Cari Lettori,<br />
in chiusura del 2011, alla domanda “com’è andata quest’anno?” ho ricevuto<br />
le risposte più svariate: c’è chi è cresciuto, chi ha rallentato, chi<br />
si è fermato, chi non riesce a farsi pagare, chi ha selezionato la clientela<br />
e ha colto i frutti immediatamente, e vari altri scenari, fortunatamente<br />
non tutti negativi. Alla domanda seguente, però, “come vedi il 2012?” le<br />
risposte sono unanimi, tutte nel quadrante pessimistico. Gli operatori<br />
sono preparati al peggio, anche se nessuno riesce a definire il perimetro<br />
di questo “peggio”. Ma, alla prova dei fatti, le aziende stanno reagendo,<br />
soprattutto nel nostro mercato: sia a livello licensor, dove si provano<br />
nuove formule di proposta, sia a livello di aziende licenziatarie, dove<br />
sono numerosi i casi di successo di progetti di licensing, soprattutto per<br />
quelle realtà che vi si affacciano per la prima volta. In queste pagine,<br />
come al solito, cerchiamo di dare conto di questo sviluppo, augurandoci<br />
che le stagioni che verranno portino il mercato ad una nuova consapevolezza<br />

as 2011 draws to a close my question “how did it go this year?” provoked a<br />
range of answers: some companies had grown, some had had a fair amount<br />
of slack, some had stopped short, some were bogged down with slow payers,<br />
some had chosen their clients with care and reaped the benefits and so on<br />
and so forth, fortunately not all the scenarios were negative. But to my next<br />
question, “what about 2012?” I got an unanimous response, everyone was<br />
pretty pessimistic. Operators are all battening down the hatches and preparing<br />
for the worst, even though nobody really knows what the “worst” is.<br />
But put to the proof companies are actually reacting to the crisis, especially<br />
on the Italian <strong>market</strong>. Licensors are trying proposing new formulas, while licensees<br />
are spurred on by numerous cases of successful licensing projects,<br />
especially for companies who are giving licensing a whirl for the first time.<br />
In this edition we’ve tried to map developments as we have always done in<br />
the past, in the hope that the future will bring the <strong>market</strong> to a new level of<br />
maturity and awareness. I hope you enjoy the magazine.<br />

series on Boomerang USA during the opening months of 2012. The<br />
series is a co-production by Mondo TV, Giochi Preziosi and MEG<br />
with an up-and-running licensing strategy: Jakks Pacific is scheduled<br />
to produce a toy line in spring 2012, while Licensing Works!<br />
will be handling licensing contracts on the other side of the pond.<br />
A new contract for Generator Rex<br />
A new exclusive collection of Generator Rex lamincards from Edibas<br />
will be available from retailers from January. The young hero’s<br />
transformations are depicted in a highly collectable and immediately<br />
playable collection of 160 Lamincards on a transparent background.<br />
The album has clear plastic pockets and includes<br />
a game board for thrilling challenges.<br />

vehicles, have announced a new licensing contract. The<br />
agreement foresees the use of the Superman logo in communications<br />
for the launch of the latest Iveco New Daily models<br />
in EMEA countries, Australia, Argentina and Brazil. The<br />
campaign will be regional and national, emphasizing the New<br />
Iveco Daily van’s performance with the pay off “perfect for<br />
a superhero” and hinges around the concept that the van is<br />
strong, powerful and roomy. The Superman logo will figure on<br />
the material for the public, such as catalogues and leaflets,<br />
as well as being used for promotion and events involving the<br />
Iveco New Daily, one being the sponsorship of Moto GP and<br />
another a brand new app for iPhones.<br />

Spongebob va a scuola<br />
Raggiunto l’accordo tra Nickelodeon Consumer Products e Accademia, che<br />
prevede il lancio di una collezione back–to–school per la stagione 2012. Questa<br />
partnership segna l’avvio della strategia di rilancio pensata da Rainbow, l’agente<br />
eslusivo della property per il territorio italiano, supportata anche dall’ampia esposizione<br />
su Nickelodeon Tv, Italia 1 e Boing. La collezione prevede diversi prodotti<br />
ispirati al divertente personaggio tra cui: zaini, raccoglitori, diari, gomme, cartelle,<br />
quaderni, astucci e bustine, matite e penne.<br />
Spongebob goes to school<br />
Nickelodeon Consumer Products and Accademia have inked an agreement for a back<br />
to school collection to be launched in 2012. This partnership is the first<br />
step in a re-launch strategy by Rainbow, who hold the exclusive rights<br />
to the property for Italy. The re-launch is backed by lavish exposure on<br />
Nickelodeon TV, Italia 1 and Boing. The collection will offer a range of<br />
products with this cute character, among them school bags, ring binders,<br />
diaries, erasers, folders, exercise books, pencil cases, pencils and pens.<br />

Ancora una volta la politica di licensing di<br />
Grani&Partners si dimostra vincente: Dragon<br />
Ball Z si conferma l’anime più visto in<br />
Italia, con una media di spettatori giornalieri<br />
in età 4-14 anni di 400.000 bambini ed<br />
uno share medio pari al 33%, ed è proprio<br />
su questa licenza che l’azienda e le sue controllate<br />
stanno fortemente investendo a partire<br />
dallo scorso autunno. Ma le vere novità,<br />
anche in termini di prodotto, arriveranno nel<br />
2012: da metà gennaio Dragon Ball Z tornerà<br />
con muffin e brioche Dolci Preziosi con<br />
gadget; a seguire le uova di Pasqua Dragon<br />
Ball Z di Dolci Preziosi, abbinate, come sempre, a vari tipi di sorprese,<br />

Grani&Partners licensing strategies have proved a winner yet<br />
again: Dragon Ball Z wins the battle of the audience figures in cartoons<br />
for Italy, with and average of 400,000 children in the 4-14 age<br />
range glued to their TVs daily, a whopping media share of 33%.<br />
Which probably explains why the company and its subsidiaries have<br />
been investing heavily in this property since last autumn. But 2012<br />
is going to be hot for Dragon Ball Z: mid-January sees the return of<br />
branded muffins and cakes with gadgets from Dolci Preziosi; then<br />
there will be Easter, with Dragon Ball Z eggs by Dolci Preziosi, accompanied<br />
as usual by various surprises and a new magazine with<br />
gadgets from the<br />
Preziosi Collection.<br />

Despar difende la natura con Shrek<br />
CPLG Italia, che gestisce in Italia le properties DreamWorks Animation,<br />
ha appena comunicato di aver siglato con il gruppo distributivo<br />
Despar una promozione improntata al green: “Difendi<br />
la Natura con Shrek e Gatto con gli Stivali”.<br />
L’operazione commerciale si svolge in più di 200 punti vendita Despar<br />
del Triveneto e del Lazio, coinvolgendo famiglie e bambini<br />
in una collezione di carte da gioco divertente ed educativa. La<br />
promozione comincia ufficialmente il 10 Gennaio, protraendosi<br />
fino agli inizi di marzo.<br />
Despar green with Shrek<br />
CPLG Italy, who manages DreamWorks Animation properties in<br />
Italy, has just announced that had signed with the distribution<br />
group Despar a promotion geared to the green: “Defend Nature<br />
with Shrek and Puss in Boots”.<br />
The commercial operation takes place in more than 200 Despar<br />
stores of Triveneto and Lazio, involving families and children in a<br />
collection of playing cards fun and educational. The special promotion<br />
officially begins on January 10th and runs until the beginning<br />
of March.<br />

Mondo TV CP agente per Trash Pack<br />
È partita il 27 dicembre la messa in onda su Boing dei primi episodi<br />
dell’originalissima serie Trash Pack, nella quale dei buffi “rifiuti”<br />
prendono vita alla chiusura del bidone della spazzatura. La<br />
gang dei Trash Pack perlustra la città alla ricerca di altri scarti,<br />
abbandonati dall’irresponsabilità umana, per renderli uno di loro.<br />
La serie soddisfa quel gusto per “l’orrido” che tanto successo ha<br />
tra i bambini di ogni generazione con l’aggiunta di un alto valore<br />
educazionale: ambiente, altruismo, amicizia e famiglia sono infatti<br />
temi ricorrenti. Con già a bordo Giochi Preziosi (Master Toy<br />
License), Mondo TV CP gestirà il ricco programma di licensing<br />
della property con possibilità di sviluppo di nuovi progetti in varie<br />
categorie merceologiche, come la scuola, la cartoleria e i collezionabili.<br />

on board, Mondo TV CP is handling the property’s juicy<br />
licensing programme with potential development of new<br />
projects in various categories, back-to-school, stationery<br />
and collectables among others.<br />
Backstage ha acquisito i diritti delle Lalaloopsy<br />
Backstage annuncia l’arrivo di una nuova property riservata al target<br />
femminile 4+: le Lalaloopsy, una versione moderna delle tradizionali<br />
bambole di pezza. Backstage è già al lavoro per individuare<br />
partner capaci di tradurre lo spirito unico e inconfondibile di questa<br />
nuova property in linee di prodotto da immettere nel mercato<br />
italiano. Le bambole sono distribuite da Giochi Preziosi e sono già<br />
in vendita. L’agenzia modenese prevede un programma licensing<br />
tradizionale a medio/lungo termine con un’enfasi su abbigliamento/<br />
accessori e publishing, senza però trascurare altre categorie quali<br />
il gift, il food & beverage e games & puzzle. Lalaloopsy sono anche<br />
intrattenimento, con web-episodi disponibili su YouTube, uno speciale<br />
previsto per marzo 2012 intitolato “A Lalaloopsy adventure –<br />
The Search for Pillow” e infine anche una serie animata il cui lancio<br />
cadrà nel 2013.<br />
Backstage buys Lalaloopsy rights<br />
Backstage has announced its new property for girls in the 4+ age<br />
range: the Lalaloopsy, a modern take on rag dolls. Backstage is currently<br />
trawling for partners able to render the unique mood of this<br />
property in product lines for the Italian <strong>market</strong>. The dolls are distributed<br />
by Giochi Preziosi and are already available in Italy. Modenabased<br />
Backstage will be implementing a fairly traditional medium/<br />
long term licensing programme <strong>focus</strong>ing mainly on fashion, accessories<br />
and publishing, but with plenty of room to accommodate other<br />
categories like gifts, food & beverage and games & puzzle. Lalaloopsy<br />
also have an entertainment component, with web-episodes on<br />
YouTube. A special is planned for March 2012 entitled “A Lalaloopsy<br />
Adventure – The Search<br />

Heidi sugli sci<br />
Heidi è la protagonista sulle nevi del<br />
comprensorio sciistico Monterosa<br />
Ski per la stagione invernale 2011/12.<br />
Simbolo della montagna nell’immaginario<br />
collettivo di grandi e piccini,<br />
incarnazione stessa dell’anima montana, la piccola Heidi “trascorre<br />
il suo inverno” nel comprensorio valdostano, tra i paesaggi<br />
suggestivi del Monte Rosa, le piste innevate e l’accoglienza tipica<br />
delle Valli di Ayas, Gressoney e Valsesia. L’immagine gioiosa e divertente<br />
di Heidi è presente su tutti gli skipass, sul sito web e sulla<br />
cartellonistica che fa da sfondo alle piste da sci del comprensorio.<br />

A living symbol of the<br />
mountains and their lifestyle in the minds of children and adults<br />
alike, Heidi is scheduled to winter in the Val d’Aosta ski resorts that<br />
revolve around the stunning scenery and snowy heights of Monte<br />
Rosa, with all the runs and traditional hospitality of the Ayas, Gressoney<br />
and Valsesia valleys. Heidi’s smiling, cheerful face will be<br />
on all the skipasses, the web site and the signposts of the slopes<br />
of the complex. Planeta Junior holds the rights to the series in<br />
Italy, Spain, Portugal, France, Greece and Cyprus and manages all<br />
the licensing categories. The series is broadcast in Italy on Italia 1,<br />
with impressive audience figures which average 602,000 viewers.<br />

Simon’s Cat va in onda su La7d<br />
In occasione delle feste, La7d ha inserito con successo una divertente<br />
novità nella sua programmazione. A partire da domenica 18<br />
dicembre e per tutto il periodo natalizio il palinsesto ha ospitato le<br />
bizzarre avventure di Simon’s Cat, con un appuntamento fisso tutti i<br />
giorni alle 21.05 per una divertente introduzione alla prima serata,<br />
e alcune simpatiche incursioni sparse nel corso della giornata. Il<br />
cartoon, creato da Simon Tofield nel 2008, spopola da tempo sul suo<br />
canale YouTube e arriva per la prima volta sulla Tv italiana e in chiaro.<br />
Protagonista delle strisce è il dispettoso e giocherellone gatto di<br />
Simon, che si diverte a tormentare il suo padrone con rocamboleschi<br />
tentativi di attirare la sua attenzione o di procurarsi del cibo. The<br />
Licensing Machine, l’azienda che gestisce i diritti della prorperty, afferma<br />
che il livello di gradimento da parte delle aziende licenziatarie<br />
è in costante crescita.<br />

