need a clear idea <strong>of</strong> when a license is required. This Note has attempted to provide<br />

such guidance by <strong>of</strong>fering a test that would examine not only what is sampled, but also<br />

how that sample is used. Under this test, recording artists could feel free to use a few<br />

notes or a drumbeat without having to choose between a costly negotiation and<br />

licensing process, on the one hand or a potentially costly infringement suit on the other.<br />

While this is not a bright-line rule, the outcome would be fairly predictable in the vast<br />

majority <strong>of</strong> cases. Ultimately, any response to the digital sampling challenge should<br />

recognize that sampling merely allows recording artists to stand on the shoulders <strong>of</strong><br />

other artists, furthering creative expression—something that copyright law has always<br />

encouraged.
