was excluded from recent publication <strong>of</strong> <strong>the</strong> Warhol catalogue raisonné. The<br />

Court found that – at least in part – plaintiff had suffiently alleged violations <strong>of</strong><br />

sect. 43(a) <strong>of</strong> <strong>the</strong> Lanham Act. 53 Acc<strong>or</strong>dingly, <strong>the</strong> stay <strong>of</strong> discovery was lifted<br />

and <strong>the</strong> parties were invited to file fur<strong>the</strong>r pre-trial statements. 54<br />

3. <strong>Liability</strong> <strong>of</strong> <strong>the</strong> owners<br />

It is remarkable that not only <strong>the</strong> owners <strong>of</strong> w<strong>or</strong>ks <strong>of</strong> art are suing <strong>the</strong> experts<br />

having given an unfavourable expertise but it is also <strong>the</strong> expert who may have a<br />

cause <strong>of</strong> action against <strong>the</strong> owner.<br />

a) Seltzer v. M<strong>or</strong>ton<br />

In Seltzer v. M<strong>or</strong>ton 55 , <strong>the</strong> law firm Gibson Dunn & Crutcher, sued W. Steve<br />

Seltzer on behalf <strong>of</strong> Steve M<strong>or</strong>ton, an art collect<strong>or</strong> who owned <strong>the</strong> watercolour<br />

painting Lassoing a Longh<strong>or</strong>n. M<strong>or</strong>ton, <strong>the</strong> plaintiff, and his bro<strong>the</strong>r purchased<br />

<strong>the</strong> painting (which was signed with “C.M. Russell 1913.”) from Kennedy Galleries<br />

<strong>of</strong> New Y<strong>or</strong>k <strong>f<strong>or</strong></strong> USD 38’000 in 1972. The Kennedy Galleries had bought<br />

<strong>the</strong> w<strong>or</strong>k three months earlier from <strong>the</strong> Amon Carter Museum, F<strong>or</strong>t W<strong>or</strong>th, Texas.<br />

When M<strong>or</strong>ton sought to sell <strong>the</strong> painting at auction in 2001, a partner at <strong>the</strong><br />

auction house questioned whe<strong>the</strong>r <strong>the</strong> painting was done by Charles M. Russell<br />

(1864–1926). He contacted Seltzer and ano<strong>the</strong>r expert to au<strong>the</strong>nticate <strong>the</strong> painting.<br />

The plaintiff concluded <strong>the</strong> painting was <strong>the</strong> w<strong>or</strong>k <strong>of</strong> his grandfa<strong>the</strong>r, Olaf<br />

Carl Seltzer (1877–1957) and not Russell which reduced <strong>the</strong> value from approximately<br />

USD 750’000 to USD 75’000.<br />

Ra<strong>the</strong>r than sue Kennedy Galleries, M<strong>or</strong>ton hired Gibson Dunn & Crutcher to<br />

send a letter threatening to sue Seltzer if he did not lie regarding <strong>the</strong> au<strong>the</strong>nticity<br />

<strong>of</strong> <strong>the</strong> painting. Seltzer refused, and Gibson Dunn filed suit on behalf <strong>of</strong> M<strong>or</strong>ton<br />
