Premier Lara Giddings had previously provided
public assurances that all nurses working on the public
sector would be granted indemnity against legal
process, stated on ABC News 8 December 2011; “That’s
just a political furphy, really. Of course all doctors and
nurses who work within the public health system have
appropriate indemnity.”
The provisions of Ministerial Direction 8 clearly states:
• This indemnity is subject to the discretion of the
Inter-Agency Committee and will only apply to
those awards made and costs incurred after an
application for indemnity has been received by the
relevant Agency.
The following extract is from the response received from
the Premier;
It would be inappropriate for me to provide an
assurance that full indemnity will be granted to
any public officer or employee ahead of any legal
proceedings actually arising. Nor would it be
appropriate for me to make a decision or in lieu of the
process established ... particularly as the Committee is
required to take account of the circumstances giving rise
to the legal action...
This confirms that the ANF legal advice is correct and
indemnification from the Government for health workers
workers) working in the public sector could be in breach
of section 129(1) of the Act if they rely solely on the MD
The revised NMBA Professional Indemnity Insurance
ANF members wearing red T-shirts are
highlighting the short sighted decision
Absolutely - I feel that through the ANF I have been able to have
a great deal of involvement and that with their support we have
The situation is that the beds are full, ED is
being cancelled. There are a lot of people
working double shifts as we are unable to
People are getting tired and worn out;
when that happens sick leave goes up, there’s
People are getting worn out. I am worried
Nurses will continue to advocate for their
about the fiscal constraints that State
FRONTLINE HEALTH.
Premier Lara Giddings, during her tenure as
the Tasmanian Health Minister from 2006 to
2010, placed the Tasmanian health system in
its current predicament. Lara Giddings is now
the Tasmanian Premier and Treasurer.
Less beds, less services, fewer options
have made an already overburdened health
system struggle for breath. Withdrawing
health services affects our most vulnerable,
and ultimately the Tasmanian community will
suffer from the short sighted decisions made
by Premier Lara Giddings and Minister for
Health Michelle O’Byrne.
An important and enduring strategy of
this ANF campaign has been the need to
move proactively rather than be reactive.
Unfortunately the scale of the cuts to the
Tasmanian Health budget shocked ANF and
members. There was, and still appears to be,
no apparent logic to the scale of the cuts.
All direct evidence, including the DHHS
Tasmanian Health Plan, supports increasing
demand for health services. Greater
presentations to Emergency Departments,
a need for more elective surgery and more
beds; and yet the vision from the Tasmanian
Government is to shut beds, cut elective
surgery and reduce access to services.
Shut the doors and it all might go away!
ANF’s campaign was launched on 10
October for World Mental Health Day, as the
scale of the cuts was announced and the real
effects were highlighted. ANF embarked on
informing and engaging with the Tasmanian
public to expose the risks associated with the
cuts. The key elements to the ANF campaign
have included:
• Utilising public media
• Improved communication to members
and the public through the ANF website
and Facebook
• Regional community rallies in
collaboration with CPSU and HACSU
• Submission of a petition with over 27,000
signatures to the Tasmanian Parliament
• Industrial action by members
FOCUS
PROTECT Frontline
Health
ANF Petition Handover to the Tasmanian Liberals
• Rolling stop work and 48 hour bans on
overtime and double shifts
• Go Red to Save a Bed Days
• Encouraging members and the public to
speak out against the cuts.
The ANF campaign has been successful
in gaining public opinion and support.
The daily letters to all regional newspapers
confirms this. The ANF petition, presented
to the Tasmanian Parliament by Opposition
Leader Will Hodgman, was the second
largest in Tasmanian history with over 27,000
signatures. The joint ANF, HACSU and CPSU
rallies conducted across all three regions
were well attended and sent very clear
messages to the Premier, Health Minister and
Green minority Government partners.
The media coverage for our rallies was
exceptional. The themes from the rallies
included the death of the Tasmanian health
system and it was wonderful to see nurses
speak out on behalf of their colleagues in
such an articulate and passionate manner.
Everyone was left with no doubt that very
poor decisions had been made and lives will
be placed at risk.
Many fixed term and casual employees
have been left with great uncertainty as
a result of the announced budget cuts.
