, Regional<br />

Director, Juanito A. Manzano, Jr in distributing the goodies.<br />

MINE MANAGEMENT DIVISION<br />

Apprehension/Seizure of Illegally Transported Ores<br />

Since July 2008, the Office was able to apprehend <strong>and</strong> seize illegally<br />

transported ores due to lack of proper documents, some of which have<br />

fake OTP with forged signature of the OIC, Regional Director or the<br />

concerned Provincial Governors.<br />

July 11, 2008<br />

Eighty-seven (87) MT of Chromite Ore subject of an official seizure<br />

operation at the warehouse owned <strong>and</strong> operated by Mr. Venusto T. Ladeza<br />

at Opol, Misamis Oriental.<br />

On July 11, 2008 at Barangay Baybayon, Opol, Misamis Oriental, MGB <strong>10</strong><br />

personnel <strong>and</strong> OPOL PNP personnel seized approximately eighty seven<br />

(87) Metric Tons of illegally-sourced chromite ore inside a warehouse from<br />

the possession of Mr. Venusto T. Ladeza. The seizure was made under an<br />

official operation immediately after an information was received by this<br />

Office that truck loads of chromite were being transported to the pier site.<br />

During the seizure, the owner of the chromite stock presented to the<br />

apprehending personnel a fake OTP with forged signature of OIC,<br />

Regional Director Juanito A. Manzano, Jr. This situation prompted the<br />

apprehending team to effect the seizure. The Opol PNP took custody of<br />

the whole warehouse.<br />

The chromite ore stock was finally released after the owner presented to<br />

this Office some OTP’s issued by LGU-Misamis Oriental showing that the<br />

ore was not illegally-sourced minerals.<br />

July 16, 2008<br />

bodega in Patag, Opol, Misamis Oriental.<br />

On July 16, 2008, the Opol PNP Station turned-over approximately <strong>10</strong>.0<br />

MT of illegally-transported copper ore to MGB Region <strong>10</strong> personnel. The<br />

copper ore was seized by the PNP when the owner in the person of Ms.<br />

Lea Chua Mantilla failed to present an Ore Transport Permit (OTP) to the<br />

apprehending personnel. During the turn-over Ms. Lea Chua Mantilla<br />

presented to MGB <strong>10</strong> <strong>and</strong> ENRO-Misamis Oriental an OTP <strong>and</strong><br />

Certiifcation issued by MGB <strong>10</strong>. These two (2) documents were turned out<br />

to be “FAKE” as the respective signatures of Director Juanito A. Manzano,<br />

Jr. were also forged.<br />

The subject copper ore stock is still under the custody of DENR-<strong>10</strong> to this<br />

day, which was turned over by MGB-<strong>10</strong> for safekeeping.<br />

September 11, 2008<br />

Apprehension of one truckload of illegally transported chromite ore at<br />

Barangay Cugman, Cagayan de Oro City<br />

A joint team of personnel from MGB-<strong>10</strong>, PENRO-Misamis Oriental, <strong>and</strong><br />

Cagayan PNP Police Station No. 5 apprehended a ten-wheeler cargo truck<br />

loaded with illegally-sourced chromite ore without Ore Transport Permit on<br />

September 11, 2008 along the national highway at Barangay Cugman,<br />

Cagayan de Oro City. The subject cargo truck was immediately brought to<br />

DENR <strong>10</strong> compound for safekeeping <strong>and</strong> further appropriate action. The<br />

chromite ore stock was subsequently assessed as to its kind <strong>and</strong> value,<br />

<strong>and</strong> a corresponding Seizure Receipt was issued to the alleged owner in<br />

the person of Mr. Manuel Bartolome who arrived at the Regional Office<br />

minutes later. The owner tried to retrieve his truck by presenting an Ore<br />

Transport Permit issued by LGU-Bukidnon, but to no avail because said<br />

OTP was verified as FAKE OTP.<br />

As to date, the subject chromite ore stock is still under the custody of MGB<br />

