ADVERTISING POLICIES<br />

Terms and Conditions<br />

Invoices are due net 30 days with approved credit. Interest of<br />

1.5 percent per month will be added to all past due balances.<br />

First-time advertisers must submit a credit application or provide<br />

payment in full with insertion order. A 2 percent discount<br />

will apply to all prepaid advertising orders. Advertiser agrees<br />

to pay all costs of collection, including reasonable attorney’s<br />

fees incurred by publisher in connection with <strong>the</strong> collection of<br />

any past due account of advertiser.<br />

Online Advertising Orders/Payment<br />

Advertisers must complete an insertion order. All advertising is<br />

subject to publisher’s approval.<br />

Short Rate<br />

Advertisers will be short-rated if, within a 12-month period<br />

from <strong>the</strong> date of <strong>the</strong> first insertion, <strong>the</strong>y do not use <strong>the</strong><br />

amount of space upon which <strong>the</strong>ir billing has been based.<br />

Advertisers will be rebilled.<br />

COMMISSIONS AND DISCOUNTS<br />

Agency Commission<br />

Fifteen percent of gross billing allowed only to recognized<br />

agencies on space, color and position, provided account is<br />

paid within 30 days of invoice date. In <strong>the</strong> event of non-payment,<br />

publisher reserves <strong>the</strong> right to hold advertiser and/or its<br />

advertising agency jointly and severally liable for such monies<br />

as are due and payable to publisher.<br />

Ad Cancellations<br />

All cancellations must be in writing and will not be considered<br />

accepted until confirmed by <strong>the</strong> Sales Manager. No cancellation<br />

will be accepted after <strong>the</strong> issue space closing date.<br />

Contracts for covers are non-cancelable for period contracted.<br />

Publisher’s Protective Clauses<br />

In consideration of publication of an advertisement, <strong>the</strong> advertiser<br />

and <strong>the</strong> agency, jointly and severally, will indemnify and<br />

hold harmless <strong>the</strong> <strong>American</strong> <strong>Solar</strong> <strong>Energy</strong> <strong>Society</strong>, its officers,<br />

agents and employees against expenses (including legal fees)<br />

and losses resulting from <strong>the</strong> publication of <strong>the</strong> contents<br />

of <strong>the</strong> advertisement, including, without limitation, claims<br />

or suits for libel, violation of <strong>the</strong> right of privacy, copyright<br />

infringement or plagiarism.<br />

The publisher will not be bound by any conditions printed<br />

or o<strong>the</strong>rwise appearing on order blanks or copy instructions<br />

when such conditions conflict with policies set forth on this<br />

rate card.<br />

All advertisements are accepted and published by <strong>the</strong> publisher<br />

on <strong>the</strong> representation of <strong>the</strong> agency and <strong>the</strong> advertiser<br />

that both are authorized to publish <strong>the</strong> entire contents and<br />

subject matter of <strong>the</strong> advertisement. At its discretion, <strong>the</strong> publisher<br />

may refuse any ad deemed inappropriate or in conflict<br />

with its mission and objectives.<br />

Rates are subject to change<br />

with 60 days notice.<br />

The publisher is not liable for delays in delivery and/or nondelivery<br />

in <strong>the</strong> event of an Act of God, action by any government<br />

or quasi-governmental entity, fire, flood, insurrection,<br />

riot, explosion, embargo, strikes (whe<strong>the</strong>r legal or illegal),<br />

labor or materials shortage, transportation interruption of any<br />

kind, work slowdown, or any condition beyond <strong>the</strong> control of<br />

<strong>the</strong> publisher affecting production or delivery in any manner.
