WHEREAS, Section 374-a <strong>of</strong> the Executive Law <strong>of</strong> the State <strong>of</strong> New<br />

York provides, that the "State Building Construction Code" shall be applicable in<br />

each municipality in the State in which the legislative body has adopted or enacted<br />

a resolution acceptinq the applicability <strong>of</strong> such Codel and<br />

WHEREAS, in accordance with the provision <strong>of</strong> Section 383 <strong>of</strong> the<br />

Executive Law <strong>of</strong> the State <strong>of</strong> New York, this <strong>Town</strong> Board has heret<strong>of</strong>ore adopted<br />

and enacted Local Law No.1 <strong>of</strong> the year 1979, also known as the "Law for Administration<br />

and Enforcement <strong>of</strong> State Building Construction Code".<br />

NCM, THEREFORE, BE IT<br />

I RESOLVED, that the <strong>Town</strong> Board, <strong>of</strong> the <strong>Town</strong> <strong>of</strong> Cheektowaqa hereby<br />

accepts the applicability <strong>of</strong> the "State Buildinq Construction Code" for the <strong>Town</strong><br />

<strong>of</strong> ICheektowaqa to become effective in said <strong>Town</strong> <strong>of</strong> Cheektowaqa on the 8th day <strong>of</strong><br />

October, 1979, in accordance with the provisions <strong>of</strong> Section 374-a <strong>of</strong> the Executive<br />

GUIDELENES<br />

A <strong>Town</strong> Board Safety Review Committee, composed <strong>of</strong><br />

at least two <strong>Town</strong> Councilmen, is hereby established to review<br />

the reports and activities <strong>of</strong> the <strong>Town</strong> Safety Committee, the<br />

Department Safety Committees, the Department Heads (as they<br />

relate to Loss Control and Safety), the <strong>Town</strong>'s insurers and<br />

Risk and Insurance Manager, and report to the <strong>Town</strong> Board as<br />

appropriate.<br />

The <strong>Town</strong> <strong>of</strong> <strong>Cheektowaga</strong> Loss Control and Safety<br />

Prc)gram, developed by the <strong>Town</strong> Safety Committee in cooperation<br />

with the major department heads is hereby accepted as the <strong>of</strong>ficial<br />

<strong>Town</strong> Loss Control and Safety Program and by this action indicates<br />

support by the Board and nirects the program be implemented and I<br />

the Safety Rules be enforced after a two week period <strong>of</strong> personnel<br />

indoctrination.

Guidelines:<br />

1. FUli1.iarize yourself with your duties and the<br />

tools and equipment you use; recognize the hazards <strong>of</strong> your<br />

job and equipment and do not t:ake unnecessary risks.<br />

2. No employee shall Jllisuse, overload or over­<br />

extend any '1'own equipment or vehicle. CEmployees shall use<br />

correct tools and equipment for th,e work to be performed.<br />

Employees will check the condition <strong>of</strong> <strong>Town</strong> equipment or<br />

vehicles for safety prior to use.<br />

3. Read and heed all -Warning- and -Instructions­<br />

labels on equipment, chElllli.cals and other materials, and<br />

follow accordingly. You do not fUlly understand the warning<br />

or instructions, ask your supervisor for assistance.<br />

4. Always check ladders, steps, scaffolds, ropes,<br />

cables, slings, hoists and jacks for wear or unsafe condition<br />

before use.<br />

5. Do not use boxes or other unstable devices for<br />

climbing or work platforms.<br />

6 • Know how much you can lift and use correct<br />

lifting techniques. Do not attempt to lift or carry by<br />

hand anything that is too heavy or bulky for one person to<br />

hancile safely. Use the correct tifting devi_ for the job.

HOUSEKEEPING " MAINTENANCE RULES<br />

1. No employee shall remove protect:!ve guards over<br />

IIIOving parts <strong>of</strong> lllachinery.<br />

2. Warning tags IDUSt be placed on cireuit breakers<br />

or plugs <strong>of</strong> lllachinery that is being repaired or worked on.<br />

