This checklist details the documents required to accomp<strong>an</strong>y the lodgement of your application. Supplying these with<br />
your application will allow the Vict<strong>or</strong>i<strong>an</strong> Commission f<strong>or</strong> Gambling <strong>an</strong>d Liqu<strong>or</strong> Regulation (<strong>VCGLR</strong>) to commence<br />
assessment of the application <strong>an</strong>d c<strong>an</strong> reduce processing time. Your application may be returned if the accomp<strong>an</strong>ying<br />
documents do not meet the requirements below.<br />
The <strong>VCGLR</strong> may contact applic<strong>an</strong>ts to request additional documentation depending on the circumst<strong>an</strong>ces of their business.<br />

Questionnaire<br />
Each person listed on the application, including <strong>an</strong>y nominee, must complete <strong>an</strong>d submit the ‘Liqu<strong>or</strong><br />
licensing questionnaire.’ F<strong>or</strong> comp<strong>an</strong>ies, partnerships <strong>or</strong> clubs, questionnaires are required from each<br />
direct<strong>or</strong>, partner <strong>or</strong> executive committee member respectively.<br />
New entr<strong>an</strong>t training (if applicable)<br />
A copy of <strong>an</strong> approved new entr<strong>an</strong>t training certificate f<strong>or</strong> all required persons is needed in <strong>or</strong>der<br />
to determine the application, as detailed in the ‘Training f<strong>or</strong> <strong>licence</strong> applic<strong>an</strong>ts’ fact sheet.<br />
Responsible Service of Alcohol (RSA) training<br />
A copy of <strong>an</strong> approved RSA certificate f<strong>or</strong> all required persons is needed in <strong>or</strong>der to determine<br />
the application, as detailed in the ‘Training f<strong>or</strong> <strong>licence</strong> applic<strong>an</strong>ts’ fact sheet.<br />
Maximum patron capacity<br />
Patron capacity is the maximum number of patrons allowed on the licensed premises at <strong>an</strong>y one time.<br />
The following documents will need to be attached f<strong>or</strong> the Commission to determine maximum patron capacity:<br />
A rep<strong>or</strong>t from a registered building survey<strong>or</strong> showing patron capacity calculations as outlined in the<br />
‘Maximum patron capacity’ fact sheet.<br />
A copy of the occup<strong>an</strong>cy <strong>permit</strong> prescribing the patron capacity. If this <strong>permit</strong> c<strong>an</strong>not be supplied,<br />
then the rep<strong>or</strong>t from the building survey<strong>or</strong> must also include patron calculations on the same basis as per<br />
<strong>an</strong> occup<strong>an</strong>cy <strong>permit</strong> under the Building Act 1993.<br />
If available, a copy of the most recently issued pl<strong>an</strong>ning <strong>permit</strong> f<strong>or</strong> the premises which specifies<br />
the maximum patron capacity that is allowed.<br />

A business name certificate is required if <strong>an</strong> individual <strong>or</strong> partnership is applying f<strong>or</strong> a liqu<strong>or</strong> <strong>licence</strong>, <strong>or</strong> if the<br />

