Valley Rent Growth Slows, Tucson Sees

The Phoenix metropolitan area in 

third quarter 2007 recorded average rents 

$22 higher than third quarter 2006 and 

just $5 higher than second quarter 2007, 

while vacancies increased 2.9 percentage 

points since last year. Concessions rose to 

62 percent during the period, up from 43 

percent in third quarter 2006. Tucson saw 

rents $20 higher than last year and 

increased vacancy.

Violence Bill 

Since the passage of Senate Bill 1227 

this year, a multitude of issues have arisen 

regarding its intent, its flaws and evidence 

of the need to amend the new law. The 

intent of this article is to highlight what 

actually constitutes domestic violence 

and a few of the glitches in the new law 

and how to deal with them. 

The legal definition of domestic violence 

is set forth in ARS §13-3601 

(A)(1-5), which states: 

A. "Domestic violence" means any act 

which is a dangerous crime against children 

as defined in section 13-604.01 or an offense 

defined in section 13-1201 through 13-1204, 

13-1302 through 13-1304, 13-1502 

through 13-1504 or 13-1602, section 13- 

2810, section 13-2904, subsection A, paragraph 

1, 2, 3 or 6, section 13-2916 or

Average monthly rent in the Valley in 

third quarter 2007 was $773, a record 

high but only $5 higher than second 

quarter 2007. This is the second smallest 

quarter-to-quarter increase recorded in 

the Phoenix metropolitan area since first 

quarter 2005. (The September issue of 

Apartment News reported that rent 

growth for the remainder of 2007 would 

occur, but that it would also decelerate.)

During third quarter 2007, the North 

Scottsdale/Fountain Hills submarket 

recorded the Valley’s highest rents at 

$1,030. This compares to an average of 

Federal Judge Neil Wake on Nov. 

14 heard oral arguments from plaintiffs 

as well as defendants regarding the 

2007 Arizona Workers Act, which is 

slated to take effect Jan. 1, 2008. Representing 

the plaintiffs are the Arizona 

Contractors Association, the U.S. 

Chamber of Commerce and 10 other 

organizations; the state of Arizona and 

$1,010 one year earlier. The area’s 

vacancy rate in third quarter 2007 was 

11.8 percent, the fourth highest rate 

among Valley submarkets for the period 

and an increase from the third quarter 

2006 average of 8.8 percent. Fifty-nine 

percent of area communities offered concessions, 

drastically higher than the 38 

percent recorded one year ago. 

Fallout from the deteriorating condo 

conversion market in the area was exacerbated 

due to the number of units that 

have either reverted back to rental properties 

or to the converted units originally 

purchased by speculators who were actually 

landlords, many of which did not 

employ effective rent-maximization 

strategies. (Readers should note that averages 

in this article are summarized only 

from apartment communities that 

remained as rental communities or ones 

that reverted back to rental communities. 

The increased vacancies and concessions

remaining submarket landlords to remain 

competitive.) 

The Valley’s most affordable apartment 

rental housing in third quarter 2007 

was in the Central Black Canyon submarket 

with average rents of $595. This is 

$27 higher than the area’s average of 

$568 in third quarter 2006. Central Black 

Canyon experienced the sixth highest 

rent growth percentage Valley wide in 

the past year. (The June 2006 edition of 

Apartment News reported rents in the 

area would increase.)

Area job growth, strong submarket fundamentals 

and the addition of a Class ‘A’ 

apartment community with the highest 

rental rates in the Phoenix metropolitan 

area contributed to this increase. 

The Uptown/Central Phoenix submarket 

experienced the Valley’s fifth 

highest percentage rent gain for the 

period. Area residents anticipating the 

light rail transit system that will begin 

service in the area in 2008 fueled demand 

for area housing. This demand has 

enabled area landlords to increase rents 

since last year. The area also had the 

sixth lowest vacancy in the Phoenix area, 

registering a vacancy rate of 7.7 percent 

in third quarter 2007. Intrinsic rent 

growth and relatively low vacancies for 

the area are likely for the remainder of 

2007 and throughout 2008. 

VACANCY 

Phoenix area vacancies rose to 10.3 

percent in third quarter 2007. This is a 

2.9 percentage point increase from the 

third quarter 2006 average of 7.7 percent. 

Third quarter 2006 was the tenth consecutive 

quarter that vacancies fell from the 

same period of the prior year. 