1. Keep your work area orderly at all times.<br />

4. Always use proper containers for disposal <strong>of</strong><br />

waste, oily rags and scrap.<br />

5. Floors, steps and walkways should be kept clean<br />

6. All lllachinery and power tools should be inspected<br />

. for wear and hazardous conditions before use. Defective or<br />

INTRODUC'l'ION<br />

MOTOR VEHICLE SAFETY RUT!!!<br />

Motor Vah,icle Safety is a combination <strong>of</strong>: (1)<br />

Driver selection .Ad training, (2) Vehicle inspection and<br />

JDaintenance and, IDOSt iaportantly, (3) Proper operating<br />

aDd use <strong>of</strong> the vehicle by the driver. While much <strong>of</strong> the<br />

responsibility for the first two activities rests with<br />

I<br />

management, the driver's responsibility for his own training<br />

and the inspection and maintenance <strong>of</strong> the vehicle he operates<br />

is necessary for aD effective safety prograa. A driver<br />

generally knows when a vehicle should not be driven, whether<br />

it be due to lack <strong>of</strong> the driver's ability and training or<br />

due to defective equipment.<br />

The following rules should be considered the IllinilllUlll<br />

standards governing the operation <strong>of</strong> the <strong>Town</strong> <strong>of</strong> <strong>Cheektowaga</strong><br />

. RULES:<br />

1. All current and prospective drivers must be licensed<br />

in New York to drive the type <strong>of</strong> .vehicle being used. A Class 1<br />

or 3 license is required fOJ: trucks exceeding 18,000 pounds<br />

MGW; a Class 1, 3, .. OJ: 5 license is satisfactory fOJ:<br />

p..senger cars and trucks 18,000 pounds or les. MGW. This rule

stub to your supervisor upon request.<br />

10. AIIsist in any investigation or inquiry <strong>of</strong> the accident<br />

or damage occurring while you are in charge <strong>of</strong> the vehicle.<br />

11. Be sure any cargo, load or attacbmenU on your<br />

vehicle are secure or fastened at all times.<br />

12. Drive with particular care and caution:<br />

a. At all intersections - watch pedestrian<br />

When changing lanes - signal youf plan<br />

ahead <strong>of</strong> time - avoid -squeeze plays- ­<br />

are crossing at the rear and look for<br />

toy nearby could mean a child is around<br />

be sure speed is sufficiently reduced to<br />

avo,id skidding on exit curves, particularly<br />

<strong>of</strong> October, 1979 to consider the advisability <strong>of</strong> adoption <strong>of</strong> a proposed aaendllent<br />

to the Traffic Ordinance <strong>of</strong> the <strong>Town</strong> <strong>of</strong> Cheektowaqa which was adopted on July 17,<br />

1967, sud hearinq beinq held in accor4ance with Notice there<strong>of</strong> which was duly<br />

published as required by law, at which hearinq an opportunity to be heard was<br />

afforded all persons interested in the subject there<strong>of</strong>.<br />

NON, THEREFORE, BE IT RESOLVED as follows:<br />

Section 1.<br />

That this <strong>Town</strong> Board deteEllline that it is in the public interest<br />

to adopt the followinq amendllent to the Traffic Ordinance <strong>of</strong> the <strong>Town</strong> <strong>of</strong> Cheektowaqa,<br />

County <strong>of</strong> Erie and State <strong>of</strong> New York, and said amendment is herewith<br />

BERYL DRIVE (SERVICE ROAD) is hereby desiqnated I for one-way traffic in a northerly<br />

direction, between its intersection with Genesee Street and its intersection with<br />

(a) This amendment shall take effect when properly posted within<br />

a reasonable time except those parts" if any, which are subject to approval under<br />

Section 1684 <strong>of</strong> the Vehicle and Traffic Law <strong>of</strong> the State <strong>of</strong> New York.<br />

(b) Any part or parts <strong>of</strong> this amendment which is subject to<br />

maintained by the <strong>Town</strong> Clerk pursuant to Subdivision 6 <strong>of</strong> Section 30 <strong>of</strong> the<br />

<strong>Town</strong> Law <strong>of</strong> the State <strong>of</strong> N_ York, and affidavits <strong>of</strong> such publication and postinq<br />

shall be filed with the <strong>Town</strong> Clerk and the <strong>Town</strong> Clerk shall lik_ise enter in the<br />

A. There will be no extension <strong>of</strong> service life, improved capacity nor any other betterment <strong>of</strong> the<br />

Reimbursement on Utility A8rcements, and by PPM 30-4) as a result <strong>of</strong> the adjustments made<br />