Approved training f<strong>or</strong> <strong>licence</strong> applic<strong>an</strong>ts. Please refer to the ‘Training f<strong>or</strong> <strong>licence</strong> applic<strong>an</strong>ts’ fact sheet. Following the<br />
completion of new entr<strong>an</strong>t training <strong>an</strong>d Responsible Service of Alcohol (RSA) training, evidence of completion is to be provided<br />
to the Commission.<br />
A pl<strong>an</strong> <strong>or</strong> drawing of the premises . If the <strong>existing</strong> approved pl<strong>an</strong> of the licensed premises held by Vict<strong>or</strong>i<strong>an</strong> Commission f<strong>or</strong><br />
Gambling <strong>an</strong>d Liqu<strong>or</strong> Regulation does not accurately depict the flo<strong>or</strong> layout of the premises, you must submit a pl<strong>an</strong> which<br />
meets the requirements specified by the Commission. Please refer to the 'Pl<strong>an</strong>s of licensed premises' fact sheet.<br />
If you intend to increase the size of the licensed area from what the Commission has auth<strong>or</strong>ised under <strong>an</strong> <strong>existing</strong> approved<br />
pl<strong>an</strong>, then you will also need to complete <strong>an</strong> application f<strong>or</strong> variation to <strong>an</strong> <strong>existing</strong> <strong>licence</strong> <strong>or</strong> <strong>permit</strong> f<strong>or</strong>m.<br />
A letter confirming that settlement has occurred must be provided bef<strong>or</strong>e the <strong>licence</strong> <strong>or</strong> <strong>permit</strong> is issued. The proposed new<br />
licensee <strong>or</strong> <strong>permit</strong>tee c<strong>an</strong>not trade until such time as their name appears as licensee <strong>or</strong> <strong>permit</strong>tee on the <strong>licence</strong> <strong>or</strong> <strong>permit</strong>.<br />
If you wish to ch<strong>an</strong>ge the trading hours/conditions of the <strong>licence</strong>, you will also need to complete <strong>an</strong> application f<strong>or</strong> variation<br />
to <strong>an</strong> <strong>existing</strong> <strong>licence</strong> <strong>or</strong> <strong>permit</strong> f<strong>or</strong>m. You c<strong>an</strong> lodge the variation application at the same time as lodging this tr<strong>an</strong>sfer f<strong>or</strong>m.<br />
Maximum patron capacity (if applicable)<br />
If you are applying to tr<strong>an</strong>sfer a general, on-premises, late night general, late night on-premises, restaur<strong>an</strong>t <strong>an</strong>d cafe <strong>or</strong> full club<br />
<strong>licence</strong> which does not have a maximum patron capacity end<strong>or</strong>sed you must provide the following documents to assist the<br />
Commission in determining a maximum patron capacity:<br />
• a rep<strong>or</strong>t from a registered building survey<strong>or</strong> stating:<br />
- the area in square metres available to the public f<strong>or</strong> the whole of the internal premises (excluding toilets, passageways<br />
<strong>an</strong>d the like) <strong>an</strong>d (if applicable) f<strong>or</strong> <strong>an</strong>y external areas such as courtyards <strong>or</strong> decks, <strong>an</strong>d<br />
- the number of patrons that may be accommodated on the internal premises <strong>an</strong>d (if applicable) on <strong>an</strong>y external areas of<br />
the premises based on a ratio of 0.75 square metres per person. The basis of the calculations must be included in the<br />
rep<strong>or</strong>t.<br />
• <strong>an</strong> occup<strong>an</strong>cy <strong>permit</strong> showing a prescribed patron capacity. If <strong>an</strong> occup<strong>an</strong>cy <strong>permit</strong> c<strong>an</strong>not be supplied, then the rep<strong>or</strong>t from<br />
the building survey<strong>or</strong> must also include patron calculations on the same basis as <strong>an</strong> occup<strong>an</strong>cy <strong>permit</strong> under the Building Act<br />
1993, <strong>an</strong>d<br />
• if available, a copy of the most recently issued pl<strong>an</strong>ning <strong>permit</strong> f<strong>or</strong> the premises which specifies the maximum patron<br />
capacity that is allowed.<br />
Note: Please ensure that the building survey<strong>or</strong> registration number is displayed on the rep<strong>or</strong>t.<br />

• The application fee must be paid at the time of application. There is no GST payable on this fee.<br />

What happens next<br />
You will be sent a letter that confirms we have received your application <strong>an</strong>d outlines <strong>an</strong>y further inf<strong>or</strong>mation required. Once we have<br />
received all the required inf<strong>or</strong>mation <strong>an</strong>d documents, your application will be determined. You will be advised of the outcome in writing.<br />

An associate of <strong>an</strong> applic<strong>an</strong>t is:<br />
(a) a person who:<br />
(i) holds <strong>or</strong> will hold <strong>an</strong>y relev<strong>an</strong>t fin<strong>an</strong>cial interest,<br />

