2. A statement that an estimate of the total cost of the work, and a preliminary plat and
schedule showing the amount proposed to be assessed to each lot for the improvement are on file
in the office of the city clerk.
3. The date, time and place at which a hearing on the improvement is to be held.
The proposed resolution of necessity may be adopted with substantially the following
wording:
Be it resolved by the council of the City of Oelwein, Iowa:
That a permanent sidewalk of the width of _______________ feet is to be constructed (or
repaired) of (name of material) adjoining or abutting lot(s) ___________, in the block(s)
_____________________, of the City of Oelwein, Iowa. The estimate of the total cost, a plat
and a schedule of the amount proposed to be assessed to each lot is on file at the office of the
clerk. A public hearing is to be held (list the day, hour and place of the hearing), at which time
the council will hear property owners subject to the assessment and interested parties for or
against the improvement, its cost, the assessment, or the boundaries of the district. The clerk is
directed to publish the notice of the hearing in conformity with the city ordinance on sidewalk
construction and repair. (Ord. No. 528, Section 8, 11-10-75.)
SECTION 14-78. NOTICE OF HEARING.
The clerk shall publish notice of the date, time and place of the hearing once each week
for two (2) consecutive weeks in a newspaper published at least once weekly and having a
general circulation in the city. The notice shall be published not less than ten (10) or more than
twenty-five (25) days before the date of the hearing. Not less than fifteen (15) days before the
hearing, the clerk shall send a copy of the notice by certified mail to each property owner whose
property is subject to assessment for the improvement as shown by the records of the county
auditor. If the property is shown to be in the name of more than one owner at the same mailing
address, a single notice may be mailed to all owners at that address. Failure to receive a mailed
notice is not a defense to the special assessment. The notice shall be in the following form:

Notice is hereby given that there is now on file for public inspection in the office of the city
clerk, a proposed resolution of necessity, an estimate of cost, and a plat and schedule showing
the amounts proposed to be assessed against each lot and the valuation of each lot within a
district approved by the council of Oelwein, Iowa, for a _____________________________
Improvement of the type(s) and in the location(s) as follows:
__________________________________________________________. The council will meet
at _______________ o’clock ___.m., on _______________, 19_____, at the
______________________________, at which time the owners subject to assessment for the
proposed improvement or any other person having an interest in the matter may appear and be
heard for or against the making of improvement, the boundaries of the district, the cost, the
assessment against any lot, or the final adoption of a resolution of necessity. A property owner
