York provides, that the "State Building Construction Code" shall be applicable in
each municipality in the State in which the legislative body has adopted or enacted
a resolution acceptinq the applicability of such Codel and
WHEREAS, in accordance with the provision of Section 383 of the
Executive Law of the State of New York, this Town Board has heretofore adopted
and enacted Local Law No.1 of the year 1979, also known as the "Law for Administration
and Enforcement of State Building Construction Code".
NCM, THEREFORE, BE IT
I RESOLVED, that the Town Board, of the Town of Cheektowaqa hereby
accepts the applicability of the "State Buildinq Construction Code" for the Town
of ICheektowaqa to become effective in said Town of Cheektowaqa on the 8th day of
October, 1979, in accordance with the provisions of Section 374-a of the Executive
Law, and it is

A Town Board Safety Review Committee, composed of
at least two Town Councilmen, is hereby established to review
the reports and activities of the Town Safety Committee, the
Department Safety Committees, the Department Heads (as they
relate to Loss Control and Safety), the Town's insurers and
Risk and Insurance Manager, and report to the Town Board as
appropriate.
The Town of Cheektowaga Loss Control and Safety
Prc)gram, developed by the Town Safety Committee in cooperation
with the major department heads is hereby accepted as the official
Town Loss Control and Safety Program and by this action indicates
support by the Board and nirects the program be implemented and I
the Safety Rules be enforced after a two week period of personnel
indoctrination.

Employees will check the condition of Town equipment or
vehicles for safety prior to use.

or instructions, ask your supervisor for assistance.
4. Always check ladders, steps, scaffolds, ropes,
cables, slings, hoists and jacks for wear or unsafe condition
before use.
5. Do not use boxes or other unstable devices for
climbing or work platforms.
6 • Know how much you can lift and use correct
lifting techniques. Do not attempt to lift or carry by
hand anything that is too heavy or bulky for one person to
hancile safely. Use the correct tifting devi_ for the job.

MOTOR VEHICLE SAFETY RUT!!!
Motor Vah,icle Safety is a combination of: (1)
Driver selection .Ad training, (2) Vehicle inspection and
JDaintenance and, IDOSt iaportantly, (3) Proper operating
aDd use of the vehicle by the driver. While much of the
responsibility for the first two activities rests with

management, the driver's responsibility for his own training
and the inspection and maintenance of the vehicle he operates
is necessary for aD effective safety prograa. A driver
generally knows when a vehicle should not be driven, whether
it be due to lack of the driver's ability and training or
due to defective equipment.
The following rules should be considered the IllinilllUlll
standards governing the operation of the Town of Cheektowaga

1. All current and prospective drivers must be licensed

WHEREAS, this Town Board duly held a public hearinq on the 15th day
of October, 1979 to consider the advisability of adoption of a proposed aaendllent
to the Traffic Ordinance of the Town of Cheektowaqa which was adopted on July 17,
1967, sud hearinq beinq held in accor4ance with Notice thereof which was duly
published as required by law, at which hearinq an opportunity to be heard was
afforded all persons interested in the subject thereof.
NON, THEREFORE, BE IT RESOLVED as follows:
Section 1.
That this Town Board deteEllline that it is in the public interest
to adopt the followinq amendllent to the Traffic Ordinance of the Town of Cheektowaqa,
County of Erie and State of New York, and said amendment is herewith
iildopted and enacted:

One-way Roadways
BERYL DRIVE (SERVICE ROAD) is hereby desiqnated I for one-way traffic in a northerly
direction, between its intersection with Genesee Street and its intersection with
Beryl Drive.
Section 2. Tillie to take effect.
(a) This amendment shall take effect when properly posted within
a reasonable time except those parts" if any, which are subject to approval under
Section 1684 of the Vehicle and Traffic Law of the State of New York.
(b) Any part or parts of this amendment which is subject to
approval under Section 1684 of the Vehicle and Traffic Law of the State of New
York shall take effect from and after the day on which approval in writing is
received from the New York State Traffic Commission.

