1 - Background<br />
ABOUT THE APPROVALS PROCESS<br />
Regulati<strong>on</strong>s 25-27 of the Water Supply (Water Quality) (Scotl<strong>and</strong>) Regulati<strong>on</strong>s 1990 provide<br />
<strong>for</strong> the approval of substances, products <strong>and</strong> processes used <strong>in</strong> the provisi<strong>on</strong> of public water<br />
supplies. From 1 st January 2004, regulati<strong>on</strong>s 27 - 29 of the Water Supply (Water Quality)<br />
(Scotl<strong>and</strong>) Regulati<strong>on</strong>s 2001 replace the 1990 Regulati<strong>on</strong>s.<br />
The <str<strong>on</strong>g>Committee</str<strong>on</strong>g> <strong>on</strong> <strong>Products</strong> <strong>and</strong> <strong>Processes</strong><br />
The <str<strong>on</strong>g>Committee</str<strong>on</strong>g> <strong>on</strong> <strong>Products</strong> <strong>and</strong> <strong>Processes</strong> <strong>for</strong> <strong>Use</strong> <strong>in</strong> Public Water Supply (the <str<strong>on</strong>g>Committee</str<strong>on</strong>g>)<br />
advises the <strong>Scottish</strong> Executive Dr<strong>in</strong>k<strong>in</strong>g Water Quality Divisi<strong>on</strong> <strong>on</strong> approval issues. The<br />
<str<strong>on</strong>g>Committee</str<strong>on</strong>g> is an advisory n<strong>on</strong>-departmental public body. It c<strong>on</strong>sists of six members with<br />
expertise <strong>in</strong> eng<strong>in</strong>eer<strong>in</strong>g, materials science, toxicology, chemical analysis, water treatment<br />
<strong>and</strong> c<strong>on</strong>sumer relati<strong>on</strong>s. Details of the current membership are given <strong>in</strong> secti<strong>on</strong> 3.<br />

The Annual List of Approved <strong>Products</strong><br />
A list is published each year of all substances, products <strong>and</strong> processes <strong>for</strong> which approval has<br />
been granted, refused, revoked or modified, or <strong>for</strong> which use has been prohibited. This<br />
document is posted <strong>on</strong> the <strong>Scottish</strong> Executive website.<br />
2 - Report <strong>for</strong> 2003<br />
Impact of the 2000 <strong>and</strong> 2001 Regulati<strong>on</strong>s<br />
From 1 st January 2004 regulati<strong>on</strong>s 25 - 27 of the 1990 Regulati<strong>on</strong>s are replaced by regulati<strong>on</strong>s<br />
27 – 29 of the 2001 Regulati<strong>on</strong>s. The pr<strong>in</strong>cipal changes <strong>in</strong> the new Regulati<strong>on</strong>s are:<br />
• Precedence is given to European st<strong>and</strong>ards <strong>and</strong> European Technical Approvals<br />
• No provisi<strong>on</strong> <strong>for</strong> unapproved use at the water undertaker’s discreti<strong>on</strong><br />
• No provisi<strong>on</strong> <strong>for</strong> traditi<strong>on</strong>al use exempti<strong>on</strong>s from approval<br />
• Introducti<strong>on</strong> <strong>for</strong> the purposes of test<strong>in</strong>g <strong>and</strong> research must be authorised by the<br />
Government Authorities<br />
Regulati<strong>on</strong> 25 letter 5/2003 provides specific guidance <strong>on</strong> the new requirements <strong>for</strong> small<br />
surface area products that were <strong>for</strong>merly eligible <strong>for</strong> unapproved use.<br />
Approvals 2003 1 Pr<strong>in</strong>ted December 2003
<str<strong>on</strong>g>Committee</str<strong>on</strong>g> Bus<strong>in</strong>ess<br />
Dur<strong>in</strong>g 2003 the <str<strong>on</strong>g>Committee</str<strong>on</strong>g> met <strong>on</strong> six occasi<strong>on</strong>s:<br />
• 101 applicati<strong>on</strong>s <strong>for</strong> approval were c<strong>on</strong>sidered, <strong>in</strong>clud<strong>in</strong>g 45 new applicati<strong>on</strong>s<br />
• 51 products were approved <strong>and</strong> no product was refused approval<br />
• 19 products were revoked as a result of an audit <strong>and</strong> 9 products as a result of the<br />
prohibiti<strong>on</strong> of the use of PVC pipes with lead stabilisers<br />
