The meet<strong>in</strong>g was held <strong>in</strong> English and Bahasa Ind<strong>on</strong>esia. Simultaneous <strong>in</strong>terpretati<strong>on</strong><br />

for the day was provided by Mia Badib and the logistics were arranged by Ms. V<strong>in</strong>na<br />

Sapr<strong>in</strong>a of SawitWatch.<br />

Agenda and Purpose of the Meet<strong>in</strong>g:<br />

After <strong>in</strong>troducti<strong>on</strong>s and a note of welcome from the Co-Chair, Norman Jiwan, the<br />

agenda (Annex 1) was followed very closely <strong>in</strong> the meet<strong>in</strong>g.<br />

The Co-Chair, Marcus Colchester, then expla<strong>in</strong>ed the objectives of the meet<strong>in</strong>g and<br />

rem<strong>in</strong>ded the participants of the purpose, reas<strong>on</strong>s for and terms of reference of the<br />

<str<strong>on</strong>g>Work<strong>in</strong>g</str<strong>on</strong>g> <str<strong>on</strong>g>Group</str<strong>on</strong>g>. It was expla<strong>in</strong>ed that the morn<strong>in</strong>g sessi<strong>on</strong> was a meet<strong>in</strong>g of the<br />

<str<strong>on</strong>g>Work<strong>in</strong>g</str<strong>on</strong>g> <str<strong>on</strong>g>Group</str<strong>on</strong>g> but opened to observers, while the afterno<strong>on</strong> was an expanded<br />

meet<strong>in</strong>g to engage with others actively seek<strong>in</strong>g to apply the HCV c<strong>on</strong>cept <strong>in</strong> the oil<br />

palm sector <strong>in</strong> Ind<strong>on</strong>esia. Marcus noted that the work programme of the <str<strong>on</strong>g>Work<strong>in</strong>g</str<strong>on</strong>g><br />

<str<strong>on</strong>g>Group</str<strong>on</strong>g> had been delayed <strong>in</strong> 2010 but that the Executive Board of the <str<strong>on</strong>g>RSPO</str<strong>on</strong>g> had<br />

agreed to extend the work.<br />

Review of the Legal Opti<strong>on</strong>s Paper (Annex 2):<br />

Andiko presented the ma<strong>in</strong> f<strong>in</strong>d<strong>in</strong>gs of the Legal Opti<strong>on</strong>s study he had carried out.<br />

The paper is appended below as Annex 2. A powerpo<strong>in</strong>t is also available.<br />

Andiko’s revised analysis deepens but substantiates the c<strong>on</strong>clusi<strong>on</strong>s of the 2009 study.<br />

HCV is not directly referred to <strong>in</strong> Ind<strong>on</strong>esian law although some HC <strong>Values</strong> may be<br />

protected by certa<strong>in</strong> pieces of law <strong>in</strong>clud<strong>in</strong>g the laws relat<strong>in</strong>g to EIAs (AMDAL), laws<br />

relat<strong>in</strong>g to protected areas and certa<strong>in</strong> provisi<strong>on</strong>s <strong>in</strong> the envir<strong>on</strong>mental laws.<br />

His study identified the follow<strong>in</strong>g legal opti<strong>on</strong>s for secur<strong>in</strong>g HCVs with<strong>in</strong> the current<br />

framework:<br />

� Companies can argue that by sett<strong>in</strong>g aside areas <strong>in</strong> their ij<strong>in</strong> lokasi as HCV<br />

areas, they are not c<strong>on</strong>tradict<strong>in</strong>g the terms of their licence by referr<strong>in</strong>g to<br />

Paragraphs two and three of the Decree of the M<strong>in</strong>istry of Agrarian Affairs<br />

and the Head of the Nati<strong>on</strong>al Land Agency 2/1999 <strong>on</strong> Ij<strong>in</strong> Lokasi which<br />

requires them to respect the rights and <strong>in</strong>terests of other parties and the public.<br />

� The Envir<strong>on</strong>mental Impact laws do not refer directly to HCV areas but<br />

protecti<strong>on</strong> of HCV areas with<strong>in</strong> HGU can be <strong>in</strong>cluded <strong>in</strong> the envir<strong>on</strong>mental<br />

and social mitigati<strong>on</strong> plans of AMDAL<br />

� Under Article 12 Paragraph 1 subparagraph e. of the PP <strong>on</strong> HGU (40/1996)<br />

companies can argue that they need to set aside areas to prevent natural<br />

resource destructi<strong>on</strong> and to preserve the envir<strong>on</strong>ment<br />

� HCV areas <strong>in</strong> APL can be secured as set asides by companies or communities<br />

as hutan hak through a regent’s decree.<br />

� HCV 5 and 6 can be recognised as customary rights areas by a decree of the<br />

regent or <strong>in</strong> forest areas as customary forests. There are a few precedents.<br />

However, his study also noted that s<strong>in</strong>ce the HCV assessment presented at RT7, a new<br />

law has been passed, PP No 11/2010 On the C<strong>on</strong>trol and Utilizati<strong>on</strong> of Neglected<br />

Land, which is designed to encourage companies to develop idle lands to which they<br />

have been granted rights but which they are not actively develop<strong>in</strong>g. This law<br />

strengthens the authority of regents to reallocate unused (‘neglected’) lands <strong>in</strong> HGU.<br />

The study therefore argues that <strong>in</strong>deed str<strong>on</strong>ger legal reforms are needed <strong>in</strong> Ind<strong>on</strong>esia<br />

to secure HCVs. One opti<strong>on</strong> would be an amendment to the C<strong>on</strong>servati<strong>on</strong> Law. Laws<br />

for the recogniti<strong>on</strong> of customary rights are also <strong>in</strong> c<strong>on</strong>siderati<strong>on</strong> which could help to<br />

protect HCVs 4, 5 and 6. The simplest soluti<strong>on</strong> might be a regulati<strong>on</strong> relat<strong>in</strong>g to HGU<br />

clarify<strong>in</strong>g that set asides should be allowed with<strong>in</strong> HGU, of the k<strong>in</strong>d already permitted<br />

