The first reason is unsubstantiated and fallacious. The second reason is irrational.<br />

The <strong>Board</strong> holds that Application should have been approved. As we are in full agreement<br />

with the Appellant’s contentions, we state our reasons:-<br />

THE MODUS OPERANDI OF DAY-CARE CENTRES<br />

The Appellant testified that day-care centres of the type involved in the case before the<br />

<strong>Appeal</strong> <strong>Board</strong> operate along the following lines:<br />

i. To provide reliable care for primary school-age (7 to 11 years) children who attend<br />

school for half the day while both parents are at work for the whole day or, for any<br />

reason, are unable to look after their children for part of the day, including the periods<br />

of going to school or returning from school.<br />

ii.<br />

For those children attending the morning school session the children are delivered<br />

directly to school by their parents. After school in the afternoon the children are<br />

collected and walked to the Centre in a procession, escorted by two staff members of<br />

the Centre. In the evening their parents arrived at the Centre to fetch them home.<br />

iii. For those children who attend the afternoon session the children are delivered in the<br />

morning to the Centre by their parents (or by other arrangements) and left to the care<br />

of the Centre. When the time comes to go to school, two staff members of the Centre<br />

walk the children to school in a procession. After school the children are fetched<br />

directly from the school by the parents.<br />

iv. During the hours the children are in the Centre, they are provided with:<br />

a) a meal<br />

b) supervision with their homework<br />

c) a bath and use of toilet facilities<br />

d) emergency care (taken to see a doctor in case of sudden illness)<br />

It should be noted that in the afternoon no parent of any of the children at the Centre is<br />

anywhere near the Centre while parking congestion is still occurring in the streets around<br />

the Centre. The Respondent should have noted this fact.<br />