The AMA/Pete TeKampe Phoenix 

Projected Apartment Income (PPAI) 

Index, a weighted index that takes into 

consideration manifold factors that influence 

rental property metrics, was down 

sharply in third quarter 2006 and again in 

first quarter 2007, forecasting lower collected 

apartment rental income. Since 

the downturn in the PPAI, vacancies 

have risen steadily. Rising vacancy erodes 

collected rental income. (The AMA at 

its industry outlook conference Perspec- 

tives and Projections in September 2007 

reported rising vacancies were likely for 

the Phoenix area for the foreseeable 

future.)

2007, the area added five projects totaling 

1,351 units. (The March 2007 issue of 

Apartment News reported that climbing 

vacancies were likely in this submarket in 

2007.) 

The Southeast Valley submarket had 

the second-highest vacancy for third 

quarter 2007, recording vacancies of 17.3 

percent. Since the beginning of 2006, the 

area added 1,686 apartment units, and 

this increased competition contributed to 

submarket vacancies.

Northwest/Southwest County had the 

lowest vacancies during third quarter 

2007 at 6.5 percent. Area landlords 

reduced rents 6.2 percent since third 

quarter 2006, and this strategy was effective 

in reducing area vacancies from the 

20.6 percent average that occurred one 

year ago. (The AMA at Perspectives and 

Projections in September 2007 cited the 

East Mesa/Apache Junction submarket as 

a paragon submarket.) Rent reductions in 

2001 resulted in steadily declining vacancies 

that ultimately led to subsequent 

steady area rent growth. Fifty percent of 

area communities offered concessions, 

which is below the Phoenix area average. 

CONCESSIONS 

Concessions rose from second quarter 

2007 to third quarter 2007. In third quarter 

2007, 62 percent of area communities 

offered concessions. This is up from first 

quarter 2007, when 60 percent of area 

communities offered concessions.

The Northwest Black Canyon submarket 

had the highest percentage of communities 

offering concessions at 80 

percent. Area vacancies have risen to 9.5 

percent from 5.4 percent since last year, 

and area landlords are trying to mollify 

this increase by offering more concessions. 

The West Phoenix submarket had 

the second highest concession percentage 

for the period, with vacancies held relatively 

low at 6.6 percent as a result. 

Southeast Valley and Chandler area landlords 

have had to offer relatively high 

concessions due to increasing vacancies 

in both submarkets. Area job losses and 

increased competition from single-family 

homes as rentals have emasculated area 

landlords’ ability to reduce concessions.

This was made possible by the area’s relatively 

low vacancy rate of 6.5 percent. 

North Tempe had the second lowest percentage 

of communities offering concessions. 

The submarket also experienced 

the largest percentage rent gain in the 

past 12 months. Area conditions are auspicious 

for continued rent growth and relatively 

low vacancies. As reported at this 

year’s Perspectives and Projections, the 

East Central Phoenix submarket is one of 

the most operationally stable submarkets 

in the valley, and this stability contributes 

to its relatively low concession ratio. 

NEW CONSTRUCTION 

The Valley in third quarter 2007 saw 

the addition of four projects totaling 663 

units, compared to seven projects totaling 

1,812 units in third quarter 2006; six 

projects totaling 1,294 units in third 

quarter 2005; seven projects totaling 

1,780 units in third quarter 2004; four 

projects totaling 1,063 units in third 

quarter 2003; and four projects totaling 

662 units in third quarter 2002.

TUCSON 

The city in third quarter 2007 saw 

rents increase to $643 from an average of 

$623 in third quarter 2006. Vacancy 

increased to 7.4 percent from 6.1 percent. 

(As previously noted in past market 

update columns, the use of a more inclusive 

methodology for calculating averages 

in the city explains the difference from 

previously reported numbers.) There were 

no new units added to the city in third

Addressing Conflicts With The Homeowners Association

My partners and I spend a lot of time 

and energy advertising the properties we 

have for lease with one goal in mind: 

finding a resident who will respect the 

property and pay rent on time. So once 

we go through the advertising, answering 

ad/sign calls, driving back and forth 

showing the property and creating fliers 

and distributing them, we find a candidate. 

The next step is going through the 

application process, which includes 

more time involvement: calling past 

landlords, researching the databases (to 

make sure the proclaimed previous landlord 

is truly the owner or manager of the 

property), pulling credit, calling employers 

or verifying funds to pay potential 

rent, and then running criminal background 

checks. 

