Die Antragstellerin beantragte unter Bezugnahme auf die Nachl-assakten
7 IV 372/06 und 7 VT 37L/06 die Eintragung eines
Te stament svoll s t reckerve rmerks .
Das Testament, welches die Anordnung der Zwangsvollstreckung beinhaltet,
wurde durch Beschluss des Oberlandesgerichts ZweibrUcken vom 13.11 .2007
(Az.: 3 W l-98l07) im Verfahren fiber die Erteilung des Erbscheins fiir
ungtiltig erkltirt.
Der Erbschein, der zudem fUr die Grundbuchberichtigung, das heiBt die
Eintragung der Erben, maBgeblich ist, beinhaltet somit den Vermerk
"Testamentsvollstreckung ist angeordnet" nicht
Eine erneute Prtifung der Angelegenheit ist nicht erforderlich.
Die Ej-ntragung des Zwangsvolfstreckervermerks kann unter keinen Umstiinden
erfolgen und war daher zurtickzuweisen.

The applicant appiied for the recording of an executor note with reference
to the estate files 1 IV 312106 and 7 VI 31I/06.
The wi11, which lncfudes an order of compulsory execution, was, declared
nulf and void in the proceedings regarding the issuing of the certificate
of inheritance by order of the Oberfandesgericht Zweibrilcken [ZweibrUcken Higher
RegionalCourtl of 11/13/2001 (file reference: 3 W 198/Oj) .
The certificate of inheritance, which is re.l-evant for the correction of the
land register, meaning the recordinq of lnheritors, does not include the
note "execution of w1lf is ordered". A re-examination of the matter is not
necessary.
The recording of the executor note cannot be made under any circumstances