<strong>in</strong> HTI (timber plantati<strong>on</strong>s), to ma<strong>in</strong>ta<strong>in</strong> and enhance <strong>High</strong> C<strong>on</strong>servati<strong>on</strong> <strong>Values</strong>.<br />

There was a technical discussi<strong>on</strong> about the exact mean<strong>in</strong>g of paragraph 5 of the<br />

41/1999 Forestry Law and whether it implies that hutan hak should be recognised <strong>in</strong><br />

ungazetted forests or <strong>in</strong> APL (or could be <strong>in</strong> both).<br />

It was noted that it was important to use Ind<strong>on</strong>esian terms <strong>in</strong> new laws. Use of the<br />

acr<strong>on</strong>ym HCV <strong>in</strong>stead of speak<strong>in</strong>g about Nilai K<strong>on</strong>servasi T<strong>in</strong>ggi impeded<br />

comprehensi<strong>on</strong>. A new law relat<strong>in</strong>g to transmigrati<strong>on</strong> actually uses the words ‘clean<br />

and clear’ <strong>in</strong> English. Such practice does not encourage applicati<strong>on</strong> of the law.<br />

Review of the Work Plan:<br />

The meet<strong>in</strong>g then reviewed <strong>on</strong>e by <strong>on</strong>e the activities that had been planned at the<br />

previous meet<strong>in</strong>g to ascerta<strong>in</strong> what progress has been made. After the legal discussi<strong>on</strong><br />

(see above) acti<strong>on</strong> po<strong>in</strong>ts and a tentative schedule for next steps were then also<br />

agreed.<br />

1. Meet<strong>in</strong>g with the Coord<strong>in</strong>at<strong>in</strong>g M<strong>in</strong>ister for Ec<strong>on</strong>omic Affairs (Amalia and<br />

Marcus).<br />

This activity was to be led by Dr. Marcus and Amalia Pramaswari of WWF-<br />

Ind<strong>on</strong>esia. Marcus reported that after some delays a letter jo<strong>in</strong>tly signed by the Co-<br />

Chairs and WWF had been sent by WWF to the M<strong>in</strong>ister and a meet<strong>in</strong>g was be<strong>in</strong>g<br />

arranged by WWF-Ind<strong>on</strong>esia with the Deputy M<strong>in</strong>ister. WWF-Ind<strong>on</strong>esia had reported<br />

that a meet<strong>in</strong>g was planned for after 20 th February 2011. Cherie noted that the lack of<br />

<strong>in</strong>volvement of Ind<strong>on</strong>esian producers was mak<strong>in</strong>g it harder for WWF to set up this<br />

meet<strong>in</strong>g as the <strong>in</strong>itiative was be<strong>in</strong>g seen as an NGO <strong>on</strong>e and was associated <strong>in</strong> the<br />

M<strong>in</strong>ister’s m<strong>in</strong>d with WWF’s other agenda to push for a str<strong>on</strong>g moratorium <strong>on</strong> the<br />

issuance of permits <strong>in</strong> forests and peatlands which was under discussi<strong>on</strong> <strong>in</strong> the c<strong>on</strong>text<br />

of the Norwegian Government’s plans to assist Ind<strong>on</strong>esia to slow deforestati<strong>on</strong>. It was<br />

vital that this meet<strong>in</strong>g with the <str<strong>on</strong>g>Work<strong>in</strong>g</str<strong>on</strong>g> <str<strong>on</strong>g>Group</str<strong>on</strong>g> was seen by the M<strong>in</strong>ister as a high<br />

profile multi-stakeholder c<strong>on</strong>cern and not just an NGO <strong>in</strong>itiative.<br />

Acti<strong>on</strong> agreed: It was agreed that the matter be reported to the <str<strong>on</strong>g>RSPO</str<strong>on</strong>g> Board and that<br />

the <str<strong>on</strong>g>RSPO</str<strong>on</strong>g> Secretary General and Chair be asked to make an approach to the M<strong>in</strong>ister<br />

<strong>on</strong> behalf of the <str<strong>on</strong>g>Work<strong>in</strong>g</str<strong>on</strong>g> <str<strong>on</strong>g>Group</str<strong>on</strong>g>.<br />

2. Revis<strong>in</strong>g AMDAL (Amalia and Bambang Dwi Laks<strong>on</strong>o)<br />

WWF-Ind<strong>on</strong>esia has established c<strong>on</strong>tacts with the M<strong>in</strong>istry of the Envir<strong>on</strong>ment and is<br />

<strong>in</strong>volved <strong>in</strong> a work<strong>in</strong>g group review<strong>in</strong>g the AMDAL procedures. However, a meet<strong>in</strong>g<br />

<strong>on</strong> behalf of the <str<strong>on</strong>g>Work<strong>in</strong>g</str<strong>on</strong>g> <str<strong>on</strong>g>Group</str<strong>on</strong>g> had not been c<strong>on</strong>vened. The <str<strong>on</strong>g>Work<strong>in</strong>g</str<strong>on</strong>g> <str<strong>on</strong>g>Group</str<strong>on</strong>g> noted<br />

that <strong>in</strong> the light of the new AMDAL law it was all the more important to assess how<br />

the new law and <str<strong>on</strong>g>RSPO</str<strong>on</strong>g> requirements <strong>on</strong> HCV can relate.<br />

Acti<strong>on</strong> agreed: Cherie of WWF will take the lead. She will seek to c<strong>on</strong>solidate the<br />