With that task behind us, we are on 

to the hour-long lease writing process, 

and then it’s another hour to document 

the walk-thru. We are all exhausted 

from the process, and the new renter 

still has to get all the utilities transferred 

and move in. I think it is safe to assume 

we have a mutual plan for the resident 

to be happy and stay for years! 

Then we get the phone call. A lot of 

things we can change, but what if the 

next-door neighbors allow their dog(s) 

to bark non-stop? Or if our residents 

cannot walk from their home to the car 

without the group of people sitting in 

the garage next door drinking beer, tossing 

cans between the properties, and 

making comments to the women? 

This is a scenario we recently faced. 

Both of these incidences occurred in 

newer neighborhoods with homeowner 

associations (HOAs). One association 

threatened my client with a fine due to 

the fact that frost killed the tree in the 

front yard and we were not replacing it 

fast enough. However, when we contacted 

the HOA and continually supplied 

proof of the nuisance—which was 

necessary since it was not occurring 

when board members drove by—the 

HOA advised me to back off as it did 

and let the neighbors take care of the 

problem through the law. Well, that 

might work for them, but it does not 

work for us. 

How can owners deal with this kind 

of situation? The first step is for the 

owner and the renter to document what 

is happening. In this case, both properties 

are located in a city with a good 

neighborhood task force that addresses 

these types of problems. The process, 

however, is time-consuming. The resident 

must participate with the manager 

and/or owners, complete and mail out 

forms, and record the noise violation (a 

video tape would certainly be helpful for 

the obnoxious drinking crew.) Once you 

complete these tasks, you then wait for 

the city to get to your complaint. 

Our experience has been to take 

action immediately and show renters 

they are not alone. Do all you can to 

learn what your city has in place to help 

its citizens to live a tranquil life. We 

have also hired an attorney to aid us in 

correcting the problems. 

In the event our residents decide to 

simply move at the end of their lease, 

our problem is not ending. It is our goal 

to get very involved to help create 

neighborhoods where good renters, as 

ours, want to live. This might include 

going to or starting a block watch, 

attending HOA meetings, and talking 

to the neighbors and or the property 

owners (in the event they are investment 

properties). 

Taking action when a problem first 

arises can be crucial in protecting your 

investment. AMA

Customer Experience is New Driving Force in Industry’s 

Progressive Amenity Offerings 

We have moved from a product to 

a service economy, and are now transitioning 

into an "experience" economy 

that adds a very high level of 

emotion not previously seen in the 

multi-housing industry. To successfully 

maintain and attract residents in 

today’s market, companies are providing 

amenities that cater to the entire 

experience for its residents that 

encompass every customer 

touch-point of a brand. This new 

direction in today’s market utilizes 

new and innovative tools, coined as 

Customer Experience Management 

(CEM), to understand customer 

needs. 

CEM is a buzz term that originated 

in the highly service-oriented automotive 

industry, and has been 

expanding to all industries across the 

board because of its great success in 

improving customer retention, 

increasing revenue, and transforming 

a company’s image and brand. Using 

research-based tools and technologies, 

CEM helps to improve experiences by 

extracting information from their 

most valuable asset – their customer. 

This information helps companies 

understand what types of products the 

customer truly values and what fundamentally 

drives their loyalty. This 

shift to a customer-driven approach is 

a striking contrast to the traditional 

internal approach known to institute 

plans based on a company’s goals—

wants. 

The evolution of the multi-family 

industry into an experience-focused 

market directly correlates with our 

growing "renter-by-choice" demographic 

that is comprised predominantly 

of Generation X and 

Generation Y members who are currently 

in their 20s and 30s. This 

demographic is the driving force in 

the increased demand for amenities 

that provide a lifestyle enhanced 

experience; the multi-family industry 

is beginning to cater to this demand 

with unique, amenity-rich communities. 

Gen X and Yers exude a great deal 

of excitement, energy and creativity, 

as well as a high level of expectations, 

wants and needs. While seeking hassle-free 

living in vibrant, fun and hip 

communities, this generation also 

expects a fair market value; the multifamily 

industry now faces the challenge 

of balancing both. Companies 

need to hone in on what their resident 

demographic wants so they can 

decipher how to satisfy that need 

while managing the bottom line. 

