Goal 1<br />

Move children promptly to permanent families (“a child’s sense of time”)<br />

A major goal of ASFA was to speed a child’s time to permanency. Table 1 explains <strong>the</strong> key provisions<br />

designed to move children promptly to permanent families. The more notable fe<strong>at</strong>ures include <strong>the</strong> requirement<br />

to termin<strong>at</strong>e parental rights if <strong>the</strong> child has been in foster care 15 out of <strong>the</strong> most recent 22 months, <strong>the</strong><br />

authoriz<strong>at</strong>ion of adoption incentive payments, <strong>and</strong> <strong>the</strong> provision th<strong>at</strong> required permanency hearings to be held<br />

within 12 months of <strong>the</strong> child’s entering care, while also intending to elimin<strong>at</strong>e long-term foster care as a<br />

potential permanency goal.<br />

REQUIREMENT TO TERMINATE PARENTAL RIGHTS:<br />

The st<strong>at</strong>e must file a petition to termin<strong>at</strong>e parental rights (TPR) of <strong>the</strong> child’s parents <strong>and</strong> concurrently seek to<br />

find a qualified family to adopt <strong>the</strong> child in three circumstances:<br />

� <strong>the</strong> child has been in foster care for 15 out of <strong>the</strong> most recent 22 months;<br />

� <strong>the</strong> court determines <strong>the</strong> child to be an ab<strong>and</strong>oned infant, as defined by st<strong>at</strong>e law;<br />

� <strong>the</strong> parent has committed murder or voluntary manslaughter of ano<strong>the</strong>r of his or her children;<br />

<strong>at</strong>tempted, conspired, or solicited to commit or aided <strong>and</strong> abetted in <strong>the</strong> murder or voluntary<br />

manslaughter of ano<strong>the</strong>r of his or her children; or committed felony assault th<strong>at</strong> resulted in serious<br />

bodily injury to <strong>the</strong> child or to ano<strong>the</strong>r of <strong>the</strong> parent’s children.<br />

There are three exceptions when this requirement does not apply:<br />

� <strong>the</strong> child is being cared for by a rel<strong>at</strong>ive;<br />

� <strong>the</strong> st<strong>at</strong>e documents a compelling reason th<strong>at</strong> filing for TPR would not be in <strong>the</strong> best interests of <strong>the</strong> child;<br />

� <strong>the</strong> st<strong>at</strong>e has not provided necessary services for <strong>the</strong> safe return of <strong>the</strong> child to <strong>the</strong> child’s home, if<br />

“reasonable efforts” were required.<br />

The Final Rule provided guidance to st<strong>at</strong>es on how to calcul<strong>at</strong>e <strong>the</strong> stipul<strong>at</strong>ed 15 months of foster care <strong>and</strong><br />

gave examples of compelling reasons for not filing a petition to termin<strong>at</strong>e parental rights, including <strong>the</strong> following:<br />

adoption is not <strong>the</strong> appropri<strong>at</strong>e permanency goal; no grounds exist for filing a TPR petition; <strong>the</strong> child is an<br />

unaccompanied refugee minor, <strong>and</strong> <strong>the</strong>re are intern<strong>at</strong>ional legal oblig<strong>at</strong>ions or compelling foreign policy reasons<br />

to preclude TPR. The Final Rule also clarifies th<strong>at</strong> <strong>the</strong>re are no autom<strong>at</strong>ic exceptions for groups of children<br />

but th<strong>at</strong> exceptions must be made on a case-by-case basis.<br />

DOCUMENTATION OF ADOPTION/PERMANENCY EFFORTS:<br />

For children whose permanency plan is adoption or placement in ano<strong>the</strong>r permanent home, st<strong>at</strong>es must document<br />

in <strong>the</strong> case plan <strong>the</strong> steps being taken to secure this arrangement as part of <strong>the</strong>ir reasonable efforts<br />

toward permanency. The legisl<strong>at</strong>ion specified th<strong>at</strong> <strong>at</strong> a minimum, document<strong>at</strong>ion should give evidence of<br />

child-specific recruitment efforts such as use of st<strong>at</strong>e, regional, <strong>and</strong> n<strong>at</strong>ional adoption exchanges.<br />

ADOPTION INCENTIVE PAYMENTS:<br />

The legisl<strong>at</strong>ion authorized incentive payments to st<strong>at</strong>es th<strong>at</strong> increased adoptions from foster care, rel<strong>at</strong>ive to a<br />

baseline number of adoptions. The baseline for each st<strong>at</strong>e in 1998 was calcul<strong>at</strong>ed as <strong>the</strong> average of a st<strong>at</strong>e’s<br />

finalized adoptions for 1995, 1996, <strong>and</strong> 1997. For subsequent years, <strong>the</strong> baseline is <strong>the</strong> gre<strong>at</strong>est number of<br />

adoptions in any fiscal year from 1997 on. St<strong>at</strong>es were eligible to receive $4,000 for each child adopted from<br />

foster care above <strong>the</strong> foster care adoptions baseline <strong>and</strong> $6,000 for each special needs child adopted above<br />

<strong>the</strong> special needs adoptions baseline. To qualify for <strong>the</strong> l<strong>at</strong>ter disbursement, st<strong>at</strong>es must provide health insurance<br />

coverage of special needs children for which <strong>the</strong>y have an adoption assistance agreement with <strong>the</strong><br />

adoptive parents.