<strong>in</strong>puts and views of others also work<strong>in</strong>g <strong>on</strong> the AMDAL.<br />

3. Revis<strong>in</strong>g spatial plann<strong>in</strong>g (Patrick, Norman and Dr Erw<strong>in</strong>syah)<br />

Norman reported that there had been two attempts to c<strong>on</strong>vene a meet<strong>in</strong>g of the three<br />

<str<strong>on</strong>g>Work<strong>in</strong>g</str<strong>on</strong>g> <str<strong>on</strong>g>Group</str<strong>on</strong>g> members with the M<strong>in</strong>istry of Public Works. The first meet<strong>in</strong>g had<br />

been cancelled at short notice. The sec<strong>on</strong>d meet<strong>in</strong>g with the M<strong>in</strong>istry’s Spatial<br />

Plann<strong>in</strong>g and Management Unit (Perencanaan dan Penataan Ruang Nasi<strong>on</strong>al) had<br />

been very productive. The M<strong>in</strong>istry admitted that the spatial plann<strong>in</strong>g process did not<br />

explicitly accommodate HCVs. The plann<strong>in</strong>g process had got stuck <strong>in</strong> a political<br />

discussi<strong>on</strong>s about how to harm<strong>on</strong>ize top-down and bottom-up plann<strong>in</strong>g. Although all<br />

prov<strong>in</strong>ces were required by law to complete their spatial plans by 2010, to date <strong>on</strong>ly 6<br />

prov<strong>in</strong>ces had complete their spatial plann<strong>in</strong>g, so this made it difficult to come up<br />

with c<strong>on</strong>solidated spatial plans at the nati<strong>on</strong>al level. N<strong>on</strong>e of these prov<strong>in</strong>ces were<br />

major palm oil expansi<strong>on</strong> areas. On the other hand this meant that there was still<br />

scope to explore how HCVs could be <strong>in</strong>cluded <strong>in</strong>to the spatial plann<strong>in</strong>g process. The<br />

M<strong>in</strong>istry would be keen to discuss this further with the <str<strong>on</strong>g>Work<strong>in</strong>g</str<strong>on</strong>g> <str<strong>on</strong>g>Group</str<strong>on</strong>g>.<br />

Acti<strong>on</strong> agreed: As suggested by the M<strong>in</strong>istry, an Inter-M<strong>in</strong>isterial meet<strong>in</strong>g should be<br />

c<strong>on</strong>vened to report and discuss all the legal challenges and possibilities identified <strong>in</strong><br />

the research and discussi<strong>on</strong>s. It was agreed that this should come after less<strong>on</strong>s had<br />

been learned from the field visits (see below). Late July/ August were proposed.<br />

Norman would lead <strong>in</strong> coord<strong>in</strong>at<strong>in</strong>g and sett<strong>in</strong>g a date for the meet<strong>in</strong>g.<br />

5. Revis<strong>in</strong>g Regulati<strong>on</strong>s of Agrarian Law (Norman, Andiko and Sim<strong>on</strong> )<br />

Norman reported that members of the HCV WG had met with Dr. Harris Simanjuntak<br />

and other senior staff <strong>in</strong> the Nati<strong>on</strong>al Land Agency’s (BPN) Unit <strong>on</strong> land<br />

regularisati<strong>on</strong>. The meet<strong>in</strong>g was likewise very c<strong>on</strong>structive. BPN noted that the fact<br />

that HCVs are not identified <strong>in</strong> spatial plann<strong>in</strong>g makes it hard for the land agency to<br />

act to regularise such areas. S<strong>in</strong>ce the HCV c<strong>on</strong>cept has come from a third party<br />

<strong>in</strong>itiative (NGOs, market and private bus<strong>in</strong>esses), BPN is not authorised to allocate<br />

lands for HCVs so l<strong>on</strong>g as the c<strong>on</strong>cept has not be adopted <strong>in</strong>to nati<strong>on</strong>al legal<br />

framework. Designati<strong>on</strong> of HCV sites should properly be under the authority of the<br />

forestry department and envir<strong>on</strong>mental m<strong>in</strong>istry. BPN acknowledged that there<br />

c<strong>on</strong>t<strong>in</strong>ue to be disputes and competiti<strong>on</strong> between m<strong>in</strong>istries about the areas over<br />

which they have jurisdicti<strong>on</strong>.<br />

Acti<strong>on</strong> agreed: It was likewise agreed that these issues should now be explored at the<br />

Inter-M<strong>in</strong>isterial meet<strong>in</strong>g <strong>in</strong> July/August.<br />

6. Secur<strong>in</strong>g HCVs released from Ij<strong>in</strong> Lokasi (Norman, Andiko and Sim<strong>on</strong> )<br />

The legal review had shown that areas outside forests (ie APL land) could be secured<br />

as Hutan hak. Technically forested areas <strong>in</strong> APL could revert to the status of forest.<br />

Acti<strong>on</strong> agreed: It was likewise agreed that these issues should now be explored at the<br />

Inter-M<strong>in</strong>isterial meet<strong>in</strong>g <strong>in</strong> July/August.<br />

7. Opti<strong>on</strong>s for Secur<strong>in</strong>g HCVs with<strong>in</strong> HGU: review of Plantati<strong>on</strong>s Act (Norman and<br />

Dr Erw<strong>in</strong>syah)<br />

Norman reported that Members of the <str<strong>on</strong>g>Work<strong>in</strong>g</str<strong>on</strong>g> <str<strong>on</strong>g>Group</str<strong>on</strong>g> had met with the M<strong>in</strong>istry of<br />