Simon’s Cat, with a fixed daily evening slot at 09.05 pm to usher in<br />
the evening’s viewing and random appearances during the rest of<br />
the day. The cartoon was created by Simon Tofield in 2008, went viral<br />
on YouTube and is now on free-to-air Italian TV for the first time.<br />
The hero is Simon’s cheeky cat, who drives his owner mad with his<br />
constant attention-seeking and endless scrounging for food. The<br />

in the hands of Nadia Necchi and Ginger Baroni. The aim is to boost<br />

Dimensione Danza brand’s profit currently comes from Italy (80%),<br />

Italy di CN: «Quest’anno vorremmo<br />
valorizzare molto il nostro vissuto<br />
storico, i primi cartoni animati che<br />
continuano però ad andare in onda<br />
sui nostri canali, in particolare su<br />
Boing. Abbiamo riscontrato degli ottimi<br />
risultati trasversali, infatti sono<br />
seguiti sia dai bambini che dai giovani<br />
adulti: una conferma che stanno<br />
diventando dei veri e propri classici.<br />
Dunque l’idea è quella di lavorare<br />
maggiormente con la moda, posizionando<br />
anche i Cartoon Network<br />
Originals (con Le Superchicche è<br />
già in parte avvenuto) in un target<br />
12+. Tutte queste serie andranno in<br />
onda nel 2012 a rotazione, dunque le<br />
properties saranno continuamente<br />
supportate dalla programmazione<br />

K.: I vostri licenziatari<br />
saranno coinvolti?<br />

S.S.: «I licenziatari esistenti<br />
saranno sicuramente<br />
coinvolti, ma il lavoro<br />
che stiamo svolgendo<br />
ora è quello di “semina”, al<br />
fine di cercare nuovi partner<br />
per coprire le categorie chiave.<br />
Come già anticipato, per i Cartoon<br />
Network Originals e Le Superchicche<br />
non è fondamentale il settore<br />
del giocattolo; l’interesse è rivolto<br />
all’abbigliamento, agli accessori<br />
moda, alle calzature e al personal<br />
care. L’obiettivo è: da parte nostra<br />
quello di comunicare il più possibile<br />
questi personaggi, ma allo stesso<br />
tempo di coinvolgere i licenziatari<br />
nelle stesse operazioni di comunicazione<br />
e <strong>market</strong>ing.»<br />
K.: Come sono inserite nel vostro<br />
portfolio? Come riuscite a mantenere<br />
un livello alto di gradimento?<br />
S.S.: «Noi siamo sicuramente avvantaggiati<br />
avendo la possibilità di<br />
controllare direttamente la programmazione<br />
televisiva. Una possibilità<br />
che aiuta sicuramente a innalzare<br />
l’awareness dei personaggi.<br />
Anche se siamo conosciuti per lo più<br />
per alcune properties maschili action,<br />
in realtà il nostro background<br />
nasce dalla comedy. Si tratta di<br />

great all-round results, because they’re popular with<br />
kids and young adults too. So we’re targeting fashion in<br />
the 12+ age range with the Cartoon Network Originals,<br />
something we’re already doing to a certain extent with<br />
The Powerpuff Girls.»<br />
K.: Are you involving your licensees? Will you be<br />
looking for new partners?<br />
S.S.: «We’ll certainly be involving our current licensees,<br />
but at the moment we’re also putting out feelers for<br />
new partners in key areas. Toys aren’t a particular<br />
priority, what we’re really gunning for is fashion, fashion<br />
accessories, footwear and personal care.»<br />

prodotto diverso. Quello che intendiamo<br />
dire quando parliamo di “property<br />
classica”, è che ormai i nostri<br />
personaggi fanno parte del<br />
bagaglio culturale di persone<br />
che arrivano ad avere anche<br />
25-30 anni, perché hanno iniziato<br />
a vedere i nostri programmi<br />
quando avevano 10-15 anni.»<br />
K.: How do they fit into your portfolio? How do you<br />
keep your approval rating looking healthy?<br />
S.S.: «We definitely have an advantage because we’re<br />
in complete control of the TV schedules. Which makes<br />
it easy to boost awareness of this or that character. Our<br />
characters are fun, they’re ironic, they’re not moralising<br />
goody-goodies. Cartoon Network has always wanted to<br />
stand out from the crowd and give the public a different<br />
product. What we mean by “classic properties” are<br />
titles and series that today’s 25-30 year-olds grew up<br />
with, because they started watching them when they<br />
were 10-15.»<br />
K.: What’s the <strong>market</strong> outlook? What new <strong>trends</strong> are<br />
there?<br />
S.S.: «I’ve seen too many people looking demotivated<br />
at recent fairs. OK, things might not be easy, but<br />
companies need to react, to try harder, but they all<br />
seem a bit lost. There are a huge number of licenses<br />
on offer, but investment capacity has shrunk compared<br />
to a couple of years ago. Companies need to make<br />
choices, but they’re not too sure which way to turn,<br />
which strategy to follow...»<br />
K.: Future projects and targets?<br />
S.S.: «We want to go on developing our licensing<br />
portfolio, especially for pre-schoolers. Then we<br />
want to pay more attention to the female half of the<br />
universe, starting with the Zoobles (a similar concept<br />
to Bakugan). Last, but not least, we’ve started to invest<br />
in comedy again, so we’re betting heavily on Gumball,<br />
a property that has just won a prize in London at the<br />
British Academy Children’s Awards.»<br />
K.: Come sta andando il mercato?<br />
Quali sono le nuove tendenze?<br />
S.S.: «Nelle ultime fiere ho riscontrato<br />
un po’ troppa demotivazione.<br />
Anche se il momento non è dei più<br />
facili, le aziende dovrebbero reagire;<br />
invece vedo in loro troppo disorientamento.<br />
Esiste una grande offerta<br />
in termini di licensing, ma non c’è<br />
più quella possibilità di investimento<br />
che c’era fino a 2 anni fa. Si trovano<br />
nella situazione di dover fare delle<br />
scelte ma senza saper bene dove<br />
andare, che strategia seguire...»<br />
K.: Progetti futuri? E quali sono gli<br />
obiettivi che vi siete posti?<br />
S.S.: «Vogliamo continuare a sviluppare<br />
il portfolio licenze, concentrandoci<br />
in particolar modo sulla<br />
fascia prescolare, visto che abbiamo<br />
lanciato da poco il canale dedicato<br />
Cartoonito. Poi vorremmo lavorare<br />
più sul femminile, iniziando da Zoobles<br />
(un concetto simile a quello<br />
di Bakugan). Infine, avendo cominciato<br />
a reinvestire<br />

È partito il programma licensing della property in onda su K2. E i primi traguardi sono già<br />
stati raggiunti<br />
Timmy Turner è un ragazzino<br />
di 10 anni come<br />
tanti, ma una cosa lo distingue<br />
dagli altri: possiede<br />
due fantagenitori! I suoi veri<br />
genitori sono molto occupati, pertanto<br />
Timmy, quando ha bisogno di<br />
aiuto, si rivolge a Cosmo e Wanda,<br />
una fantastica coppia munita di bacchetta<br />
magica che lo aiuta a realizzare<br />
ogni suo desiderio. “Due Fantagenitori”<br />
è una serie animata che<br />
appassiona giovani fan, ma gradita<br />
anche ai parenti per il messaggio<br />
positivo che trasmette. Nei maggiori<br />
<strong>focus</strong> group delle ultime stagioni,<br />
Due Fantagenitori risulta essere<br />
uno dei brand più amati dal target<br />
di riferimento (4-12 anni), un apprezzamento<br />
rafforzato dagli ottimi<br />
risultati in termini di ascolti: in onda<br />
su K2, la serie raggiunge stabilmente<br />
un ascolto medio di 93mila<br />
bambini, con picchi di oltre 200mila<br />
bambini e 400mila individui nelle<br />
fasce pomeridiane di programmazione.<br />
La gestione della property è<br />
affidata a Switchover Licensing, la<br />
divisione interna dell’editore televisivo<br />
Switchover Media, che fa leva<br />
sulle caratteristiche e i valori del<br />
brand per sviluppare un piano licensing<br />
a 360°, completo e aggressivo,<br />
che includa sinergie e contratti di<br />
licenza con i retailer della grande<br />
distribuzione e dell’abbigliamento.<br />
Sono chiusi diversi accordi con<br />
importanti player, primo su tuttiquello<br />
con RCS Quotidiani: a partire<br />
da fine gennaio, e per 20 uscite<br />
settimanali, al Corriere della Sera<br />
è abbinato un DVD della serie con<br />
3/4 episodi ciascuno. Un progetto<br />
editoriale consistente (69 gli episodi<br />
complessivi della collana) che<br />
coinvolge il pubblico più giovane<br />
con le magiche vicende quotidiane<br />
di Cosmo e Wanda. Due Fantagenitori<br />
sarà inoltre il protagonista,<br />
insieme agli altri personaggi delle<br />
serie animate trasmesse dai canali<br />
K2 e Frisbee, di uno speciale<br />
tour itinerante organizzato per intrattenere<br />
i ragazzi nei centri commerciali<br />

Oddparents<br />
The licensing programme for the property currently<br />
aired on K2 has kicked in and the first<br />
targets have already been met<br />
Timmy Turner is an average 10 year-old whose<br />
parents are always busy, so when Timmy needs help<br />
he whistles up Cosmo and Wanda, his two fairy godparents,<br />
complete with magic wands, who help him to get<br />
his every wish. All the main <strong>focus</strong> groups from the last<br />
2 seasons have pinpointed Two Fairly Oddparents as the<br />
brand kids love best in its target 4-12 audience, which<br />
confirms its excellent viewing figures. Broadcast on K2<br />
the series regularly reaches an AMR of 93 thousand<br />
children (a 7.6% share), with peaks of over 200 thousand<br />
kids (20% share) when it’s scheduled on the afternoon<br />
slots. The property is being managed by Switchover Licensing,<br />
the in-house division of Switchover Media TV,<br />
which has already inked agreements with major players.<br />
First off the blocks is RCS Quotidiani: from the end<br />
of January their daily Corriere della Sera will carry a<br />
DVD of the series with 3 episodes each for a total of 20<br />
issues. The initiative is backed up by an extensive advertsing<br />
campaign in the press (in the Rcs titles), Tv (on<br />
the Switchover Media channels), newsagents and other<br />
outlets and on the web. Two Fairly Oddparents will also<br />
be starring, together with other characters from series<br />
broadcast by K2 and Frisbee, on a special tour organised<br />
for children in shopping centres throughout Italy.<br />

Race Exhibition.” When he is defeated Kazuya decides<br />
to move into the universe with his friends to hone his<br />
skills as a racer and warrior with the goal of winning<br />
the intergalactic race and earning the title of “Universe<br />
best racer.” Each character has their own car<br />
equipped with special features and controlled via a<br />
special card. By putting their fate in Scan2Go, the protagonists<br />
of this series show their epic adventures in<br />
space. Adventures which help children create longlasting<br />
friendships and grow by discovering the world<br />
around them. The plot features a fascinating mix of fun<br />
and adrenaline and is addictive not only for children but<br />
also for teenagers. The array of characters leaves<br />
plenty of room to develop and customize various product<br />

Italia: sì perché, a partire proprio<br />
dal 24 dicembre, sul canale 609 di<br />
Sky, sono andati in onda i nuovissimi<br />
episodi del The Looney Tunes<br />
Show. Una serie televisiva interamente<br />
dedicata al cartoon più spiritoso<br />
della storia dell’animazione<br />
con importanti novità: il format è<br />
stato infatti rivisto in chiave fresca e<br />
moderna per uno show che ospita,<br />
al suo interno, star vecchie e nuove,<br />

series dedicated entirely to the cheekiest cartoon in the<br />
history of animation with some great updates: the format<br />
has been given a complete facelift for a show jampacked<br />
with old favourites and new stars, exhilarating<br />
adventures, romantic intrigues and guest appearances<br />
of famous people. The series hinges on the adventures<br />
of friends Bugs Bunny and Daffy Duck, who are now<br />
housemates, have found girlfriends and have a host of<br />
new friends. A show for young and old alike, with Bugs<br />
and Daffy sharing the screen together with Porky Pig,<br />
Speedy Gonzales and Tweety Pie and Sylvester. Then<br />
there are a slew of 2.5 mini shorts produced with cutting<br />
computer graphics starring Wile E. Coyote and Road<br />
Runner. The new graphics highlight the characters to<br />
give a very contemporary feel to a whole host of comic<br />
gags. Warner Bros. C.P. are gearing up for a new licensing<br />
foray, with great opportunities for product development<br />
for their partners, who can choose between the<br />
revamped properties in what’s bound to be a merchandising<br />

Tornano gli animali dal fascino gotico che suscitano simpatia, facilmente declinabili in<br />

Arrivano in Starbright gli<br />
Skelanimals, un gruppo<br />
di 30 adorabili animaletti<br />
che, per distrazione o imprudenza,<br />
sono passati a miglior vita. Accompagnati<br />

need love too”, raccontano storie originali<br />
sulla loro scomparsa di scena<br />

