Chairman of the Association 

Adhesives and sealants are an 

essential component in so many 

areas of our daily lives. Though 

usually unseen by the end user, 

we simply could not function 

without them. 

The lifeblood of any industry or 

business is the development 

of new products through 

innovation and evolution. 

These enable businesses 

to reap the benefits of new 

technology, offer new solutions 

to old problems and push the 

boundaries of development with 

new, innovative products. It is 

therefore essential that help is 

available to assist our industry 

and this is where BASA, as the 

only representative body of 

the UK’s adhesive and sealant 

sector, supports its members 

and – indirectly – the public at 

large. It does this in many ways 

by representing and promoting 

the industry, working with 

governments in the UK and 

Ireland, offering guidance on 

technical and compliance issues, 

and providing networking 

opportunities and support 

services for members. BASA also 

has a strong voice in Europe 

through its active membership 

of FEICA. 

Newcomers to the industry 

are often surprised at just how 

innovative the industry is. We are 

at the forefront of the “sunrise 

industries” – the so-called green 

technologies – but our members 

are continuing also to enhance 

the performance of the older 

established sectors. Building 

and construction is a case in 

point where glass, wood – even 

metal – building components 

are now routinely bonded 

with adhesives. Then there are 

the new composite materials 

combining relatively lightweight 

with strength, and insulation 

techniques and materials that 

save heat and energy in the 

winter but allow for natural 

cooling in the summer. 

Traditional fastening systems 

are also being replaced in the 

drive for greater efficiency and 

economy. This has long been 

evident in the aerospace industry; 

now the latest aircraft from 

Airbus or Boeing are bonded 

together to a significant extent 

with adhesives, providing 

benefits of lightweight, 

improved performance and a 

lower carbon footprint. The car 

industry uses adhesives and 

sealants in ways that would have 

been unthinkable to an earlier 

generation. 

In healthcare adhesives play 

their part in wound healing and 

post-operative care, as well as the 

assembly of both disposable and 

reusable medical devices. 

The constantly developing field of 

electronics is another area where 

adhesives and sealants have 

increasingly been used to simplify 

construction and enhance 

performance. 

The UK is one of the largest and 

most competitive markets in 

Europe. In spite of the major 

run-down in manufacturing over 

the last 20 years the UK adhesives 

industry remains second only 

to Germany’s in size, and 

comparable with France and Italy.

Association (BASA) has been the 

representative association for 

the UK adhesives and sealants 

industry for more than 25 years. 

Formed from the merger of 

the Sealants Manufacturers 

Conference and the British 

Adhesives Manufacturers 

Association in November 1983, 

BASA can trace its pedigree back 

to the 1940s when adhesive 

and sealant manufacturers 

were invited to assist the UK 

government with the strategic 

planning of materials for the 

industry. During the ensuing 

period organisations such as 

the Adhesive Manufacturers 

Association, the British 

Resin Rubber Manufacturers 

Association, The British Adhesive 

Manufacturers Association 

and the Sealant Manufacturers 

Conference gradually merged 

to form what is now Europe's 

only completely independent 

dedicated solely to the interests 

of its adhesives and sealants 

industry.

proved itself to be surprisingly 

resilient in spite of the triple 

whammy of astonishing increases 

in raw materials prices, growing 

costs from new regulation of 

chemicals and the desire for ever 

tighter controls to protect the 

environment. 

If 2010 was the year of cost 

increases 2011 looks set to be 

the year of major raw material 

shortages and our customers may 

find themselves increasingly with 

less choice of supply. 

Despite today’s tough trading 

conditions BASA has continued 

to increase its membership – for 

the eighth consecutive year. 

A further six companies joined 

in 2010 and membership now 

stands at almost 100 UK and 

Irish companies. We expect the 

coming year to be difficult but 

are confident that the adhesives 

and sealants industry has the 

ability and expertise to meet 

any challenges, as it has done 

in the past, and that BASA will 

continue to expand its services 

and contribute to a UK growth 

industry.

The Global Market 

The year 2010 earmarks the recovery of the demand for adhesives and 

sealants worldwide. 

While the first signs of growth were evidenced in the Asia-Pacific 

region in late 2009 it was only in the first half of 2010 that recovery in 

the industrialised markets became more noticeable. In late 2010 and 

continuing into 2011 the industrialized regions’ demand reached prerecession 

levels. 