Agriculture’s Office of the Directorate of Horticulture Crops. It was noted that the<br />

focus of the horticulture directorate is <strong>on</strong> the improvement and revitalisati<strong>on</strong> of<br />

agriculture and plantati<strong>on</strong> lands. The new law <strong>on</strong> neglected land did make it harder for<br />

companies to reta<strong>in</strong> areas <strong>in</strong> their HGU or ij<strong>in</strong> lokasi as HCV set asides. It would be<br />

desirable to explore this matter further <strong>in</strong> a jo<strong>in</strong>t meet<strong>in</strong>g with relevant decisi<strong>on</strong>makers<br />

<strong>in</strong>clud<strong>in</strong>g the M<strong>in</strong>istry of Agriculture and other l<strong>in</strong>e M<strong>in</strong>istries, with the aim<br />

of discuss<strong>in</strong>g a proposal to develop a m<strong>in</strong>istry regulati<strong>on</strong> and/or technical<br />

regulati<strong>on</strong> that can be implemented immediately. It would be time-c<strong>on</strong>sum<strong>in</strong>g and<br />

politically challeng<strong>in</strong>g to get a legal reform through the legislature (DPR) given the<br />

high <strong>in</strong>terests vested <strong>in</strong> land development.<br />

Acti<strong>on</strong> agreed: It was likewise agreed that these issues should now be explored at the<br />

Inter-M<strong>in</strong>isterial meet<strong>in</strong>g <strong>in</strong> July/August.<br />

8. Opti<strong>on</strong>s for secur<strong>in</strong>g HCVs <strong>in</strong> HGU as Hutan Hak (Andiko and S<strong>in</strong>ar Mas)<br />

Andiko noted that his legal review shows that the legislative framework now exists<br />

for hutan hak to be recognised by a regent’s decree.<br />

Acti<strong>on</strong> agreed: It was likewise agreed that the opti<strong>on</strong> should also be explored at the<br />

Inter-M<strong>in</strong>isterial meet<strong>in</strong>g <strong>in</strong> July/August. Prior to that, the opti<strong>on</strong> should also be<br />

explored <strong>in</strong> discussi<strong>on</strong> with bupati dur<strong>in</strong>g the field visits.<br />

9. Meet<strong>in</strong>g with ISPO to explore compatibilities (Bamgang Dwi Laks<strong>on</strong>o)<br />

No acti<strong>on</strong> was reported. It was noted that the ISPO proposals were still <strong>in</strong> the form of<br />

a discussi<strong>on</strong> draft. It was reported that the <str<strong>on</strong>g>RSPO</str<strong>on</strong>g> Secretary General and RILO were<br />

carry<strong>in</strong>g out a comparative assessment of the ISPO and <str<strong>on</strong>g>RSPO</str<strong>on</strong>g> standards to ascerta<strong>in</strong><br />

gaps and compatibilities. Pilot assessments by <str<strong>on</strong>g>RSPO</str<strong>on</strong>g> accredited CBs were also<br />

planned <strong>in</strong> <str<strong>on</strong>g>RSPO</str<strong>on</strong>g> member sites to ga<strong>in</strong> a practical understand<strong>in</strong>g of the extent that the<br />

two systems are compatible.<br />

Acti<strong>on</strong> agreed: Await the results of the <str<strong>on</strong>g>RSPO</str<strong>on</strong>g> secretariat/RILO assessment and<br />

pilots.<br />

10. Secur<strong>in</strong>g tax exempti<strong>on</strong>s (Marcus, Norman and Sim<strong>on</strong> )<br />

Marcus noted that the last meet<strong>in</strong>g had agreed that this matter should be explored <strong>in</strong><br />

the discussi<strong>on</strong>s with the bupati so this issue was delayed pend<strong>in</strong>g the legal<br />

assessments and the schedul<strong>in</strong>g of the field visit (below).<br />

Acti<strong>on</strong> agreed: Explore the issue <strong>in</strong> discussi<strong>on</strong>s with the bupati and gubernur dur<strong>in</strong>g<br />

field visit (see below).<br />

11. Local recogniti<strong>on</strong> through PERDA (Marcus, Norman, Sim<strong>on</strong>)<br />

The <strong>in</strong>itial assessment, the work<strong>in</strong>g group discussi<strong>on</strong>s and legal review al show that<br />

the bupati (regent) has c<strong>on</strong>siderable discreti<strong>on</strong> <strong>in</strong> decid<strong>in</strong>g how to apply the law and<br />

whether or not to accept set asides for HCVs. Where bupati are <strong>in</strong>different to HCV<br />

protecti<strong>on</strong> and/or have reas<strong>on</strong>s for <strong>in</strong>sist<strong>in</strong>g <strong>on</strong> lands be<strong>in</strong>g allocated for development,<br />

HGU which <strong>in</strong>clude HCV set asides are vulnerable. However, where bupati are<br />

sympathetic there are opti<strong>on</strong>s for secur<strong>in</strong>g HCVs.<br />

Based <strong>on</strong> the discussi<strong>on</strong>s of the work<strong>in</strong>g group and the legal study, the follow<strong>in</strong>g local<br />

level legal opti<strong>on</strong>s had now been identified as possible ways of secur<strong>in</strong>g HCVs either<br />

as decrees of the regent or as local legislative acts (PERDA).<br />

� Secur<strong>in</strong>g HCV areas <strong>in</strong> APL designated as Hutan Hak (either held by the company<br />

or by the communities as appropriate)<br />

� Secur<strong>in</strong>g HCV areas <strong>in</strong> Kawasan Hutan Negara as Hutan Desa (particularly HCVs<br />

4, 5 and 6)<br />

� Secur<strong>in</strong>g HCV 5-6 areas <strong>in</strong> Kawasan Hutan Negara as Hutan Adat<br />