Training f<strong>or</strong> <strong>licence</strong> applic<strong>an</strong>ts is one way<br />
licensees c<strong>an</strong> underst<strong>an</strong>d their obligations under<br />
the Liqu<strong>or</strong> Control Ref<strong>or</strong>m Act 1998. Certain<br />
<strong>licence</strong> applic<strong>an</strong>ts must complete specific<br />
training requirements bef<strong>or</strong>e a <strong>licence</strong><br />
is gr<strong>an</strong>ted.<br />
There are two courses that applic<strong>an</strong>ts<br />
may be required to complete, new entr<strong>an</strong>t<br />
training <strong>an</strong>d Responsible Service of Alcohol.<br />
It is the applic<strong>an</strong>t’s responsibility to ensure<br />
the c<strong>or</strong>rect course is completed. There are<br />
different requirements f<strong>or</strong> applic<strong>an</strong>ts that<br />
are a body c<strong>or</strong>p<strong>or</strong>ate <strong>or</strong> natural persons.<br />
New entr<strong>an</strong>t training<br />
New entr<strong>an</strong>t training is a training st<strong>an</strong>dard<br />
developed by the Vict<strong>or</strong>i<strong>an</strong> Commission f<strong>or</strong><br />
Gambling <strong>an</strong>d Liqu<strong>or</strong> Regulation (<strong>VCGLR</strong>)<br />
to ensure that applic<strong>an</strong>ts have <strong>an</strong> adequate<br />
knowledge of the liqu<strong>or</strong> law, including:<br />
• the legislative environment f<strong>or</strong> liqu<strong>or</strong> licensees<br />
• underst<strong>an</strong>ding liqu<strong>or</strong> <strong>licence</strong>s<br />
• best practice in m<strong>an</strong>aging licensed premises.<br />
Section 44 (2)(iii) of the Liqu<strong>or</strong> Control Ref<strong>or</strong>m<br />
Act 1998 (the Act) provides that the <strong>VCGLR</strong> may<br />
refuse to gr<strong>an</strong>t <strong>an</strong> application if the applic<strong>an</strong>t <strong>or</strong><br />
tr<strong>an</strong>sferee does not have <strong>an</strong> adequate knowledge<br />
of the Act.<br />
The completion of one of the following approved<br />
training courses constitutes completing new<br />
entr<strong>an</strong>t training:<br />
• Licensees’ First Step<br />
• Licensee Compli<strong>an</strong>ce Certificate <strong>or</strong><br />
• Club Seminar (restricted club <strong>or</strong> renewable<br />
limited club <strong>licence</strong> applic<strong>an</strong>ts only).<br />
• Evidence of completing the course must be<br />
provided to the <strong>VCGLR</strong> pri<strong>or</strong> to a <strong>licence</strong> being<br />
gr<strong>an</strong>ted, tr<strong>an</strong>sferred <strong>or</strong> end<strong>or</strong>sed.<br />

• partnerships – all partners<br />
• comp<strong>an</strong>y (body c<strong>or</strong>p<strong>or</strong>ate) – at least one<br />
direct<strong>or</strong><br />
• club – at least one committee member<br />
• association – at least one committee member.<br />
In addition:<br />
• all applic<strong>an</strong>ts f<strong>or</strong> appointment as a nominee<br />
must complete new entr<strong>an</strong>t training
Vict<strong>or</strong>i<strong>an</strong> Commission f<strong>or</strong> Gambling <strong>an</strong>d Liqu<strong>or</strong> Regulation<br />
• all applic<strong>an</strong>ts seeking approval to sublet <strong>an</strong>y<br />
part of the licensed premises, <strong>or</strong> to carry on<br />
the business of supplying liqu<strong>or</strong> on the licensed<br />
premises, must complete new entr<strong>an</strong>t training.<br />
If applic<strong>an</strong>ts have already undertaken <strong>an</strong><br />
approved new entr<strong>an</strong>t training course, a copy<br />
of the training certificate will be considered as<br />
evidence of completion.<br />
Responsible Service of Alcohol (RSA)<br />
training<br />
RSA training is one imp<strong>or</strong>t<strong>an</strong>t component of a<br />
venue’s risk m<strong>an</strong>agement strategy to reduce <strong>an</strong>d<br />
minimise alcohol-related harm. This training<br />
provides licensees <strong>an</strong>d staff who w<strong>or</strong>k in licensed<br />
venues with the skills to m<strong>an</strong>age their legal<br />
obligations as well as promoting responsible<br />
consumption of alcohol.<br />
Which <strong>licence</strong> applications require<br />
proof of RSA training?<br />

