Gentile Cliente,
il 1° giugno 2007 è entrato in vigore in tutta l’Unione Europea il
nuovo sistema di regolarizzazione (REACH - REGOLAMENTO (CE)
N. 1907/2006) per la valutazione, la registrazione ed il controllo
dell’immissione di sostanze e preparati chimici sul mercato europeo.
Questo prevede che tutte le sostanze chimiche prodotte o importate
nell’Unione Europea in quantità superiore ad 1 tonnellata/anno
debbano essere registrate presso l’Agenzia Europea della Chimica
(ECHA). Al fine di usufruire di un periodo transitorio durante il quale
sarò possibile preparare il dossier di registrazione, è necessario
effettuare una registrazione preliminare entro il 01/12/08. Si ricorda
che, se entro tale data non è stata effettuata la pre-registrazione, la
sostanza in oggetto non potrà essere immessa sul mercato finché
non sarà stata effettuata la registrazione.
A tal proposito si comunica che la Novellini S.p.A. riveste solamente
il ruolo di utilizzatore a valle non producendo o importando sostanze
all’interno dell’ UE, quindi non deve assolvere gli obblighi relativi alla
registrazione di tali sostanze.
Al fine di garantirVi l’abituale continuità nella fornitura dei nostri prodotti
con la presente siamo a comunicarVi che ci stiamo assicurando che i
nostri fornitori, qualora ricorra il caso, effettuino la pre-registrazione.
Nel caso ciò non avvenisse sostituiremo le sostanze in uso con altre
che rispondano ai requisiti delle norme cogenti. Comunque la nostra
fornitura non subirà alcuna modifica a valle degli obblighi REACH.
Per quanto riguarda i nostri prodotti si evidenzia che si inseriscono
tutti nella definizione di articolo presente nel Regolamento (CE) N.
1907/2006 del Parlamento Europeo e del Consiglio del 18 dicembre
2006. In particolare ai sensi dell’art. 7 “Registrazione e notifica delle
sostanze contenute in articoli”, comma 1 lettera b), tali articoli non
risultano soggetti a registrazione in quanto eventuali sostanze in essi
contenute non sono destinate a essere rilasciate in condizioni d’uso
normali o ragionevolmente prevedibili.
Si specifica inoltre che, sempre ai sensi del Regolamento (CE) N.
1907/2006, i suddetti articoli, in base alle loro caratteristiche, non
rientrano negli obblighi previsti dall’art. 33 “Obbligo di comunicare
informazioni sulle sostanze presenti negli articoli” in quanto la
percentuale in peso delle sostanze ritenute pericolose, ai sensi della
presente normativa, è inferiore allo 0,1% del peso totale dell’articolo.

On the 1st. of June 2007 there entered into force over the whole
European Union the new regulatory system (REACH - REGULATION
(EC) N. 1907/2006), for the evaluation, registration and control of the
release of substances and chemicals on to the European market. This
requires that all substances and chemicals produced in or imported
into the European Union, in quantities superior to 1 ton/year must
be registered with the European Chemicals Agency (ECHA). In order
to make use of a transition period during which it will be possible
to prepare the registration dossier, it will be necessary to perform a
preliminary registration before 01/12/08. It should be remembered
that, if before this date the pre-registration has not been performed,
the substance in question will not be able to be released on to the
market until registration has been carried out.
In this regard it is communicated that Novellini S.p.A. holds only the
role of downstream user, neither producing nor importing substances
inside the EU, and therefore does not have to carry out the duties
relative to the registration of such substances.
In order to guarantee you the regular continuity of supply of our products,
with this document we inform you that we are assuring ourselves that
our suppliers, if necessary, perform the pre-registration. Should that not
happen we will replace the substances in use with others complying
with the requisites of the binding regulations. However our supply will
undergo no modification downstream of the REACH obligations.
As regards our products it appears that they all come under the
definition of article present in the Regulation (EC) N. 1907/2006 of
the European Parliament and Council of 18th. December 2006. In
particular within the meaning of art. 7 “Registration and notification
of the substances contained in articles”, comma 1 letter b), such
articles are not subject to registration as any substances contained in
them are not destined for release in normal or reasonably foreseeable
conditions of use.
Moreover, it is pointed out that, still within the meaning of Regulation
(EC) N. 1907/2006, the above mentioned articles, based on their
characteristics, do not come under the obligations foreseen by art. 33
“Duty to communicate information on substances present in articles”
as the percentage in weight of the substances held to be dangerous,
within the meaning of the present regulation, is lower than 0,1% of
the total weight of the article.
