4.7. LA CONSULTA CASOS ESPECIALES • Si el Fiscal Provincial decide no promover acción penal porque considera que los hechos no constituyen delito; deberá obligatoriamente elevar en consulta la Resolución que ampara su decisión en los siguientes casos: a)Delitos contra la Salud Pública (Tráfico Ilícito de drogas - narcotráfico) b)Delitos contra la Tranquilidad Pública: Terrorismo —Traición ala patria EFECTO a) Si Fiscal Superior aprueba la resolución de no promover la acción penal, la confirma yel caso se archiva definitivamente. b) Si desaprueba la resolución de Fiscal Provincial ordena la formalización de la denuncia ante el Juez Penal.