� Gett<strong>in</strong>g tax exempti<strong>on</strong>s for areas of HGU set aside for ma<strong>in</strong>ta<strong>in</strong><strong>in</strong>g and enhanc<strong>in</strong>g<br />

HCVs<br />

Acti<strong>on</strong> agreed: A field visit should be made by the <str<strong>on</strong>g>Work<strong>in</strong>g</str<strong>on</strong>g> <str<strong>on</strong>g>Group</str<strong>on</strong>g> to the Wilmar<br />

site <strong>in</strong> Kota War<strong>in</strong>g<strong>in</strong> Timur followed by a visit to the bupati and then a discussi<strong>on</strong><br />

with the governor. It was agreed to explore dates with the bupati but after c<strong>on</strong>sult<strong>in</strong>g<br />

their diaries the <str<strong>on</strong>g>Work<strong>in</strong>g</str<strong>on</strong>g> <str<strong>on</strong>g>Group</str<strong>on</strong>g> meet<strong>in</strong>g proposed that this field visit be carried out <strong>in</strong><br />

the week of 16-20 May 2011. Wilmar would c<strong>on</strong>tact the bupati to ask if the date<br />

suited him.<br />

Compositi<strong>on</strong> of the <str<strong>on</strong>g>Work<strong>in</strong>g</str<strong>on</strong>g> <str<strong>on</strong>g>Group</str<strong>on</strong>g><br />

The Compositi<strong>on</strong> of the <str<strong>on</strong>g>Work<strong>in</strong>g</str<strong>on</strong>g> <str<strong>on</strong>g>Group</str<strong>on</strong>g> was reviewed. It <strong>in</strong>cludes producers, a<br />

government research body (IOPRI), NGOs and the <str<strong>on</strong>g>RSPO</str<strong>on</strong>g> Secretariat.<br />

The NGOs are active. There was no need to change the NGO actors.<br />

The <str<strong>on</strong>g>RSPO</str<strong>on</strong>g> Secretariat had been represented by Jutta Poetz who has s<strong>in</strong>ce left the<br />

secretariat. The Co-Chairs had <strong>in</strong>vited the new Secretary General to attend but he had<br />

reluctantly decl<strong>in</strong>ed ow<strong>in</strong>g to pressure of work. Cherie had taken the <strong>in</strong>itiative to<br />

<strong>in</strong>vite Pak Asril Darussam<strong>in</strong> and Desi Kusumadewi from RILO. Marcus thanked them<br />

for be<strong>in</strong>g <strong>in</strong>volved.<br />

Acti<strong>on</strong> agreed: It was agreed that the RILO should c<strong>on</strong>t<strong>in</strong>ue to engage <strong>in</strong> future <strong>in</strong> the<br />

<str<strong>on</strong>g>Work<strong>in</strong>g</str<strong>on</strong>g> <str<strong>on</strong>g>Group</str<strong>on</strong>g> while the <str<strong>on</strong>g>RSPO</str<strong>on</strong>g> Secretariat determ<strong>in</strong>ed how it be best represented <strong>in</strong><br />

future meet<strong>in</strong>gs.<br />

It was unclear why IOPRI had not been able to attend this meet<strong>in</strong>g. It was hoped that<br />

Dr Erw<strong>in</strong>syah would be able to attend future meet<strong>in</strong>gs.<br />

It was aga<strong>in</strong> affirmed that for the <str<strong>on</strong>g>Work<strong>in</strong>g</str<strong>on</strong>g> <str<strong>on</strong>g>Group</str<strong>on</strong>g> to functi<strong>on</strong> effectively it was vital<br />

that it reta<strong>in</strong> a multi-stakeholder character so that the Government officials could see<br />

that the issues be<strong>in</strong>g addressed were of c<strong>on</strong>cern to all <str<strong>on</strong>g>RSPO</str<strong>on</strong>g> members and not just to<br />

NGOs. Disappo<strong>in</strong>tment was expressed at the lack of engagement by Ind<strong>on</strong>esian<br />

producers.<br />

It was noted that lack of progress <strong>on</strong> this issue <strong>in</strong> Ind<strong>on</strong>esia threatens to underm<strong>in</strong>e<br />

<strong>on</strong>e of the key purposes of the <str<strong>on</strong>g>RSPO</str<strong>on</strong>g> which is to divert palm oil expansi<strong>on</strong> away from<br />

HCV areas. It was therefore essential that legal means of secur<strong>in</strong>g HCVs be found.<br />

Acti<strong>on</strong> agreed: The members of the <str<strong>on</strong>g>Work<strong>in</strong>g</str<strong>on</strong>g> <str<strong>on</strong>g>Group</str<strong>on</strong>g> <strong>on</strong> the Executive Board would<br />

report the c<strong>on</strong>cern of the participat<strong>in</strong>g members about the lack of <strong>in</strong>volvement by<br />

Ind<strong>on</strong>esian producers. A soluti<strong>on</strong> should be sought at the Executive Board <strong>in</strong><br />

discussi<strong>on</strong> with the Ind<strong>on</strong>esian producer members <strong>on</strong> the EB.<br />

Afterno<strong>on</strong> sessi<strong>on</strong>: Expanded Discussi<strong>on</strong><br />

The afterno<strong>on</strong> sessi<strong>on</strong> <strong>in</strong>cluded other actors apply<strong>in</strong>g the HCV c<strong>on</strong>cept <strong>in</strong> Ind<strong>on</strong>esia.<br />

The aim was to share <strong>in</strong>formati<strong>on</strong> and promote coord<strong>in</strong>ati<strong>on</strong> between the various<br />

<strong>in</strong>itiatives relat<strong>in</strong>g to HCV <strong>in</strong> the palm oil sector <strong>in</strong> Ind<strong>on</strong>esia.<br />