The DHHS has stated that they have poorly
administered fixed term contracts and ANF
has been fighting relentlessly to ensure those
nurses eligible to be converted to permanent
employment will be. Unfortunately not all
nurses on fixed term contracts will be able
to gain ongoing employment. Many nurses
have already left nursing or have decided to
seek work in other States.
The 48 hour ban on overtime successfully
highlighted that the Tasmanian health
system is run on the goodwill of nurses.
In October 2011, 198 double shifts were
worked across the three regions of Tasmania.
Based on current Award rates those 198
double shifts were the equivalent of 3168
hours paid at ordinary rates. That is 1.6 full
time equivalent nursing positions for a
full year!
ANF’s campaign to protect frontline
positions and health services WILL
continue into 2012 and ANF would like
to thank the assistance, guidance and
great effort undertaken by our Workplace
Representatives and members. n
ultimately mean an overflowing emergency
all round increase in cost.
The State Government has failed to
It took just two days to hear back from NSW
the ACT. I was nervous, it was my first ever
Just one day after I had returned home
the graduate coordinator for the Southern
the first 12 months of their employment.
As an estimated monetary figure this
accounts for over $1.5 million.
This cost cutting strategy employed
by the Government is a false economy, as
reducing the fixed term contract staff will
only cost more money in the long run; if we
look to the future we will see a health system
that cannot keep up with demand.
So what will happen then? We will need
to re-open the services, re-open the beds,
and re-open the wards. Then we will need
to recruit more staff. We will have to turn
Murrumbidgee Area Health called and said as
long as I wanted a job, I would have one.
I was pretty pumped that I had a job,
and looked at it as a back up or a second
option so that when the time came to choose,
I would have the choice to work in Tasmania
or NSW. Then my luxury of having a choice
was taken away from me.
I am incredibly disappointed in my
Government, that I am not being given
the opportunity to continue serving in my
community. I was born here, I went to school
here, I did my university degree here and I
did all my practicals here. So for me the next
logical step for my transition to employment
would be to work here too!
If I ever want to come back to Tasmania to
work and live, I have to seize this opportunity
with open arms because at the end of the day,
we will all be fighting for the same job. n
around and orientate and educate the new
staff at a cost of over $1.5 million when we
could have just kept the exceptional nursing
staff we already have.
I am fearful for the future of the health
system. I fear for the health and lives of our
patients. We must continue to fight and
show our patients, our community and our
fellow nursing colleagues that we will never
condone or respect these decisions.
United we stand, divided we fall and if we
have any chance of making this government
see sense, we must do it together. n
A healthy health system is
the sign of a healthy country.
Australians deserve access to
the best health care provided by trained
and licensed professionals. We work hard
and pay our taxes. I want to know that if
my family or I need care we get what we
have paid for. I implore you do not cut the
health budget. When a country’s health
system deteriorates, so does
I am a 24 year old Registered
future, my job and my career.
Your decision to cut the Tasmanian health
budget has affected my entire life.
Today, I cried to the parking meter man
when he wrote out a parking ticket for
taking too long at the counsellors. I cried
to the employee assistance man that could
only shrug his shoulders and say ‘why you
are in a pickle then aren’t you?’
I cried in the toilets during my lunch
break because a patient asked me where I
would be working when my contract runs
out. I cried to my workmates when it was
time to knock off. They reassure that they
were feeling the same as me.
I cried to my partner when I got home
and saw my puppy waiting for me at
the front door. I cried and cried to him,
because I know that when I decide to
relocate interstate he won’t be coming with
me. This is not living.
I have seen my doctor who referred
me to a psychologist, I joined a gym, I am
seeing the employee assistance counsellor.
I find going to work toxic as everyone else is
feeling as down as I am. These people have
families, mortgages and LIVES.
I do not have a mortgage nor am I
married. I do however have a partner,
a puppy, a father, a mother, grandparents
and friends who are all concerned about
my welfare at the moment.
It won’t be a merry Christmas for my
family this year.
Please take a moment to think
about how your decisions are affecting
Tasmanians.
You are not helping us.
How are the budget cuts
affecting YOU?