The owner will not claim reimbursement for that portion <strong>of</strong> the work but will duly account for it<br />

for Reimbursement on Utility Apuements and FHWA PPM 30-4 with respect to depreciation<br />

credit when applicable.<br />

V. General Covenants<br />

The owner hereby agrees to ac:cept fuB title and responsibility for the adjusted facility in writing upon<br />

satisfactory completion <strong>of</strong> the work. Such acceptance will acknowledge the owner's responsibility to<br />

maintain the facility in acc:onJance with all applicable codes, standards and regulations, including his<br />

obliption, where applicable, to remove any or all <strong>of</strong> the facility from the highway at the order <strong>of</strong> the<br />

Commissioner <strong>of</strong> Transportation, all in accordance with the Rules and Re&ulations Governing the<br />

Accommodation <strong>of</strong> Utilities within the State Highway Rilht-<strong>of</strong>-Way and Federal Highway<br />

Administration, PPM 30-4.1. All claims covered by this ageement will be included in an agreemellt <strong>of</strong><br />

adjustment foDowina completion <strong>of</strong>the work, or in a municipal agreement prior to the performance <strong>of</strong><br />

WHEREAS, it would appear that parents generally favor the early<br />

evening hours, since it tends to limit participation to the younger children,<br />

for whom the observance was originally intended and thereby discourages interfereJ1,ce<br />

and disruption by the very small percentage <strong>of</strong> older children, who under<br />

cover <strong>of</strong> darkness and with their identities concealed by IIIllsltS and cost.-s,<br />

might otherwise spoil the fun for the smaller children; NOW, THEREFORE, BE IT<br />

WHEREAS, the increasing possibility <strong>of</strong> accidents is an ever present<br />

RESOLVED that Wednesday, October 31, 1979 shall be known as<br />

i"Halloween Night" in the <strong>Town</strong> <strong>of</strong> <strong>Cheektowaga</strong>, and that the <strong>Town</strong> Board ask both<br />

children and their parents to cooperate in limiting the time <strong>of</strong> "trick-or-treating"<br />

activities to the period between 6:00 P.M. and 9:00 P.M. We further ask that,<br />

whenever possible, parents <strong>of</strong> the very young insure that they or other responsible I<br />

adults accaapany them, and we further encourage all householders, whenever they<br />

are able to do so, to cooperate in malting this a happy occasion for all yOWl.gsters<br />

by keeping their porch or exterior lights on.<br />

WHEREAS, the regular daytime <strong>Town</strong> Board meeting for the month <strong>of</strong><br />

December, 1979 falls on December 24, 1979, and<br />

WHEREAS, all <strong>Town</strong> employees will be <strong>of</strong>f frcm work in accordance<br />

with the teDI8 <strong>of</strong> the bargaining contracts between the employees' representatives<br />

and the <strong>Town</strong> and all <strong>Town</strong> <strong>of</strong>fices will be closed, 'l'IIEREFORE, BE IT<br />

RESOLVED that the third regular _thly <strong>Town</strong> Board _ting be and<br />

hereby is authorized to be held on December 27, 1979 in the <strong>Town</strong> Ball Ch!!J!!bers at<br />

1:00 o'clock P.M. in place <strong>of</strong> said December 24th meeting, and BE IT FURl'HER<br />

Section 2. Time to take effect.<br />

(a) This amendment shall take effect when properly posted<br />

within a reasoIlClble time except those parts, if any, which are subject to<br />

approval under Section 1684 <strong>of</strong> the Vehicle and Traffic Law <strong>of</strong> the State <strong>of</strong><br />

New York.<br />

(b) Any part or parts <strong>of</strong> this amendment which is subject to<br />

approval under Section 1684 <strong>of</strong> the Vehicle and Traffic Law <strong>of</strong> the State <strong>of</strong><br />

New York shall take effect fran and after the day on which approval in writing<br />

is r,aceived fran the New York State Traffic Callmission.<br />

Section 3. Territorial application.<br />

This amendment shall apply to all <strong>of</strong> the <strong>Town</strong> <strong>of</strong> <strong>Cheektowaga</strong>,<br />

Erie County, New York outside <strong>of</strong> the villages <strong>of</strong> Depew and Sloan.<br />

That this amendment to the Traffic Ordinance shall be entered<br />

in the minutes <strong>of</strong> this <strong>Town</strong> Board and shall be published in the CiiEEK'KlWAGA<br />