<strong>10</strong> that was turned over to DENR-<strong>10</strong> for safekeeping.<br />

SOCIAL DEVELOPMENT & MANAGEMENT PROGRAM UNIT<br />

Capability Building for Mining Stakeholders<br />

There were two (2) capability building workshops conducted for the first<br />

half of CY 2008. The first was the Social Development <strong>and</strong> Management<br />

Program (SDMP) Seminar, Planning Workshop <strong>and</strong> Barangay Social<br />

Development Advisory Council (BSDAC) creation conducted at Midway<br />

Beach Resort, Initao, Misamis Oriental in January <strong>10</strong>-11, 2008 for the<br />

Platinum Group Metals Corporation stakeholders.<br />

Another forum was conducted in January 15, 2008 at Gazpachos<br />

Restaurant in Iligan City for three hundred sixty-three (63) participants<br />

representing key persons of the seven identified Barangays of the unified<br />

Social Development <strong>and</strong> Management Program of Iligan Cement<br />

Corporation <strong>and</strong> Mindanao Portl<strong>and</strong> Cement Corporation namely, Brgys.<br />

Kiwalan, Bonbonon, Bunawan, Acmac, Dalipuga, Sta. Filomena <strong>and</strong><br />

Paniangan. The forum was conducted to assess the implemented SDMP<br />

projects for the past five (5) years <strong>and</strong> conducted initial planning for the<br />

next five year SDMP.<br />

In January 28, 2008, a forum was held at the St. Michaels College Mini<br />

Hotel in Iligan City. MGB – <strong>10</strong> attended the said forum along with a total of<br />

thirty-five (35) key persons from the concerned barangays of Buru-un <strong>and</strong><br />

Kiwalan, Iligan City, Department of Trade <strong>and</strong> Industry (DTI) <strong>and</strong> other<br />

government sector. The said activity was conducted in relation to the<br />

Social Impact Assessment of the 5-year SDMP implementation of Ma.<br />

Cristina Chemicals Inc. <strong>and</strong> initial planning for the next 5-year SDMP.<br />

Community Development <strong>and</strong> Management Program (CDMP)<br />

In July 5, 2007, Memor<strong>and</strong>um Circular No. 2007-07 was issued, m<strong>and</strong>ating<br />

all Small-Scale Mining Permit holders to implement the Community<br />

Development <strong>and</strong> Management Program (CDMP) for the host <strong>and</strong><br />

neighboring mining communities.<br />

MC-2007-07 through the implementation of CDMP requires SSMP Permit<br />

Holders to exercise their social responsibilities in their identified mining<br />

communities within the approved duration of their mining permit. CDMP is<br />

equivalent to the SDMP requirement for large-scale mining contractors.<br />

MGB Regional Office No.<strong>10</strong> approved the first CDMP on November 28,<br />

2008 for CEED Mining <strong>and</strong> Exploration Inc. The company was applying for<br />

a small-scale mining permit for the copper ore extraction in Sitio Nasuli,<br />

Barangay Limonda, Opol, Misamis Oriental. The CDMP fund allocations<br />

for social development projects of the three host <strong>and</strong> neighboring mining<br />

sitios for two years is Php 240,000.00. The CDMP will start on the first<br />

quarter of 2009, to include establishment of Cooperative Store, educational<br />

assistance for elementary <strong>and</strong> high school students, <strong>annual</strong> medical<br />

mission <strong>and</strong> medicine provisions.<br />

INFORMATION, EDUCATION & COMMUNICATION UNIT<br />

Earth Day People’s Caravan<br />

In April 14, 2008, MGB-<strong>10</strong> along with DENR-<strong>10</strong> <strong>and</strong> the Environmental<br />

Management <strong>Bureau</strong> participated with DENR-MGB Regional Offices like 9,<br />

11, 12 <strong>and</strong> 13 constituting the entire Mindanao caravan contingents with<br />

the objective of proclaiming our call of action in working together for the<br />

protection of the environment. In region <strong>10</strong>, the launching of the 5- day<br />

