can Legislatures last winter in re-districting<br />

these States under the new apportionment—<br />

The Democratic gain in the popular vote in<br />

each of the above-mentioned States is much<br />

greater than the.gain in members of Congress<br />

would seem to indicate. Pennsylvania ehowe<br />

a gain of over 90^000 on Lincoln's eleotion,<br />

Ohio of 65,000, and Indiana of about 30,000.<br />

The New York World, in Bpeaking of the<br />

elections, says:<br />

The result of these eleotions cannot fail to<br />

have an immediate salutary influence. They<br />

relieve our northern communities from the<br />

military terrorism whioh has for some months<br />

repressed 'and paralyzed free discussion. The<br />

anti-abolitionists find that they are so nu-<br />

merous that there can be no danger in the<br />

free expression of their sentiments. Tlie con-<br />

servative reaction will accordingly proceed<br />

with increased momentum. By the_time the<br />

November elections are over and their results<br />

declared , the President will perceive that the<br />

emancipation proclamation was not demanded<br />

by a majority of the people. It will be evi-<br />

dent to him that he used a wise precaution in<br />

making Mb proclamation merely preliminary,<br />

and postponing final and irreversible action<br />

until the public will could bo gathered through<br />

the fall elections. The administration will<br />

also be led to proceed with more caution in<br />

the management of the national finances.—<br />

The conservative sucoess in these elections is<br />

merely a revival of the doctrine of responsi-<br />

bility. It demonstrates that hereafter all the<br />

measures of the government will be freely<br />

canvassed by the people, and that they will<br />

hol d the administration to a strict accounta-<br />

bility in its, management both of the war.and<br />

of the finances. The people demand that the<br />

war shall bo prosecuted with vigor and that<br />

the currency shall not bo ruined by needless<br />

inflation. They will ma,ke no factious oppo-<br />

sition, but they will not fail to keep their<br />

rulers under that just and wholesome sense of<br />

accountability which should never be relaxed<br />

either in peace or war.<br />

Much curiosity is evinced to know the pen-<br />

alties under the State and National laws for<br />

refusing to serve when drafted.<br />

The draft is enforced under an aot of Con-<br />

gress of July 17th, 1862, whieh states, among<br />

other things, that "ihe President is authorized<br />

to make all necessary rules ' and \regulations ," in<br />

cases where State laws are defective as to the<br />

enrolment or execution of the draft.<br />

An act of Assembly of Pennsylvania, passed<br />

in 1822, (65th section, April 2d,) uses the fol-<br />

lowing language :<br />

"Sach and every * * * private of the mi-<br />

litia w ho shall have neglected or refused to<br />

Borye when called into active service in pursu-<br />

ance of an order or requisition of the Pr esident<br />

of the United States, shal l be liable to the pen<br />

altiea" defined in the Act of Congress of Feb.<br />

28th , 1795, or any other Acts that may there-<br />

after be passed.<br />

On reference to the Act of Congress referred<br />

to, it will be found to embrace the following<br />

points :<br />

"Every officer, non-commissioned officer , or<br />

private of the militia, who shall fai l to obey the<br />

orders nf the President of the United States,<br />

* * * shall forfeit a sum not exceeding one<br />

year's pay, and not less than one month's pay,<br />

to be determined and adjudged by a Court-<br />

martial * * * ; and such non-commisBioned<br />

offi cers and privates shall be liable to be im-<br />

prisoned by a like sentence on failure oi pay-<br />

ment of th e fines adjudged against them , for<br />

one calendar month for every twenty five dol-<br />

lars of such fine."<br />

It has been decided by the Supreme Court<br />

of this State that those who disobey the requi-<br />

sition are not employed in the service so as to<br />

be liable to the articles of war, but that they<br />

are liable to be tried by a Court martial under<br />

the. above act. Such Court-martial to be con ¦<br />

stituted under the authority of the United<br />

States.<br />