TIMES a newspaper published in this <strong>Town</strong>, and a printed copy there<strong>of</strong> shall be<br />

posted on the signboard maintained by the <strong>Town</strong> Clerk pursuant to Subdivision 6<br />

<strong>of</strong> section 30 <strong>of</strong> the <strong>Town</strong> Law <strong>of</strong> the state <strong>of</strong> New York, and affidavits <strong>of</strong> such<br />

publication and posting shall be filed with the <strong>Town</strong> Clerk and the <strong>Town</strong> Clerk<br />

shall likewise enter in the Ordinance Book a copy <strong>of</strong> this amendment specifying<br />

the date <strong>of</strong> adoption there<strong>of</strong>.<br />

Vacation schedules shall be posted for ninety (90) days<br />

prior to the beginning <strong>of</strong> a vacation period, and during the first<br />

forty-five (45) days, vacation scheduling shall be deterlllined,<br />

based upon seniority, within each shift or bureau concerned. At<br />

the end <strong>of</strong> the said forty-five (45) days, vacation scheduling<br />

shall be deterlllined in order <strong>of</strong> date <strong>of</strong> request and not by<br />

seniority. The choice <strong>of</strong> vacations, during the first forty-five<br />

(45) days for each vacation period will be baaed, strictly, on<br />

seniority.<br />

Police <strong>of</strong>ficers shall not be perlllitted to split vacations<br />

during any <strong>of</strong> the vacation periods, for periods <strong>of</strong> time <strong>of</strong> less<br />

than one (1) calendar week.<br />

In the event an <strong>of</strong>ficer is not able to take the vacation<br />

time he selected, notice will be given to less senior <strong>of</strong>ficers<br />

and they will be entitled to take the vacation time not used and<br />

selection will be based upon seniority for that shift.<br />

Nothing contained herein shall prevent the granting <strong>of</strong><br />

vacations one day at a time.<br />

Except as herein provided, no <strong>of</strong>ficer will, be permitted<br />

to carry-over or to accUllUlate more than one-half <strong>of</strong> one year I s<br />

annual vacation.<br />

Section 10.02 -- UNUSED VACATION<br />

"<br />

Each police <strong>of</strong>ficer shall be paid, at the time <strong>of</strong> retirement,<br />

the monetary value <strong>of</strong> any unused vacation time and overtime<br />

standing to his credit, on the date <strong>of</strong> retirement. In the event<br />

<strong>of</strong> death, the value <strong>of</strong> such time, standing to his credit, will be<br />

paid to his estate or his heirs at law.<br />

Police <strong>of</strong>ficers intending to retire may notify the <strong>Town</strong><br />

two (2) years in advance and will be perlllitted to accumulate time<strong>of</strong>f<br />

and vacations for one and one-half years, the value <strong>of</strong> which<br />

will be paid as salary during the final year <strong>of</strong> employment and<br />

included as wages for pension purposes.<br />

Upon terlllination <strong>of</strong> employment, for any reason, an<br />

<strong>of</strong>ficer will be paid the value <strong>of</strong> all accUllUlated vacation, or<br />

other time-<strong>of</strong>f, including sick leave, pursuant to Appendix B. However,<br />

in the event termination is by discharge or dismissal, there<br />

will be no payment for accUIIIUlated sick leave.<br />

(a) Personal leave shall not be used in less than onehalf<br />

day increments.<br />

(b) Personal leave will be granted based upon the priority<br />

<strong>of</strong> the emergency and tf no emergency exists. upon the chronological<br />

time requested.<br />

ARTICLE XIII<br />

(c) Unused personal leave days shall be added to sick<br />

Section 12.02 -- PROBATIONARY POLICE OFFICERS<br />

During civil service probation. <strong>of</strong>ficers will accumulate<br />

sick leave and personal leave on a pro rata basis, per IIIOnth.<br />

which leave cannot be used during the probationary period.<br />

At the end <strong>of</strong> probation, he will continue to accUlllUlate<br />

sick leave at the same rate for the balance <strong>of</strong> that calendar year<br />

and then be granted such leave in the same manner as granted to<br />

other <strong>of</strong>ficers.<br />

Newly appointed police <strong>of</strong>ficers will be granted the<br />

uniform allowance, herein provided. illlllediately. on appointment.<br />

Probationary police <strong>of</strong>ficers shall enjoy life insurance<br />

benefits effective one hundred twenty (120) days after the date<br />

<strong>of</strong> appointment <strong>of</strong> said <strong>of</strong>ficer.<br />