As much as I can only imagine
the pressure being placed on
you to do your best, it is clear
the budget cuts that have been made to
our health system are in NOBODIES (sic)
best interests. Cystic Fibrosis sufferers
heavily rely on the Hospital in the Home
service and for it to be cut could mean
life threatening infections brought on by
constant hospital stays as well as many
other complications that may
arise. I urge you to reconsider
this choice.
I am extremely concerned
about the budget cuts to our
health system. Health is one
area that cannot afford these massive cuts
without affecting everyone. We have an
increasing ageing population that relies on
an efficient health system.
We need to maintain the Royal Hobart
Hospital as a teaching facility
or we are going to lose our
prospective new doctors to
the mainland and overseas.
I have been a recipient of this
valuable service (Hospital in
the Home), that might I add,
not only gave a hospital bed to someone
else who needed it, but also gave me the
opportunity to go home and recuperate
whilst still receiving the life saving medical
treatment I needed. I could not speak highly
enough of all the dedicated nurses who
were so professional and caring during my
recovery process. The Government should
hang their heads in shame for
even thinking about getting
rid of this vital service that
DOES save lives!!
Please find a way to save our
public health system! We put
our trust in you and hope you
can return our faith in the Government.
I have just completed my first year of
nursing and have already started looking
with interest in nursing positions in QLD.
They have a great health system, and have
had more financial woes in their state
more recently than us! They still manage to
provide an excellent primary and tertiary
care base to their public hospitals. Call Anna
Bligh and ask her how she does it!!!
Don’t let down our state,
and especially don’t let all our
new graduates leave the state!!
proud to see a sea of red throughout
the crowd, showing the large number of
nursing supporters.
The crowd voiced their concern and
discontent towards the Premier, The
Honourable Lara Giddings and Leader of
the Tasmanian Greens, The Honourable Nick
McKim, as they attempted to justify the
Government’s decisions.
Union leaders were welcomed by a
Because We Care Campaign, as well as an in-depth look at possible
legal issues faced by those working in Aged Care.
The day also included the presentation of the ANF/ME Bank Aged Care
of receiving an award that we also presented a Highly Commended prize in
the Care Worker category.
Congratulations to the following award recipients, as well as to all those
who were nominated. The Aged Care sector relies on your commitment
ANF wishes to congratulate Emmerton Park for their recent success in
the Tasmanian Aged Care Awards. Emmerton Park received The Media
Award for their different ideas for keeping residents entertained.
The home recently introduced an ‘in-house’ radio station and this
has improved their social environment and has seen increased
participation from residents, improving their mental and physical
wellbeing. They were also awarded the Aged Care Organisation
Award in recognition of their achievements in people management,
training, technology, customer service, environment and stakeholder
communications. Well done to all staff involved in this success.
At the time of writing, LRP nurses and ANF
are in consultation with Management over
the existing establishment, workloads and
rostering. Consultation will continue through
the beginning of the New Year.
LGH
During the Christmas break there was the
closure of Ward 4D, 10 beds from Ward 5A
and 12 from Ward 5B, two ICU beds and
three children’s ward beds. Elective surgery
and the Day Procedure Unit have also seen a
reduction in cases.
Amidst the closures, DEM is now
operating at its new capacity of 43 beds and
the Acute Medical Assessment Unit (AMU) is
now fully operational with 20 beds open.
The first intake of Transition to Practice
Nurses commenced at NAHS on 30 January,
with 14 positions at the LGH, three in Primary
Health and three commencing in Mental
Health. ANF welcomes these new Graduates.
The 4O/4B staff survey which was
conducted in August was collated and
presented to midwives in December.
With 2011 now well behind us, the effect of
the drastic changes that have been (and are
yet to be) implemented to all areas of the
Service will remain a constant reminder of a
very difficult time.
Members have stated that they are at
a loss to fully comprehend some of the
strategies developed by Management and
have constantly protested and raised their
serious concerns at appropriate forums and
via correspondence to senior managers. The
priority issue for members is the ability to
maintain a safe and beneficial service for the
increasing needs of their patients/clients.
ANF has written to the Acting CEO
outlining members’ concerns related to
quality patient care and outcomes and also
asking who will take the responsibility for
any adverse outcome for clients/patients.
Members are also seeking an assurance that
they will be afforded indemnification (under
MD8) should an adverse event occur for
a client.