• The Authorities gave approval to the modificati<strong>on</strong> of c<strong>on</strong>diti<strong>on</strong>s to 1 currently listed<br />
product<br />
• The Authorities modified the nati<strong>on</strong>al c<strong>on</strong>diti<strong>on</strong>s of use <strong>for</strong> 1 water treatment<br />
chemical<br />
Communicati<strong>on</strong>s with water <strong>in</strong>dustry <strong>and</strong> approval holders<br />
Five Regulati<strong>on</strong> 25 letters were issued <strong>in</strong> 2003:<br />
• 1/2003 announced the issue of the 2002 list of approved products.<br />
• 2/2003 advised of the changes to nati<strong>on</strong>al c<strong>on</strong>diti<strong>on</strong> of use <strong>for</strong> polyacrylamide<br />
flocculants<br />
• 3/2003 rem<strong>in</strong>ded water companies <strong>and</strong> suppliers of PVC-U water supply pipes about<br />
the prohibiti<strong>on</strong> of the use of lead-based compounds <strong>in</strong> the producti<strong>on</strong> of PVC-U water<br />
supply pipes that takes effect from 25 th December 2003.<br />
• 4/2003 advised water companies <strong>on</strong> requirements <strong>for</strong> the civil eng<strong>in</strong>eer<strong>in</strong>g uses of<br />
c<strong>on</strong>crete <strong>in</strong> water treatment works.<br />
• 5/2003 gave guidance <strong>on</strong> the requirements under Regulati<strong>on</strong> 27 of the 2001<br />
Regulati<strong>on</strong>s <strong>for</strong> approval of small surface area products.<br />
Audit of approved products<br />
A requirement <strong>for</strong> audit of approved products was <strong>in</strong>troduced <strong>in</strong> July 2002 <strong>and</strong> the<br />
programme of audit<strong>in</strong>g, which started <strong>in</strong> Autumn 2002, has c<strong>on</strong>t<strong>in</strong>ued throughout 2003. To<br />
date 144 products have been audited <strong>and</strong> 35 <strong>for</strong>merly approved products have been removed<br />
from the 2003 List of Approved products. Some products have been removed from the list<br />
because they are no l<strong>on</strong>ger available; <strong>in</strong> other cases approval has been revoked because the<br />
product failed the audit tests or because the approval holder had failed to comply with a<br />
c<strong>on</strong>diti<strong>on</strong> of approval. Full details of products removed from the 2003 List are c<strong>on</strong>ta<strong>in</strong>ed <strong>in</strong><br />
Appendix 2 <strong>and</strong> 3.<br />
Approvals 2003 2 Pr<strong>in</strong>ted December 2003
European developments <strong>in</strong> c<strong>on</strong>structi<strong>on</strong> products <strong>and</strong> treatment chemicals<br />
The majority of chemicals <strong>and</strong> filter materials <strong>for</strong> dr<strong>in</strong>k<strong>in</strong>g water treatment are now the<br />
subject of European st<strong>and</strong>ards. A full list<strong>in</strong>g of st<strong>and</strong>ards published by BSI <strong>in</strong> its BS:EN<br />
series is c<strong>on</strong>ta<strong>in</strong>ed <strong>in</strong> Appendices 1.6 <strong>and</strong> 1.7. Appendix 1.8 lists the European st<strong>and</strong>ards <strong>for</strong><br />
test<strong>in</strong>g the effects of organic products <strong>and</strong> materials <strong>on</strong> water <strong>in</strong>tended <strong>for</strong> human<br />
c<strong>on</strong>sumpti<strong>on</strong>. Dur<strong>in</strong>g 2003 the UK made a notificati<strong>on</strong> under Directive 98/34/EC <strong>on</strong> the<br />
notificati<strong>on</strong> of new technical requirements. Details are given above <strong>in</strong> Communicati<strong>on</strong>s with<br />
water <strong>in</strong>dustry <strong>and</strong> approval holders.<br />
DWI provides the UK’s regulatory representati<strong>on</strong> <strong>on</strong> the European Commissi<strong>on</strong>’s Regulatory<br />
Group - C<strong>on</strong>structi<strong>on</strong> <strong>Products</strong> Dr<strong>in</strong>k<strong>in</strong>g Water. This Group is develop<strong>in</strong>g the European<br />
