(10) Presentation by Proposing Institution<br />
(a) Subject to the requirements of § E(2) of this regulation, the president of the<br />
proposing institution may make a presentation to the <strong>Commission</strong>.<br />
(b) The presentation shall be limited to 10 minutes, and shall be made after<br />
each objecting institution’s second presentation.<br />
(c) The presentation shall be made by one or more individuals designated by<br />
the president, and may include the president and a chief executive officer of a segment.<br />
H. Conduct of Meeting When Both the Proposing and an Objecting Institution Have<br />
Sought Review.<br />
(1) If the Secretary disapproves or does not recommend a program and both the<br />
proposing and an objecting institution seek review, and objecting institution that has<br />
complied with the provisions of §§ B and E(2)of this regulation may follow the procedures<br />
for the proposing institution set forth in § F of this regulation.<br />
(2) The objecting institution’s presentations shall follow the proposing institution’s<br />
first and second presentations as set forth in § F(3) and (5) of this regulation.<br />
(3) If more than one objecting institution has sought review, the <strong>Commission</strong><br />
chairperson shall determine the order of the presentations.<br />
I. <strong>Commission</strong>’s Decision.<br />
(1) The <strong>Commission</strong> shall follow the procedures in this section in making its<br />
decision.<br />
(2) Upon completion of the presentations, the <strong>Commission</strong> may adjourn to<br />
executive session as allowed by law to discuss the presentations and any relevant<br />
documentation submitted by the presenters.<br />
(3) The <strong>Commission</strong> shall render a decision that is consistent with the<br />
requirements of this Chapter.<br />
(4) After consideration, but not later than 10 working days after the review meeting,<br />
the <strong>Commission</strong> shall send a final written decision to the president with a copy to all<br />
presenting institutions, segments, and the Secretary.<br />
(5) The decision of the <strong>Commission</strong> is final, and is not subject to reconsideration by<br />
the <strong>Commission</strong> or review by any administrative or judicial body.<br />
(6) For purposes of the Administrative Procedure Act, the <strong>Commission</strong>’s review<br />
under this chapter is not a contested case.<br />
