gaining on stage and even attract some public attention.6 All in all <strong>the</strong> <strong>ITU</strong> in general<br />

is far away from being an anaemic or dull organisation.7 This article will highlight<br />

its importance and recognition which it still gains out <strong>of</strong> <strong>the</strong> same reason and<br />

necessity for which its predecessor was established in <strong>the</strong> lgth century. Unusual<br />

when compared to sonie o<strong>the</strong>r UN bodies and agencies <strong>the</strong> <strong>ITU</strong> and its work are<br />

accepted among its 1898 members. <strong>The</strong> reason for its uniqueness among international<br />

organisations partly lies in <strong>the</strong> fact that it was founded on <strong>the</strong> principle <strong>of</strong><br />

co-operation between governments and <strong>the</strong> private sector, and has lead to a ra<strong>the</strong>r<br />

unique process <strong>of</strong> decision- and &apos;law-making-&apos; that is rare and unparalleled within<br />

<strong>the</strong> wider UN family.<br />

While exploring <strong>the</strong> <strong>ITU</strong>s objectives, its foundation and legal frainework and<br />

examining <strong>the</strong> reasons for its speciallty, it will fur<strong>the</strong>r be discussed, whe<strong>the</strong>r <strong>the</strong> decisions<br />

made can even be seen as a truly n e w source <strong>of</strong> international law.<br />

11. Objectives<br />

While in general recognising <strong>the</strong> sovereign right <strong>of</strong> each state over its telecom-<br />

inunication,111 <strong>the</strong> <strong>ITU</strong> 1s concerned with maintenance and extension <strong>of</strong> co-operation<br />

with regard to <strong>the</strong> use <strong>of</strong> telecommunication on <strong>the</strong> international plane. In ad-<br />

dition it also promotes development <strong>of</strong> facillties and efficiency <strong>of</strong> services,11 as en-<br />

shrined in Article 1 <strong>of</strong> <strong>the</strong> <strong>ITU</strong> Constitution12 (CS).<br />

Ill. Basic Structure<br />

Following <strong>the</strong> 1992 Additional Plenipotentlary Conference, which took place in<br />

Geneva, <strong>the</strong> <strong>ITU</strong> was dramatically remodelled in order to provide it with greater<br />

flexibility to adapt to today&apos;s increasingly complex, interactive and competitive en-<br />

vironment. A change that had been called for by experts and academics for years.<br />

As a result <strong>of</strong> <strong>the</strong> reorganisation, <strong>the</strong> <strong>Union</strong> was streamlined into three Sectors,<br />

corresponding to its three main areas <strong>of</strong> activity -<br />

<strong>Telecommunication</strong> Standardisa-<br />

tion (<strong>ITU</strong>-T), Radiocommunication (<strong>ITU</strong>-R) and <strong>Telecommunication</strong> Develop-<br />