Acceptance Scheme <strong>for</strong> dr<strong>in</strong>k<strong>in</strong>g water c<strong>on</strong>structi<strong>on</strong> products. The EAS will provide<br />
harm<strong>on</strong>ised arrangements throughout the European Uni<strong>on</strong> <strong>for</strong> test<strong>in</strong>g <strong>and</strong> acceptance of<br />
dr<strong>in</strong>k<strong>in</strong>g water c<strong>on</strong>structi<strong>on</strong> products. Progress with the EAS <strong>and</strong> a copy of the <strong>in</strong>terim report<br />
are posted <strong>on</strong> the DG Enterprise website:<br />

The EAS will eventually replace the UK’s nati<strong>on</strong>al approval requirements. DWI has a number<br />
of <strong>in</strong>itiatives underway prepar<strong>in</strong>g <strong>for</strong> transiti<strong>on</strong> from nati<strong>on</strong>al to European requirements <strong>for</strong><br />
test<strong>in</strong>g <strong>and</strong> certificati<strong>on</strong>. These <strong>in</strong>clude:<br />
• Meet<strong>in</strong>gs to dissem<strong>in</strong>ate <strong>in</strong><strong>for</strong>mati<strong>on</strong> about the EAS <strong>and</strong> its implicati<strong>on</strong>s <strong>for</strong> the UK<br />
(details of current activities are <strong>on</strong> the DWI website:<br />

• Certificati<strong>on</strong> <strong>and</strong> test<strong>in</strong>g <strong>in</strong>frastructure. BuildCert <strong>and</strong> BSI are now notified bodies<br />
<strong>for</strong> the purposes of the EAS. The <str<strong>on</strong>g>Committee</str<strong>on</strong>g>’s designated test laboratories are be<strong>in</strong>g<br />
encouraged to provide test<strong>in</strong>g services<br />
• Research to assess the impact of European test requirements <strong>for</strong> the UK water<br />
<strong>in</strong>dustry <strong>and</strong> its suppliers<br />
• Where appropriate, early implementati<strong>on</strong> of European test requirements<br />
The EAS will replace the test<strong>in</strong>g <strong>and</strong> certificati<strong>on</strong> resp<strong>on</strong>sibilities of the Water Regulati<strong>on</strong>s<br />
Advisory Scheme <strong>and</strong> the approval powers of the Government Authorities. In preparati<strong>on</strong> <strong>for</strong><br />
the EAS, WRAS <strong>and</strong> the <str<strong>on</strong>g>Committee</str<strong>on</strong>g> now use jo<strong>in</strong>tly designated test laboratories.<br />

REGULATION 25<br />
<strong>Products</strong> approved by the Government Authorities <strong>for</strong> use <strong>in</strong> public water supplies<br />
are listed <strong>in</strong> three Parts. Part I <strong>in</strong>cludes products based <strong>on</strong> chemicals that are not<br />
subject of a BS EN. Part II lists c<strong>on</strong>structi<strong>on</strong> products <strong>and</strong> Part III lists membranes<br />
<strong>and</strong> filters. All the products must be used <strong>in</strong> accordance with the relevant c<strong>on</strong>diti<strong>on</strong>s<br />
of approval, <strong>in</strong>clud<strong>in</strong>g the three general c<strong>on</strong>diti<strong>on</strong>s of approval reproduced below:<br />
(1) That use is <strong>in</strong> accordance with an Instructi<strong>on</strong>s <strong>for</strong> <strong>Use</strong> document. Approval<br />
holders must provide <strong>Scottish</strong> Water with copies of the Instructi<strong>on</strong>s <strong>for</strong> <strong>Use</strong><br />
Document that was c<strong>on</strong>sidered by the <str<strong>on</strong>g>Committee</str<strong>on</strong>g> when approval was<br />
recommended.<br />

PART I CHEMICALS<br />
As a c<strong>on</strong>sequence of the publicati<strong>on</strong> of European st<strong>and</strong>ards (BS: EN) <strong>for</strong> dr<strong>in</strong>k<strong>in</strong>g<br />
water treatment chemicals, products that c<strong>on</strong><strong>for</strong>m to a BS: EN may be used without<br />
the approval of Government Authorities, provid<strong>in</strong>g that nati<strong>on</strong>al c<strong>on</strong>diti<strong>on</strong>s of use are<br />