The fast growing emerging markets, such as China and India, are 

supporting a significant portion of the incremental demand for 

adhesives and sealants globally. In comparison, the demand in the 

industrialized regions qualifies as more mature and is increasing more 

slowly. 

At the end of 2010 the size of the global market for adhesives and 

sealants was estimated at about 12 million tonnes and a value of €30 

billions.

Energy conservation and the generation of renewable energies are 

important factors that drive the demand for adhesives and sealants and the development of new products.

Adverse market forces include disruptions in raw material supplies 

and rising raw material and energy costs. Furthermore, the currency 

fluctuations between the Euro and the US Dollar can lead to double 

digit currency translation distortions in the reporting of 2010 

international sales turnover values. 

Regulatory compliance requirements continue augmenting and 

spreading around the world, which puts additional constraints on 

formulators and raw material suppliers. 

The European Market 

The demand for adhesives sealants in Europe (Western and Eastern 

Europe, including. Turkey) represented 31% of the global market in 

2010, which corresponds to a volume of 4 million tonnes and a value 

of €10,5 billions, in 2010. 

The split of the European demand for adhesives and sealants (volume 

basis) shows Germany’s large share, followed by Great Britain, France 

and Italy, very similar in size, plus a third tier of countries that each 

control a share of the European market in the range of 5% and 10%. 

The remaining countries include the Benelux and Scandinavian 

countries, Switzerland, Norway, plus smaller EU and CIS markets.

Market Trends in Europe 

The demand recovered in most European countries in 2010. In 

Western Europe growth was triggered by industrial applications 

more than by construction activities. The market recovery has been 

supported to a large extent by the production of capital goods and 

consumer durables exported to Asia and other parts of the world. 

Following a recovery of nearly 10% in 2010 the demand should 

stabilise in 2011 and 2012 and resume an average annual growth of 

about 3%. 

In Central and Eastern Europe, on the other hand, infrastructure 

and housing development continues after the fallback of 2009 and 

stimulates the demand for adhesives and sealants. At the same time 

industrial production continues to increase and so is consumer 

spending. 

The projection of an average annual demand growth above 6%, at 

least twice the rate of growth expected in Western Europe in 2011 

and 2012, is supported by the anticipation of sustained economic 

growth in the CEE region. 

The following graph provides a split of the European demand for 

adhesives and sealants by market segment in terms of volume. 

Market Trends in Great Britain 

The British demand for adhesives and sealants is estimated at about 

450 thousand tonnes for 2010 and a value of nearly € 1 billion. 

When compared with the total European market the structure and 

the growth of the British demand for adhesives and sealants differs in 

parts as shown in Figure 4 that displays the demand split by market

segment. 

On a tonnage basis the Converting/Packaging demand controls 

the largest market share while other industrial applications such as 

transportation, Woodworking and Joinery, Footwear and Leather as 

well as General Assembly command smaller shares than in the other 

large European countries such as Germany, Italy and France. The 

Construction and DIY/Consumer segments enjoy a similar share as in 

other parts of Europe. 

The difference between the growth of the British market in 2010 

compared with that in other regions of Europe is the upswing in 

the Construction sector and a rather moderate increase in industrial 

output, which could not yet make up for the volume losses 

accumulated since 2008.

as revealed by volume 30 2010, of the 

International Journal of Adhesion and Adhesives

There are three journals in the world which deal with the science and 

technology of adhesives and sealants, namely the Journal of Adhesion, 

the International Journal of Adhesion and Adhesives (IJAA) and the 

Journal of Adhesion Science and Technology. The IJAA is published in 

the UK by Elsevier Ltd and we are the joint editors-in-chief.

Here we review the contents of volume 30 for 2010, our intention 

being to provide a window of what is happening in research into 

adhesives and sealants. Authors of articles are asked to provide a few 

keywords and here we use them to indicate which areas are most 

active. Below we show topics which have prompted keywords in 

more than 5 articles; the number of keywords is shown in brackets. 

Epoxides (26), finite element stress analysis (22), lap-shear (14), 

joint design (13), composites (13), aluminium and alloys (10), novel 

adhesives (8) stress analysis (8). mechanical properties of adhesives 

(7), adhesives for wood (6) and fatigue (6). 

The total number of papers to appear was 84, and the following 

countries were represented. 

France 12 papers, UK 11, Germany 9, USA 7, Italy and Spain 6, Canada, 

Japan and the Netherlands 5, China, India and Portugal 4, South 

Korea and Malaysia 3, Brazil, Poland, Sweden, Switzerland and Turkey 

2 and Algeria, Australia, Denmark, Greece, Lebanon, Luxembourg, 

Mexico, Roumania, South Africa 1. Some papers had authors 

from more than one country. Almost all papers originated from 

universities or research institutes. 