Caravan was held in the isl<strong>and</strong> of Camiguin after which the group<br />

proceeded to the Provinces of Bukidnon, Misamis Oriental, Misamis<br />

Occidental <strong>and</strong> Lanao Del Norte. Exhibits on the programs <strong>and</strong> services of<br />

the different DENR sectors were displayed <strong>and</strong> Signing of Earth Day<br />

covenant between the DENR <strong>and</strong> representatives from the local<br />

government units were done in every stop-over in the identified<br />

municipalities of each province, likewise, different information materials like<br />

leaflets, tarpaulins, brochures <strong>and</strong> booklets were distributed.<br />

In April 17, 2008 the entire contingents converged at the DENR-<strong>10</strong><br />

compound for a welcome program <strong>and</strong> a salo-salo. In the following Day,<br />

April 18, 2008 was the day for the culminating activity wherein all<br />

participating contingents assembled at the DENR <strong>10</strong> Regional Office for a<br />

motorcade <strong>and</strong> for the official closing ceremonies. Highlight of the<br />

culminating activities was the signing of the Earth Day Covenant with the<br />

National <strong>and</strong> Local Executives, other government agencies, NGOs, private<br />

<strong>and</strong> business sector, religious group, academe <strong>and</strong> civil society with the<br />

presence of Hon. Congressman Rufus Rodrigues, Misamis Oriental<br />

Governor Hon. Oscar S. Moreno <strong>and</strong> DENR Undersecretary for Special<br />

Concerns, Teresita S. Castillo.<br />

Different booth exhibits showcasing display of the different DENR Regional<br />

Offices also marked the culminating activity along with the different<br />

entertainment numbers presented by each of the participating contingents.<br />

Educational Plant Tour-“Dalaw Aral sa Minahan”<br />

In line with the thrust of the Hon. DENR Secretary Jose L. Atienza, Jr. to<br />

enhance <strong>and</strong> intensify the agency’s IEC strategies <strong>and</strong> advocacies <strong>and</strong> to<br />

promote responsible small-scale <strong>and</strong> large –scale mining operations in the<br />

region provided under E.O. 270, MGB-<strong>10</strong> conducted an educational plant<br />

tour dubbed “Dalaw Aral sa Minahan” at the Holcim Philippines<br />

Manufacturing Corporation plant <strong>and</strong> quarry in the Municipality of Lugait,<br />

Misamis Oriental in June 25, 2008 which is also one of the highlights of the<br />

Environment Month Celebration.<br />

The plant tour was in cooperation with the three mining companies i.e.<br />

HPMC, Orex Mindanao <strong>and</strong> Mindanao Gold Resource Corporation. This<br />

was attended by forty five (45) participants representing three local<br />

government units of Bukidnon such as the Sangguniang Bayan members,<br />

Municipal Mayor of Kitaotao <strong>and</strong> the Municipal Board members of the<br />

Municipality of Impasugong. The one day activity include a visit to the<br />

Butterfly lepiary inside the company site, forest nursery, herbal garden,<br />

quarry site, reforested areas (mined-out areas) wherein participants did the<br />

ceremonial tree planting, relocation site <strong>and</strong> at Brgy. Lower Talacogon <strong>and</strong><br />

Brgy. Poblacion display centers showcasing social development <strong>and</strong><br />

management program products like calamansi juice, t-shirts, artificial<br />

flowers, scented c<strong>and</strong>les <strong>and</strong> slippers among others. In every site visited,<br />

a brief lecture was conducted to orient the participants.<br />

Exhibits Displayed/Conducted<br />

MGB-<strong>10</strong> participated in the Sentro K3 (Kaisahan, Kalikasan at Kalayaan<br />

ng Bayan Exhibit sponsored by the Department of Tourism-Regional Office<br />

No. <strong>10</strong> held on June <strong>10</strong>-12, 2008 at the Activity Center of SM Department<br />