observed – see Appendix 1.6. These products are there<strong>for</strong>e no l<strong>on</strong>ger listed <strong>in</strong> this<br />

system with equivalent per<strong>for</strong>mance, which provides a c<strong>on</strong>t<strong>in</strong>uous numerical visual<br />
display <strong>and</strong> a m<strong>in</strong>imum of 2 copies of a pr<strong>in</strong>tout show<strong>in</strong>g a record of the res<strong>in</strong> <strong>and</strong><br />
hardener delivered to the spray head. The equipment must dispense the res<strong>in</strong> <strong>and</strong><br />
hardener with<strong>in</strong> ±5% of the correct mix ratio. The system must also give appropriate<br />
audible-alarm <strong>and</strong> abort resp<strong>on</strong>ses if the mix-ratio is out of specificati<strong>on</strong>.<br />
(iv) From completi<strong>on</strong> of material applicati<strong>on</strong>, the l<strong>in</strong><strong>in</strong>g shall be air cured <strong>for</strong> a<br />
m<strong>in</strong>imum period of 16 hours be<strong>for</strong>e uncapp<strong>in</strong>g <strong>and</strong> subsequent <strong>in</strong>specti<strong>on</strong>,<br />
dis<strong>in</strong>fecti<strong>on</strong> <strong>and</strong> return to service procedures can commence.<br />
(v) <strong>Scottish</strong> Water’s appo<strong>in</strong>ted representative must obta<strong>in</strong> or must be<br />
provided with copies of the records listed below be<strong>for</strong>e each secti<strong>on</strong> of the ma<strong>in</strong> is<br />
accepted <strong>for</strong> return to supply:<br />
a) a record of weight measurements of res<strong>in</strong> <strong>and</strong> hardener made to check the mix<br />
ratio prior to each operati<strong>on</strong>;<br />
b) the temperatures of the res<strong>in</strong> <strong>and</strong> hardener <strong>in</strong> the storage tanks;<br />
c) a c<strong>on</strong>t<strong>in</strong>uous hard-copy record, which <strong>in</strong>dicates the proporti<strong>on</strong>s <strong>and</strong> quantities of<br />
res<strong>in</strong> <strong>and</strong> hardener delivered to the spray head, <strong>and</strong> a record of the length <strong>and</strong><br />
diameter of ma<strong>in</strong> renovated;<br />
d) a record of the pre-cure <strong>in</strong>specti<strong>on</strong>, <strong>in</strong>clud<strong>in</strong>g the assessment of the quality,<br />
uni<strong>for</strong>mity <strong>and</strong> thickness of the l<strong>in</strong><strong>in</strong>g;<br />
e) a record of the post-cure <strong>in</strong>specti<strong>on</strong> <strong>in</strong>clud<strong>in</strong>g the assessment of the quality,<br />
uni<strong>for</strong>mity <strong>and</strong> hardness of the cured l<strong>in</strong><strong>in</strong>g; <strong>and</strong><br />
f) a closed-circuit televisi<strong>on</strong> record<strong>in</strong>g of all secti<strong>on</strong>s of renovated ma<strong>in</strong> <strong>and</strong> the<br />
results of the <strong>in</strong>specti<strong>on</strong> of any pipe samples taken.<br />
C<strong>on</strong>diti<strong>on</strong> (ii) above should be deemed to be satisfied, notwithst<strong>and</strong><strong>in</strong>g the fact that<br />
the c<strong>on</strong>tractor who applies the res<strong>in</strong> has not achieved full certificati<strong>on</strong> of their Quality<br />
System, so l<strong>on</strong>g as the c<strong>on</strong>tractor has been accredited by an Approved Certify<strong>in</strong>g<br />
Body <strong>and</strong> not more than 18 m<strong>on</strong>ths have elapsed s<strong>in</strong>ce the date of the accreditati<strong>on</strong>.<br />
Where WRc approved the c<strong>on</strong>tractor be<strong>for</strong>e 7 July 1992, he shall be treated <strong>for</strong> this<br />
purpose as if he had been approved <strong>on</strong> that date. <strong>Scottish</strong> Water <strong>and</strong> approval holders<br />
should encourage c<strong>on</strong>tractors to register with a certificati<strong>on</strong> body which has been<br />
