Dear Principals, Dear Readers,
Due to the measures related to the Coronavirus COVID-19, the Luxembourg Government has taken a
number of measures in order to support companies and their employees and thus avoid the notification
of redundancies:
1. Possibility to introduce a request for partial unemployment for your employees
The Luxembourg Government is offering Luxembourg companies which fear that they will have to lay
off their employees, since their activity is in decline due to the coronavirus, the option of having recourse
to the short-time working scheme.
This partial unemployment may be requested for employees whom the companies can no longer employ
on a full-time basis or can no longer employ at all, even if the employees in question do not have
a certificate of incapacity for work, regardless of whether the employee in question is hired under a
fixed-term or open-ended contract.
If such a request is accepted, the Employment Fund will then pay 80% of the normal wage (limited,
however, to 250% of the minimum social wage for an unskilled employee, i.e. EUR 5,354.98) for a maximum
of 1022 hours per employee. The remaining 20%, as well as the social security charges, remain
the responsibility of the employer.
It should be emphasized that companies that make use of short-time working undertake not to dismiss
their employees for economic reasons.
The application, which should be addressed to the "Ministry of the Economy - Comité de conjoncture", is

, it being specified that the first application must be made without specific delay, and any subsequent
applications, if necessary, each month and at the latest on the 12th of the month preceding the
month concerned by the application.
Self-employed persons are unfortunately not currently authorized to make such a request. This possibility
could also be open to self-employed persons in the coming days and weeks.
2. Possibility of using leave for family reasons
In view of the temporary closure of all educational establishments (schools, daycare, etc.), the Luxembourg
Government offers the possibility to parents affiliated to the Luxembourg social security system,
regardless of whether they are Luxembourg residents or not, and who have to take care of their child(-
ren) under the age of 13, to make use of "leave for family reasons".
This leave can only be taken by a parent of a child or children, provided that there is no other alternative
for the care of the child or children.
If necessary, parents have the option of alternating family leave. However, it is recommended that if one
parent is in a health profession, the other parent should take the family leave.
Like salaried employees, this option is also available to self-employed persons, provided they are affiliated
to the “Mutualité des Employeurs”.

3. Possibility of a bank guarantee
Given that many companies are currently experiencing major financial difficulties, the Chamber of Commerce
has also set up a specific bond in the form of a guarantee, which is offered by the Chamber of
Commerce through its “Mutualité de Cautionnement”.
This guarantee is intended for companies that will need a bank loan or a line of credit.
It is for an amount not exceeding 250 000,-€ per surety, and will be up to 50% of the credit.
Companies wishing to take advantage of this guarantee must apply directly to their bank and submit the
application to them. The bank will then decide on the release of the credit.
4. The obligation for frontier workers to certify the need to cross the border
a) German frontier workers :
The German Government has decided to tighten controls at the border between the Grand Duchy of
Luxembourg and the Federal Republic of Germany.
Only frontier workers who can prove the need to cross the border despite the current situation will be
entitled to cross the German-Luxembourg border without any restrictions.
In this connection, the Luxembourg Government has drawn up a certificate for German frontier workers:

the person concerned and his employer and must be presented to the border control authorities.
b) French frontier workers :
The French Government has taken the decision to carry out reinforced controls at the border between
the Grand Duchy of Luxembourg and the French Republic.
Only frontier workers who can prove the need to cross the border despite the current situation will be
entitled to actually cross the Franco-Luxembourg border.
In this respect, the Luxembourg Government has drawn up a certificate for French border workers:

, which attests to the employment relationship between the person concerned and his/her employer
and must be presented to the border control authorities.
In addition, French residents will also have to present an „attestation de déplacement dérogatoire“

) and a „justificatif

Upon presentation of these three documents, the border crosser in question will be exempted from any
restrictions when crossing the border.
c) Belgian border workers:
The Belgian Government has also just taken the decision to carry out reinforced controls at the border
between the Grand Duchy of Luxembourg and Belgium.
Only frontier workers who can prove the need to cross the border despite the present situation will be
entitled to actually cross the Belgian-Luxembourg border.

to the employment relationship between the person concerned and his/her employer and must be presented
to the border control authorities.

On presentation of the abovementioned certificate, the frontier worker in question will be exempted
from any restrictions when crossing the border.