Town Law of the State of N_ York, and affidavits of such publication and postinq

satisfactory completion of the work. Such acceptance will acknowledge the owner's responsibility to
maintain the facility in acc:onJance with all applicable codes, standards and regulations, including his
obliption, where applicable, to remove any or all of the facility from the highway at the order of the
Commissioner of Transportation, all in accordance with the Rules and Re&ulations Governing the
Accommodation of Utilities within the State Highway Rilht-of-Way and Federal Highway
Administration, PPM 30-4.1. All claims covered by this ageement will be included in an agreemellt of
adjustment foDowina completion ofthe work, or in a municipal agreement prior to the performance of

i"Halloween Night" in the Town of Cheektowaga, and that the Town Board ask both
children and their parents to cooperate in limiting the time of "trick-or-treating"
activities to the period between 6:00 P.M. and 9:00 P.M. We further ask that,
whenever possible, parents of the very young insure that they or other responsible I
adults accaapany them, and we further encourage all householders, whenever they
are able to do so, to cooperate in malting this a happy occasion for all yOWl.gsters

bids for the construction of the BeAch Road stcnm sewer, which bids were duly
received and opened at the regular Town Board meeting of NovElllber 5, 1979, and
WHEREAS, said bids were referred to the consulting firm of McFarland
Johnson Engineers, Inc. and the Town Engineer for analysis, tabulation and report,
which said analysis, tabulation aDd report is hereto attached and contained in the
letter frCllll the Town Engineer to the Town Board dated NOvElllber 20, 1979, and
WHEREAS, said report rec--med. that the bids be awarded to
Firstrhyme Construction Corporation, Inc., 133 RansaIl Road, Lancaster, New York
14086 for the bid price of $182,752.00, said bid being the lowest meeting the
requirements of the specifications, NON, THEREFORE, BE IT
RESOLVED that the cont:ract for the construction of the Beach RDlld
stcnm sewer be· and hereby is awarded to FirSt:rhyme Construction Corporation, Inc.

Section 2. Time to take effect.
(a) This amendment shall take effect when properly posted
within a reasoIlClble time except those parts, if any, which are subject to
approval under Section 1684 of the Vehicle and Traffic Law of the State of
New York.
(b) Any part or parts of this amendment which is subject to
approval under Section 1684 of the Vehicle and Traffic Law of the State of
New York shall take effect fran and after the day on which approval in writing
is r,aceived fran the New York State Traffic Callmission.
Section 3. Territorial application.
This amendment shall apply to all of the Town of Cheektowaga,
Erie County, New York outside of the villages of Depew and Sloan.
That this amendment to the Traffic Ordinance shall be entered
in the minutes of this Town Board and shall be published in the CiiEEK'KlWAGA
TIMES a newspaper published in this Town, and a printed copy thereof shall be
posted on the signboard maintained by the Town Clerk pursuant to Subdivision 6
of section 30 of the Town Law of the state of New York, and affidavits of such
publication and posting shall be filed with the Town Clerk and the Town Clerk
shall likewise enter in the Ordinance Book a copy of this amendment specifying
the date of adoption thereof.

Vacation schedules shall be posted for ninety (90) days
prior to the beginning of a vacation period, and during the first
forty-five (45) days, vacation scheduling shall be deterlllined,
based upon seniority, within each shift or bureau concerned. At
the end of the said forty-five (45) days, vacation scheduling
shall be deterlllined in order of date of request and not by
seniority. The choice of vacations, during the first forty-five
(45) days for each vacation period will be baaed, strictly, on
seniority.
Police officers shall not be perlllitted to split vacations
during any of the vacation periods, for periods of time of less
than one (1) calendar week.
In the event an officer is not able to take the vacation
time he selected, notice will be given to less senior officers
and they will be entitled to take the vacation time not used and
selection will be based upon seniority for that shift.
Nothing contained herein shall prevent the granting of
vacations one day at a time.
Except as herein provided, no officer will, be permitted
to carry-over or to accUllUlate more than one-half of one year I s
annual vacation.
Section 10.02 -- UNUSED VACATION
"
Each police officer shall be paid, at the time of retirement,
the monetary value of any unused vacation time and overtime
standing to his credit, on the date of retirement. In the event
of death, the value of such time, standing to his credit, will be
paid to his estate or his heirs at law.
Police officers intending to retire may notify the Town
two (2) years in advance and will be perlllitted to accumulate timeoff
and vacations for one and one-half years, the value of which
will be paid as salary during the final year of employment and
included as wages for pension purposes.
Upon terlllination of employment, for any reason, an
officer will be paid the value of all accUllUlated vacation, or
other time-off, including sick leave, pursuant to Appendix B. However,
in the event termination is by discharge or dismissal, there
will be no payment for accUIIIUlated sick leave.

