2. A statement that an estimate <strong>of</strong> the total cost <strong>of</strong> the work, and a preliminary plat and<br />

schedule showing the amount proposed to be assessed to each lot for the improvement are on file<br />

in the <strong>of</strong>fice <strong>of</strong> the city clerk.<br />

3. The date, time and place at which a hearing on the improvement is to be held.<br />

The proposed resolution <strong>of</strong> necessity may be adopted with substantially the following<br />

wording:<br />

Be it resolved by the council <strong>of</strong> the <strong>City</strong> <strong>of</strong> <strong>Oelwein</strong>, Iowa:<br />

That a permanent sidewalk <strong>of</strong> the width <strong>of</strong> _______________ feet is to be constructed (or<br />

repaired) <strong>of</strong> (name <strong>of</strong> material) adjoining or abutting lot(s) ___________, in the block(s)<br />

_____________________, <strong>of</strong> the <strong>City</strong> <strong>of</strong> <strong>Oelwein</strong>, Iowa. The estimate <strong>of</strong> the total cost, a plat<br />

and a schedule <strong>of</strong> the amount proposed to be assessed to each lot is on file at the <strong>of</strong>fice <strong>of</strong> the<br />

clerk. A public hearing is to be held (list the day, hour and place <strong>of</strong> the hearing), at which time<br />

the council will hear property owners subject to the assessment and interested parties for or<br />

against the improvement, its cost, the assessment, or the boundaries <strong>of</strong> the district. The clerk is<br />

directed to publish the notice <strong>of</strong> the hearing in conformity with the city ordinance on sidewalk<br />

construction and repair. (Ord. No. 528, Section 8, 11-10-75.)<br />

SECTION 14-78. NOTICE OF HEARING.<br />

The clerk shall publish notice <strong>of</strong> the date, time and place <strong>of</strong> the hearing once each week<br />

for two (2) consecutive weeks in a newspaper published at least once weekly and having a<br />

general circulation in the city. The notice shall be published not less than ten (10) or more than<br />

twenty-five (25) days before the date <strong>of</strong> the hearing. Not less than fifteen (15) days before the<br />

hearing, the clerk shall send a copy <strong>of</strong> the notice by certified mail to each property owner whose<br />

property is subject to assessment for the improvement as shown by the records <strong>of</strong> the county<br />

auditor. If the property is shown to be in the name <strong>of</strong> more than one owner at the same mailing<br />

address, a single notice may be mailed to all owners at that address. Failure to receive a mailed<br />

notice is not a defense to the special assessment. The notice shall be in the following form:<br />

NOTICE TO PROPERTY OWNERS<br />

Notice is hereby given that there is now on file for public inspection in the <strong>of</strong>fice <strong>of</strong> the city<br />

clerk, a proposed resolution <strong>of</strong> necessity, an estimate <strong>of</strong> cost, and a plat and schedule showing<br />

the amounts proposed to be assessed against each lot and the valuation <strong>of</strong> each lot within a<br />

district approved by the council <strong>of</strong> <strong>Oelwein</strong>, Iowa, for a _____________________________<br />

Improvement <strong>of</strong> the type(s) and in the location(s) as follows:<br />

__________________________________________________________. The council will meet<br />

at _______________ o’clock ___.m., on _______________, 19_____, at the<br />

______________________________, at which time the owners subject to assessment for the<br />

proposed improvement or any other person having an interest in the matter may appear and be<br />

heard for or against the making <strong>of</strong> improvement, the boundaries <strong>of</strong> the district, the cost, the<br />

assessment against any lot, or the final adoption <strong>of</strong> a resolution <strong>of</strong> necessity. A property owner<br />