Redakai and the quest for Kairu<br />
New property in the offing: cards, cartoons and<br />
licensing galore!<br />
Redakai is the brainchild of two important players in<br />
the sector: Marathon Media, which produced the 52<br />
episodes of the 2D cartoon series and Spin Master<br />
(master toy license), which came up with the new 3D<br />
card game. The star of the show is Ky, a 15 year-old<br />
martial arts devotee whose adventures we follow in his<br />
search for the Kairu, an ancient mystical power. Helped<br />
by his friends Maya and Boomer, Ky travels the world<br />
searching for the Kairu to protect himself against his<br />
alien enemies from outer space. The teenager’s dream<br />
is one day to become one of the greatest Kairu warriors,<br />
the Redakai of the title. The most innovative aspect of<br />
RedaKai is the game, which is based partially on the<br />
patented 3-D process used for the cards. Players will<br />
reap the benefits of a sense of depth and movement,<br />
giving more of a true cartoon feel to the game. This new<br />
cartoon series for kids who love action and adventure<br />
has been broadcast by Cartoon Network since last<br />
July in the USA and is due to go on air soon in Italy too.<br />

di una serie Tv in cui il leone Max si<br />
batte ogni giorno per proteggere il<br />
suo popolo contro il perfido Maestro<br />

friends, learns a raft of useful stuff and discovers the<br />
meaning of true friendship. And it’s thanks to his best<br />
friend Leena, lively Fahn the monkey and the incredible<br />
strength of Kaow the bear that Max manages to deal with<br />
the continuous threats from Kahn the tiger, cruel Cobra<br />
and all the other allies of the perfidious Maestro<br />
Ombra. Created for a target of 6 to10 yearolds<br />
this property has already been a hit<br />
with Heartbrand Algida ice creams in Italy<br />
as the protagonist of their children’s ice<br />
cream line. Max is also the mascot of the<br />
Mirabilandia amusement park, sponsored<br />

Special promotions are a familiar <strong>market</strong>ing feature<br />
abroad, but only took off in Italy last spring<br />
3 March 2011: Billa, part of the Rewe Group, launched<br />
its “Animal Adventures” special promotion. For every<br />
10 euros of shopping, loyalty card holders were given<br />
a packet of 5 trading cards to stick into a special album,<br />
sold separately.<br />
12 May 2011: Esselunga launched a similar operation,<br />
with trading cards featuring Disney Pixar cartoons.<br />
1 September 2011: Billa again with a new special promotion<br />
dedicated to the Smurfs.<br />
Quick in and out operations, lasting just a few weeks,<br />
aimed at upping the amount loyal customers spend<br />
per shop thanks to a product worth little in itself, but<br />
with a high emotional impact. Children are the main<br />
reference target, because they can have such a big<br />
influence on shopping. They are also part of several<br />
communities (school, family, sports clubs etc) and<br />
there’s huge scope for peer influence. They observe<br />
each other, imitate each other and want to share<br />

non è orientata all’utilizzo tout-court<br />
delle licenze, ma coglie delle occasioni<br />
in linea con la comunicazione della<br />
brand image.»<br />
Una struttura esterna specializzata<br />
evidentemente è funzionale al successo<br />
dell’operazione.<br />
«L’esperienza di un’agenzia che conosce<br />
il campo è fondamentale per<br />
delineare tutti i processi: contrattuali,<br />
logistici, creativi. Stiamo già lavorando<br />
ad una nuova special promotion,<br />
sempre con The Continuity Company.<br />
Il target di riferimento sarà sempre lo<br />
stesso, ma lavoreremo facendo leva<br />
sul tema educativo. I Puffi erano più<br />
emozionali, ora vogliamo entrare nelle<br />
scuole con un progetto editoriale. Si<br />
tratta di una licenza attualissima, ma<br />
per ora non posso dire di più» conclude<br />

Creare sinergie, puntare sul “virale”<br />
Riguardo la comunicazione, tutti hanno<br />
ben chiaro che, quello della special<br />
promotion, è un momento di cui<br />
approfittare.<br />
«A fianco delle operazioni special è<br />
anche utile proporre diversi eventi<br />
collaterali per sfruttare al massimo la<br />
comunicazione che la licenza offre»<br />
afferma Marco Camisi. «Con I Puffi<br />
abbiamo creato delle sinergie con la<br />
casa distributrice della pellicola (inithings,<br />
the ideal seedbed for leveraging the collectable<br />
dynamic.<br />

the second time round with the Smurfs we distributed<br />
between 9 and 10 million trading cards, with a really<br />
high redemption rate» enthuses Rosanna Ungaro,<br />

licensing wasn’t actually part of a long-term plan. The<br />
first special promotion, “Animal Adventures”, picked<br />
up the thread of sustainability from past initiatives.<br />
Then we had a meeting with The Continuity Company<br />
who suggested the Smurfs as a suitable property, something<br />
which fitted in with our ethos. Just to explain<br />
that Billa isn’t exclusively centred around licensing,<br />
but is happy to use it as a tool when it fits in with our<br />
brand image communication.<br />

emotional appeal, but now we want<br />
to access schools with a publishing<br />

Creating synergies and going viral<br />
Everyone is aware that special<br />
promotions are a great communication<br />
opportunity. «It’s a good<br />
idea to couple special promotions<br />
with collateral events to exploit the<br />
communicative power of the license<br />
to the full» agrees Marco Camisi.<br />
«With the Smurfs we worked in<br />
synergy with the film distribution<br />
company and arranged preview<br />
screenings for Billa staff to get<br />
them into the mood for the operation;<br />
then we organised live Smurf<br />
events so the kids could “meet”<br />
their favourite characters in person.»<br />

più di uno. Le evidenze<br />
degli ultimi casi di successo ci dimostrano<br />
come la novità fondamentale<br />
riguardi la creazione del fenomeno<br />
del passaparola: l’attenzione non è<br />
concentrata tanto sul prodotto in sé<br />
quanto sull’evento che è in grado di<br />
generare. Componente essenziale<br />
è sicuramente l’interattività del progetto,<br />
il fatto che l’oggetto del “collezionare”<br />
possa favorire momenti di<br />
aggregazione.<br />
L’impressione che abbiamo è che il<br />
comparto delle special<br />
promotion sia un<br />
mercato destinato ad<br />
una sicura crescita<br />
futura, soprattutto<br />
perché si evidenzia<br />
in maniera sempre<br />
più netta la necessità<br />
di offrire promozioni<br />
originali che diventino<br />
elemento distintivo dell’insegna, e<br />
la possibilità che offre la special promotion<br />
è proprio questa. Ecco perché<br />
siamo convinti che questo tipo di<br />
operazione troverà sempre più spazio<br />
nel panorama dei programmi loyalty.<br />
Noi abbiamo in cantiere diverse e<br />
innovative idee che stiamo studiando<br />

vede nel licensing<br />
grandi opportunità. «Il mondo delle<br />
operazioni di loyalty oggi sembra<br />
venire riscoperto proprio grazie<br />
all’utilizzo di licenze kids – racconta<br />

quindi uno dei settori in cui l’azienda<br />
rector at Coro Marketing, concentrates more on the<br />
viral aspect and makes a forecast for the future of<br />
this type of operation. «There are several added values<br />
a special promotion carries in its wake compared<br />
to any other standard loyalty initiative. Evidence<br />
from the latest success stories show that what’s new<br />
is the way people pass the good word on: they don’t<br />
<strong>focus</strong> so much on the product itself as the event. The<br />
impression we get is that special promotions are certainly<br />
going to prove a growth <strong>market</strong> for the future,<br />
especially because it’s becoming increasingly clear<br />

We’ve got several innovative ideas in the pipeline that<br />
we’re fine tuning at the moment, starting with the<br />
decision on the right licensor, a question of primary<br />
importance when it comes to a special promotion<br />

and collectables, see licensing as the big opportunity.<br />

di <strong>market</strong>ing sono tipicamente applicate<br />
al Grocery e al Petrol, ma<br />
ci possono essere delle eccezioni,<br />
ad esempio i department store o i<br />
negozi di abbigliamento “conclude<br />
Camisi.” In questo caso, però,<br />
la collection deve essere ridotta<br />
in numero di pezzi da raccogliere,<br />
perché ovviamente la frequenza<br />
della clientela non è e non potrà<br />
mai essere come quella di un supermercato.<br />
Bisogna legare la promotion<br />
a una soglia di acquisto più<br />
alta e alzare il “valore” del premio<br />
che si eroga».<br />

operations commonly used in the Grocery and Petrol<br />
sectors, but they could work elsewhere, for example<br />
in department stores or clothes shops. But in this<br />
case the collection would have to consist in a limited<br />
number of pieces and the promotion would kick in at<br />
a higher purchase price, obviously corresponding to a<br />
more valuable product».<br />

«Il valore aggiunto di un’operazione<br />
special consiste nell’unicità e nella<br />
collezionabilità del prodotto; al di fuori<br />
della stessa non è possibile trovarlo,<br />
per cui il target a cui è rivolta, in questo<br />
caso prevalentemente i bambini,<br />
induce la sfera di persone che li circonda<br />
(non solo i genitori, ma anche<br />
i nonni, gli zii etc.) ad aderirvi. Tutto<br />
questo porta ad una forte fidelizzazione.<br />
Il valore aggiunto varia però a<br />
seconda del brand e/o della property<br />
coinvolta nell’operazione e dalla meccanica<br />
della stessa. La nostra azienda<br />
punta soprattutto sulla giocabilità,<br />
sull’unicità e sulla collezionabilità del<br />
prodotto.<br />
Attraverso la creatività ed esperienza<br />
del nostro Art Director Paola Malfatto,<br />
maturata attraverso dei lavori realizzati<br />
per il settore edicola e adattata a quello delle operazioni<br />
promozionali e special, stiamo compiendo uno sforzo<br />
importante al fine di sviluppare concept innovativi che possano<br />
nascere in contesti e canali di vendita alternativi e che<br />
in modo omogeneo possano arrivare al pubblico della GDO<br />
e delle petrolifere, in quelle che in gergo si chiamano operazioni<br />
di cross <strong>market</strong>ing.<br />
Ritengo il licensing fondamentale nell’ambito delle operazioni<br />
special così come il prodotto che si propone e il suo<br />
valore percepito.<br />
Le EQSG sta partecipando a numerosi eventi a livello italiano<br />
ed europeo in modo da adeguarsi alla tendenza dei paesi<br />
del Nord Europa che già da tempo hanno avuto modo di<br />
verificare concretamente il valore delle operazioni special,<br />
cosa che invece i paesi del Sud Europa hanno scoperto solo<br />

«The added value in a special promotion operation comes from<br />
the fact that the product is unique and collectable; you can’t get<br />
it anywhere else. So its main target, in this case children, egg on<br />
those around them to take part. All this adds up to a strong element<br />
of customer loyalty. However the added value varies according to<br />
the brand and/or property involved in the operation and the way<br />
the whole thing works. Our company concentrates on playability,<br />
collectability and the fact that the products are unique.<br />
Thanks to the creativity and experience of our Art Director Paola<br />
Malfatto we’re making a huge effort to come up with innovative<br />
concepts that can be applied in a range of contexts and through<br />
alternative sales channels.<br />
I think that licensing is fundamental in special promotion operations,<br />
on a par with the product on offer and its perceived value.<br />
EQSG is taking part in a large number of events in Italy and elsewhere<br />
in Europe to catch up with what’s happening in northern<br />
Europe, where special promotions are already a consolidated success<br />
story, whereas here in southern Europe they’ve only caught on<br />

Spinto da Gandalf, Bilbo si unisce<br />
al gruppo di tredici nani, capeggiato<br />

a Wild attraverso terre pericolose,<br />
popolate da folletti, orchi, ragni<br />