To acquire and compile authentic 

resident feedback about their experiences 

within an apartment community, 

progressive technology companies 

have started to provide services that 

help businesses extract subjective 

feedback through the use of items 

sanctions law. This has, obviously, upset 

many members of the committee who 

felt that their concerns would be 

addressed in future legislation and that 

this committee would be responsible for 

making recommendations to the full 

Legislature.

during the 2008 session; members of the 

committee have actually drafted model 

legislation: 

� Contractor/subcontractor concerns. 

� Definition of "knowingly." 

� Definition of "license." 

� Complaint process clarification.

design a better resident experience to 

highlight the types of amenities they 

desire. 

Resident experiences often begin 

online because of the push to drive 

traffic to an apartment community’s 

Web site. As the first introduction or 

"face" of a property, Web site layouts 

have become more engaging, interactive 

and easily maneuverable—from 

virtual tours to renting online. 

Architecturally, a community must 

also be inviting both from an exterior 

and interior design. Renters-bychoice 

expect flexibility on that 

design, even so far as selecting their 

own accent wall or adding data ports 

for their technology needs. 

New amenities in the multi-housing 

industry range beyond the interior 

and exterior structure, however, and 

now incorporate unique services. Onsite 

amenities often include towel 

service, concierge service, laptop 

check-outs and Wi-Fi access. 

Clubhouses have evolved into the 

"hub" of the community, and it is the 

on-site team’s responsibility to create 

the perfect synergy for their particular 

property by generating the "buzz" that 

residents crave. Old and new apartment 

communities alike are able to 

integrate activities for residents that 

cater to their specific demographic— 

ranging from poolside yoga to hiking

IMMIGRATION REFORM 

INITIATIVES FILED 

The Arizona Secretary of State 

Office has received two immigration 

reform initiative filings. The first one, 

filed in March and known as the "Support 

Legal Arizona Workers," is already 

collecting the 153,365 signatures 

clubs—to offer residents varying 

opportunities to socialize and network. 

The resident experience is further 

enhanced by the leasing and management 

team. The multi-housing industry 

and the hospitality industry have 

many similarities, and apartment 

companies have long since looked to 

the hospitality business for ideas and 

enhancements. Leading-edge hotels 

have raised the bar in service expectations, 

which have played an influential 

role in how on-site teams interact 

with residents. Apartment communities 

strive to provide the same 

level of customer service similar to 

these unique hotels to accommodate 

the growing resident expectations 

that are now unfolding. 

Operating an apartment community 

in today’s market is much like 

operating a resort-like lifestyle experience 

for residents. Unique and innovative 

amenities are essential to 

enhance living experiences in order 

to attain and retain residents. Keep

Program Training 

Learn how you and your apartment community become certified in 

the AMA’s innovative outreach program. Its goal is to create more 

appealing and safer neighborhoods where properties, renters, 

homeowners and businesses interact for mutual benefit. The rental 

industry wins with a proven marketing/resident-retention tool that 

helps attract and retain more desirable residents while improving 

relations with local government, elected officials and activists. 

Among FIVE STAR requirements are enhanced customer service, 

joining and being active in a neighborhood group, 

involved in at least one phase of the Crime Free Multi-housing 

Program, and FAX NET 1 registration.

All first-time managers in the program-either initial certification for 

the property or taking over a property already certified but no prior

Natural Gas Safety and Repair 

Instructor: Southwest Gas representatives. 

Utility experts will use demonstrations and lectures to provide natural 

gas safety and maintenance information, especially updated Blue 

Stake legislation. The seminar will help prevent leaks inside rental 

units and common areas of the apartment community plus address 

basic appliance repair. The class is geared for service supervisors 

and technicians, but other on-site team members also would benefit 

from the instruction. Representatives from Southwest Gas will

They further felt they had reached

the ballot box if the governor approved 

and signed the legislation. This, unfortunately, 

does not appear to be the case. 

The second initiative, filed in October 

by the "Stop Illegal Hiring" organization, 

is thought to be much more 

business-friendly and addresses concerns 

of the business community, such 

as removal of the provisions that allows 

for the filing of anonymous complaints 

with the county attorney or the Arizona 

Attorney General.

NEW I-9 FORMS 

Long-awaited changes to the I-9 

form and requirements are finally here. 

The U.S. Citizenship and Immigration 

Services (USCIS) announced the 

release of the revised form, which all 

employer must complete for each new 

employee hired in the United States. 