The common theme from the midwives
outlined insufficient communication from
Management, who are now looking to have
biweekly unit meetings and open forums to
allow staff to discuss and resolve issues as
they arise.
Because We
Care Campaign
The Because We Care Campaign is continuing
into 2012 with renewed pressure to be applied
to the Federal Government in the lead up to
the 2012-13 Federal Budget.
This pressure is being applied at a
national level with all State and Territory ANF
Branches being involved in activities across
the country.
In Tasmania we will be looking at
targeting influential and marginal electorate
Care Tasmania taking over the James Scott
Wing from the DHHS. Staff are currently
public sector employees and are having
to make a decision to transfer to the
private sector with Presbyterian Care or
remain public sector employees and face
redeployment and/or redundancy. ANF will
work closely with individual members to
ensure a smooth process, that they are not
disadvantaged and to enable members to
make the best decision for themselves and
their families. n
Federal MPs. ANF will be planning activities
in those key electorates. ANF thanks
members for their continuing involvement in
the Campaign and we look forward to your
continued participation.
Aged Care Enterprise
Agreements (EAs)
2012 will see the continuation of bargaining
in the Aged Care Sector with Agreements
coming up for renegotiation throughout the
year. ANF encourages members to actively
participate in the bargaining process as it
is the only way to ‘HAVE YOUR SAY IN
YOUR EA’.
Child Health and
Parenting Services
(CHAPS)
ANF attended a presentation on the new
model of care for Children and Youth Services
(CYS) in January. ANF is encouraging members
currently working in CHAPS to provide
feedback on the new model of care and any
concerns that they may have so that this
information can be forwarded to CYS as part of
the consultative process. n
North West Report n–west
NWAHS
Surgical West at NWRH is now fully closed
with staff moving on to different chapters
of life and little belief it will open again.
The nurse educator and chaplains organised
a memorial service for the end of an era,
allowing nurses to express their grief and
share memories. A bookmark was given
to each nurse commemorating the ward
featuring the following words:
“When you’re a nurse, you know that
every day you will touch a life or a life
will touch yours.” Author Unknown
Surgical Central at NWRH is chaotic with bed
numbers increasing up to 34, when it is only
benchmarked for 24. Nurses have raised
concerns regarding the mixing of clean and
dirty surgery, infection control issues and safe
workspace issues.
Burnie Acute Care at Home (NWRH HITH
service) will be relocated to function from
the Community Health Centre. Staff are
concerned at the impact this will have on
some clients requiring more complex care
provided in the BACH clinic setting in the
hospital. Management have committed to
work through the issues with ANF Members
over a six month transition period.
Mental Health
Slashing continues across the service with
changes occurring prior to final endorsement
of the proposal. Nurses hold grave fears
for their clients with fixed term contracts
only being renewed at the ‘11th hour’, which
prevents the waiting list blowing out but
provides no certainty to members OR
the clients.
CATT has been negotiating a 10 hour shift
Section 55 Agreement for over a year, to now
have Management withdraw their agreement
to undertake ANOTHER review. Industrial
action is occurring until Management agree
to have an Agency Officer external to MHS
conduct the review.
ARCBS
Visits have been made to Devonport and
Burnie to establish a Log of Claims for the
upcoming EA negotiations. The nurses
are concerned that Vic/Tas is managed as
a single operational unit but yet they have
different Agreements. Tasmanian members
seek to have the same entitlements as
their Victorian counterparts. 100% density
celebrations have also been held at both sites
with members receiving an ANF gift. n
dentist, nurse practitioner, registered
nurse or midwife.
Supervision may be direct, where a
registered nurse is present in the same
room as the EN, or indirect, where a
registered nurse is onsite and accessible at
all times to supervise the administration
of medications and to clinically assess
residents as required prior to the
administration of PRN medications.
Therefore an EN should not check
schedule 4 medications with a carer as this
does not meet the legislative guidelines.
An EN may administer a schedule 4
medication without the direct supervision
of a registered nurse where the medication
is a regularly administered dose, there is
written authority for the medication to be
administered and the administration does
not require a clinical assessment of the
resident prior, that is a PRN medication.
An EN may not administer a schedule 8
medication without the direct supervision
of a registered nurse. n