The Hobbit tells the tale of the journey made by Bilbo<br />
Baggins when he is dragged into an epic adventure to reclaim<br />
Erebor, once the dwarf kingdom, now ruled by the<br />
dragon Smaug. This is where our hero meets the creature<br />
that will change his life forever, Gollum, from whom he<br />
receives the famous ring, a simple gold band with hidden<br />
powers destined to decide the fate of all Middle-earth.<br />
The Hobbit is planned as a story divided into two<br />
films. The Hobbit: An Unexpected Journey, due out in December<br />
2012 and the Hobbit: There and Back, scheduled<br />
to follow in December 2013. Maurizio Distefano, General<br />

il male, sulle amicizie, i sacrifici e<br />
la crescita personale del protagonista<br />
che avviene durante il viaggio.<br />
Simile al Signore degli Anelli, Lo<br />
Hobbit avrà immagini straordinarie<br />
e creature e luoghi meravigliosi che<br />
si possono trovare solamente nel<br />
mondo della Terra di Mezzo.»<br />
K.: Avete già iniziato a proporre la<br />
licenza?<br />
M.D.: «Sì, e stiamo riscuotendo ottimi<br />
risultati, infatti ci siamo già assicurati<br />
partner importanti nell’ambito<br />
giocattolo quali The Bridge, Vivid<br />
e un ulteriore leader di mercato nel<br />
publishing.»<br />
K.: Applicherete una particolare<br />
strategia?<br />
M.D.: «Sfrutteremo al massimo la<br />
forza della licenza della categoria<br />
giocattolo per espanderci su altre<br />
categorie merceologiche quali abbigliamento<br />
e accessori.»<br />
K.: Esiste già una style guide?<br />
M.D.: «La style guide è già disponibile<br />
ed è ricca di elementi iconici,<br />
background e location che richiamano<br />
il mondo fantastico e di avventura<br />
che troviamo anche nel libro Lo<br />
Hobbit di Tolkien.»<br />
K.: Avete in previsione delle presentazioni<br />
per far conoscere la<br />
property prima dell’uscita del film?<br />
M.D.: «Abbiamo presentato ai nostri<br />
licenziatari e partner principali la<br />
property in occasione dello scorso<br />
Brand Licensing Europe di Londra.<br />
Daremo nuovi aggiornamenti sul<br />
brand in occasione del nostro prossimo<br />
licensig meeting, che si terrà<br />
entro la seconda settimana di febbraio,<br />
a Milano.»<br />
K.: Come si inserisce nel vostro<br />
portfolio licenze?<br />
M.D.: «Lo Hobbit è una property movie<br />
che beneficerà sicuramente del<br />
successo della Trilogia de Il Signore<br />
degli Anelli e sfrutterà quindi la finestra<br />
mediatica del film: il nostro<br />
obiettivo è farla diventare parte del<br />
catalogo dei nostri brand classici.»<br />

K.: Have you already launched the license?<br />
M.D.: «Yes, and we are getting excellent results, in fact<br />
we have already secured key partners in toys, such as<br />
The Bridge, Vivid and another <strong>market</strong> leader in publishing.<br />
The we’re making the most of the power of the<br />
license in toys to expand into other product categories<br />
such as apparel and accessories.»<br />
K.: Have you already got a style guide?<br />
M.D.: «Yes, the style guide is already available and is packed<br />
with iconic elements, backgrounds and locations<br />
that evoke the world of fantasy and adventure in Tolkien’s<br />
The Hobbit.»<br />
K.: Are you planning presentations to raise awareness<br />
of the property before the movie comes out?<br />
M.D.: «We presented the property to our licensees and<br />
partners at the last Brand Licensing Europe in London.<br />
And we will be giving updates on the new brand at<br />
our next licensing meeting to be held in the second week<br />
of February, in Milan.»<br />
K.: How does it fit into your licensing portfolio?<br />
M.D.: «The Hobbit is a movie that’s bound to roll on the<br />
success of The Lord of the Rings trilogy, so the property<br />
can piggy back on all the media fuss generated by the film:<br />
our goal is to put it into our catalogue of classic brands.»<br />

Affluenza record anche per la quinta edizione dell’evento di riferimento per il<br />
networking dell’industria del licensing: il <strong>Kazachok</strong> Licensing Forum 2011, che si<br />
è tenuto giovedì 10 novembre a Palazzo Mezzanotte di Milano<br />
Durante la giornata si sono incontrati più di 500<br />
operatori del settore, riconfermando l’evento<br />
come punto di riferimento per il mercato del licensing<br />
italiano ed europeo. Il Forum offre, infatti,<br />
la possibilità di creare incontri e sinergie tra<br />
nuovi licenziatari, licensor nazionali ed internazionali,<br />
consulenti, agenzie, buyer del retail, studi<br />
legali e giornalisti, e di conoscere in anteprima<br />
progetti, programmi, novità e trend previsti per il<br />
mercato del licensing. L’incremento del numero<br />
di partecipanti – che si aggira sul +14% rispetto<br />
all’edizione del 2010 – è il segnale più tangibile<br />
dell’estremo interesse: oltre 500 presenze (esattamente<br />
512!).<br />
«Il numero e la qualità dei partecipanti al Forum<br />
– dichiara Paolo Lucci di <strong>Kazachok</strong> Italia – confermano<br />
che il licensing sta vivendo un momento<br />
di grande vitalità su tutta la business community.<br />
Non è più appannaggio di pochi player in settori<br />
dedicati al bambino: produttori di ceramiche di<br />
Sassuolo, aziende vitivinicole, cosmetici e farmaceutici,<br />

ha descritto gli ultimi scenari retail (focalizzando<br />
il discorso sull’aumento delle quote di mercato<br />
delle private label: come vengono vissute<br />
dai consumatori italiani ed europei e quali sono<br />
i trend che le caratterizzano); M. Maggiolino e M.<br />
Maggiore, dell’Università Bocconi, hanno trattato<br />
alcune tematiche legali (si veda articolo completo<br />
a pagina 52); Cristina Liverani di Doxa ha<br />
rilevato le ultime tendenze del target teenager<br />
e infine Antonio Romano, dell’Agenzia delle Dogane,<br />
ha illustrato il Progetto Falstaff. Frequentatissimi<br />
anche i “property pitch” pomeridiani<br />
che hanno visto coinvolti: Elastic Rights Italia,<br />
Victoria Licensing-Mattel, Cartoon Network, MTV<br />
Nickelodeon e VBM-All Blacks. Inoltre c’è stata<br />
una gradita novità: la “Legal Clinic” messa a disposizione<br />
da LES Italy, per fornire informazioni<br />
e rispondere alle varie domande e dubbi legati al<br />
mondo dei marchi e dei brevetti.<br />

carte e nastri per confezioni regalo, borse,<br />
calzature, prodotti back-to-school, parure letto,<br />
ombrelli, sedie in cartone e wallsticker.<br />
Prodotti MOMO Design, back-to-school Cosmopolitan,<br />
t-shirt e borse Coca Cola e t-shirt Perrier<br />
(prodotte da Fix Design, agenzia TLC). Infine<br />
si è fatta notare la presenza straordinaria di PEP<br />
Marchegiani, artista di tele e di pittosculture, che<br />
ha prodotto una linea di abbigliamento per adulto<br />
e bambino. Un interessante esempio di licensing<br />
applicato all’arte che parte dallo stesso autore, in<br />
collaborazione con un’agenzia (la CLA, ndr).

Record attendance at the fifth edition of the networking event for the Italian<br />
licensing industry: the <strong>Kazachok</strong> Licensing Forum 2011, which took place on<br />
Thursday 10 November at Palazzo Mezzanotte in Milan<br />
During the day more than 500 operators from<br />
the sector attended the event, confirming it as<br />
a reference point for the Italian and European<br />
licensing <strong>market</strong>s. The Forum is just the place<br />
for meeting and forging links with a whole<br />
galaxy of new licensees, national and international<br />
licensors, consultants, agencies, retail<br />
buyers, lawyers and journalists, and to get the<br />
lowdown ahead of the herd on projects, programmes,<br />
novelties and <strong>trends</strong> on the licensing<br />
<strong>market</strong> horizon.<br />
Paolo Lucci from <strong>Kazachok</strong> Italy is upbeat.<br />
«The number and calibre of the participants<br />
at the Forum confirms that licensing is living<br />
through a moment of great vitality throughout<br />
the business community. No longer is it a niche<br />
phenomenon for a handful of players in<br />
sectors dedicated to children’s products: ceramics<br />
manufacturers from Sassuolo, wine makers,<br />
and representatives from the cosmetics,<br />
pharmaceutical and packaged food industries<br />
were all out in force on the day, gearing up for<br />
new challenges.»<br />

The morning’s key speakers were greeted very<br />
positively, expertly moderated by Riccardo<br />
Colletti, MD of Gamestore. Anna Bertolini from<br />
Mark Up described current retail scenarios; M.<br />
Maggiolino and M. Maggiore, from the Bocconi<br />
University dealt with legal issues; Cristina Liverani<br />
from the Doxa <strong>market</strong> research agency<br />
gave an overview of the latest <strong>trends</strong> in the teenager<br />
target and Antonio Romano, from the<br />
Italian customs and excise department, illustrated<br />
the Falstaff Project.<br />
The afternoon “property pitches” proved hugely<br />
popular, with presentations this year from<br />
Elastic Rights Italy, Victoria Licensing-Mattel,<br />
Cartoon Network, MTV Nickelodeon and VBM-<br />
All Blacks. Another success story was the new<br />
“Legal Clinic” courtesy of LES Italy, a mine of<br />
information and a reliable source of answers<br />
to everyone’s doubts and queries on the world<br />
of brands and patents.<br />

an artist well-known for his canvases<br />
and picto-sculptures, who earns a special<br />
mention because he has produced a fashion<br />
line for children and adults. An interesting<br />
example of licensing applied to art by the artist<br />
himself.

Cartoon Network Enterprises, divisione licensing<br />
di Turner, gruppo TimeWarner, si occupa direttamente<br />
di posizionare, nel modo piú efficace in<br />
tutte le regioni EMEA (Europa, Africa e Medioriente),<br />
i diversi brand di Turner: dai marchi legati<br />
a Cartoon Network e ai suoi Studios a quelli di<br />
TCM (Turner Classic Movies), del fenomeno americano<br />

promising 2012 with plenty of entertainment and licensing for all; there’s new property “I Soliti Idioti” and the<br />
Turtles series, plus the ongoing success of cartoon favourites like Spongebob and TV series like Victorious. Nickelodeon<br />
has also created a channel dedicated to pre-schoolers, Nick Jr, with carefully crafted programmes<br />
for tots. Parents are as enthusiastic as their kids, thanks to the channel’s positive values and the way it encourages<br />

Elastic Rights Italy<br />
Elastic Rights durante il pitch del pomeriggio<br />
ha annunciato una grande novità: dopo i grandi<br />
successi de Il Mondo di Patty e Incorreggibili,<br />
l’azienda ha presentato il proprio upgrade da<br />
gestore di diritti al nuovo ruolo di produttore<br />
di contenuti per il mercato kids e teen. È previsto<br />
per il 2012, infatti, l’inizio della produzione<br />
di Lola, Apprendista Musa, la nuova appassionante<br />
serie teen argentina realizzata da Elastic<br />
Rights in co-produzione con Resonant. Attesissima<br />
protagonista della serie, Laura Esquivel,<br />
l’amata beniamina de Il Mondo Di Patty. Dal lato<br />
animation invece, il nuovo progetto in cantiere,<br />
in coproduzione con L’Orange Gutan, è Gluko<br />
& Lennon, un’innovativa animation comedy<br />
definita come “l’incontro visionario tra Alice in<br />
Wonderland e Yellow Submarine!”. La giornata<br />
del Forum è stata anche l’occasione per fare un punto sulle attuali opportunità di licenza, condividendo<br />
gli entusiasmanti risultati Tv di Lunar Jim, la nuova property prescolare in onda dal 22 agosto<br />
scorso su Cartoonito, dedicata al target dei più piccoli.<br />
During its afternoon pitch Elastic Rights made an exciting announcement: following the huge success of Patty<br />
Feo and Consentidos the company presented its upgrade from rights’ manager to content producer for the<br />
kids and teen <strong>market</strong>. 2012 will see work start on the production of Lola, Apprendista Musa (Lola the Apprentice<br />
Muse), the new Argentinian teen series made by Elastic Rights in co-production with Resonant. The star of the<br />
series is to be the extremely popular Laura Esquivel, who already features in Patty Feo. On the cartoon front<br />
they have another new project up their sleeves in co-production with Orange Gutan; called Gluko & Lennon, it<br />
is an innovative animation comedy defined as “a visionary encounter between Alice in Wonderland and Yellow<br />
Submarine!”. Forum day also gave Elastic Rights a chance to showcase their current successes and licensing<br />
opportunities, with the excellent TV results of their new preschool property Lunar Jim, (broadcast by Cartoonito<br />
from 22 August 2011) very much to the fore. An ideal license for a very young target.
RTI Gruppo Mediaset<br />
Il dipartimento licensing di RTI cura lo sfruttamento<br />
della maggior parte dei marchi legati<br />
a prodotti televisivi presenti sulle reti<br />
del gruppo. Tra le varie properties presentate<br />
quest’anno grande attenzione è andata a<br />
Wild Oltrenatura, un programma arrivato alla<br />
quinta edizione in onda in prime time di Italia1.<br />
Con un profilo d’ascolto che nell’ultima<br />
edizione ha vantato un 21% di bambini 4-7<br />
e ben un 29% di 8-14, Mondadori è stata la<br />
prima azienda a credere in questo progetto.<br />
Ghenos Games, dopo il successo del board<br />
game di Lupin The 3rd si lega ancora ad RTI<br />
Licensing e uscirà in primavera con un accattivante<br />
board game su Wild. Gli sticker album<br />
sono stati affidati a Edibas, mentre Hobby &<br />
Work sta lavorando su action figures; diversi<br />
soggetti si stanno proponendo per flow-pack,<br />
playset, back to school, abbigliamento e molto<br />
altro ancora.<br />
The RTI licensing department manages most of<br />
the brands for the TV programmes broadcast on<br />
the Mediaset network. Among the various properties<br />
presented this year, one attracted a particular<br />
amount of attention. Wild Oltrenatura is a programme<br />
in its fifth year scheduled in prime time<br />
on Italia 1 with a current audience profile boasting<br />
21% of the kids in the 4-7 age range and a whopping<br />
29% among the 8-14 year olds. Mondadori<br />
was the first company to pick up on the project.<br />

trial, mentre a livello internazionale quella<br />
con Jorge Lorenzo, portabandiera di Hot<br />
Wheels sulle piste della moto GP. Il piano di<br />