Completion of the revised form within 

three days of hire will become mandatory 

once notice is published in the 

Federal Register. We are not sure when 

publication will occur, but we will 

update members in the future. 

USCIS is encouraging employers to 

start using the revised form immediately. 

The form and USCIS’s Handbook 

for Employers, Instructions for Completing 

the Form I-9 are available online at 

www.uscis.gov. Key to the revision is 

the removal of the following five documents 

for proof of both identity and 

employment eligibility because they 

lack features to help deter counterfeiting, 

tampering, and fraud: 

� Certificate of U.S. Citizenship (Form 

N-560 or N-570) 

� Certificate of Naturalization (Form 

N-550 or N-570) 

� Alien Registration Receipt Card 

(Form I-151)

Every owner and management 

company has faced a situation where 

they must terminate an employee. 

The purpose of this article is to 

address the acceptable grounds to terminate 

an employee and the procedures 

to vacate the premises, if the 

individual received housing as part of 

his or her employment. 

Most employees are "at will;" that 

is, they work at the pleasure of their 

employer. Every employment contract 

for an indefinite period of time is presumed 

to be terminable at will. 

As an "at will" employee, his or 

her employment is for an indefinite 

term, at sufferance, and either party 

can terminate the employment at will 

for no cause or any cause. This principle 

is generally known as the employment-at-will 

doctrine. 

As such, an employer can fire an 

employee for good cause or no cause, 

but not for "bad" cause. For example, 

both parties agree that the employee 

will do the work required by the 

employer and the employer will provide 

the necessary working conditions 

pay him or her for the work done. 

However, one of the agreed benefits 

to the at-will employee cannot be a 

guarantee of continued employment 

or tenure. The very nature of the atwill 

agreement precludes any claim 

for a prospective benefit. Either 

employer or employee may terminate 

the contract at any time. 

There is an implied covenant of 

good faith and fair dealing in the 

employment-at-will contract. 

However, the covenant does not create 

a duty for the employer to terminate 

the employee only for good 

cause. Additionally, it does not protect 

the employee from a "no-cause" 

termination because tenure was never 

a benefit inherent in the at-will 

agreement. 

EXCEPTIONS 

The state of Arizona recognizes 

three major exceptions: 

� The "implied contract" exception, 

which relies upon proof of an implied 

promise of continued employment— 

absent just cause—for termination to 

protect the legitimate expectations of

the worker. Establishing this can be 

oral representations, a course of dealing, 

personnel manuals or memoranda. 

� The "public policy" exception, 

which permits recovery upon a finding 

that the employer’s conduct 

undermined important public policy. 

� The implied covenant of "good 

faith and fair dealing," which protects 

employees from termination for a bad 

cause. 

Good cause for discharge can 

include such things as lying, fighting, 

destroying employer property, inability 

to perform job duties and insubordination. 

An employer can terminate 

employment if he or she has made a 

good-faith, subjective determination 

that the employee’s work was unsatisfactory. 

Oftentimes, an employee receives 

housing as part of his or her compensation. 

The Arizona Residential 

Landlord and Tenant Act does not 

protect the employee in these situations. 

A.R.S. 33-1308(5) states in part: 

A.R.S. 33-1308. Exclusion from 

application of chapter 

Unless created to avoid the application 

of this chapter, the following 

arrangements are not covered by this 

chapter: 

1. Resident at an institution, public or 

private, if incidental to detention or 

the provision of medical, educational, 

counseling or religious services. 

2. Occupancy under a contract or 

sale of a dwelling unit or the property 

of which it is a part, if the occupant is 

the purchaser or a person who succeeds 

to his interest. 

3. Occupancy by a member of a fraternal 

or social organization in the 

portion of the structure operated for 

the benefit of the organization. 

4. Transient occupancy in a hotel, 

motel or recreational lodging. 

5. Occupancy by an employee of a 

landlord as a manager or custodian 

whose right to occupancy is conditional 

upon employment in and about the 

premises. 

6. Occupancy by an owner of a condominium 

unit or a holder of a proprietary 

lease in a cooperative. 

7. Occupancy in or operation of public 

housing as authorized, provided, or 

conducted under or pursuant to Title 

36, Chapter 12, or under or pursuant 

to any federal law or regulation. 