En raison des mesures liées aux Coronavirus COVID-19, le Gouvernement luxembourgeois a pris un certain
nombre de mesures afin de soutenir les entreprises et leurs salariés et ainsi, éviter la notification
de licenciements :
1. Possibilité d’introduire une demande de chômage partiel pour vos salariés
Le Gouvernement luxembourgeois offre aux entreprises luxembourgeoises qui craignent de devoir
licencier leurs salariés, dès lors que leur activité est en déclin dû au coronavirus, la faculté de recourir
au régime du chômage partiel.
Ce chômage partiel peut être demandé pour des salariés que les entreprises ne peuvent plus occuper à
temps plein ou ne peuvent plus du tout occuper, même si les salariés en question n´ont pas de certificat
d´incapacité de travail, et ce peu importe si le salarié en question est engagé par un contrat à durée déterminée
ou indéterminée.
En cas d’acceptation d´une telle demande, le Fonds pour l‘emploi prendra alors 80 % du salaire normal
en charge (limité toutefois, à 250 % du salaire social minimum pour un salarié non qualifié, soit
5.354,98 EUR) pendant au plus 1.022 heures par salarié. Les 20 % restants, ainsi que les charges sociales
demeurent à charge de l´employeur.
A souligner que les entreprises qui recourent au chômage partiel, s´engagent à ne pas licencier leurs
salariés pour des raisons économiques.
La demande qui est à adresser à « Ministère de l’Economie – Comité de conjoncture » est disponible
sous le lien suivant : https://adem.public.lu/fr/formulaires/employeurs/Chomage-partiel.html, ceci
étant précisé que la première demande devra intervenir sans délai spécifique, et toutes demandes subséquentes
le cas échéant, chaque mois et au plus tard le 12 du mois précédant le mois concerné par la
demande.
Les indépendants ne sont malheureusement, actuellement pas autorisés à faire une telle demande. Cette
possibilité pourrait également s’ouvrir aux indépendants dans les jours et semaines à venir.
2. Possibilité de recourir au congé pour raisons familiales
Compte tenu de la fermeture temporaire de tous les établissements scolaires (écoles, crèches, maisons
relais, etc.), le Gouvernement luxembourgeois offre la possibilité aux parents affiliés au régime luxembourgeois
de sécurité sociale, peu importe qu’ils soient résidents luxembourgeois ou non, et qui doivent
assurer la garde de leur(s) enfant(s) âgé(s) de moins de 13 ans, de recourir au « congé pour raisons
familiales ».
Ce congé ne peut être pris que par un parent d´un enfant ou d´enfants, à condition qu´il n´existe aucune
autre alternative permettant d´assurer la garde de l´enfant ou des enfants.

Au besoin, les parents ont la faculté d´alterner le congé pour raisons familiales. Il est toutefois recommandé
que si l´un des deux parents exerce une profession de santé, l´autre parent devra prendre le
congé pour raisons familiales.
Tout comme les salariés, cette faculté s’offre aussi aux indépendants à condition toutefois, d´être affiliés
à la Mutualité des Employeurs.
Afin de bénéficier de ce congé, chaque parent doit soumettre une demande de congé pour raisons familiales
individuelle telle que disponible sous le lien suivant : https://cns.public.lu/fr/formulaires/prises-en-charge/cprf-extraordinaire.html,
à la Caisse nationale de santé, et en informer son employeur.
3. Possibilité d’une garantie bancaire
Attendu que de nombreuses entreprises connaissent actuellement d’importantes difficultés financières,
la Chambre de Commerce a également mis en place un cautionnement spécifique sous la forme d´une
garantie, lequel est proposé par la Chambre de Commerce à travers sa Mutualité de Cautionnement.
Cette garantie est destinée aux entreprises qui auront besoin d´un prêt bancaire ou d´une ligne de crédit.
Elle porte sur un montant ne pouvant pas dépasser les 250. 000,-€ par cautionnement, et sera à hauteur
de 50 % du crédit.
Les entreprises souhaitant profiter de ce cautionnement devront s´adresser directement à leur banque
et leur soumettre la demande. Cette dernière décidera ensuite du déblocage du crédit.
4. L´obligation pour les travailleurs frontaliers de certifier la nécessité de traverser
la frontière
a) Les frontaliers allemands :
Le Gouvernement allemand a décidé de procéder à des contrôles renforcés à la frontière entre le Grand-
Duché de Luxembourg et la République fédérale d´Allemagne.
Seul le travailleur frontalier justifiant de la nécessité de passer la frontière malgré la situation actuelle,
aura le droit de traverser, sans éventuelles restrictions, effectivement la frontière germano-luxembourgeoise.
A cet égard, le Gouvernement luxembourgeois a élaboré un certificat pour les frontaliers allemands

lequel atteste de la relation de travail entre la personne
concernée et son employeur, et doit être présenté aux autorités de contrôle des frontières.
b) Les frontaliers français :
Le Gouvernement français a pris la décision de procéder à des contrôles renforcés à la frontière entre le
Grand-Duché de Luxembourg et la République française.
Seul le travailleur frontalier justifiant de la nécessité de passer la frontière malgré la situation actuelle,
aura le droit de traverser effectivement la frontière franco-luxembourgeoise.