The journal has a strong theme on joint mechanics. Issue 5, edited by 

da Silva and Öchsner, was devoted to joint design and featured 14 

papers from 10 countries. Several other papers used finite element 

analysis and similar numerical techniques for predicting stresses 

and strains in joints, the aim being to predict failure strengths, 

whether static or fatigue, with various types of configuration. Stress 

reduction techniques were based on such analyses. In two papers, 

ultrasonics were used; in one case for defect location and the other 

for improving the bondability of surfaces by subjecting them to 

high-power ultrasonics. Some other timely topics are as follows. 

Pressure-sensitive adhesion features in a paper from China (UVcrosslinking), 

from India and the USA (tackifiers) and from Canada 

(latex polymer). Adhesives from natural sources are topics from 

Sweden (soy protein and wheat gluten), China and the USA (cow 

blood), the Netherlands (soy protein) and Canada (lodgepole pine 

bark). Nanoparticulate fillers featured in a paper from the UK and 

Malaysia (moisture absorption in epoxides for timber bonding), 

the UK (hybrid sol-gel epoxide) and Spain (carbon nanotubes and 

electrical conductivity). 

Other papers of note included surface treatment of SBR (Spain), 

underwater bonding to polycarbonate by photoinitiation of a 

cyanoacrylate (South Africa), a dielectric study of water attacking 

CFRP joints (UK) and the effect of surface roughness an the adhesion 

of polyacrylates (Germany).

com). Here titles of articles and names of authors are displayed, 

and abstracts and section headings can be seen. There is also the 

opportunity to purchase individual papers on line. As an example 

“Thermal residual stress analysis of epoxy bi-material laminates and 

bonded joints” by Jumbo, Ashcroft, Crocombe and Abdel Wahab 

which occupies 16 pages costs 31.50 US$.

£2.5bn each year to the UK economy and 

play a key role in enabling innovation, 

improving competitiveness, increasing 

reliability, ensuring safety, improving 

accessibility, controlling quality, managing

As the world’s first national standards body, 

BSI British Standards (www.bsigroup.com) 

has a globally recognized reputation for 

independence, integrity and innovation. 

Work on the standardisation of adhesives 

and sealants in the UK began over 50 years 

ago and now has extended into European 

and Internationally developed Standards . 

British standards covering the performance 

of adhesives and sealants can be found in 

applications as diverse as Aerospace industry 

and bathroom tiles. In Eire the standards 

body is the National Standards Authority of

Put at its simplest, a standard is an agreed, 

repeatable way of doing something. It is 

a published document that contains a 

technical specification or other precise 

criteria designed to be used consistently 

as a rule, guideline, or definition. Any 

standard is a collective work. Committees of 

manufacturers, users, research organisations, 

government departments and consumers 

work together to draw up standards that 

evolve to meet the demands of society 

and technology. As the recognised trade 

association for the adhesives and sealants 

industry in the UK, BASA has nominated 

experts drawn principally from member 

companies to represent the industry on the 

relevant BSI, CEN and ISO committees and 

working groups. 

Although standards are designed for 

voluntary use and do not impose any 

regulations,, laws and regulations may refer 

to certain standards and make compliance 

with them compulsory. Moreover both the 

European Court of Justice and the national 

courts within the EU are obliged to base their 

jurisdiction on European standards. 

The use of standards is increasingly becoming 

a prerequisite to worldwide trade. A very 

large percentage of export is influenced by 

the European and international standards 

business. For instance all European Union 

standards are automatically adopted as British 

Standards. 

Although standards are designed for 

voluntary use and do not impose any 

regulations, standards are often used as a 

flexible alternative to regulation and many 

industry bodies and trade associations 

require products (e.g. motorcycle helmets) to 

conform to a British Standard or a European 

Directive before they can be offered for sale in 

the UK or EU. This is to ensure that countries 

and companies can compete on equal terms.

ISO 14001 Accreditation

Introduction 

All industrial activities cause some degree 

of environmental impact, through the 

consumption of natural resources, generation 

of waste and release of polluting discharges 

and emissions. There is now an increasing 

expectation on the business community to take 

greater responsibility for their environmental 

impacts as environmental issues gain a higher 

profile. 