1. Andjar Rafiastanto of Fauna and Flora Internati<strong>on</strong>al made a short presentati<strong>on</strong><br />

accompanied by power po<strong>in</strong>t (available) <strong>on</strong> the efforts be<strong>in</strong>g made to secure<br />

HCVs <strong>in</strong> Kapuas Hulu <strong>in</strong> West Kalimantan work<strong>in</strong>g both with communities and<br />

companies, and also with the local government. After mapp<strong>in</strong>g HCVs 1-3 FFI was<br />

able to persuade the local government to adopt 45% of the z<strong>on</strong><strong>in</strong>g <strong>in</strong>to their spatial<br />

plann<strong>in</strong>g. They are also experiment<strong>in</strong>g with HCV set asides <strong>in</strong> both logg<strong>in</strong>g and<br />

oil palm c<strong>on</strong>cessi<strong>on</strong>s, are experiment<strong>in</strong>g with hutan hak with companies and<br />

experiment<strong>in</strong>g with secur<strong>in</strong>g community lands through an SK bupati hutan desa.<br />

FFI is also work<strong>in</strong>g with a community REDD project as hutan adat. It was noted<br />

that HCVs are naturally not c<strong>on</strong>f<strong>in</strong>ed to the limits of c<strong>on</strong>cessi<strong>on</strong>s boundaries but<br />

HCV management relies <strong>on</strong> company best practice. Transboundary collaborative<br />

management is thus required but presents particular challenges. FFI looked<br />

forwards to further collaborati<strong>on</strong><br />

2. Sophie Persey of the Zoological Society of L<strong>on</strong>d<strong>on</strong> and Nick Brickle of the<br />

Wildlife C<strong>on</strong>servati<strong>on</strong> Society presented the work be<strong>in</strong>g d<strong>on</strong>e by both groups<br />

under a BACP project to explore means of protect<strong>in</strong>g wildlife values <strong>in</strong> the palm<br />

oil sector <strong>in</strong> Ind<strong>on</strong>esia. The presentati<strong>on</strong>s summarised the f<strong>in</strong>d<strong>in</strong>gs of two studies<br />

<strong>on</strong>e by ZSL <strong>on</strong> the possibilities of HCV recogniti<strong>on</strong> <strong>in</strong> spatial plann<strong>in</strong>g processes<br />

<strong>in</strong> Ind<strong>on</strong>esia (see Annex 3) and the sec<strong>on</strong>d a legal review of opti<strong>on</strong>s for secur<strong>in</strong>g<br />

biodiversity <strong>in</strong> oil palm areas (Annex 4). Both studies referred extensively to the<br />

<str<strong>on</strong>g>RSPO</str<strong>on</strong>g> P&C <strong>on</strong> HCVs. The ZSL study had <strong>in</strong>cluded detailed <strong>in</strong>terviews with<br />

CSOs, company pers<strong>on</strong>nel and local functi<strong>on</strong>aries to ascerta<strong>in</strong> what they knew<br />

about <str<strong>on</strong>g>RSPO</str<strong>on</strong>g> and HCV. The level of knowledge and comprehensi<strong>on</strong> is very poor.<br />

The ZSL study also c<strong>on</strong>firmed that there are no regulati<strong>on</strong>s to protect HCVs <strong>in</strong><br />

APL or outside forest nor is there any land use category <strong>in</strong> spatial plann<strong>in</strong>g that<br />

can be applied: besides the level of resoluti<strong>on</strong> of spatial plans is too crude to<br />

capture and map HCV areas <strong>in</strong> fragmented landscape mosaics. One opti<strong>on</strong> the<br />

ZSL study explored was reclassify<strong>in</strong>g released lands as ‘forests’.<br />

The WCS study had derived from its work <strong>on</strong> the wildlife trade and orang utan<br />

protecti<strong>on</strong>. The idea of the document was that it be a primer summaris<strong>in</strong>g the<br />

hierarchy of laws that were relevant to the protecti<strong>on</strong> of HCVs. The study had<br />

shown that there is c<strong>on</strong>siderable c<strong>on</strong>tradicti<strong>on</strong>s between higher and lower laws<br />

and between sector laws. WCS now plans a review of the gaps and c<strong>on</strong>tradicti<strong>on</strong>s<br />

between the different laws. There is some hope that the promised moratorium <strong>on</strong><br />

permitt<strong>in</strong>g <strong>in</strong> forests and peatlands can allow time for a better process for the<br />

protecti<strong>on</strong> of HCVs to be worked out.<br />

In discussi<strong>on</strong> it was also noted that Dolly Priatna of ZSL is also work<strong>in</strong>g <strong>on</strong> how<br />

AMDAL might be used to better protect HCVs.<br />

There was also a discussi<strong>on</strong> about whether the studies had looked at the full range of<br />

HCVs. It was noted that the ZSL and WCS studies had basically focused <strong>on</strong> HCVs 1,<br />

2 and 3 and had not looked at the legal opti<strong>on</strong>s for secur<strong>in</strong>g HCV 4, 5 and 6. The<br />

<str<strong>on</strong>g>RSPO</str<strong>on</strong>g> standard and the HCVRN Charter <strong>on</strong> the other hand require assessment and<br />

protecti<strong>on</strong> of all 6 HCVs. It was expla<strong>in</strong>ed that ZSL and WCS lack social science<br />

expertise.<br />

There was also a discussi<strong>on</strong> about the costs of HCV assessment and management.<br />