Section 13.01 -- SICK LEAVE<br />

Each police <strong>of</strong>ficer. except as herein provided. shall be<br />

entitled to accUlllUlate one and one-half sick days per IlIOnth to a<br />

maximum accUlllUlation <strong>of</strong> 280 days in 1979 and 298 days in 1980 and<br />

each year thereafter.<br />

Section 13.02 -- NOTIFICATION<br />

A police <strong>of</strong>ficer will not be granted sick leave. unless<br />

he notifies his connanding <strong>of</strong>ficer that he will be absent and the<br />

reason for the same, at least ODe (1) hour prior to the time he<br />

is scheduled to report for duty. In cases <strong>of</strong> emergency. the onehour<br />

notice requirements will be waived.<br />

Section 13.03 -- EXTDmED SICK LEAVE<br />

If a police <strong>of</strong>ficer baa exhausted all <strong>of</strong> his accumulated<br />

sick days and is still disabled or ill, upon receipt <strong>of</strong> a physician1s<br />

report, verifying the illness or disability, and upon the police<br />

<strong>of</strong>ficer obtaining medical verification that there is a reasonable<br />

expectation that the police <strong>of</strong>ficer "1ill return to work, the<br />

police <strong>of</strong>ficer will be granted up to ninety (90) additional sick<br />

days. However, no salary will 'be paid during the first ten (10)<br />

days <strong>of</strong> extended sick leave, unless said police <strong>of</strong>ficer is still<br />

ill or disabled beyond said period <strong>of</strong> time.<br />

Section 13.04 -- WRICMEN'S COMPENSATION BENEFITS<br />

A police <strong>of</strong>ficer, who is entitled to receive Workmen's<br />

Compensation Benefits, shall be paid full pay and the benefits<br />

under Workmen's Compensation, to which he is entitled, shall be<br />

assigned to the <strong>Town</strong>. Absence from duty in this event will not<br />

be chargeable against sick leave and no other benefits, provided<br />

by this Agreement, will be lost during that period <strong>of</strong> time.<br />

Absence from duty for work-related disability will. not be chargeable<br />

against sick leave and no other benefits, provided by this Agreement,<br />

will be lost during such absence.<br />

Section 13.0S -- SICK LEAVE REmRDS<br />

Each police <strong>of</strong>ficer will be provided with a record <strong>of</strong><br />

his accuaulated sick leave within sixty (60) days after the beginning<br />

<strong>of</strong> each calendar year.<br />

Section 13.06 -- ILLNESS OF FAMILY MEMBERS<br />

Sick leave shall apply to absence due to illness <strong>of</strong> a<br />

police <strong>of</strong>ficer's illlDediate family, residing in his household.<br />

A police <strong>of</strong>ficer, who is required to leave the <strong>Town</strong>, by<br />

reason <strong>of</strong> his employment ,or as part <strong>of</strong> his <strong>of</strong>ficial duty, shall be<br />

reimbursed for all actual, reasonable and necessary expenses<br />

incurred, including meals, if he is absent from the <strong>Town</strong> during<br />

normal meal time.<br />

The <strong>Town</strong> will pay the full costs <strong>of</strong> all tuition, bookd<br />

and other fees, for all police <strong>of</strong>ficers, authorized by the <strong>Town</strong>,<br />

who attend schools or seminars relating to Police Science courses.<br />

Section 19.03 -- CIVIL SERVICE EXAMINATIONS -<br />

The <strong>Town</strong> may request from the Civil Service

The Club may purchase and maintain vending machiaes, to<br />

be installed and used in the section <strong>of</strong> the building frequented<br />

solely by police <strong>of</strong>ficers and the revenues derived therefrom shall<br />

be funds <strong>of</strong> the PoliJ:e Benevolent Fund alld will not be used Eor<br />

union purposes.<br />

The Club will indemnify the <strong>Town</strong> against any claims<br />

arising out <strong>of</strong> installation or use <strong>of</strong> such machines.<br />