inc<strong>or</strong>p<strong>or</strong>ated association, <strong>or</strong> Council – the<br />
person who is <strong>or</strong> will be in m<strong>an</strong>agement <strong>an</strong>d<br />
control of the licensed premises must complete<br />
<strong>an</strong> approved RSA training program.<br />
Note: Applic<strong>an</strong>ts must advise the <strong>VCGLR</strong> of the<br />
name of the person who m<strong>an</strong>ages <strong>or</strong> will m<strong>an</strong>age<br />
the day-to-day operations of the business on the<br />
application f<strong>or</strong>m.<br />
RSA training requirements<br />
The approved RSA training program must have<br />
been completed within the past three years. If a<br />
person has completed <strong>an</strong> approved RSA training<br />
program m<strong>or</strong>e th<strong>an</strong> three years ago that person<br />
is required to complete the RSA online refresher<br />
course that c<strong>an</strong> be found at www.vcglr.vic.gov.au.<br />
Evidence of completing <strong>an</strong> approved RSA training<br />
course <strong>an</strong>d the RSA online refresher course (if<br />
required) must be provided to the <strong>VCGLR</strong> pri<strong>or</strong><br />
to the gr<strong>an</strong>t of a <strong>licence</strong>.<br />
If you attach the evidence with the application on<br />
submission, it will allow the <strong>VCGLR</strong> to commence<br />
assessment of the application <strong>an</strong>d will reduce<br />
processing time.<br />
RSA exemptions<br />
If <strong>an</strong> applic<strong>an</strong>t f<strong>or</strong> general, on-premises, packaged<br />
liqu<strong>or</strong> <strong>an</strong>d late night (general, on-premises <strong>an</strong>d<br />
packaged) <strong>licence</strong>s seek to be exempt from one <strong>or</strong><br />
all of the RSA training provisions they are required to<br />
complete the ‘Application f<strong>or</strong> the exemption from the<br />
Responsible Service of Alcohol training requirements’<br />
f<strong>or</strong>m available at www.vcglr.vic.gov.au.<br />
All other <strong>licence</strong> applic<strong>an</strong>ts are required to write<br />
a letter to the <strong>VCGLR</strong> detailing their reasons<br />
f<strong>or</strong> seeking <strong>an</strong> exemption from completing RSA<br />
training bef<strong>or</strong>e the <strong>licence</strong> is gr<strong>an</strong>ted. There are no<br />
m<strong>an</strong>dat<strong>or</strong>y RSA training requirements f<strong>or</strong> staff of<br />
these <strong>licence</strong>s, however the <strong>VCGLR</strong> has discretion<br />
to impose <strong>licence</strong> conditions relating to RSA<br />
training f<strong>or</strong> staff.<br />
Registered Training Org<strong>an</strong>isations<br />
There are a number of training <strong>or</strong>g<strong>an</strong>isations that<br />
provide new entr<strong>an</strong>t training <strong>an</strong>d/<strong>or</strong> RSA training.<br />

Why do I need to submit four copies<br />
of the pl<strong>an</strong>?<br />
Four copies are required to enable:<br />
• a copy to be end<strong>or</strong>sed as <strong>an</strong> approved pl<strong>an</strong><br />
<strong>an</strong>d retained by the <strong>VCGLR</strong><br />
• a copy to be provided to Vict<strong>or</strong>ia Police as part<br />
of the application process<br />
• a copy to be provided to the relev<strong>an</strong>t local<br />
council as part of the application process<br />
• <strong>an</strong> approved copy to be provided to the<br />
applic<strong>an</strong>t on the gr<strong>an</strong>t of <strong>an</strong> application.<br />

In addition to the above, section 101A of the<br />
Liqu<strong>or</strong> Control Ref<strong>or</strong>m Act 1998 provides that the<br />
<strong>VCGLR</strong> may at <strong>an</strong>y time request that a licensee<br />
submit a current pl<strong>an</strong> of a licensed premise.<br />
What f<strong>or</strong>m should a pl<strong>an</strong> take?<br />
The <strong>VCGLR</strong> has specified that a pl<strong>an</strong> must contain<br />
the following elements:<br />
• be on suitably sized paper, minimum A4 size<br />
(graph paper is not acceptable)<br />
• be drawn in ink <strong>an</strong>d be neat <strong>an</strong>d legible<br />
• show the flo<strong>or</strong> pl<strong>an</strong>(s) of the owned <strong>or</strong> leased<br />
property<br />
• outline in red the boundaries of the proposed<br />
area to be licensed<br />
• if the proposed area does not follow a physical<br />
barrier (such as a wall), describe what is being<br />
used to separate the area<br />
• show clear <strong>an</strong>d consistent measurements<br />
on the pl<strong>an</strong><br />
• include the address of the premises<br />
• include a compass point showing n<strong>or</strong>th <strong>an</strong>d<br />
names of the surrounding streets<br />
• show basic functions <strong>or</strong> fixtures, f<strong>or</strong> example,<br />
bar <strong>an</strong>d dining area/kitchen area <strong>or</strong> in the case<br />
of a packaged liqu<strong>or</strong> outlet, shelf areas where<br />
alcohol is displayed <strong>an</strong>d the cash register is<br />
located<br />
• if applying f<strong>or</strong> kerbside trading, identify the area<br />
to be licensed <strong>an</strong>d separately outlined this area<br />
in red on the pl<strong>an</strong>.
Vict<strong>or</strong>i<strong>an</strong> Commission f<strong>or</strong> Gambling <strong>an</strong>d Liqu<strong>or</strong> Regulation<br />
A pl<strong>an</strong> should be drawn to a suitable scale so<br />
that all elements above are clearly identified.<br />
A suggested scale is 1:100 (1cm = 1m).<br />
Where a proposed licensed area includes large<br />
outdo<strong>or</strong> spaces, a separate site pl<strong>an</strong> must be<br />
provided that shows:<br />
• the entire site including internal <strong>an</strong>d external<br />
areas drawn to a suitable scale<br />
• outline in red the proposed area that is to be<br />
licensed<br />
• clear descriptions of how the proposed outdo<strong>or</strong><br />
area will be distinguished (f<strong>or</strong> example, fence,<br />
p<strong>or</strong>table barriers, warning signs).<br />
If the pl<strong>an</strong> does not meet these requirements,<br />
the applic<strong>an</strong>t will be required to resubmit<br />
the pl<strong>an</strong>.<br />