Once terminated, the employer 

should give the employee a notice to 

vacate, usually within five days. If the 

employee signed an agreement at the 

time of hire to vacate within a specific 

time after termination—such as 72 

hours—that would be the notice to 

issue. 

While lockouts may be permissible 

if done without causing a breach of 

the peace, courts do not look favorably 

on them. This writer is aware of 

one employee lockout in Maricopa 

County that resulted in $5,000 in 

punitive damages issued to the 

employee. 

At the end of the notice period, an 

employer may file a forcible detainer 

requesting possession, fair rental value 

from the date of termination, attorney’s 

fees and costs. The procedure is 

identical to a normal eviction for 

nonpayment of rent. Following a 

hearing and an entering of judgment, 

the constable can evict the employee 

under a Writ of Restitution after five 

days. 

EXAMPLE 

Consider the following example: 

The Apple Apartments hire Kay Bull 

as a leasing assistant and gives her a 

free apartment as part of her employment. 

Manager Ann Tenna has Kay 

Bull sign an employee agreement to 

vacate within three days if terminated. 

Kay Bull’s supervisor, N. Turn 

Met, finds Kay Bull embezzling rent 

money, and issues her a termination 

letter and notice to move within 

three days. When Kay Bull doesn’t 

vacate, attorney P.C. Mack files an 

eviction action and Judge Bill Greats 

orders Kay Bull out of the apartment.

Therefore, ARS §33-1318 is only 

applicable in a situation that falls under 

the above listed definition. It does not 

include a boyfriend and girlfriend who 

were not related and who have not lived 

together in the same household. 

When dealing with issues of domestic 

violence, landlords should be very careful 

not to use the words "domestic violence." 

Based on the new rule, management cannot 

evict a leaseholder that is a victim of 

domestic violence. 

However, you can evict a victim of 

domestic violence if the domestic violence 

creates a situation that interferes 

with the peace and quite enjoyment of a 

neighbor, especially if the perpetrator and 

the victim both live in the premises. In 

such a situation, domestic violence is not 

the issue. The issue is the interference 

with the peace and quite enjoyment of a 

neighbor. 

For example, a husband assaults his 

wife. There is yelling, screaming and 

wall-pounding that awakens and startles a 

neighbor, who is in fear as to what’s going 

on at the property. The neighbor then 

calls police to the scene. 

In this type of scenario, can a landlord 

do anything if the underlining cause of 

the disturbance was domestic violence? 

The answer is yes. If the victim was a lessee, 

the landlord can still deliver a 10-day 

notice for interference and disturbing the 

peace and quite enjoyment of neighbors. 

If the victim was an occupant and the 

perpetrator a lessee, you can evict the lessee 

for assault. 

Let’s consider another scenario. What 

does a landlord do when a victim follows 

the statute and moves out and the new 

potential landlord calls and asks if you 

had any problems with his or her tenancy? 

You could tell the truth and indicate 

that the person was a victim of 

domestic violence and the resident terminated 

his or her lease early. Although 

there is no defamation in telling the 

truth, this may not be the best business 

decision, as you could still face a frivolous 

lawsuit. The statute does not address the 

issue. Additionally, you could also indicate 

that if he or she met your criteria, 

you would re-rent to him or her, and say 

no more, because the new statute requires 

you to do so. 

The greater question is whether or not 

to deny residency to a new potential 

renter who was a victim of domestic violence 

during a previous residency. To 

deny simply because the individual was a 

victim of domestic violence could bring 

about a lawsuit. To deny because of inter- 

ference with peace and quite enjoyment—where 

the underlining cause was 

domestic violence—is less likely to end 

up in a lawsuit. 

Be sure not to use any words involving 

domestic violence on any notice to any 

resident, in any communication to any 

resident or in any other way whatsoever. 

Domestic violence is simply not the issue.

Religious Discrimination?

A recent decision from a federal 

court in Florida addressed an issue of 

interest for all of our members: religious 

services conducted on-site. (My 

colleague and fellow AMA member 

attorney Mike Parham alerted me to 

this decision.) 

In this case, a religious group/club 

conducted religious services in the 

clubhouse of a community managed 

by a homeowner's association (HOA) 

that had adopted a new rule disallowing 

anyone from conducting "religious 

services" in any of the common areas. 

The group brought suit against the 

HOA alleging discrimination based 

upon religion and violation of the 

federal Fair Housing Act (FHA). 

