1. RIGHT OF REFUSAL<br />

RE Company Limited (ABN 92 079 543 874) (Company) reserves the right, at<br />

its absolute discretion, to decline or reject any advertisement for any reason<br />

whatsoever, including, without limitation, that the advertising is unlawful,<br />

defamatory, offensive or otherwise unsuitable, without giving any reason<br />

whatsoever.<br />

2. COPYRIGHT<br />

All material including, without limitation, articles, information, data<br />

photographs and artists illustrations contained within <strong>Real</strong>estate WA<br />

North is subject to <strong>Australia</strong>n and international copyright laws. Subject to<br />

the provisions of such laws, you must not copy or reproduce any material<br />

contained within <strong>Real</strong>estate WA North, whether in whole or in part, by any<br />

means, or attempt to deal in any infringing copies taken from <strong>Real</strong>estate WA<br />

North.<br />

3. DISCLAIMER LIABILITY<br />

While care is taken by the Company in the publication of advertisements, no<br />

liability will be incurred by the Company by reason of any amendment to or<br />

error or inaccuracy in, or the partial or total omission of, an advertisement<br />

by reason of any delay or default or from any cause whatsoever. If an error<br />

4. PLACEMENT OF ADVERTISEMENT<br />

Where the Company accepts an advertisement for publication, it may, at<br />

its absolute discretion, place or position the advertisement anywhere it so<br />

chooses unless the advertiser has paid for and the Company has accepted<br />

payment and agreed to the placement of the advertisement at a particular<br />

place or position.<br />

5. REPRESENTATION AND WARRANTY<br />

The advertiser warrants to the Company that any advertisement that is<br />

accepted for publication contains information that is true and correct in all<br />

respects, is in no way misleading or deceptive such that it may contravene<br />

the Competition and Consumer Act 2010, the Fair Trading Act 1987 or any<br />

other provision of any law of the State or Commonwealth, and is otherwise<br />

lawful.<br />

6.INDEMNITY<br />

The advertiser indemnifi es the Company (and its employees and agents)<br />

against all actions, proceedings, claims, demands, losses, damages,<br />

costs and expenses arising out of or in connection with the publication of<br />

the advertisement (Including any relation to defamation, malicious or false<br />

infringement of copyright, trademark or design, or breach of the Competition<br />

and Consumer Act 2010, the Consumer Credit Code, or the Fair Trading<br />

Act 1987) and warrants that publication of the advertisement will not give<br />

rise to any legal, equitable or statutory rights against the Company and<br />

will not breach any laws or regulations including the prohibitions related to<br />

advertising in the Competition and Consumer Act 2010, Consumer Credit<br />

Code and the Fair Trading Act 1987.<br />