Over recent years environmental legislation 

has risen in profile with any pollution incident 

now leading to considerable financial impact 

through fines and clean up costs, and perhaps 

more importantly significant and lasting 

reputational damage. The management of legal 

requirements and environmental performance 

are therefore becoming increasingly 

mainstream management issues. 

Benefits of Environmental 

Management Systems 

An Environmental Management System 

(EMS) is a direct and meaningful step that 

any business can take to help address these 

pressures. A robustly implemented EMS will 

also provide potential opportunities such as 

year-on-year cost savings, marketing benefits 

through third party certification and reduced 

regulatory pressures/costs. Implementing an 

EMS that is certified to the ISO 14001 standard is 

becoming increasingly important and desirable 

for companies, largely because of the following 

benefits: 

l Helps to meet customer expectations and win 

more business on the back of stronger tendering 

credentials; 

l Provides a robust framework for delivering cost 

savings through resource efficiency, pollution 

prevention and waste management; 

l Helps to address demands and expectations of 

regulators, insurers, employees, investors and 

other stakeholders; 

l Provides regulatory benefits through reduced 

permit fees and regulatory inspection time; 

l Improves company image and reputation; and 

l Improves legal compliance status, and reduces 

business risk and cost of insurance premiums. 

WYG Environment Planning Transport Ltd is a 

leading environmental consultancy with a long 

history of helping businesses with the EMS 

implementation process. Within the context of 

a multi-sector EMS project, WYG’s experience 

has shown that that the average cost saving 

during the initial EMS implementation year is 

£6,000 per business. These savings can be much 

higher in larger and more complex businesses 

such as those within the BASA membership, 

and can often increase during the years after 

certification, when the focus shifts away from 

the system development and more towards 

environmental performance improvement. By 

focusing on energy, fuel, raw material and water

management practices, attractive savings and 

business benefits can be delivered year on year.. 

Externally recognised EMS 

certification – ISO 14001 

An EMS provides a consistent approach to the 

management of significant environmental 

aspects for any business, and helps to drive 

continual improvement in environmental 

performance. It also allows external recognition 

in the form of accredited third party certification 

to the ISO 14001, EMAS and/or BS 8555/Acorn 

standards. Pre-qualification questionnaires and 

tender specifications now frequently require 

certification to at least one of these standards, 

and without such certification, companies 

may increasingly be losing out on business 

opportunities. 

Achieving certification to ISO 14001 and EMAS 

can appear somewhat daunting at face value, 

so the step-by-step approach offered by BS 

8555/Acorn provides a clear route map to either 

standard, but with the added benefit of phased 

certification on route. This enables companies, 

of varying size and complexity, to reach the 

level of environmental management that is 

appropriate for them, which in some cases may 

not necessarily be full certification to ISO 14001 

or EMAS. 

Implementation of an EMS 

To initiate an EMS, the first step of securing 

senior management commitment is essential. 

This helps to prepare the company for a 

successful and effective EMS implementation 

process and support the ongoing requirement 

to deliver continual improvement following 

certification. The next step is to identify the 

company’s environmental baseline and 

applicable legal and other requirements can 

be identified, this helps inform the company’s 

significant environmental aspects.. 

To tackle the identified significant 

environmental aspects, a series of objectives, 

targets and programmes are set out and a set 

of environmental performance indicators is 

established to monitor progress. These key steps 

help to deliver a performance-focused EMS. 

Operational controls, training and awareness 

campaigns, and communication processes are 

introduced to support continual improvement 

and help engage employees, a key feature 

of any successful EMS. As with any formal 

management system, documentation control, 

internal auditing and management review 

process are essential to assist the company 

in identifying strengths and weaknesses and 

maintaining standards. 

An EMS shares many common themes with 

quality, health and safety management 

systems and an integrated approach can help a 

company to manage all its significant impacts 

and business priorities in an efficient manner. 

The BASA EMS scheme 

BASA has identified Environmental 

Management as one of its key priorities 

and through a Task Group is now working 

on the development of a sector-specific 

support package to aid BASA members in 

implementing an EMS. WYG is providing the 

specialist environmental support to enable 

this and brings experience of doing similar 

with other industry sectors. The BS 8555/Acorn 

approach will be used to enable BASA members 

to progressively work towards ISO 14001 

certification. The package will be developed 

and tested within a pilot project in 2011 prior 

to being made available for roll out to all BASA 

members. 

