Part of President Barack Obama’s health care law, the program is in limbo as a congressional debt panel searches for budget savings and behind the scenes, administration offi cials scramble to fi nd a viable fi nancing formula. A longstanding priority of the late Sen. Edward M. Kennedy, D-Mass., the Community Living Assistance Services and Supports program, or CLASS, was spliced into the health care law despite nagging budget worries. Administration e-mails and documents reveal that alarms were sounded earlier and more widely than previously thought. CLASS remains vulnerable to repeal. “There has been no decision made,” Health and Human Services spokesman Richard Sorian said Wednesday. “We are continuing our analysis. But it’s an open question. The question is whether we can develop a program that is fi scally solvent and self-sustaining into the future.” CLASS was intended as a voluntary long-term care insurance plan, supported by premiums, not taxpayer dollars. On the other hand, many economic experts believe the government has already promised seniors more than it can deliver, and now is not the time to launch another program likely to need a taxpayer bailout or new mandates. CLASS poses a dilemma for the new congressional supercommittee, since it initially reduces the federal defi cit until payouts overwhelm premiums collected. The e-mails show that the fi rst warning about CLASS came in May 2009, from Richard Foster, head of long range economic forecasts for Medicare. “At fi rst glance this proposal doesn’t look workable,” Foster wrote in an email to other HHS offi cials, some of whom were working with Congress to get CLASS into the health care law. Foster said a rough outline of the program would have to enroll more than 230 million people — more than the U.S. workforce — to be fi nancially feasible. But work on CLASS continued, bolstered in part by a report for AARP that laid out scenarios for implementing the plan. The AARP study also raised fi nancial concerns, although the seniors’ lobby supports CLASS. In July, Foster tried again. After reviewing the latest information from Kennedy’s offi ce, he wrote HHS offi cials: “Thirty-six years of (professional) experience lead me to believe that this program would collapse in short order and require signifi cant federal subsidies to continue.” Too late. The Obama administration had decided to support CLASS. In the months that followed, documents and e-mails indicate that Foster was edged out of deliberations. By that time, Marton, the HHS aging policy offi cial, was also chiming in. E-mails he sent other administration offi cials relayed studies that raised concerns about such issues as premiums and the role of employers, while also recommending fi xes. Publicly, the administration maintained it would all work out. A December 2009 presentation for senior offi cials stressed the end result would be a fi nancially robust program. In private, administration insiders were still spelling out concerns. In January 2010, amid the fi nal drive to pass the health care law through a divided Congress, offi cials circulated a 10-page list of “technical corrections.” One item questioned whether the law gave HHS suffi cient authority to redesign the program to keep it afl oat, and recommended a “failsafe” clause spelling that out. Republicans say none of those changes were ever made. However, HHS spokesman Sorian said Secretary Kathleen Sebelius will not go forward with the program unless it is fi nancially sustainable, and the law explicitly gives her that power. GOP lawmakers aren’t reassured. “The CLASS program is fi scally unsound and was used as a budget gimmick in the health care law,” said Rep. Fred Upton, R-Mich., chairman of the House Energy and Commerce Committee. Sen. John Thune, R-S.D., called it “a ticking time bomb that will place taxpayers’ money at risk.” A GOP plans to release report on the CLASS program today. Statue appears COUNCIL BLUFFS, Iowa (AP) — A Hot Dog Man statue that suddenly appeared in one Iowa town has mystifi ed police, who would relish information about it. The Daily Nonpareil in Council Bluffs reported that a concerned citizen called police there last week to report a man in a hot dog costume near a bus stop where children congregate. When offi cers arrived, they found the man was actually a 6-foot tall statue, with spindly legs and a pair of high-top sneakers. The statue has been spotted elsewhere, but police Capt. Terry LeMaster says no one knows anything about it. It is being stored until someone claims it. Thief swallows jewel MADRID (AP) — Spanish authorities say a $16,500 diamond was found in a thief’s stomach after he was taken to a hospital for an X-ray. A British tourist reported that a purse with the diamond in it was stolen by two welldressed men who entered a restaurant in the beach resort of Marbella. Police said Wednesday that offi cers later stopped a car with four men with criminal records, and found the purse inside the car. An offi cer saw one of the men put his hand to his mouth, like he was hiding something. The man was taken to a medical center, where the X-ray revealed the diamond in his stomach.