Section 12.02 -- PROBATIONARY POLICE OFFICERS
During civil service probation. officers will accumulate
sick leave and personal leave on a pro rata basis, per IIIOnth.

At the end of probation, he will continue to accUlllUlate
sick leave at the same rate for the balance of that calendar year
and then be granted such leave in the same manner as granted to
other officers.
Newly appointed police officers will be granted the
uniform allowance, herein provided. illlllediately. on appointment.
Probationary police officers shall enjoy life insurance
benefits effective one hundred twenty (120) days after the date
of appointment of said officer.
Section 13.01 -- SICK LEAVE
Each police officer. except as herein provided. shall be
entitled to accUlllUlate one and one-half sick days per IlIOnth to a
maximum accUlllUlation of 280 days in 1979 and 298 days in 1980 and
each year thereafter.
Section 13.02 -- NOTIFICATION
A police officer will not be granted sick leave. unless
he notifies his connanding officer that he will be absent and the
reason for the same, at least ODe (1) hour prior to the time he
is scheduled to report for duty. In cases of emergency. the onehour
notice requirements will be waived.

Section 13.03 -- EXTDmED SICK LEAVE
If a police officer baa exhausted all of his accumulated
sick days and is still disabled or ill, upon receipt of a physician1s
report, verifying the illness or disability, and upon the police
officer obtaining medical verification that there is a reasonable
expectation that the police officer "1ill return to work, the
police officer will be granted up to ninety (90) additional sick
days. However, no salary will 'be paid during the first ten (10)
days of extended sick leave, unless said police officer is still
ill or disabled beyond said period of time.
Section 13.04 -- WRICMEN'S COMPENSATION BENEFITS
A police officer, who is entitled to receive Workmen's
Compensation Benefits, shall be paid full pay and the benefits
under Workmen's Compensation, to which he is entitled, shall be
assigned to the Town. Absence from duty in this event will not
be chargeable against sick leave and no other benefits, provided
by this Agreement, will be lost during that period of time.
Absence from duty for work-related disability will. not be chargeable
against sick leave and no other benefits, provided by this Agreement,
will be lost during such absence.
Section 13.0S -- SICK LEAVE REmRDS
Each police officer will be provided with a record of
his accuaulated sick leave within sixty (60) days after the beginning
of each calendar year.
Section 13.06 -- ILLNESS OF FAMILY MEMBERS
Sick leave shall apply to absence due to illness of a
police officer's illlDediate family, residing in his household.
ARTICLE XIV

A police officer, who is required to leave the Town, by
reason of his employment ,or as part of his official duty, shall be
reimbursed for all actual, reasonable and necessary expenses
incurred, including meals, if he is absent from the Town during
normal meal time.