The main advantages of a sector approach are 

the development of bespoke support materials 

that are specifically tailored for BASA members, 

together with the ability to deliver group 

training and support. This drastically reduces 

the EMS implementation costs and provides 

good opportunities for best practice sharing 

and problem solving. The sector approach has 

already been successfully tried and tested by 

WYG in nine other sectors, and has proven to be 

a very effective and value for money approach. 

This 12-month pilot programme will allow each 

of the 10 participant companies to implement 

an EMS in line with the ISO 14001 standard, and 

will involve attendance at a series of training 

workshops together with a number of site 

support visits. 

The pilot project will result in the production of 

a sector-specific support package that can be 

utilised by other BASA member companies in 

future. Ten places on the pilot programme are 

available to BASA members for £3,000 (+VAT). 

The same package of support offered on a 

single company basis would cost approximately 

£6,000, so the BASA project represents a 50% 

saving. 

The £3,000 investment will provide the 

following support: 

l One baseline audit; 

l Five central EMS training workshops; 

l Two consultancy support days; 

l One internal environmental auditor training 

workshop; and 

l Tailored EMS guidance notes and templates for 

each Phase of BS 8555/Acorn. 

With some members already eagerly signing 

up for the 2011 pilot programme, BASA 

is confident that this initiative to increase 

the number of member companies with a 

certified EMS is the way forward to improve 

environmental standards and stay ahead of the 

rest of the industry. This will cast the adhesives 

and sealants sector in a particularly good light 

on what is becoming a key business issue.

Indoor Air Quality, VOC 

testing, regulations and 

harmonisation

The impact of construction products on 

Indoor Air Quality has come into focus of 

several regulators in Europe and in a number 

of EU member states. Most attention is given 

to VOC (volatile organic compounds) and 

formaldehyde. Harmonization within Europe 

proceeds regarding testing methods, but not 

concerning evaluation and limit values. 

German AgBB and DIBt 

requirements 

German DIBt approval on basis of AgBB VOC 

emissions testing and evaluation is required for 

more and more construction products, such as 

l all kind of floor covering, parquet adhesives 

and parquet coatings 

l all floorings adhesives from 2012 

l resin floor coatings 

l sport floors 

l wall coverings 

Without approval, which is shown by 

fixing the “Ü” mark on the product (Ü = 

Übereinstimmung = conformity), these 

products can be sold in Germany, but they 

must not be installed in any room meant 

for humans staying longer than short-term. 

This is independent of whether such rooms 

are located in public, commercial or private 

building. 

Evaluation goes for compliance with AgBB 

VOC requirements after 3 and after 28 days 

in a ventilated test chamber. This includes 

limit values for TVOC, TSVOC, carcinogenic 

compounds, individual VOC LCI values, and 

sum of both VOCs without assigned LCI and 

not identified VOCs. Testing is performed using 

DIBt test method, similar to ISO 16000 parts 

3, 6, 9 and 11. Results are calculated to the 

European Reference Room as specified by 

CEN TC 351 WG 2. 

Besides testing, you have to deliver a precise 

recipe to DIBt approval body, and you need a 5 

years contract on auditing and certification. 

French regulations 

Emissions of 4 CMR compounds are limited 

for construction products and decorative 

products used indoors since 2010: Benzene, 

trichloroethylene, dibutylphthalate (DBP) 

and diethylhexylphthalate (DEHP). Emissions 

must not be higher than 1 µg/m3 if tested in 

accordance with ISO 16000 parts 3, 6, 9, 10 

and 11. Results are calculated to the European 

Reference Room as specified by CEN Technical 

Committee (TC) 351 Working Group (WG) 

2. Testing is needed only if you do not have 

any other information available supporting 

absence of these substances. No labelling 

is required. 

A compulsory labelling of VOC emissions 

class is required for all construction products 

and decorative products used indoors. No 

concerned product must be sold in France 

without such a label from 1st January 2012 

(for products new on French market) or 

from 1st September 2013 (for all products). 

Products with high emissions will not be 

banned, they just have to be labelled as such. 

Labelling shall occur without any registration 

or approval system, but by self-declaration 

of the manufacturer. Testing is needed only 

if you do not have any other information 

available supporting absence or sufficiently 

low emissions of the limited substances and 

of TVOC. 

The classification knows two sets of emissions 

classes, one containing a list of 10 individual 

VOCs, whereof formaldehyde is the most 

important challenge, and one for Total VOCs 

(TVOC). The highest (“worst”) of the individual 

emissions classes determines the overall 

emissions class. All this relies on emissions after 

28 days in a ventilated test chamber. Again, any 

testing is performed in accordance with ISO 

16000 parts 3, 6, 9, 10 and 11, and results are 

calculated to the European Reference Room. 