A cet égard, le Gouvernement luxembourgeois a élaboré un certificat pour les frontaliers français : https://gouvernement.lu/dam-assets/documents/actualites/2020/03-mars/certificat-frontaliers.pdf,
lequel
atteste de la relation de travail entre la personne concernée et son employeur, et doit être présenté
aux autorités de contrôle des frontières
A noter qu’en outre, les résidents français devront, en sus, également présenter une « attestation de
déplacement dérogatoire » (disponible sous le lien suivant : https://gouvernement.lu/dam-assets/documents/actualites/2020/03-mars/certificats-france/Attestation-de-deplacement-derogatoire.pdf)
et

Sur présentation du prédit certificat, le frontalier en question sera dispensé d´éventuelles restrictions
lors du passage de la frontière.

Sehr geehrte Mandanten, sehr geehrte Leserinnen und Leser,
Aufgrund der Maßnahmen im Zusammenhang mit dem Coronavirus COVID-19 hat die luxemburgische
Regierung eine Reihe von Maßnahmen ergriffen, um die Unternehmen und ihre Beschäftigten zu
unterstützen und so die Meldung von Entlassungen zu vermeiden:
1. Möglichkeit, einen Antrag auf Teilarbeitslosigkeit für Ihre Mitarbeiter zu
stellen
Die luxemburgische Regierung bietet luxemburgischen Unternehmen, die befürchten, ihre Mitarbeiter
entlassen zu müssen, da ihre Tätigkeit aufgrund des Coronavirus rückläufig ist, die Möglichkeit an, auf
die Kurzarbeitsregelung zurückzugreifen.
Diese Teilarbeitslosigkeit kann für Arbeitnehmer beantragt werden, die von den Unternehmen nicht
mehr Vollzeit oder gar nicht mehr beschäftigt werden können, auch wenn die betreffenden Arbeitnehmer
keine Arbeitsunfähigkeitsbescheinigung haben, unabhängig davon, ob der betreffende Arbeitnehmer
mit einem befristeten oder unbefristeten Vertrag eingestellt ist.
Wird einem solchen Antrag stattgegeben, zahlt der Beschäftigungsfonds dann 80 % des normalen
Lohns (begrenzt jedoch auf 250 % des sozialen Mindestlohns für einen ungelernten Arbeitnehmer, d. h.
5.354,98 EUR) für maximal 1.022 Stunden pro Arbeitnehmer. Die restlichen 20 % sowie die Sozialversicherungsabgaben
bleiben in der Verantwortung des Arbeitgebers.
Hervorzuheben ist, dass Unternehmen, die von Kurzarbeit Gebrauch machen, sich verpflichten, ihre
Mitarbeiter nicht aus wirtschaftlichen Gründen zu entlassen.
Der Antrag, der an das „Wirtschaftsministerium - Comité de conjoncture“ zu richten ist, kann unter
folgendem Link abgerufen werden: https://adem.public.lu/fr/formulaires/employeurs/Chomage-partiel.html.
Der erste Antrag muss ohne besondere Verzögerung gestellt werden, die Folgeanträge gegebenenfalls
jeden Monat, spätestens jedoch am 12. des Monats, der dem vom Antrag betroffenen Monat
vorausgeht.
Selbständige sind derzeit leider nicht berechtigt, einen solchen Antrag zu stellen. Diese Möglichkeit
könnte in den kommenden Tagen und Wochen auch Selbständigen offen stehen.
2. Möglichkeit der Inanspruchnahme von Urlaub aus familiären Gründen
Angesichts der vorübergehenden Schließung aller Bildungseinrichtungen (Schulen, Kinderkrippen,
Maison Relais usw.) bietet die luxemburgische Regierung den dem luxemburgischen Sozialversicherungssystem
angeschlossenen Eltern, unabhängig davon, ob sie in Luxemburg ansässig sind oder nicht,
und die ihr(e) Kind(er) unter 13 Jahren betreuen müssen, die Möglichkeit, „Urlaub aus familiären Gründen“
in Anspruch zu nehmen.
Dieser Urlaub kann von einem Elternteil eines Kindes mehrerer Kinder genommen werden, vorausgesetzt,
dass es keine andere Alternative für die Betreuung des Kindes oder der Kinder gibt.