Victoria Licensing & Marketing, licensing consultants for Mattel, is <strong>focus</strong>ing on their pitch for the high adrenaline<br />
brand in their portfolio, Hot Wheels. 2012 will see the property repositioned as a reference point for all<br />
those teenagers and young adults who enjoy cars and competitions. Money is being pumped into the property<br />
and some important partnerships have been forged, firstly with bike trial world champion Vittorio Brumotti, and<br />
then on an international level with Jorge Lorenzo, who flies the flag for Hot Wheels on the GP motorbike circuits.<br />
The licensing plan is well underway, with all the key categories already up and running, from sporting goods<br />
with Mondo and Dino Bikes, back to school with Seven, footwear with Siport, eyewear with Inottica and an adult<br />
fashion line with Blomor just to mention some.<br />
The Licensing Machine-Panini<br />
Per il 5° anno consecutivo, The Licensing Machine non ha mancato l’appuntamento di Milano dedicando<br />
il proprio stand al Brand Panini e ai suoi prodotti, che nell’ultimo anno hanno destato grande<br />
interesse in Italia e all’estero. Tra le aziende italiane licenziatarie del marchio risultano: Franco Cosimo<br />
Panini per il settore scuola e stationary, Italian Tobacco Agency/Juego per i biliardini e gli orologi<br />
“Panini 50” di Terra-Cielo-Mare. La società Carpentier (Svizzera) con una linea vintage di raccoglitori<br />
per collezionisti e Ginger Fox, licenziatario UK nonché fornitore di Marks & Spencer per il gift,<br />
esporteranno invece il Panini brand in Europa. Ma è sicuramente nel settore dell’abbigliamento che<br />
Panini lancia la sua sfida più alta, firmando un nuovo importante accordo di licenza con una azienda<br />
italiana di moda.<br />

the Milan Licensing Forum for five years running,<br />
and this year saw its stand dedicated to the Panini<br />
brand and all its products, a huge success both<br />
in Italy and abroad during 2011. Italian brand licensees<br />
include: Franco Cosimo Panini for schools<br />
and stationery, Italian Tobacco Agency/Juego<br />
for table billiards and the “Panini 50” watches by<br />
Terra-Celo-Mare. Carpentier from Switzerland,<br />
who do a line of vintage binders for collectors,<br />
and Ginger Fox, the UK licensee and gift supplier<br />
to Marks & Spencer, are exporting the Panini<br />
brand to Europe. But Panini’s big challenge<br />
for 2012 is in apparel, where they have inked an<br />
agreement with an Italian fashion company.
Atlantyca<br />
Atlantyca ha posto l’attenzione su tre properties attualmente in onda. Il Piccolo Principe Animation,<br />
on air il sabato e la domenica mattina su Rai Due è una veste nuova per una property di successo,<br />
che permetterà alle nuove generazioni di conoscere questo intramontabile eroe. Il sottomarino Olly,<br />
serie animata prescolare in onda su Cartoonito, è un esempio convincente di edutainment con tanto<br />
di collaborazione dell’UNESCO. Geronimo Stilton: partita la seconda stagione, in onda su Rai Due, si<br />
riconferma uno dei personaggi più amati dai bambini. Un successo editoriale e della serie animata,<br />
non manca di contare un numero di partner licensing di rilievo, come Sony, con il nuovo videogioco<br />
per PSP e progetti che vedono coinvolte le istituzioni come Zampe&Ruote, progetto sull’educazione<br />
stradale ideato insieme al Ministero dell’Istruzione.<br />
Atlantyca is concentrating on three of its properties which<br />
are all currently on air. First up is The Little Prince Animation,<br />
broadcast Saturday and Sunday morning on Rai 2, a<br />
successful property in a new guise so that the next generations<br />
can get to know this evergreen hero. Then there is<br />
Olly the submarine, the cartoon series for preschoolers<br />
on Cartoonito, a good example of edutainment with a prestigious<br />
partnership with UNESCO. Last but not least is<br />
Geronimo Stilton, now in its second season on Rai 2 and a<br />
consolidated uber-favourite with children. As a publishing<br />
and cartoon success Stilton has harvested a respectable<br />
number of big names in licensing partnerships, among<br />
them Sony, where he stars in a new videogame for the<br />
PSP, and in various institutional projects such as the<br />
Zampe&Ruote (Paws and Wheels) campaign for road safety<br />
by the Italian Ministry for Education.<br />
Planeta Junior Italia<br />
Planeta Junior ha presentato al Forum la property<br />
di punta per il 2012, la versione in 3D dell’Ape<br />
Maia che sarà prossimamente in onda su Rai<br />
Due. In Italia sono già stati siglati numerosi accordi<br />
di licenza come il bts, decorazioni, tessile<br />
casa, sticker, libri, personal care, abbigliamento<br />
e accessori, carte augurali, decorazioni dolci, biciclette,<br />
palloncini gonfiabili, giochi outdoor, plush<br />
standard, carte prepagate e tantissimi altri. Altra<br />
property del Gruppo è The DaVincibles, serie già<br />
di successo in Francia e Spagna, creata e prodotta<br />
da Zodiak Active Kids, in coproduzione con Rai<br />
Fiction e Moonscoop, attualmente in onda su Rai<br />
Due, il cui target di riferimento è 8-12 anni. Infine<br />
DQ Entertainment, produttore delle serie animata<br />
in 3D CGI 52x11, e PJ, hanno firmato un accordo<br />
per The Jungle Book. La serie, già trasmessa su<br />
Rai Due, sarà nuovamente on air nel 2012.<br />

to be broadcast on Rai Due. Licensing agreements galore<br />
have already been inked in Italy, among them backto-school,<br />
decorations, home textiles, stickers, books,<br />
personal care, apparel and accessories, greeting cards,<br />
cake decorations, bicycles, balloons, outdoor games,<br />
standard plush, prepaid cards and many more. Another<br />
of the group’s properties is The DaVincibles, a series that<br />
has already proved a success in France and Spain, created<br />
and produced by Zodiak Active Kids, in co-production<br />
with Rai Fiction and Moonscoop. Currently aired on Rai<br />
Due, is addresses a target audience of 8-12 year olds.<br />
Lastly DQ Entertainment, the producers of the cartoon<br />
series in 3D CGI 52x11 and PJ have inked an agreement<br />
for The Jungle Book. The series has already been broadcast<br />
on Rai Due and will be on air again in 2012.

ever! Innovation is the watchword in the Gormiti Industry programme, with new look stories and graphics and<br />
new technologies. And the innovation extends to the licensing programme with a raft of special conditions and<br />

The Smiley Company is home to one of the most recognisable logos in the world. The original Smiley brand was born<br />

Non si può premeditare più di tanto di mettere in agenda un programma di licenze legato<br />
a questo tipo d’intrattenimento, ma una volta sotto le luci della ribalta, i risultati arrivano!<br />
Il genere teatrale del<br />
musical affonda le sue<br />
radici in America e, in<br />
Europa, ha trovato la<br />
sua consacrazione a Londra: a chi,<br />
infatti, non vengono in mente subito<br />
le mille luci di Broadway a New York,<br />
i titoli classici come West Side Story<br />
(anni ‘50) o i successi di Andrew<br />
Lloyd Webber (Jesus Christ Super<br />
Star, Cats ecc. degli anni ’70 e ‘80)?<br />
L’Italia ha sempre avuto<br />
interesse per questo genere di<br />
intrattenimento, ma, a causa<br />
delle inadeguate strutture e degli<br />
inesistenti investimenti privati, i<br />
musical “transitano” sempre per un<br />
breve periodo (al contrario degli altri<br />
paesi, dove uno spettacolo viene<br />
ripetuto per anni). Unica eccezione,<br />
forse, il Rocky Horror Picture Show<br />
al cinema Mexico di Milano… (nella<br />
versione metà musical - metà film,<br />
però).<br />

paese riguarda l’esponenziale<br />
Musical: stage properties<br />
Musicals are a sure hit with young fans and a great<br />
vehicle for brand awareness. They might not be part<br />
of the standard licensing kit, but hitting the footlights<br />
makes headlines<br />
The roots of theatre musicals lie in America and in<br />
Europe, where London reigns supreme. The word<br />
“musical” immediately conjures the lights of Broadway<br />
in New York, with its classics like West Side<br />
Story from the fifties or the British successes of Andrew<br />
Lloyd Webber with Jesus Christ Super Star, Cats<br />
et al in the seventies and eighties.<br />
Italy has always had a soft spot for the genre, but without<br />
suitable infrastructure or private investments<br />
musicals have always tended to make a mere fleeting<br />
bow in the Bel Paese, unlike other countries where<br />
they run happily for years on end. Despite this Daniele<br />
Luppino has always been convinced that the sector<br />
was a winner and back in 1994 founded M.A.S. – Music<br />
Arts & Show, a school for young talents in the field<br />
of entertainment. Over the years the school achieved<br />
international recognition, and Luppino decided to<br />
expand into production. In 2004 he hit on a <strong>market</strong><br />
segment ripe for development, the family show, and<br />
founded Poltronissima, a company to handle all the<br />
different sectors of the show business. Because he<br />
had decided to concentrate on a precise target where<br />
children were key, the world of licensing was the next<br />
logical step. <strong>Kazachok</strong> interviewed him to discover<br />
what happened.<br />
<strong>Kazachok</strong>: How are musicals doing today?<br />
Daniele Luppino: «In Europe the <strong>market</strong> is still flourishing,<br />
it’s not what it was 15 years ago, but it has<br />
managed to be fairly resilient in the crisis. In Italy it’s<br />
doing well, although we always have to bear in mind<br />
that the culture of entertainment is different here. As<br />
far as quality products go the public is still enthusia-<br />

interesse che si è creato nell’ultima<br />
decade nei confronti delle arti<br />
coinvolte nei musical (canto, ballo,<br />
recitazione) grazie alla complicità<br />
dei programmi televisivi (Amici di<br />
Maria de Filippi non a caso è iniziato<br />
traendo ispirazione da Fame, film<br />
musical cult degli anni ‘80). Tanti<br />
aspiranti artisti a tutto tondo, ma<br />
con pochi sbocchi professionali…<br />
Però, esiste un caso a sé stante.<br />
Nell’ormai lontano 1994, infatti,<br />
Daniele Luppino crede nel settore<br />
e fonda il M.A.S. – Music Arts &<br />
Show, una scuola per formare<br />
giovani talenti nel campo dello<br />
spettacolo. Diventato negli anni<br />
un centro riconosciuto a livello<br />
internazionale, Luppino decide<br />
di ampliarsi entrando nel mondo<br />
delle produzioni. Così, nel 2004,<br />
individuato un segmento di mercato<br />
al tempo poco esplorato – quello del<br />
family show – avvia Poltronissima,<br />
società che gestisce e supervisiona<br />
tutti i settori dello show business.<br />
Volendosi rivolgere a un target ben<br />
preciso, dove i bambini la fanno<br />
da protagonisti, l’avvicinamento<br />
al mondo delle licenze è stato un<br />
passo fondamentale. Ripercorriamo<br />
con lui la sua storia.<br />
<strong>Kazachok</strong>: Qual è lo stato del<br />
musical?<br />
Daniele Luppino: «In Europa è un<br />
mercato ancora florido, non a livello<br />
di 15 anni fa, ma resiste alla crisi.<br />
In Italia va piuttosto bene, anche<br />
se da sempre facciamo i conti con<br />
una cultura dell’entertainment<br />
diversa, a partire dalle strutture<br />
mancanti o non adatte a ospitare<br />
grandi produzioni internazionali. Un<br />
musical in Germania viene replicato<br />
per 4-5 anni, mentre in Italia, se dura<br />
per 4-5 mesi, è già da considerarsi<br />
un successo. Sicuramente sui<br />
prodotti di alto livello il pubblico<br />
reagisce bene; sarà banale, ma se<br />
si porta qualità, i risultati ci sono<br />
sempre.<br />
Quando ha iniziato a interessarsi<br />
di licensing e come si è evoluto il<br />
discorso?<br />
D.L.: «Nel momento stesso in cui ho<br />
iniziato a pensare di fare produzioni,<br />
cioè nel 2004. Abbiamo cercato di<br />
capire quale potesse essere la strada<br />
giusta, e soprattutto volevamo che<br />
fosse di respiro internazionale (per<br />
fare investimenti più sostanziosi). Ci<br />
siamo guardati attorno e abbiamo<br />
capito che le Winx potevano essere<br />
il cavallo di battaglia con cui iniziare<br />
l’avventura. È stato un tale successo<br />
che lo show è stato anche proposto<br />
nella versione “On Ice” con Carolina<br />
Kostner. Successivamente abbiamo<br />
prodotto i musical con protagonisti<br />
Scooby Doo, Hello Kitty, Il Mondo di<br />
Patty, Ben10. Per ognuno di questi<br />
spettacoli, chi più chi meno, non ci<br />
stic. It might seem obvious, but if you do things well<br />
you always get results.<br />
When did you start exploring licensing and how did<br />
things develop?<br />
D.L.: «Right from the word go. As soon as I decided<br />
to go into production. We wanted to find a way to ensure<br />
success and it had to be something which would<br />
work on an international level. We had a look round<br />
and realised that the Winx were probably the right<br />
property to start with. Later we went on to produce<br />
musicals starring Scooby Doo, Hello Kitty, Patty Feo<br />
and Ben10.»<br />
So how does it work in detail? How do you make a<br />
licensed musical?<br />
D.L.: «Each production is different, there is no standard<br />
mould, we’re talking about creativity here. Some<br />
of the titles already came with a story, so you build<br />
directly from that. While with Hello Kitty for example<br />
we were interpreting a mood. Another example is our<br />
Ben10 show, where we developed two new alien characters<br />
specifically for the show.»<br />
A comment on your merchandising?<br />
D.L.: «It’s doing really well, partly because we come<br />
up with things that go beyond the show as such. For<br />
example with Hello Kitty we created a special style<br />
guide and the products sold all over Europe, they weren’t<br />
just linked to the event.<br />
We’re also really keen on synergy, from media partnerships<br />
to initiatives in retail chain outlets… All<br />
forms of communication that boost the property, over<br />
and beyond the musical.»<br />