What am I required to do with my<br />

A copy of the approved pl<strong>an</strong> must be kept on<br />
the licensed premises <strong>an</strong>d must be available f<strong>or</strong><br />
inspection on request by a member of Vict<strong>or</strong>ia<br />
Police <strong>or</strong> a Compli<strong>an</strong>ce Inspect<strong>or</strong>.<br />
Failure to keep a copy of the pl<strong>an</strong> on the licensed<br />
premises <strong>or</strong> produce a copy of the pl<strong>an</strong> f<strong>or</strong><br />
inspection could result in a fine being issued.<br />
Where c<strong>an</strong> I get a copy of my<br />
approved pl<strong>an</strong>?<br />
If you do not have a copy of your approved pl<strong>an</strong>,<br />
you will need to purchase a copy from the <strong>VCGLR</strong>.<br />

Maximum patron capacity<br />
The Vict<strong>or</strong>i<strong>an</strong> Commission f<strong>or</strong> Liqour <strong>an</strong>d<br />
Gambling Regulation (<strong>VCGLR</strong>) has a maximum<br />
patron capacity policy that guides how patron<br />
capacity is determined f<strong>or</strong> a liqu<strong>or</strong> <strong>licence</strong>.<br />
Maximum patron capacity is the maximum<br />
number of patrons allowed on a licensed premises<br />
at <strong>an</strong>y one time. This is to prevent overcrowding<br />
inside the venue <strong>an</strong>d to minimise impacts on local<br />
amenity. Patron capacity may be used to calculate<br />
the <strong>an</strong>nual <strong>licence</strong> fee payable by each licensee.<br />
Applic<strong>an</strong>ts will be required to provide specific<br />
documentation in <strong>or</strong>der f<strong>or</strong> the <strong>VCGLR</strong> to<br />
determine <strong>an</strong>d end<strong>or</strong>se maximum patron capacity<br />
f<strong>or</strong> a premises.<br />
Under the Liqu<strong>or</strong> Control Ref<strong>or</strong>m Act 1998 the<br />
<strong>VCGLR</strong> c<strong>an</strong> set a maximum patron capacity as a<br />
condition of a liqu<strong>or</strong> <strong>licence</strong>. This is enf<strong>or</strong>ceable,<br />
<strong>an</strong>d penalties apply f<strong>or</strong> licensees who do not<br />
comply.<br />
Which <strong>licence</strong>s have a maximum<br />
patron capacity?<br />
Maximum patron capacity will be end<strong>or</strong>sed in<br />
respect of applications f<strong>or</strong> the following new<br />
<strong>licence</strong>s:<br />
• general<br />
• on-premises<br />
• restaur<strong>an</strong>t <strong>an</strong>d cafe<br />
• late night (on-premises <strong>an</strong>d general)<br />
• full club<br />
• restricted club.<br />
Some <strong>existing</strong> <strong>licence</strong>s may also be end<strong>or</strong>sed with<br />
maximum patron capacities.<br />
Maximum patron capacities may also be required<br />
on some maj<strong>or</strong> event <strong>licence</strong>s where appropriate.<br />
What documents need to be<br />
provided?<br />
Three documents are required in <strong>or</strong>der to<br />
determine the maximum patron capacity:<br />