Store. The said exhibit was in celebration of the Philippine Independence<br />

Day Commemoration.<br />

In the same month, another exhibit was also conducted by MGB-<strong>10</strong> at the<br />

Misamis Oriental Provincial Capitol Compound hosted by the Provincial<br />

Government of Misamis Oriental.<br />

In June 17, 2008 another exhibit was conducted at the DENR -<strong>10</strong><br />

compound along with the different sectors as one of the highlights of the<br />

2008 Environment Month celebration. The display lasted until the<br />

culminating activity of the Celebration.<br />

Apart from the different exhibits mentioned above, MGB-<strong>10</strong> also conducted<br />

exhibits in the different provinces during the conduct of the Earth Day<br />

Caravan in April.<br />

All these exhibits were centered on the display of tarpaulins depicting<br />

Responsible Mining, display of the different kinds of gemstones, mineral<br />

<strong>and</strong> rock samples. Various information materials like fliers leaflets<br />

brochures <strong>and</strong> booklets were also distributed.<br />

INSTALLATION OF TWO BILLBOARDS<br />

Two (2) billboards on Responsible mining were installed in Iligan City near<br />

the ICC/MPCC compound.<br />

GEOLOGY DIVISION<br />

Emergency Geohazard Assessment<br />

The Division dispatches technical teams to areas affected by geologic<br />

hazards (e.g. flooding, l<strong>and</strong>slide, etc.) to conduct investigation <strong>and</strong> analysis<br />

on geohazard events. Results of the assessment are presented to the<br />

concerned agencies/LGUs along with recommendations to mitigate the<br />

geohazard or prevent its reoccurrence if possible. For this semester,<br />

technical teams have responded to four (4) geohazard events. These are<br />

the (1) l<strong>and</strong>slide <strong>and</strong> flooding events in Salvador, Lanao del Norte, (2)<br />

reported cracks in Brgy. Vintar, Valencia City, Bukidnon, (3) mass<br />

movement affected areas in Brgy. Magsaysay, Kibawe, Bukidnon <strong>and</strong> (4)<br />

flash flooding incidents in portions of Cagayan de Oro City.<br />

Geohazard Identification Report (GIR)<br />

A total of seven (7) subdivisions <strong>and</strong> housing project sites were assessed.<br />

These are (1) Villemer Subdivision in Brgy. Biga, Lugait, Mis. Or., (2)<br />

Virgilia Homes Subdivision in Brgy. Pugaan, Iligan City, Lanao del Norte,<br />

(3) Hillsborough Pointe Phase 4, Pueblo de Oro Township in Carmen,<br />

Cagayan de Oro, (4) Bloomingdale Subdivision Phase III in Iponan,<br />

Cagayan de Oro city, (5) Paglaum Village in Brgy. Poblacion, Quezon,<br />

Bukidnon, (6) Silvercreek Subdivision Phase III in Puli, Carmen, Cagayan<br />

de Oro City, <strong>and</strong> (7) Isabel Residences Subdivision in Brgy. Tankulan,<br />

the map combination <strong>and</strong> subjective weights were<br />

assigned to each unit in the parameter map.<br />

EXPLANATION<br />

L<strong>and</strong>slide hazard susceptibility zones were deriverd<br />

through qualitative map combination using lithology,<br />

geomorphology <strong>and</strong> slope gradient. GIS was used in<br />

the map combination <strong>and</strong> subjective weights were<br />

assigned to each unit in the parameter map.<br />

Areas with High Susceptibility of L<strong>and</strong>slides<br />

Areas with equally high probability of occurences<br />

of mass movements particulalry rock fall, debris slides<br />

<strong>and</strong> slumps. Very steep to nearly vertical slopes are rated<br />

high susceptibility areas <strong>and</strong> are unsuitable for housing<br />

<strong>and</strong> human settlement. Detailed engineering geological<br />

<strong>and</strong> geohazard assessment is needed.<br />