occupiamo solo della produzione,<br />
ma anche della creazione di eventi<br />
speciali, del merchandising;<br />
insomma, di tutti gli aspetti dello<br />
show business.»<br />
Quali sono le specificità? Come si<br />
crea un musical in licenza?<br />
D.L.: «Ogni prodotto ha una sua<br />
storia, è un po’ un lavoro artigianale.<br />
Alcuni titoli, infatti, hanno già<br />
una trama, quindi si lavora su un<br />
immaginario già esistente; nel<br />
caso di Hello Kitty, invece, abbiamo<br />
dovuto interpretare un mood. Un<br />
altro esempio riguarda lo show<br />
di Ben10, per il quale abbiamo<br />
sviluppato due nuovi alieni ad hoc.»<br />
Un commento sulle possibilità<br />
offerte dal merchandising?<br />
D.L.: «È un settore che va molto<br />
bene, anche perché ci inventiamo<br />
delle cose che vanno oltre lo show.<br />
Ad esempio, sempre per citare<br />
Hello Kitty, abbiamo realizzato una<br />
style guide apposita e i prodotti<br />
sono stati venduti in tutta Europa,<br />
al di fuori dell’evento. In questo<br />
caso abbiamo cercato di uscire dalla<br />
logica dell’acquisto impulsivo postshow,<br />
creando articoli un po’ più<br />
“duraturi”.<br />
Inoltre crediamo molto nelle<br />
sinergie, dalle media pertnership<br />
alle iniziative nelle catene di negozi…<br />
Tutte operazioni di comunicazione<br />
che diffondono la property stessa,<br />
oltre al musical. Non sempre ce<br />
le lasciano fare, ma quando ci<br />
riusciamo, ci sono stati grandi<br />
risultati.»<br />
La soddisfazione dei licensor<br />
Se da parte del “licenziatario” si<br />
riscontra grande entusiasmo, gli<br />
aventi diritto non sono da meno.<br />
«L’idea di produrre un musical non è<br />
stata casuale – ci racconta Francesca<br />
Barigelli, Marketing Manager<br />
Rainbow. Avevamo iniziato a<br />
lavorare su questo format da tempo,<br />
con il primo prodotto in assoluto di<br />
“casa Rainbow”, il cartone Tommy &<br />
Oscar, sperimentando con successo<br />
questo genere nel mercato asiatico<br />
già nel 2000.<br />
Poi chiaramente un fenomeno come<br />
Winx ha permesso di portare questo<br />
tipo di intrattenimento in tutta<br />
Europa, dandogli un respiro più alto:<br />
un vero musical alla Broadway, con<br />
musiche avvincenti, coreografie<br />
di tutto rispetto e ballerini<br />
professionisti.<br />
È un modo per portare il brand<br />
amato a casa di ogni fan grazie<br />
al tour che, nel caso dei musical<br />
Winx (Winx power + Winx on ice), ha<br />
toccato tutte le città principali e poi<br />
anche le secondarie d’italia, mentre<br />
all’estero si è focalizzato sulle tappe<br />
principali.<br />
Poi l’emozione che si vive in uno<br />
spettacolo live non è paragonabile<br />
a nessun’altra: il contatto con le<br />
proprie eroine incontrate dal vivo, e<br />
non solo in Tv, per i bimbi è senza pari.<br />
In termini di business, ovviamente,<br />
tutto ciò è una grande spinta, sia che<br />
si parli di merchandising specifico<br />
sullo spettacolo, sia che si parli di<br />
merchandising riferito al brand in<br />
generale.»<br />
Aumentare la brand awareness<br />
Stefano Salis, Territory Manager Italy<br />
di Cartoon Network Enterprises,<br />
per l’esperienza con Ben10 parla<br />
molto in termini di comunicazione:<br />
«È stata un’avventura interessante<br />
e stimolante, poiché abbiamo<br />

at Rainbow. «We’d been working on the format<br />
for some time with Rainbow’s very first property, the<br />
cartoon Tommy & Oscar. When the Winx production<br />
took off we piggy-backed on its success and exported<br />
this model of entertainment to the rest of Europe. A<br />
real Broadway-style musical. It’s one way of taking a<br />
much-loved brand directly to fans. The emotion you<br />
get from seeing a live show is like no other, actually<br />
seeing and meeting your heroes and heroines in the<br />
flesh and not just on TV is something kids will never<br />
forget, a unique experience. In terms of business<br />
it’s obviously a huge boost, both for the specific merchandising<br />
linked to the show and the brand’s merchandising<br />
in general.»<br />
Boosting brand awareness<br />
Stefano Salis, Territory Manager Italy at Cartoon<br />
Network Enterprises, talks about their Ben10 experience<br />
mainly in terms of communication: «It was an<br />
interesting, stimulating experience, because we had<br />
to write a show based on something quite different<br />
in type, considering that the cartoon was strictly for<br />
boys, while here we had to involve the parents and<br />
older siblings... And that was the real challenge: to<br />

dovuto scrivere uno show basandoci<br />
su presupposti che andavano in<br />
tutt’altra direzione, visto che il<br />
cartone animato si rivolgeva solo<br />
a un pubblico maschile; invece in<br />
questo caso bisognava coinvolgere<br />
anche i genitori, i fratelli più grandi...<br />
Un’altra differenza importante è<br />

con titoli più classici, mentre<br />
Ben10 è recentissimo. Ma è stata<br />
proprio questa la sfida, riuscire a<br />
portare a teatro tutta la famiglia,<br />
facendola simpatizzare con il<br />
brand. Operazione impossibile<br />
attraverso il solo cartone animato.<br />
Per questo consideriamo il<br />
musical alla pari di un qualsiasi<br />
media, in grado di diffondere e<br />
comunicare il “prodotto”. Serve<br />
tantissimo in termini di awareness,<br />
ripercuotendosi in modo positivo<br />
sul merchandising: si allargano<br />
le licenze, magari con un piccolo<br />
rischio di sovrapposizione, ma il<br />
canale di vendita e il momento<br />
di acquisto sono diversi, legati<br />
all’evento.»<br />
Il Mondo di Patty, invece, per<br />
alcuni aspetti – in primis che la<br />
protagonista Laura Esquivel è reale<br />
ed è una bravissima cantante–<br />
ha avuto meno problemi come<br />
adattamento della sceneggiatura,<br />
anche se tutto lo show andava<br />
approvato dagli autori argentini.<br />
«È stata un’esperienza nuova:<br />
normalmente in Italia non si<br />
considerava parte di un programma<br />
di licenza un musical» spiega Elena<br />
Picco, Managing Director di Elastic<br />
Rights Italia. È stata un’occasione<br />
per testare questo mercato. Aver<br />
portato in Italia Laura Esquivel<br />
in carne ed ossa è stato davvero<br />
emozionante e i risultati sono stati<br />
notevoli sia da un punto di vista<br />
degli incassi, sia di brand extension.<br />
Purtroppo abbiamo notato una<br />
quantità enorme di prodotti falsi<br />
fuori dai teatri; in molti casi siamo<br />
riusciti a coinvolgere la Guardia<br />
di Finanza. Per quanto riguarda i<br />
nostri licenziatari, il back-to-school<br />
di Cartorama, che è stato sponsor<br />
ufficiale del tour italiano, ha avuto un<br />
enorme successo.» Alla domanda<br />
“se ripeteranno l’esperienza”,<br />
Elena Picco risponde: «Se ci<br />
sarà l’occasione, sicuramente. In<br />
Argentina stiamo producendo delle<br />
nuove live action con Laura Esquivel<br />
che saranno pronte per il 2013; se<br />
saranno adattabili a un musical, non<br />
ci tireremo certo indietro.»<br />

get the whole family to go to the theatre, to get them<br />
to empathise with the brand. It would have been impossible<br />
with just the cartoon, which is why we see<br />
the musical in the same light as any other media, a<br />
vehicle to communicate the “product”. It’s very effective<br />
in terms of awareness.»<br />
Patty Feo on the other hand was not such a tricky proposition<br />
from some points of view. In the first place<br />
the star Laura Esquivel is actually a real person and<br />
a brilliant singer, so it was easier to write the screenplay,<br />
although the whole show had to be approved<br />
by the Argentinean authors. «It was a new experience,<br />
in Italy we don’t usually consider a musical as part of<br />
a licensing programme» says Elena Picco, Managing<br />
Director of Elastic Rights Italy. It gave us a chance to<br />
test the <strong>market</strong>. Bringing Laura Esquivel to Italy in<br />
the flesh was an amazing experience and produced<br />
brilliant results, both from a box office point of view<br />
and as an exercise in brand extension.» When asked<br />
whether she would repeat the experience Elena Picco<br />
answers: «Certainly, if we get the chance. In Argentina<br />
we’re currently producing a new live action series<br />
with Laura Esquivel which will be ready in 2013; if it<br />
can be adapted into a musical, why not?»<br />
Geronimo Stilton in tour<br />

Geronimo Stilton on tour<br />
This last autumn has seen the musical “Geronimo Stilton The Kingdom<br />
of Fantasy”, inspired by the Geronimo Stilton books, on tour in<br />
Europe, with initial performances in Amsterdam and Madrid. «We feel<br />
honoured to represent Geronimo Stilton as the inspiration for these<br />
fantastic shows. Their successes and the numerous awards they have<br />
won confirm the public’s deep-rooted attachment to this incredible<br />
property» claims Rachele Geraci, Licensing and Agent Manager at Atlantyca<br />
Entertainment. The publication rights have already been sold<br />
through Atlantyca’s Foreign Rights Dept. to The Netherlands, Spain,<br />
France and Poland among others.<br />

che passione!<br />
Un settore per nulla semplice, quello del licensing legato alle serie Tv per adulti. Ma una<br />
volta trovato il metodo con cui avvicinarsi al target prescelto, i risultati non mancano,<br />
soprattutto in termini di <strong>market</strong>ing<br />
L’utilizzo delle properties<br />
legate ai titoli delle serie<br />
Tv per adulti può avvenire<br />
in diverse modalità: la prima è quella<br />
di andare incontro al pubblico degli<br />
appassionati; altrimenti, possono<br />
essere adoperate per differenziare e<br />
posizionare (o riposizionare) un prodotto;<br />
infine, per allargare il target, si<br />
possono sfruttare per operazioni di<br />
brand extension o branding “puro”,<br />
utilizzando solo il logo e il mood del<br />
telefilm, senza che vengano usate le<br />
immagini degli attori o altri elementi<br />
caratteristici (es. Sex and the City).<br />
Il pubblico delle serie Tv è però piuttosto<br />
critico: fatta eccezione per i super-fan,<br />
è difficile che la loro fedeltà<br />
a un certo programma televisivo si<br />
trasformi in acquisto di prodotti in<br />
licenza.<br />
In questo caso risulta quindi fondamentale<br />
profilare bene il target: capire<br />
quali prodotti proporre e comunicarli<br />
sul media giusto, che a rigor<br />
di logica dovrebbe essere la televisione.<br />
L’eccezione che conferma la regola<br />
è rappresentata da I Soliti Idioti che,<br />
da fenomeno di MTV, grazie alla sua<br />
particolare struttura, è riuscito ad<br />
imporsi anche sul web, complice il<br />
fatto che il pubblico di questa serie<br />
– concentrato nella fascia 16-25 ma<br />
con molti simpatizzanti anche over<br />
30 – è fortemente legato al mondo<br />
virtuale.<br />
«Per quanto riguarda il licensing de<br />