AFSSET guideline has been discussed for a 

while, but this did not receive any legal status 

and remained just an opinion, even though 

sometimes required for public buildings and 

for sustainable building projects (HQE). 

Other countries 

Some other countries are considering to 

establish their own requirements on low VOC 

emissions, namely Belgium, but nothing has 

been published by end of 2010 

Harmonization 

There is no real activity to harmonize legal limit 

values for VOC emissions on European level, 

even though some industries lobby for having 

the same requirements in whole Europe. There 

is an informal task force trying to harmonize 

LCI limit values of individual VOCs for whole 

Europe, but this work showed to be difficult 

and time-consuming. 

Harmonization is about to take place on the 

aspect of testing method. While ISO 16000 

parts 3, 6, 9 and 11 were taken as basic 

method, a number of additional specifications 

and precisions have been put together by 

CEN TC 351. The present draft European 

VOC emissions test method will undergo 

robustness validation during 2011, with an 

investigation of how a change of some critical 

testing parameters will influence test result. 

Publication as CEN Technical Specification 

is foreseen for 2012/2013. Final publication 

as EN norm requires some round-robin tests 

and will not occur before 2016. Already now, 

a number of CEN product TCs wait on this 

technical specification as to work on inclusion 

of VOC testing into their proper performance 

standards for CE marking. 

Future CE marking 

EU Commission granted mandates to several 

CEN product standardization committees for 

establishing tests and performance classes 

covering the different requirements in EU 

member states under Construction Products 

Directive. CE mark means that a product 

has been characterised in conformity with 

such a norm. In near future EU Commission 

will require that several of these norms also 

cover VOC emissions into air. As national 

requirements are different, and will remain 

different, most probably there will be defined 

performance classes under CE mark that allow 

sales in the different countries, e.g. one class for 

Germany, another one for France, etc. The old 

idea that a CE mark will allow unrestricted sales 

in the whole EU will no longer hold true for the 

VOC emissions under Construction Products 

Directive.

BASA Meetings 

Code of Conduct 

All companies must at all times comply with 

the requirements of competition law as set out 

in the Competition Act 1998. The Act requires 

that companies must not engage in any 

practice, which will or may prevent, restrict or 

distort competition or constitute an abuse of a 

dominant position. 

Application of Guidance 

These guidelines apply to all persons 

attending any BASA meeting, or representing 

the Association at any external meeting, or 

communicating by post, telephone, e-mail or 

by any other means on any issue or activity 

connected with the affairs of the Association. At 

the start of all BASA meetings the Chairman will 

remind those present that the meeting is held 

under the terms of the BASA Code of Conduct 

and will so record in the minutes.

Conduct of Meetings 

l All Committees, Working Groups and Task 

Groups must have agreed Terms of Reference 

and formally appointed a Chairman. 

l All meetings must have a clear purpose, 

which is communicated in advance along 

with an agreed agenda. 

l The Chairman must ensure that the meeting 

keeps to its agenda. 

l The agenda and minutes/action notes of each 

meeting must be kept together with a list of 

participants. Copies should be posted to the 

appropriate Forum on the BASA website and 

to the BASA office. 

l Participants should never discuss any issues 

that could affect competition in a market 

(such as collusive or exclusionary practices). 

A non-exhaustive list of definite “no-go” areas 

include discussions on: prices or other terms 

on which goods or services are currently, 

or are to be, provided; sharing markets or 

customers; limiting the supply of goods or 

services (to keep the price up); rigging bids or 

colluding when tendering; and exclusionary 

measures including any against non-BASA 

members. 

l Attendees should take care with their 

language, careless use of language can cast 

suspicion of collusion on otherwise legitimate 

discussions. For example do not use “guilty” 

vocabulary such as “stitch up the market”, 

“cartel” or “dominant”. 

l If the Chairman of the meeting, or any other 

person present, becomes concerned that 

discussions are potentially anti-competitive 

he/she should ask for the subject to be 

changed at once. Attendees must not 

speculate about whether an activity is or 

is not in breach of competition law and 

if in doubt about an activity must stop 

discussing it. The Chairman’s decision will 

be final. This is because mere presence at an 

anti-competitive discussion is sufficient to be 

implicated in an infringement.