Falls erforderlich, haben die Eltern die Möglichkeit, den Familienurlaub abwechselnd zu nehmen. Es
wird jedoch empfohlen, dass, wenn ein Elternteil in einem Gesundheitsberuf tätig ist, der andere Elternteil
den Familienurlaub nehmen sollte.
Wie Angestellte steht diese Option auch Selbständigen zur Verfügung, sofern sie der Mutualité des Employeurs
angeschlossen sind.
Um diesen Urlaub in Anspruch nehmen zu können, muss jeder Elternteil einen individuellen Antrag
auf Urlaub aus familiären Gründen, der unter folgendem Link verfügbar ist: https://cns.public.lu/fr/
formulaires/prises-en-charge/cprf-extraordinaire.html, beim Nationalen Gesundheitsfonds stellen und
seinen Arbeitgeber informieren.
3. Möglichkeit einer Bankgarantie
Da sich viele Unternehmen derzeit in großen finanziellen Schwierigkeiten befinden, hat die Handelskammer
auch eine spezielle Bürgschaft in Form einer Garantie gestellt, die von der Handelskammer
über ihre Mutualité de Cautionnement angeboten wird.
Diese Garantie ist für Unternehmen gedacht, die einen Bankkredit oder eine Kreditlinie benötigen.
Die Höhe des Kredits beträgt maximal 250.000,-€ pro Kaution und bis zu 50% des Kredits.
Unternehmen, die diese Garantie in Anspruch nehmen wollen, müssen sich direkt an ihre Bank wenden
und den Antrag bei ihr einreichen. Die Bank wird dann über die Freigabe des Kredits entscheiden.
4. Die Verpflichtung für Grenzgänger, die Notwendigkeit des Grenzübertritts
zu bescheinigen
a) Deutsche Grenzgänger :
Die deutsche Regierung hat beschlossen, die Kontrollen an der Grenze zwischen dem Großherzogtum
Luxemburg und der Bundesrepublik Deutschland zu verschärfen.
Nur Grenzgänger, die trotz der derzeitigen Situation die Notwendigkeit des Grenzübertritts nachweisen
können, dürfen die deutsch-luxemburgische Grenze ohne Einschränkungen passieren.
Die luxemburgische Regierung hat in diesem Zusammenhang eine Bescheinigung für deutsche Grenzgänger
erstellt: https://gouvernement.lu/dam-assets/documents/actualites/2020/03-mars/Zertifikat-Berufspendler-Nachweis-Notwendigkeit-Grenzuebertritt.pdf,
die das Arbeitsverhältnis zwischen
der betreffenden Person und ihrem Arbeitgeber bescheinigt und den Grenzkontrollbehörden vorgelegt
werden muss.
b) Französische Grenzgänger
Die französische Regierung hat beschlossen, verstärkte Kontrollen an der Grenze zwischen dem Großherzogtum
Luxemburg und der Französischen Republik durchzuführen.
Nur Grenzgänger, die trotz der derzeitigen Situation die Notwendigkeit des Grenzübertritts nachweisen
können, werden das Recht haben, die französisch-luxemburgische Grenze tatsächlich zu überschreiten.

In diesem Zusammenhang hat die luxemburgische Regierung eine Bescheinigung für französische
Grenzarbeiter erstellt: https://gouvernement.lu/dam-assets/documents/actualites/2020/03-mars/
certificat-frontaliers.pdf, die das Arbeitsverhältnis zwischen der betreffenden Person und ihrem Arbeitgeber
bescheinigt und den Grenzkontrollbehörden vorgelegt werden muss.
Darüber hinaus müssen die in Frankreich ansässigen Personen auch eine „attestation de déplacement
dérogatoire“ (verfügbar unter folgendem Link: https://gouvernement.lu/dam-assets/documents/

Bei Vorlage dieser drei Dokumente wird der betreffende Grenzgänger von jeglichen Beschränkungen
beim Grenzübertritt befreit.
c) Belgische Grenzgänger:
Die belgische Regierung hat außerdem gerade die Entscheidung getroffen, verstärkte Kontrollen an
der Grenze zwischen dem Großherzogtum Luxemburg und Belgien durchzuführen.
Nur Grenzgänger, die trotz der derzeitigen Situation die Notwendigkeit des Grenzübertritts nachweisen
können, werden das Recht haben, die belgisch-luxemburgische Grenze tatsächlich zu überschreiten.
In diesem Zusammenhang hat die luxemburgische Regierung eine Bescheinigung für belgische Grenzgänger

pdf, die das Arbeitsverhältnis zwischen der betreffenden Person und ihrem Arbeitgeber bescheinigt
und den Grenzkontrollbehörden vorgelegt werden muss.
Bei Vorlage der oben genannten Bescheinigung wird der betreffende Grenzgänger von jeglichen Beschränkungen
beim Grenzübertritt befreit.
