Für Schritt 1 (Ermittlungdes nächstliegenden Stands derTechnik) des Aufgabe-Lösungs-Ansatzesin Pozzoli/Windsurfing gebe es zwarkeine Entsprechung, dies liege jedochdarin begründet, dass vor dem britischenPatentgericht zugelassene Patentvertretergelernt hätten, sich insbesonderevor Gericht auf ihre besten Fälle zubeschränken. Mit ausschweifendenZitaten würden britische Patentrichterganz einfach nicht konfrontiert.Der Aufgabe-Lösungs-Ansatz habezwar seine Grenzen, wenn jedoch keineNotwendigkeit zur Umformulierung derAufgabe bestehe, könne er sehr guteDienste leisten. Dies sei hier der Fall.Laut Patent würde der Fachmann dieLöslichkeit von Fluvastatin für sehr hochund infolgedessen eine Formulierung zurverzögerten Freisetzung für unmöglichhalten. Diese Auffassung teilte dasGericht nicht. Allein aufgrund seinesallgemeinen Fachwissens würde derFachmann nicht auf diesen Gedankenkommen. Die im Patent dargelegte Aufgabesei irreal – in Wirklichkeit existieresie gar nicht, weil Fluvastatin nicht in sohohem Maße löslich sei, dass der Fachmanndie Erzeugung einer Formulierungzur verzögerten Freisetzung für schwierigoder gar unmöglich halten würde.Wenn das Hindernis, das der Erzeugungeiner Formulierung mit Freisetzungsverzögerungpatentgemäß entgegenstehe,nachweislich irreal sei, dann sei eineFormulierung zur verzögerten Freisetzungnaheliegend. Im Sinne von Pozzoliunterscheide sich der Anspruch vomStand der Technik nur durch die Idee,eine Formulierung zur verzögerten Freisetzungzu erzeugen. Diese Idee seitechnisch motiviert und berge wederechte noch scheinbare Schwierigkeiten.Zu diesem Ergebnis führe auch derAufgabe-Lösungs-Ansatz. Die Aufgabebestehe in der Erzeugung einer Formulierungzur verzögerten Freisetzung vonFluvastatin. Die Lösung sei naheliegend,weil ganz offensichtlich auch die Stanwasimplicit in all other approaches.Step 4, for example, merely posed thequestion. Althoughthere was nothing like step 1 of theproblem-solution approach (identifythe closest prior art) in the Pozzoli/Windsurfing approach, this was becausepractitioners before the English PatentsCourt had learned to confine themselvesto their best cases, especially by thetime of trial. English patent judges weresimply not faced with profligate citations.While the problem-solution approachhad its limitations, it was apt to workvery well when there was no need toreformulate the problem. This was sucha case.The patent stated that the skilled manwould think the solubility of fluvastatinwas so high that a sustained-releaseform could not be made. The Courtdisagreed. The skilled man wouldnot think that, based on his commongeneral knowledge alone. The problempresented in the patent was illusory – itwas in reality a non-problem becausefluvastatin was not so highly solublethat the skilled person would expect itto be impossible or difficult to make asustained-release form. Once theobstacle put forward in the patentagainst being able to make a sustainedformulation was shown to be illusory,then a sustained-release formulationwas obvious. In Pozzoli terms, the onlydifference between the prior art andthe claim was the idea of making asustained-release formulation. For thatthere was a technical motivation and nodifficulty, real or apparent.The problem-solution approach gavethe same answer. The problem was toproduce a sustained-release form offluvastatin. The solution was obvious,because any of the standard methodsfor such formulations would clearly work.fait qu'expliciter ce qui était implicitedans les autres approches. C'étaitle cas ici.D'après le brevet, l'homme du métieraurait jugé la solubilité de la fluvastatineélevée au point de rendre impossibleune formulation à libération prolongée.Le Tribunal n'a pas été de cet avis.L'homme du métier ne serait pas arrivé àcette conclusion, sur la seule base deses connaissances générales pertinentes.Le problème présenté dans le brevetétait illusoire. Il s'agissait en réalité d'unnon-problème, car la fluvastatine n'estpas à ce point soluble que l'homme dumétier jugerait impossible ou difficiled'en obtenir une formulation à libérationprolongée. Une fois apparu commeillusoire le problème présenté dans lebrevet, à savoir la mise au point d'uneformulation à libération prolongée, laditeformulation devenait évidente. Du pointde vue de l'espèce Pozzoli, l'idée mêmede mettre au point une formulation àlibération prolongée constituait la seuledifférence entre l'état de la technique etla revendication. Il existait pour cela unemotivation technique, sans difficultéréelle ou apparente.L'approche "problème-solution" donnaitla même réponse. Le problème était deproduire une formulation à libérationprolongée de la fluvastatine. La solutionétait évidente puisqu'il était clair quen'importe lequel des procédés standard