Costs vary widely so generalisati<strong>on</strong> could be mislead<strong>in</strong>g. FFI reported that it was<br />

currently do<strong>in</strong>g an analysis of costs.<br />

It was noted that companies were reluctant to reta<strong>in</strong> areas with high human<br />

populati<strong>on</strong>s and HCVs 4, 5 and 6 <strong>in</strong> their c<strong>on</strong>cessi<strong>on</strong>s as the costs of management<br />

were high and the risks of communities degrad<strong>in</strong>g HCVs also high. It was simpler for<br />

companies to exclude such areas <strong>in</strong> their ij<strong>in</strong> lokasi when they sought to re-def<strong>in</strong>e and<br />

secure their hold<strong>in</strong>gs as smaller HGU. These excluded areas were then at heightened<br />

risk of degradati<strong>on</strong> – they ‘get annihilated’, noted <strong>on</strong>e company representative. This<br />

emphasised the f<strong>in</strong>d<strong>in</strong>g of the previous survey: the <str<strong>on</strong>g>RSPO</str<strong>on</strong>g> missi<strong>on</strong> to divert the palm<br />

oil fr<strong>on</strong>tier away from HCVs was not effective if there was not complementary acti<strong>on</strong><br />

by the State as companies could not be expected to s<strong>in</strong>gle-handedly manage HCVs <strong>in</strong><br />

the wider landscapes bey<strong>on</strong>d their c<strong>on</strong>cessi<strong>on</strong>s. Nor could they afford to carry<br />

resp<strong>on</strong>sibility for the degradati<strong>on</strong> of HCVs with<strong>in</strong> their c<strong>on</strong>cessi<strong>on</strong>s if this was be<strong>in</strong>g<br />

carried out by other <strong>in</strong>terests (eg communities) over which they had no or limited<br />

c<strong>on</strong>trol.<br />

The challenge of secur<strong>in</strong>g HCVs <strong>in</strong> spatial plann<strong>in</strong>g was also discussed. Marcus<br />

<strong>in</strong>vited the participants from the WRI/POTICO project to summarise their approach.<br />

The POTICO project has sought to map vegetati<strong>on</strong> cover to ascerta<strong>in</strong> which areas are<br />

primary forest or not ‘degraded land’. The aim was to discourage clearance. POTICO<br />

was also explor<strong>in</strong>g a process of gett<strong>in</strong>g companies to release high forest areas back to<br />

be<strong>in</strong>g classed as forests and provided with alternative degraded area for development.<br />

Some land swaps have now been planned but have not yet secured political<br />

authorisati<strong>on</strong>. Cherie noted that McK<strong>in</strong>sey was also develop<strong>in</strong>g a ‘degraded land’<br />

database.<br />

There was then a discussi<strong>on</strong> about the risks that noti<strong>on</strong>s such as degraded land could<br />

facilitate land c<strong>on</strong>versi<strong>on</strong> and land grabb<strong>in</strong>g. History is replete with examples of land<br />

be<strong>in</strong>g classed as ‘waste land’, ‘empty land’, ‘critical land’, ‘unproductive land’, ‘idle<br />

land’. ‘neglected land’, and ‘aband<strong>on</strong>ed land’ which had been used to legitimise the<br />

allocati<strong>on</strong> of such lands to new purposes often at the expense of the <strong>in</strong>digenous<br />

peoples. The term ‘degraded lands’ was particularly open to multiple def<strong>in</strong>iti<strong>on</strong>s<br />

which led to c<strong>on</strong>fusi<strong>on</strong>s. It seemed to be generally agreed that this was a dilemma and<br />

the soluti<strong>on</strong> <strong>in</strong> part was to emphasise that such general screen<strong>in</strong>g not be seen as a<br />

substitute for f<strong>in</strong>er gra<strong>in</strong>ed attenti<strong>on</strong> to other issues. HCVs 5 and 6 <strong>in</strong> particular could<br />

<strong>on</strong>ly be identified through local level c<strong>on</strong>sultati<strong>on</strong>s with local communities. The lack<br />

of secure community land rights made HCVs 4-6 especially vulnerable.<br />

POTICO had identified some 2.5 m ha of high quality forests <strong>in</strong> APL but <strong>on</strong>ly about<br />

0.5 m ha of this forest could be swapped for nearby degraded areas and then reclassed<br />

as forest.<br />

It was asked if the Ad Hoc <str<strong>on</strong>g>Work<strong>in</strong>g</str<strong>on</strong>g> <str<strong>on</strong>g>Group</str<strong>on</strong>g> was go<strong>in</strong>g to address the wider challenge<br />

of HCV management at landscape scale. It was noted this was bey<strong>on</strong>d the TORs of<br />

the WG.<br />

The highly variable quality and techniques of HCV assessments was also noted. It<br />

was queried if the HCV assessment summaries posted <strong>on</strong> the web as part of the New<br />

Plant<strong>in</strong>gs Procedure provided enough <strong>in</strong>formati<strong>on</strong> to know if HCVs were be<strong>in</strong>g<br />

attended to adequately or not. This would be a crucial matter for <strong>in</strong>vestigati<strong>on</strong> by the<br />

New Plant<strong>in</strong>gs Procedure review.<br />

3. Cherie Tan of WWF-Internati<strong>on</strong>al, <strong>on</strong> behalf of Gary Paoli of Daemeter<br />

C<strong>on</strong>sult<strong>in</strong>g and recognis<strong>in</strong>g the major <strong>in</strong>puts from Sim<strong>on</strong> Siburat of Wilmar<br />

Internati<strong>on</strong>al, expla<strong>in</strong>ed the new project be<strong>in</strong>g funded by the <str<strong>on</strong>g>RSPO</str<strong>on</strong>g> to further<br />

explore the technical challenges to the identificati<strong>on</strong> and management of HCVs <strong>in</strong><br />

palm oil areas <strong>in</strong> Ind<strong>on</strong>esia. (Power po<strong>in</strong>t available). Although there had been<br />

some delays <strong>in</strong> gett<strong>in</strong>g the project approved ow<strong>in</strong>g to staff changes <strong>in</strong> the <str<strong>on</strong>g>RSPO</str<strong>on</strong>g><br />