Section 20.04 -- RADIO DISPATCHER<br />

The <strong>Town</strong> agrees to employ only civil service police<br />

<strong>of</strong>ficers to do police work, in any capacity, except routine clerical<br />

work, now being performed by clerks in the <strong>Town</strong> Board. The <strong>Town</strong><br />

agrees that it will not enter into any private contracts that<br />

eliminate police connected services or work now being performed<br />

by members <strong>of</strong> the police department, except as hereinafter set<br />

forth.<br />

The <strong>Town</strong> will phase out police <strong>of</strong>ficer ·radio dispatchers<br />

and the <strong>Town</strong> agrees there will be no decrease in the number <strong>of</strong><br />

police <strong>of</strong>ficers employed as a result <strong>of</strong> such phasing out. Police<br />

<strong>of</strong>ficers assigned as police radio dispatcher will be paid at a<br />

rate <strong>of</strong> pay equal to the difference between the salary paid to a<br />

senior patrolman and the salary paid to <strong>of</strong>ficers assigned as<br />

detective.<br />

As an <strong>of</strong>ficer leaves the department (for reasons other<br />

than lay<strong>of</strong>f), a police <strong>of</strong>ficer dispatcher may be moved into other<br />

duties and be replaced by a civilian dispatcher. When there are<br />

no police <strong>of</strong>ficers assigned to a shift as radio dispatcher. a<br />

sergeant will be designated to supervise that shift oE civilian<br />

radio dispatchers. No sergeant will be required if there is at<br />

least one (1) police <strong>of</strong>ficer assigned as a dispatcher.<br />

The position <strong>of</strong> the sergeant is to be a civil service<br />

position by competitive examination. A police <strong>of</strong>ficer must have<br />

three (3) years <strong>of</strong> service before he is qualified to take the<br />

Sergeant's ex&lll. The <strong>of</strong>ficer's three (3) years <strong>of</strong> s ervice must<br />

be completed prior to the date <strong>of</strong> the sergeant's ex&lll.<br />

Section 20.05 -- SAFETY<br />

After <strong>of</strong>ficers are assigned to duty singly to each <strong>of</strong><br />

six (6) patrol vehicles and two (2) <strong>of</strong>ficers are assigned to duty<br />

in an accident car, additional <strong>of</strong>ficers on duty will be assigned<br />

so that patrol vehicles, including the first six (6) patrol vehicles.<br />

are manned by t1IfO (2) patrol <strong>of</strong>ficers.<br />

ARTICLE XXI<br />

Section 21.01 -- GRIEVANCE PROCEDURE<br />

A grievance shall mean any difference or dispute between<br />

the parties hereto, as to the interpretation or application <strong>of</strong> any<br />

portion <strong>of</strong> this agreement or any administrative act affecting<br />

gElnera1 working concUtions.<br />

Step 1 -- Any police <strong>of</strong>ficer may present a grievance.<br />

orally or in writing. to his immediate supervisor, within thirty<br />

(30) days <strong>of</strong> the occurrence and attempt to adjust .the matter. If<br />

the matter is not satisfactorily adjusted the police <strong>of</strong>ficer may<br />

request a representative <strong>of</strong> the Club meet with him and his illlDediate<br />

supervisor for the purpose <strong>of</strong> adjusting the grievance.<br />

Step 2 -- If the grievance is not satisfactorily settled.<br />

under Step 1, the Club representative may forward the grievanc.:!<br />

r-o the Club's Gri8'l.,ance Coumittee. After review <strong>of</strong> the grievance.<br />

the Club will forward a copy <strong>of</strong> the grievance to the Chief <strong>of</strong><br />

Police, within five (5) calendar days or receipt by the colllllittee.<br />

The Chief <strong>of</strong> Police will, within five (5) calendar days <strong>of</strong> presentation<br />

to him, discuss the matter with the Club Grievance Co1llDittee<br />

in an attempt to settle the grievance.<br />

Step 3 -- In the event the grievance is DOt settled under<br />

Step 2, above, a report <strong>of</strong> the grievance will be made by the Club<br />

Grievance Collllll1ttee and by the Chief <strong>of</strong> Police and each will forward<br />

their report, within five (5) days, to the <strong>Town</strong> Supervisor or his<br />

•representative. The <strong>Town</strong> SUpervisor or his representative will<br />

.discuss the grievance with the Grievance Comad.ttee, within fifteen<br />

(15) calendar days after receipt <strong>of</strong> the written report.<br />

Step 4 -- In the event the dispute is aot satisfactorily<br />

settled, either party 1lI&y take the matter to arbitration. upon<br />

service <strong>of</strong> written notice to the other party <strong>of</strong> intention to do so.<br />