The court faced the question of 

whether such a rule—which the 

HOA enforced against all religions— 

was in violation of the FHA. 

HOA enforcement of such a rule is 

analogous to the enforcement of a 

similar rule or community policy by 

the management of a rental community. 

In order to prove discrimination, 

the club had to show: 

� That it was the aggrieved party. 

� That it suffered an injury because 

of the alleged discrimination. 

� That, based on religion, the 

HOA denied provision of services 

protected by the FHA that were 

available to other homeowners. 

The court felt the group could 

establish the first two elements, but 

not the third. 

It stated that the HOA had not 

denied any of the homeowners’ access 

to the common areas. They simply 

denied permission to the group to use 

the common areas to conduct religious 

services, which was not a complete 

denial of access to the on-site 

services and facilities. According to 

the court decision, the rule barring 

the practice of religion in the common 

areas did not impede the homeowner's 

right to practice his or her 

religion, and, by not denying access 

to the common areas for other purposes, 

the HOA did not treat the 

club differently from other persons of 

other religions. 

The court then went on to explain 

that the HOA had a legitimate, non- 

discriminatory reason for its conduct. 

It showed that its members had complained 

numerous times of not only 

the club’s use of the common areas, 

but other problems it created, such as 

being disruptive to other functions 

occurring at the property. 

The court agreed with the HOA 

that it had a legitimate, non-discriminatory 

reason for the rule. This left 

the group with the burden of proving 

that the HOA had articulated reasons 

that were actually a pretext for discrimination. 

The club was unable to 

establish this.

The last argument the club made 

was that the HOA should have granted 

it a "reasonable accommodation." 

The court rejected it, as this requirement 

only exists in relation to handicap 

discrimination. 

This case stands for the proposition 

that you can ban the use of community 

areas by religious groups as long as

interest to most readers. For specific or urgent

QUESTION: We recently evicted 

one of our residents, who had rental furniture 

in his unit. Do we have to hold 

that property as well as his, or can we just 

return it to the rental company? 

ANSWER: As long as the rental 

company brings you proof that the furniture is 

actually theirs, you can return it to them or 

allow them into the apartment to remove it. 

Make sure that if they provide you with any 

serial numbers or other identification numbers 

to match the furniture with the rental 

contract. Otherwise, the former renter may 

have a claim against you for removing his 

property. 

Q: Our community receives frequent 

phone calls from relatives and parents 

of renters who want to talk to us 

about them. Is this ok? 

A: You are under no obligation to 

discuss anything about the tenancy other 

than with the renter. Whether you decide to 

talk to a family member or not, I would recommend 

getting the resident’s permission in 

writing to do that. 

Q: Our occupancy limit is two per 

bedroom. An elderly couple who currently 

resides in a one-bedroom asked me to 

make an exception to let their grown, 

handicapped son move in. He sustained 

severe injuries from an accident and can 

no longer care for himself. They say the 

law requires me to do this. Does it? 

A: Yes. Fair housing laws require 

landlords to make "reasonable accommodations" 

to policies when necessary to accommodate 

the needs of handicapped residents or 

applicants. Though the reasoning is complicated, 

the law is clear that in this situation, 

you need to make an exception to your occupancy 

limit if the residents’ son is handicapped 

and dependent on them. If the situation 

is not apparent, you can require medical 

evidence of the existence of the handicap and 

the fact the person is dependent on the 

renters for care. However, you cannot require 

this if the facts are obvious as they are here, 

and you cannot require more than a statement 

from a medical provider. A recent 

Arizona Court of Appeals case makes this 

clear. 

Q: During a work order in one of 

our units, our maintenance technician 

noticed drugs and drug paraphernalia. Can 

you conduct an immediate eviction? 

Additionally, we took photos of the evidence. 

Is that legal?

A: Yes to both. It is against the law 

to have illegal drugs and or drug paraphernalia 

in the apartment in plain view, and there 

is nothing wrong with photographing the 

contents of the apartment when you are 

inside. 

Q: One of our residents committed 

a hit-and-run on another renter’s vehicle 

in the middle of the night. The individual 

apparently was drunk and did not call the 

police; he simply went to his apartment. 

Can our property conduct an immediate 

eviction? 

A: Yes. This involves serious property 

damage, plus the threat of additional property 

damage. Additionally, someone could 

have been seriously hurt by the action. AMA