Section 19.02 -- TUUION
The Town will pay the full costs of all tuition, bookd
and other fees, for all police officers, authorized by the Town,

Section 19.03 -- CIVIL SERVICE EXAMINATIONS -
The Town may request from the Civil Service

The Club may purchase and maintain vending machiaes, to
be installed and used in the section of the building frequented
solely by police officers and the revenues derived therefrom shall
be funds of the PoliJ:e Benevolent Fund alld will not be used Eor
union purposes.
The Club will indemnify the Town against any claims
arising out of installation or use of such machines.
Section 20.04 -- RADIO DISPATCHER
The Town agrees to employ only civil service police
officers to do police work, in any capacity, except routine clerical
work, now being performed by clerks in the Town Board. The Town
agrees that it will not enter into any private contracts that
eliminate police connected services or work now being performed
by members of the police department, except as hereinafter set
forth.
The Town will phase out police officer ·radio dispatchers
and the Town agrees there will be no decrease in the number of
police officers employed as a result of such phasing out. Police
officers assigned as police radio dispatcher will be paid at a
rate of pay equal to the difference between the salary paid to a
senior patrolman and the salary paid to officers assigned as
detective.
As an officer leaves the department (for reasons other
than layoff), a police officer dispatcher may be moved into other
duties and be replaced by a civilian dispatcher. When there are
no police officers assigned to a shift as radio dispatcher. a
sergeant will be designated to supervise that shift oE civilian
radio dispatchers. No sergeant will be required if there is at
least one (1) police officer assigned as a dispatcher.
The position of the sergeant is to be a civil service
position by competitive examination. A police officer must have
three (3) years of service before he is qualified to take the
Sergeant's ex&lll. The officer's three (3) years of s ervice must
be completed prior to the date of the sergeant's ex&lll.

Section 20.05 -- SAFETY
After officers are assigned to duty singly to each of
six (6) patrol vehicles and two (2) officers are assigned to duty
in an accident car, additional officers on duty will be assigned
so that patrol vehicles, including the first six (6) patrol vehicles.

ARTICLE XXI
Section 21.01 -- GRIEVANCE PROCEDURE
A grievance shall mean any difference or dispute between
the parties hereto, as to the interpretation or application of any
portion of this agreement or any administrative act affecting
gElnera1 working concUtions.
Step 1 -- Any police officer may present a grievance.
orally or in writing. to his immediate supervisor, within thirty
(30) days of the occurrence and attempt to adjust .the matter. If
the matter is not satisfactorily adjusted the police officer may
request a representative of the Club meet with him and his illlDediate
supervisor for the purpose of adjusting the grievance.
Step 2 -- If the grievance is not satisfactorily settled.
under Step 1, the Club representative may forward the grievanc.:!
r-o the Club's Gri8'l.,ance Coumittee. After review of the grievance.
the Club will forward a copy of the grievance to the Chief of
Police, within five (5) calendar days or receipt by the colllllittee.
The Chief of Police will, within five (5) calendar days of presentation
to him, discuss the matter with the Club Grievance Co1llDittee
in an attempt to settle the grievance.
Step 3 -- In the event the grievance is DOt settled under
Step 2, above, a report of the grievance will be made by the Club
Grievance Collllll1ttee and by the Chief of Police and each will forward
their report, within five (5) days, to the Town Supervisor or his
•representative. The Town SUpervisor or his representative will
.discuss the grievance with the Grievance Comad.ttee, within fifteen
(15) calendar days after receipt of the written report.
Step 4 -- In the event the dispute is aot satisfactorily
settled, either party 1lI&y take the matter to arbitration. upon
service of written notice to the other party of intention to do so.
The notice 1II18t be served within thirty (30) calendar days after

Section 22.02 •• IDENTIFICATION OF INVESTIGATING OFFICERS
A police officer, who is under investigation for a matter
;which would not constitute a crime, 1IIU8t be informed of the .tame
of the officer in charge of the investigation and the names of
the officers who will' be conducting any portion of interrogation
or investigation.
Section 22.03 _. INFORMATION REGARDING INVESTIGATION
An officer must be informed of the nature of an
investigation before any interrogation begins. The information
IllUSt be sufficient to reasonably inform him of the nature of the
investigation which is being conducted.
Section 22.04 -- LENGTH OF INTERROGATION
Interrogation shall be completed with reasonable
dispatch. Reasonable rest periods will be allowed and t:ime will
be provided for personal necessities, meals, telephone calls and
rest periods as reasonably required.
Section 22.05 -- OOERCION
A police officer shall,DQt be subjected to offensive
language and shall not be threatened with tr&Dsfer, dismisllal or
any other disciplinary punishment. No promise or reward shall
be made as an inducement to answering questions. Nothing herein
is to be construed as to prohibit the investigating officer from
informing an officer that his conduct may be subject to other
disciplinary action with resultant disciplinary punishment.
Section 22.06 -- RIGHT 'l'O OOUNSEL
I
A police .officer, who is under investigation, bas the
right to have a representative of the Police Club present and
also bas the right to the presence of an attorney with him during
any questioning, hearing or interrogation.