Secretariat, this project was now underway. The wide rang<strong>in</strong>g study should<br />

address the major challenges fac<strong>in</strong>g HCV assessment and management.<br />

Participants welcomed the study but noted its ambitious scope. It was noted that HCV<br />

Assessments were meant to identify HCVs, make recommendati<strong>on</strong>s for management<br />

and propose m<strong>on</strong>itor<strong>in</strong>g procedures. The HCV Tool Kit was str<strong>on</strong>g <strong>on</strong> identificati<strong>on</strong><br />

but less clear about management opti<strong>on</strong>s <strong>in</strong> circumstances of c<strong>on</strong>versi<strong>on</strong>. Cherie<br />

<strong>in</strong>vited participants to volunteer to form an advisory group for the project: Sophie,<br />

Patrick, Betsy and Marcus volunteered. It was hoped that the study could work<br />

closely with the new HCV Ind<strong>on</strong>esia Network.<br />

4. Dwi Muhtaman of Aksenta then reported <strong>in</strong> detail (powerpo<strong>in</strong>t available) <strong>on</strong> the<br />

sett<strong>in</strong>g up of a new Society (Perkumpulan) called the the Jar<strong>in</strong>gan Nilai<br />

K<strong>on</strong>servasi T<strong>in</strong>ggi Ind<strong>on</strong>esia. The visi<strong>on</strong>, missi<strong>on</strong> and scope of activities of the<br />

new network were described as was the proposed governance structure of the new<br />

society. This was likely to come <strong>in</strong>to legal existence with 30 found<strong>in</strong>g members <strong>in</strong><br />

March. The network would aim to act as a hub of expertise, a quality assurance<br />

forum and as a forum where disputes about the applicati<strong>on</strong> of HCV could be<br />

resolved<br />

In discussi<strong>on</strong>s it was clarified that the new network (HCVNI) would seek to establish<br />

clear l<strong>in</strong>ks with the global HCVRN and the HCVRN Charter would be made part of<br />

the new network’s statutes. It was queried whether a network built up of companies<br />

and c<strong>on</strong>sultants and other <strong>in</strong>terested parties could effectively avoid c<strong>on</strong>flict of <strong>in</strong>terest<br />

when asked to act as a dispute resoluti<strong>on</strong> forum about HCV.<br />

Management Challenges:<br />

The Chair then encouraged the f<strong>in</strong>al sessi<strong>on</strong> of the meet<strong>in</strong>g to aga<strong>in</strong> bra<strong>in</strong>storm about<br />

some of the management challenges already noted. The follow<strong>in</strong>g po<strong>in</strong>ts were noted:<br />

� There is a need to share experiences<br />

� Cross-boundary shar<strong>in</strong>g between companies is difficult ow<strong>in</strong>g to commercial<br />

rivalry, commercial c<strong>on</strong>fidentiality and mistrust<br />

� Companies often found the recommendati<strong>on</strong>s of c<strong>on</strong>sultants theoretical and<br />

impractical.<br />

� Company SOPs should however be evolved and BP SOPs should be shared with<strong>in</strong><br />

the sector<br />

� ZSL was develop<strong>in</strong>g a case book of practices which could c<strong>on</strong>tribute to the<br />

development of guidel<strong>in</strong>es and SOPs <strong>in</strong> the l<strong>on</strong>ger term and a ‘tool box of ideas’<br />

<strong>in</strong> the short term.<br />

� Sceptical comments were made about the technical capacity of CBs to actually<br />

assess the quality of HCV assessments. All that they could be expected to check<br />

was that an HCV Assessment had been d<strong>on</strong>e and had been implemented.<br />

Daemeter has developed a check list for auditors check<strong>in</strong>g HCV assessments.<br />

� In seek<strong>in</strong>g greater c<strong>on</strong>nectivity above the c<strong>on</strong>cessi<strong>on</strong> level it was noted that no<br />

data base existed which shows where <str<strong>on</strong>g>RSPO</str<strong>on</strong>g> member c<strong>on</strong>cessi<strong>on</strong>s are. <str<strong>on</strong>g>RSPO</str<strong>on</strong>g><br />

should seek to develop such a cadastre. Such a database could both encourage<br />

cross-boundary collaborati<strong>on</strong> <strong>in</strong> management and allow greater accountability.<br />

Ideally <strong>in</strong> the l<strong>on</strong>g term it could also help build up HCV data sets at the landscape<br />

level. The new Network could also encourage this and it was noted that WWF’s<br />

experience with elephant management <strong>in</strong> Riau was relevant.<br />

Closure:<br />

In clos<strong>in</strong>g the meet<strong>in</strong>g Marcus thanked Mia for her hard work <strong>in</strong>terpret<strong>in</strong>g throughout<br />

the day. He thanked SawitWatch, especially V<strong>in</strong>na, for the efficient organisati<strong>on</strong> and<br />

all the participants for their effective collaborati<strong>on</strong> which had made the meet<strong>in</strong>g very<br />

productive. He noted that it was evident that the meet<strong>in</strong>g showed the need for more<br />

regular pool<strong>in</strong>g of results between different <strong>in</strong>itiatives and that hopefully the new<br />

Ind<strong>on</strong>esia HCV Network would provide a good forum for such. He noted that<br />

communicati<strong>on</strong>s would follow the meet<strong>in</strong>g. The report from the meet<strong>in</strong>g would be<br />

circulated, while <str<strong>on</strong>g>Work<strong>in</strong>g</str<strong>on</strong>g> <str<strong>on</strong>g>Group</str<strong>on</strong>g> members would firm up the projected dates <strong>in</strong><br />

c<strong>on</strong>sultati<strong>on</strong> with government officials.<br />