A passion for Tv series!<br />
Licensing Tv series designed for older audiences is<br />
no walk in the park. But once you’ve got your target<br />
firmly in your sights the results are there, especially<br />
in <strong>market</strong>ing terms<br />
Properties linked to Tv series designed for older audiences<br />
can work in different ways: you can dovetail<br />
them to the expectations of their fans; or you can use<br />
them to differentiate, position or reposition a product;<br />
or lastly you can use them in brand extension operations<br />
and for “pure” branding, just using the series’<br />
logo and general mood, without using the image of the<br />
actors or other characteristic elements. One example<br />
is Sex and the City.<br />
Tv series’ audiences tend to be tricky customers: unless<br />
they are diehard fans of the programme they may well<br />
baulk at buying its branded licensed goods.<br />
So you really need to profile your target perfectly and<br />
judge which products to propose and which media to<br />
vehicle them on. Logically that should be television.<br />
The exception that proves the rule is the Italian series<br />
“I Soliti Idioti” which has morphed from being an MTV<br />
success into a web wonder, thanks to its flexible structure<br />
and the fact that it is mostly popular with 16-25<br />
year-old target, plus a goodly number of over-30s, all<br />
digitally-savvy.<br />
«When it came to licensing “I Soliti Idioti” we were really<br />
only following meekly in the footsteps of a spontaneous<br />
request from the <strong>market</strong> itself, particularly after the<br />
third season was broadcast» explains Simone Cremonini,<br />
Head of Business Development for MTV Italy.<br />
“I Soliti Idioti” is in the same mould as similar successes<br />
from other countries, like Little Britain in the<br />
UK, ironizing over Italy’s trite commonplaces and stereotypes.<br />
«Other brands (primarily Nickelodeon) in the Viacom<br />
Group, which includes MTV, already have their own successful<br />
licensing divisions up and running. But in Italy<br />
when we wanted to promote licensing for MTV properties,<br />
“I Soliti Idioti” among them, we initially turned to<br />

La serie I Soliti Idioti, sviluppatasi<br />
sulla scia del successo di prodotti<br />
analoghi stranieri (come Little Britain<br />
in UK), ruota attorno ai luoghi<br />
comuni e agli stereotipi del nostro<br />
Paese, facendone una sagace ironia.<br />
Le frasi dei vari personaggi (interpretati<br />
da Francesco Mandelli e Fabrizio<br />
Biggio) sono diventate dei veri e propri<br />
tormentoni, grazie anche – come<br />
già detto – alla diffusione/ripetizione<br />
via web di alcune gag.<br />
«Se, infatti, gli altri brand (in primis<br />
Nickelodeon) del gruppo Viacom, di<br />
cui MTV fa parte – continua Cremonini<br />
– hanno una divisione licensing già<br />
strutturata che lavora con successo,<br />
in Italia, per l’incremento iniziale del<br />
licensing delle properties di MTV, tra<br />
cui I Soliti Idioti, ci siamo affidati a<br />
una società di consulenza specializzata<br />
con cui abbiamo realizzato un<br />
progetto per lo sviluppo della licenza<br />
riuscendo, nel giro di pochi mesi, a<br />
presentarci sul mercato. In parallelo<br />
abbiamo anche lavorato in maniera<br />
diretta allo sviluppo della property<br />
nei mercati a noi più affini, ovvero<br />
quelli editoriali. A cominciare dal<br />
film, per cui abbiamo<br />
ceduto i diritti<br />
di adattamento cinematografico<br />
alla<br />
Taodue del Gruppo<br />
Mediaset.»<br />
La pellicola, uscita<br />
nelle sale a inizio<br />
novembre, in un<br />
mese ha raggiunto<br />
incassi record oltrepassando<br />
i 10 milioni<br />
di euro…<br />
«Abbiamo iniziato a proporre la licenza<br />
a cavallo delle vacanze estive,<br />
quando si sapeva poco del film in<br />
uscita e il mercato non poteva avere<br />
idea di quello che sarebbe successo»<br />
continua Cremonini. «Dunque, inizialmente,<br />
siamo stati noi a proporci<br />
attivamente ai licenziatari. Quando a<br />
settembre sono usciti i primi comunicati<br />
stampa e Mediaset ha iniziato<br />
a fare una massiccia comunicazione,<br />
invece, molte aziende ci hanno<br />
contattato o sono tornate sui propri<br />
passi, ma a quel punto per alcune<br />
era troppo tardi: avevamo già chiuso<br />
accordi con altre aziende, spesso<br />
loro concorrenti.<br />
Nel 2012 produrremo la quarta serie<br />
a firm of specialised consultants. At the same time we<br />
worked directly on developing the property in <strong>market</strong>s<br />
we knew more about, starting with the film based on<br />
the series» continues Cremonini. The film came out in<br />
Italy early last November and proved a huge success, in<br />
just one month the box office broke the 10 million euro<br />
barrier…<br />
«In 2012 we’ll be making the 4th series of the show and<br />
we want to reach out and take it to people directly, organising<br />
theatre shows to keep the close relationship<br />
between the characters and the public alive. We also<br />
want to make sure we can maintain the media coverage,<br />
which will have positive knock-on effects on licensing»<br />
Cremonini explains.<br />
Maria Giovanna Gurrieri, Managing Director at CPLG<br />
Italy, talked to us about Glee, the award-winning Tv series.<br />
«Glee is a pop phenomenon, a transversal product<br />
that appeals to a fairly broad target which is susceptible<br />
to identifying with branded products. We’re doing very<br />
well with it. Compared to our other properties it’s our<br />
biggest earner. The age range is from 12 to 25, which is<br />
a big help in some categories such as fashion and collectables,<br />
social stationery and lifestyle products.<br />
As far as other Tv series are concerned it can be a bit of<br />
a bumpy ride. The target changes, and as the average<br />
viewer age bar is raised licensing applications are fewer<br />
and increasingly in niche <strong>market</strong>s. Traditional favourites<br />
like Star Trek or Magnum P.I. have an edge, the former<br />
because it has a huge following of collectors and the<br />
latter, just one of the series we manage, because “neo<br />
vintage” has been quite a trend in the fashion world in<br />
recent years. If you want to make the most of these properties,<br />
which are objectively more difficult to handle<br />

dello show e vorremmo proseguire<br />
con le attività sul territorio, come lo<br />
spettacolo teatrale, per tenere vivo il<br />
rapporto tra i personaggi e il pubblico.<br />
Vogliamo inoltre continuare a garantire<br />
una copertura mediatica che<br />
possa generare buoni risultati anche<br />
sul fronte delle licenze.»<br />
Maria Giovanna Gurrieri, Managing<br />
Director di CPLG Italia, invece, ci<br />
ha parlato di Glee, serie televisiva<br />
pluripremiata che solo nel 2011 si è<br />
aggiudicata 4 Emmy e 3 Golden Globes.<br />
«Glee è un fenomeno pop, un<br />
prodotto trasversale che raccoglie<br />
un target eterogeneo e abbastanza<br />
sensibile all’identificazione, sul<br />
quale stiamo lavorando molto bene.<br />
Rispetto ad altre property che curiamo<br />
è quella che ha generato più<br />
business. L’età va dai 12 ai 25 anni,<br />
il che ci aiuta moltissimo per le diverse<br />
categorie merceologiche che<br />
si possono andare a toccare: dal<br />
fashion ai collezionabili, dal social<br />
stationery al lifestyle. Per quanto riguarda<br />
le altre serie Tv è un po’ più<br />
complicato. Il target di riferimento<br />
cambia e, alzandosi l’età media, diventano<br />
più difficile e di nicchia le<br />
applicazioni in termini di licensing.<br />
Sicuramente le serie storiche come<br />
Star Trek o Magnum P.I. sono quelle<br />
immediatamente più rappresentabili<br />
e spendibili. La prima per il grande<br />
seguito di collezionisti; la seconda,<br />
che è solo un esempio delle serie del<br />
passato che gestiamo, per la tendenza<br />
fashion di questi ultimi anni<br />
a strizzare l’occhio al “neo vintage”.<br />
Per massimizzare queste properties,<br />
obiettivamente più difficili e inusuali,<br />
bisogna entrare<br />
nel loro<br />
codice, parlare<br />
la lingua del<br />
loro pubblico, interpretarne in qualche<br />
modo le aspettative.<br />
È un lavoro sicuramente più complesso<br />
rispetto alle properties tradizionali<br />
cartoon, ma ci crediamo e<br />
investiamo la stessa passione e fantasia<br />
nel gestirlo.»<br />
Infine, una serie da poco iniziata e<br />
trasmessa sulla ABC americana<br />
(dal 25 settembre 2011) potrebbe<br />
costituire un interessante test sulle<br />
opportunità in questo mercato: stiamo<br />
parlando di Pan Am. Ambientati<br />
negli anni ‘60, il periodo di massima<br />
fama della compagnia aerea, gli episodi<br />
ruotano attorno alle storie degli<br />
assistenti di volo, tra cui spicca,<br />
fra i protagonisti, Christina Ricci.<br />
Aspettando di vedere se arriverà<br />
in Italia, per ora molti prodotti di<br />
merchandising, come la mitica Pan<br />
Am Orion Bag, sono proposti dalla<br />
stessa Pan Am Brands, divisione licensing<br />
della Pan American World<br />
Airways.<br />

and unusual, you have to think yourself inside them and<br />
their audiences and fulfil the public’s expectations.»<br />
One series that has just, ahem, taken off, is Pan Am<br />
– broadcast on ABC in the USA. It could prove a useful<br />
litmus test to see what sort of opportunities there<br />
really are in this <strong>market</strong>. Pan Am is set in the sixties<br />
and is about the various adventures of flight attendants,<br />
starring among others actress Christina Ricci. While we<br />
wait to see if it’s going to be exported to Italy, merchandising<br />
products like the legendary Pan Am Orion Bag<br />
are already being sold by Pan Am Brands, the licensing<br />
division of Pan American World Airways.<br />

in edicola, vincenti<br />
Dai gift-in-pack ai collezionabili distribuiti nei rivenditori di giornali: la Pea&Promoplast,<br />
azienda di Torino con un curriculum trentennale, punta a consolidare la propria presenza sui<br />
mercati esteri<br />
Da poco riunita sotto<br />
un’unica “egida”, la<br />
Pea&Promoplast è una<br />
società che opera nei<br />
settori del promozionale e in quello<br />
editoriale. Per quanto riguarda la<br />
prima divisione, l’azienda collabora<br />
da molti anni con grandi marchi,<br />
(area food, giocattolo, case editrici)<br />
sviluppando meccaniche e progetti<br />
che coinvolgono diversi milioni di<br />
pezzi gift-in-pack ogni anno.<br />
L’area che si occupa dei prodotti<br />
per l’edicola invece è nata da poco:<br />
«Dopo aver seguito i principali player<br />
editoriali negli ultimi 5 anni per<br />
progetti di part work e collectable<br />
internazionali, abbiamo iniziato ad<br />
esplorare il flow-pack attraverso<br />
diverse licenze in, creando in<br />
contemporanea anche delle nostre<br />
linee, riunite sotto il brand Magic<br />
Collection.» Racconta Gianluca Aprile<br />
di Cimia, amministratore delegato<br />
della Pea&Promoplast. «Si tratta<br />
di un settore in continua crescita:<br />
basti pensare che un bambino si<br />
reca in un negozio di giocattoli<br />
in occasione mediamente di soli<br />
due eventi: Natale e compleanno.<br />
In Italia, invece, esistono oltre 40<br />
mila rivenditori/edicole frequentate<br />
quotidianamente dagli adulti.<br />
Quindi è più facile che ci vada con i<br />
genitori/nonni o che questi tornino<br />
a casa con un “pensierino”. Per<br />
il 2012 abbiamo già investito su<br />
nuove risorse creative per dare<br />
grande impulso alla divisione<br />
Collectable&Toys, concentrandoci<br />
molto sull’espansione distributiva<br />
all’estero.»<br />
<strong>Kazachok</strong>: Come è iniziata<br />
l’avventura delle licenze in e con<br />
quale property?<br />
Gianluca Aprile: «Per tanti anni<br />
abbiamo supportato la produzione<br />
di prodotti in licenza di altre<br />
aziende, producendo figurine,<br />
bambole, pelouche e prodotti 3D,<br />
fino a quando ci siamo resi conto<br />
che per entrare direttamente sul<br />
mercato editoriale dovevamo avere<br />
una contrattualizzazione diversa.<br />
La prima licenza acquisita è stata<br />
“Justice League” della Warner<br />
Bros, con cui abbiano realizzato<br />
i “Bracciali del potere dei<br />
Pea&Promoplast:<br />