Section 22.07 -- REOORDING OF INTERROGATION
Interrogation of a police officer for any disciplinary
investigation will be recorded, either mechanically or by a
stenographer, and there will be no off-the-record statements.

ACCUMULATED SICK LEAVE CREDIT
A police officer shall convert his accumulated sick leave
days into value. in his final year. prior to retirement, by written
application, signifying his intention to retire on a form provided
by the Town, not later than June 1, of the year preceding retirement.
Upon receipt o·f such notification, the Town will convert
such accWIIUlated sick leave into value, not to exceed a maxilllWll

One-half of the value at each step shall be paid to the
officer, as wages, during his final year of employment.
The other half of the value shall be held by the Town
alld applied toward payment of health insurance premiums, after the
officer's retirement" This half may not be used for any other
purpose. When this fund is exhausted, the retired officer may
continue to maintain his health insurance coverage at the group
rate, at his own expense.
This benefit is to be used during the tilDe illllllediately
following retirement. and a retiree eligible for comparable health
JLnsurance coverage, by another employer, without contribution by
the retiree, shall not be entitled to this benefit during such
time; and the benefit for such employed-tilDe will be waived. Upon

a snow removal and ice control contract covering various highways in the Town of

RESOLVED that New York State Electric and Gas Corporation is hereby
authorized to remove 30 - 6000 lumen incandescent lamps and 1 - 10000 lumen
incandescent lamp on Harlem Road and 1 - 10000 lumen incandescent lamp on William
Street, as construction progresses and said removal becomes necessary, in accordance
with the attached proposal, for an annual decrease in the Town's General Lighting
District of $1,745.92, and BE IT FURTIlER
RESOLVED that authorization is hereby given to New York State
Electric and Gas Corporation to install 2 - 25000 lumen HPS lamps on Harlem ROad
and 2 - 42000 HPS lamps on William Street, in accordance with the attached proposal,
for an annual increase in the Town's General Lighting District of $420.00, and BE
IT FURTHER
RESOLVED that as construction proqresses, proposals for the
installation of additional street lighting facilities on Harlem ROad will be
subnitted by New York State Electric and Gas for Town Board approval.

WHEREAS, the Town Engineer, Chester L. Bryan, was named as a
defendant in a certain lawsuit cClllllllenced against him by a then Town Employee in
his office, t.o wit: Gloria Kowalczyk, said lawsuit was commenced on or about
May 15, 1975, and
WHEREAS, said lawsuit included allegations related to the
administration, procedures and work-related matters connected with the Town
Engineering Department, and
WHEREAS, at the time of the cammencement of said action, it was
determined by the TOwn that it would not utilize the .services of the Town Attorney's
Office in a legal matter involving a Town Official and a Town Employee because of
a possible conflict of interest, and whereupon said Chester L. Bryan retained
private legal counsel to defend and represent him in said lawsuit and said attorneys
notified the Town of their retainer, and
WHEREAS, it further appears that the plaintiff's claim was
unsuccessful and dismissed and no recovery was obtained in favor of the plainfiff,
NOW, THEREFORE, BE IT
RESOLVED that the said Chester L. Biyan, Town Engineer. be and
hereby be reimbursed for payment of attorney's fees to his private legal counsel,
the fiJ:lll of Lipsitz, Green, Fahringer, Roll, Schuller and James, in the sum of
$500.00, upon his subnission of a proper voucher to the Town Accounting Department,
said amount appearing to be a reasonable value of said legal services.
