Approved Estate Agents Policy<br />

In the process of be<strong>co</strong>ming an owner of fixed property<br />

in Fourways Gardens Residential Estate, the owner<br />

automatically be<strong>co</strong>mes a member of the Fourways<br />

Gardens Homeowners Association. The members of the<br />

Homeowners Association must accept, with the transfer<br />

of their property, that the <strong>co</strong>ncept of the Estate imposes<br />

certain restrictions on the manner in which estate<br />

agencies and their agents may operate in the Estate.<br />

Since estate agents are the first line of interaction with<br />

new homeowners/ HOA members, the HOA endeavours<br />

to empower all accredited estate agencies to ensure that<br />

the <strong>co</strong>rrect information is <strong>co</strong>nveyed to new members at<br />

all times. In order to formalise these understandings, an<br />

accreditation procedure is followed and the <strong>co</strong>nditions of<br />

this relationship are embodied in an Approval Agreement.<br />

It is imperative that prospective homeowners and<br />

tenants are made fully aware of the implications of the<br />

<strong>co</strong>mpulsory membership of the Homeowners Association<br />

and the stipulations, rules and regulations attached to this.<br />

Marketing of properties, advertising boards and show houses<br />

must adhere to pre-<strong>co</strong>nditions which approved agents agree<br />

to abide by. The General Manager of the Homeowners<br />

Association will be responsible for executing and monitoring<br />

the Approved Agents Agreement, and in <strong>co</strong>njunction with<br />

the Homeowners Association Communications Committee,<br />

must address any written grievances from either party.<br />

When it <strong>co</strong>mes time to sell the property again, it is the duty<br />

of the Board of Trustees to ensure that residents’ privacy<br />

is protected. However, it is also the right of each owner/<br />

Homeowners Association member to dispose of his/her<br />

property in the Estate, and the Board ofTrustees must ensure<br />

that this right can be executed with as little disturbance as<br />

possible to other home owners. As a result the Estate Agents<br />

Approval Policy, renewable annually, was formulated.<br />

The number of approved estate agencies is not limited, but<br />

the Homeowners Association reserves the right to approve<br />

or disapprove an application for accreditation. Upon signing<br />

the agreement, an accreditation fee be<strong>co</strong>mes payable<br />

by the estate agency. The full Estate Agents Approval<br />

Policy document is available from the Estate Office.<br />