From gifts-in-packs to collectables sold through<br />
retailers and newsagents Pea&Promoplast,<br />
the Italian company from Turin with 30 years of<br />
solid experience behind it, is looking to consolidate<br />
its <strong>market</strong>s abroad<br />
Recently reorganised under one roof, Pea&Promoplast<br />
operates in the promotional and retail/newsagent<br />
publishing sectors. Their promo division has years of<br />
experience working with big brands in the food, toy<br />
and publishing sectors, where they run projects churning<br />
out millions of gifts-in-packs every year.<br />
Their newsagent retail sector is a relatively new<br />
venture: «After 5 years working on part work and<br />
international collectable projects with some of the<br />
major players in the publishing field we started to<br />
explore the flow-pack <strong>market</strong> using licensing, but<br />
creating our own lines at the same time under the<br />
Magic Collection brand.» explains Gianluca Aprile<br />
di Cimia, CEO at Pea&Promoplast. «For 2012 we’ve<br />
already invested in new creative resources to give our<br />
Collectable&Toys division a significant boost, where<br />
we’re really concentrating on expanding our distribution<br />
abroad.»<br />
<strong>Kazachok</strong>: How did you get into licensing and what<br />
was your first property?<br />
Gianluca Aprile: «We’ve been involved in projects<br />
using licensed products for many years on behalf of<br />
other companies, until we realised that if we wanted<br />
to get into the publishing <strong>market</strong> directly we needed<br />
different types of contracts. The first license<br />
we bought was “Justice League”<br />
from Warner Bros, which we used<br />
to make our “Superheroes Power<br />
Bracelets”. We currently have 10<br />
active licenses.<br />
K.: What’s your licensing strategy?<br />
G.A.: «When we choose titles we<br />
mainly go for Disney and Warner<br />
classics and some newer favou-<br />

supereroi”: un’operazione di ottimo<br />
successo della scorsa primavera.<br />
Oggi contiamo oltre 10 licenze attive.<br />
K.: Qual è la vostra strategia di<br />
licensing?<br />
G.A.: «Per la scelta dei titoli<br />
puntiamo sia sui grandi classici<br />
Disney e Warner, sia su quelli più<br />
attuali, come gli ultimi acquisiti,<br />
Love Me Buddies, Inazuma Eleven,<br />
Dragon Ball. Quando dobbiamo<br />
selezionare le properties partiamo<br />
dalla programmazione delle uscite in<br />
edicola che è stata fatta a monte; poi<br />
guardiamo che vi sia equilibrio tra il<br />
numero di licenze a target maschile e<br />
quelle femminili. Un’altra riflessione<br />
che portiamo avanti fin dall’inizio<br />
è di riuscire a dare continuità alle<br />
uscite, stimando tutte le possibili<br />
applicazioni di investimento anche in<br />
brand extension. Per questo abbiamo<br />
creato anche dei nostri collezionabili:<br />
con i marchi come Trendyou o Brutal<br />
Bakteria ci presentiamo in edicola più<br />
volte l’anno e contemporaneamente<br />
in piu paesi.»<br />
K.: Quali vantaggi vi hanno assicurato<br />
le licenze?<br />
G.A.: «Innanzitutto di poter meglio<br />
declinare quello che è il nostro mood<br />
aziendale: noi infatti partiamo con<br />
delle idee, le sviluppiamo, raggiungendo<br />
categorie merceologiche<br />
differenti, promozione,<br />
publishing, supportando<br />
meccaniche di loyalty per la GDO e<br />
petrolifere; solo alla fine chiudiamo<br />
il cerchio con la licenza adatta. Per<br />
noi le licenze sono il mezzo con cui<br />
dare maggior valore a un progetto<br />
promozionale, a un’idea creativa o a<br />
un prodotto fisico.»<br />
K.: E quali difficoltà riscontrate? Se<br />
fosse al posto del suo principale Licensee,<br />
cosa vorrebbe cambiare?<br />
G.A.: «Alcune properties permettono<br />
un buon processo di sviluppo creativo<br />
grazie anche alla collaborazione con<br />
le agenzie di licensing. In altri casi,<br />
soprattutto quando si parla di licenze<br />

il processo di autorizzazione diviene<br />
molto lento e burocratico; questo<br />
spesso non permette di arrivare<br />
sul mercato tempestivamente. Credo<br />
che lo sforzo delle agenzie, visti<br />
i tempi e l’ampia offerta disponibile,<br />
dovrebbe essere quello di selezionare<br />
maggiormente le proposte e le<br />
aziende che investono. Fino ad oggi<br />
c’è sempre stato un rapporto per cui<br />
il minimo garantito era la condizione<br />
negoziale con la quale l’agenzia si<br />
proponeva e sceglieva gli eventuali<br />
investitori. Nel panorama attuale,<br />
bisognerebbe muoversi in modo totalmente<br />

K.: What advantages have licenses given you?<br />
G.A.: «Above all they’ve proved an excellent way of<br />
channelling the company mood. We start with ideas,<br />
then we develop them in various product areas. Choosing<br />
the right license is the last step.»<br />
K.: What difficulties have you come across? If you<br />
were your main Licensee, what would you like to<br />
change?<br />
G.A.: «Some properties ensure a good creative development<br />
process, partly thanks to the contribution<br />
of the licensing agencies. Others, especially licenses<br />
which are big international successes, have a really<br />
slow authorisation process with lots of red tape, which<br />
in turn means we are out on our timing getting the products<br />
to <strong>market</strong>. I think agencies should make more of<br />
an effort to select their proposals and the companies<br />
that invest more rigorously, especially considering the<br />
times and the huge offer on the <strong>market</strong>.»<br />

erano presenti la professoressa Mariateresa<br />
Maggiolino dell’Università<br />
Bocconi e l’avvocato Massimo Maggiore<br />
dello studio legale Maschietto<br />
Maggiore. Attraverso alcuni casi<br />
giurisprudenziali hanno affrontato il<br />
tema che riguarda i rapporti tra licensor<br />
e licensee, nel caso in cui vi<br />
sia un’errata interpretazione sull’uso<br />
di un nome o di una forma ritenuta<br />
libera di essere utilizzata.<br />
Quale diritto, quale uso<br />
Si concede in licenza un’entità che<br />
riscuote successo presso il pubblico<br />
e che, di conseguenza, possiede<br />
“selling power”.<br />
I terzi si servono dell’entità per promuovere<br />
la vendita di beni o servizi<br />
che trovano un uso non affine<br />
all’attività per la quale l’entità<br />
ha acquistato successo. Posto<br />
che può costituire un marchio<br />
qualsiasi segno che possa<br />
essere rappresentato graficamente,<br />
come le parole,<br />
nomi di persone, disegni, lettere,<br />
cifre, suoni, la forma del<br />
prodotto o della confezione,<br />
le combinazioni o le tonalità<br />
cromatiche, non è detto che in<br />
qualunque caso queste entità<br />
vengano tutelate da un diritto;<br />
quindi può anche avverarsi che<br />
vengano utilizzate liberamente<br />
senza che vi sia un contratto di<br />
licenza. Questo può dipendere<br />
sia dal tipo di entità, nonché<br />
dal tipo di uso che il soggetto<br />
vorrà fare di quell’entità.<br />
Di seguito vediamo alcuni casi<br />
pratici dai quali emerge come<br />
l’entità possa essere o meno<br />
tutelata da un diritto di privativa,<br />
o come alcuni usi possano o<br />
meno richiedere una previa autorizzazione<br />
da parte del titolare dell’entità.<br />
Caso Arsenal<br />
Corte di Giustizia Europea – 12 novembre<br />
2002 – Caso C-206/01<br />
I terzi devono sempre ottenere una<br />
licenza dal titolare del marchio,<br />
anche ove intendessero utilizzarlo<br />
come segno di sostegno, fedeltà o<br />
appartenenza?<br />
Il proprietario di un chiosco fuori<br />
dallo stadio dell’Arsenal vendeva<br />
ai tifosi sciarpe e magliette riproducendo<br />
il marchio della squadra,<br />
chiarendo che non veniva utilizzato<br />
dietro licenza. Inoltre, tramite un<br />
cartello, spiegava che, il marchio<br />
non era utilizzato per fini commerciali,<br />
ma per incrementare il sostegno<br />
del pubblico alla squadra.<br />
La Corte ha deciso che aveva torto<br />

and how?<br />
Among the speakers at the 5th <strong>Kazachok</strong> Licensing Forum<br />
were Professor Mariateresa Maggiolino from Milan’s<br />
Bocconi University and lawyer Massimo Maggiore<br />
from the Maschietto Maggiore legal firm. They examined<br />
a number of case studies in the light of relationship<br />
between licensor and licensee when issues arise through<br />
an erroneous interpretation of brand use.<br />
Background<br />
A property is licensed thanks to its public success and<br />
hence selling power. Third parties use the property to<br />
promote sales of goods or services that are not directly<br />
related to the field the property was initially successful<br />
in. Brands, or properties, may be any sign that can be<br />
graphically represented […such as…], words, including<br />
people’s names, patterns and designs, letters, numbers,<br />
sounds, the shape of a product or its packaging,<br />
and colour combinations and shades; however they<br />
may not always be covered by property rights,<br />
in which case they can be freely used without<br />
a licensing contract. This depends on both the<br />
property and its proposed use.<br />

del marchio altrui nel mondo “digitale”,<br />
rispetto a quella riconosciuta<br />
nel mondo “analogico”. È stata considerata<br />
come una manifestazione<br />
di una dinamica concorrenziale del<br />
tutto lecita.<br />
La decisione “Star Wars”<br />
Supreme Court of the United Kingdom,<br />
27 Luglio 2011, n. 39<br />
Il Sig. Ainsworth (l’inventore di questi<br />
costumi di scena ndr) realizzò e<br />
mise in commercio senza alcuna<br />
autorizzazione gli elmetti bianchi<br />
che caratterizzano i personaggi di<br />
Star Wars, film ideato e prodotto da<br />
George Lucas. La Suprema Corte<br />
nega che essi siano riconducibili<br />
alla categoria delle opere d’arte.<br />
Essi hanno una funzione utilitaristica,<br />
rappresentano un elemento nel<br />
processo di “formazione del film”,<br />
e non sono proteggibili dal diritto<br />
d’autore. È il film ad essere un’opera<br />
d’arte, non l’elmetto.<br />

Dior concedeva<br />
in licenza a SIL<br />
il marchio Christian<br />
Dior per<br />
la fabbricazione e la<br />
distribuzione di prodotti di<br />
prestigio di corsetteria. Senza autorizzazione<br />
di Dior, SIL vendeva a<br />
Copad, società attiva nella vendita di<br />
partite in saldo, alcuni prodotti con<br />
marchio Christian Dior.<br />
Dior può invocare i diritti conferiti<br />
dal marchio nei confronti di SIL, poiché<br />
ha violato una clausola del contratto<br />
di licenza con cui si vieta, per<br />
ragioni di prestigio del marchio, la<br />
vendita a rivenditori di partite in saldo<br />
di prodotti (purché si accerti che<br />
tale violazione danneggia lo stile e<br />
l’immagine di prestigio che attribuiscono<br />
ai prodotti un’aura di lusso).<br />

European Court of Justice – 12 November 2002 – Case<br />
C-206/01<br />
The owner of a kiosk outside the Arsenal ground sold<br />
scarves and t-shirts in the team’s colours to fans, clearly<br />
stating that they weren’t produced under official<br />
license. He also displayed a notice explaining that he<br />
had no contract with Arsenal and that the team’s colours<br />
were not being used for commercial purposes<br />
but rather to boost fans’ support for the team.<br />
The Court found against him, holding that although<br />
primary purchasers could read the notice and would<br />
be suitably informed this was not the case with other<br />
consumers, who would assume that the products<br />
were linked directly to the team when they saw them.<br />
The Interflora Case<br />
European Court of Justice – 22 September 2011 – Case<br />
C-323/09<br />
Can you use someone else’s brand as a key word to boost<br />
the visibility of your internet adverts as a company<br />
with similar products and services to their more famous<br />
competitor did?<br />
In this case the Court took a more lenient view of brand<br />
usage in the digital world than they had in its analogical<br />
counterpart. The episode was held to be a manifestation<br />
of dynamic competition and wholly legitimate.<br />
The Star Wars Decision<br />
Supreme Court of the United Kingdom, 27 Julyo 2011, n. 39<br />
Mr Ainsworth (the prop maker for the Star Wars<br />
Stormtroopers) manufactured and sold the Stormtroopers’<br />
famous white helmets from Star Wars, the film<br />
created and produced by George Lucas, without any authorisation<br />
to do so.<br />
The Supreme Court ruled that the helmets could not be<br />
considered works of art, they had a utilitarian function<br />
and represented an element in the film’s creation. They<br />
were thus not protected by author’s rights. The film was<br />
the work of art, not the helmet.<br />
The Dior/ Copad Decision<br />
European Court of Justice – 23 April 2009 – Case C-59/08<br />
Dior had given SIL the license to use the Christian Dior<br />
brand for manufacturing and distributing prestigious<br />
corsetry products. Without prior authorisation from<br />
Dior, SIL sold some of its Christian Dior branded products<br />
to Copad, a company specialising in job lot sales.<br />
In this case Dior was able to assert its licensor rights<br />
because SIL had contravened the clause in the licensing<br />
contract that specifically prohibited the resale<br />
of the branded products to job lot sales companies<br />
for reasons of prestige, inasmuch as it damaged the<br />
style and prestige image that surrounded Dior branded<br />
products with an aura of luxury.<br />