The notice 1II18t be served within thirty (30) calendar days after<br />

Section 22.02 •• IDENTIFICATION OF INVESTIGATING OFFICERS<br />

A police <strong>of</strong>ficer, who is under investigation for a matter<br />

;which would not constitute a crime, 1IIU8t be informed <strong>of</strong> the .tame<br />

<strong>of</strong> the <strong>of</strong>ficer in charge <strong>of</strong> the investigation and the names <strong>of</strong><br />

the <strong>of</strong>ficers who will' be conducting any portion <strong>of</strong> interrogation<br />

or investigation.<br />

Section 22.03 _. INFORMATION REGARDING INVESTIGATION<br />

An <strong>of</strong>ficer must be informed <strong>of</strong> the nature <strong>of</strong> an<br />

investigation before any interrogation begins. The information<br />

IllUSt be sufficient to reasonably inform him <strong>of</strong> the nature <strong>of</strong> the<br />

investigation which is being conducted.<br />

Section 22.04 -- LENGTH OF INTERROGATION<br />

Interrogation shall be completed with reasonable<br />

dispatch. Reasonable rest periods will be allowed and t:ime will<br />

be provided for personal necessities, meals, telephone calls and<br />

rest periods as reasonably required.<br />

Section 22.05 -- OOERCION<br />

A police <strong>of</strong>ficer shall,DQt be subjected to <strong>of</strong>fensive<br />

language and shall not be threatened with tr&Dsfer, dismisllal or<br />

any other disciplinary punishment. No promise or reward shall<br />

be made as an inducement to answering questions. Nothing herein<br />

is to be construed as to prohibit the investigating <strong>of</strong>ficer from<br />

informing an <strong>of</strong>ficer that his conduct may be subject to other<br />

disciplinary action with resultant disciplinary punishment.<br />

Section 22.06 -- RIGHT 'l'O OOUNSEL<br />

I<br />

A police .<strong>of</strong>ficer, who is under investigation, bas the<br />

right to have a representative <strong>of</strong> the Police Club present and<br />

also bas the right to the presence <strong>of</strong> an attorney with him during<br />

any questioning, hearing or interrogation.<br />

Section 22.07 -- REOORDING OF INTERROGATION<br />

Interrogation <strong>of</strong> a police <strong>of</strong>ficer for any disciplinary<br />

investigation will be recorded, either mechanically or by a<br />

One-half <strong>of</strong> the value at each step shall be paid to the<br />

WHEREAS, the <strong>Town</strong> Engineer, Chester L. Bryan, was named as a<br />

defendant in a certain lawsuit cClllllllenced against him by a then <strong>Town</strong> Employee in<br />

his <strong>of</strong>fice, t.o wit: Gloria Kowalczyk, said lawsuit was commenced on or about<br />

May 15, 1975, and<br />

WHEREAS, said lawsuit included allegations related to the<br />

administration, procedures and work-related matters connected with the <strong>Town</strong><br />

Engineering Department, and<br />

WHEREAS, at the time <strong>of</strong> the cammencement <strong>of</strong> said action, it was<br />

determined by the TOwn that it would not utilize the .services <strong>of</strong> the <strong>Town</strong> Attorney's<br />

Office in a legal matter involving a <strong>Town</strong> Official and a <strong>Town</strong> Employee because <strong>of</strong><br />

a possible conflict <strong>of</strong> interest, and whereupon said Chester L. Bryan retained<br />

private legal counsel to defend and represent him in said lawsuit and said attorneys<br />

notified the <strong>Town</strong> <strong>of</strong> their retainer, and<br />

WHEREAS, it further appears that the plaintiff's claim was<br />

unsuccessful and dismissed and no recovery was obtained in favor <strong>of</strong> the plainfiff,<br />

NOW, THEREFORE, BE IT<br />

RESOLVED that the said Chester L. Biyan, <strong>Town</strong> Engineer. be and<br />

hereby be reimbursed for payment <strong>of</strong> attorney's fees to his private legal counsel,<br />

the fiJ:lll <strong>of</strong> Lipsitz, Green, Fahringer, Roll, Schuller and James, in the sum <strong>of</strong><br />

$500.00, upon his subnission <strong>of</strong> a proper voucher to the <strong>Town</strong> Accounting Department,<br />