1) The maximum patron capacity allowed under<br />
the pl<strong>an</strong>ning <strong>permit</strong>.<br />
2) A rep<strong>or</strong>t from a registered building survey<strong>or</strong> that<br />
states:<br />
• the area in square metres available to the<br />
public f<strong>or</strong> the whole of the internal premises<br />
(excluding toilets, passageways <strong>an</strong>d the like)<br />
<strong>an</strong>d (if applicable) f<strong>or</strong> <strong>an</strong>y external areas such<br />
as courtyards <strong>or</strong> decks, <strong>an</strong>d<br />
• the number of patrons that may be<br />
accommodated on the internal premises <strong>an</strong>d<br />
(if applicable) on <strong>an</strong>y external areas of the<br />
premises based on a ratio of 0.75 square<br />
metres per person. The basis of the calculations<br />
must be included in the rep<strong>or</strong>t.<br />
3) The patron capacity prescribed on <strong>an</strong><br />
occup<strong>an</strong>cy <strong>permit</strong>. If this <strong>permit</strong> c<strong>an</strong>not be<br />
supplied, then the rep<strong>or</strong>t from the building<br />
survey<strong>or</strong> must also include patron calculations<br />
on the same basis as per <strong>an</strong> occup<strong>an</strong>cy <strong>permit</strong><br />
under the Building Act 1993.<br />
Note: Please ensure that the building survey<strong>or</strong><br />
registration number is displayed<br />
on the rep<strong>or</strong>t.<br />
Why are three calculations<br />
required?<br />
Patron capacity as calculated on the registered<br />
building survey<strong>or</strong>’s rep<strong>or</strong>t, the pl<strong>an</strong>ning <strong>permit</strong><br />
<strong>an</strong>d the occup<strong>an</strong>cy <strong>permit</strong>, may differ, as each is<br />
determined acc<strong>or</strong>ding to different criteria <strong>an</strong>d f<strong>or</strong><br />
different purposes.
Vict<strong>or</strong>i<strong>an</strong> Commission f<strong>or</strong> Gambling <strong>an</strong>d Liqu<strong>or</strong> Regulation<br />
F<strong>or</strong> example, the occup<strong>an</strong>cy <strong>permit</strong> calculates<br />
patron capacity based on the facilities <strong>an</strong>d<br />
structural features of the building, whereas the<br />
pl<strong>an</strong>ning <strong>permit</strong> bases its calculations on broader<br />
amenity issues.<br />
By having access to all available calculations, the<br />
<strong>VCGLR</strong> c<strong>an</strong> make <strong>an</strong> inf<strong>or</strong>med decision on the<br />
most appropriate maximum patron capacity.<br />
The maximum capacity will generally be<br />
determined based on the lowest of the three<br />
documents provided, however the <strong>VCGLR</strong> may<br />
prescribe a lower patron capacity if required<br />
to address amenity <strong>or</strong> other concerns.<br />
Restaur<strong>an</strong>t <strong>an</strong>d cafe <strong>licence</strong>s<br />
F<strong>or</strong> restaur<strong>an</strong>t <strong>an</strong>d cafe <strong>licence</strong>s, tables <strong>an</strong>d<br />
chairs must be available f<strong>or</strong> at least 75 per cent<br />
of patrons. F<strong>or</strong> example, if the <strong>licence</strong> states that<br />
maximum patron capacity is 100 patrons then<br />
there must be tables <strong>an</strong>d chairs available f<strong>or</strong> at<br />
least 75 patrons. Likewise, if there are tables <strong>an</strong>d<br />
chairs available f<strong>or</strong> only 50 patrons, a maximum<br />
of 66 patrons may be legally accommodated on<br />
the premises.<br />
Applic<strong>an</strong>ts f<strong>or</strong> restaur<strong>an</strong>t <strong>an</strong>d cafe <strong>licence</strong>s where<br />
the submitted pl<strong>an</strong>ning <strong>permit</strong> <strong>an</strong>d/<strong>or</strong> occup<strong>an</strong>cy<br />
<strong>permit</strong> specifies 50 patrons <strong>or</strong> less, will be<br />
exempted from the need to obtain a rep<strong>or</strong>t from<br />
a registered building survey<strong>or</strong>. In these inst<strong>an</strong>ces,<br />
the <strong>VCGLR</strong> will determine the maximum patron<br />
capacity based solely on the pl<strong>an</strong>ning <strong>permit</strong> <strong>an</strong>d/<br />
<strong>or</strong> occup<strong>an</strong>cy <strong>permit</strong>.<br />
External areas<br />
The overall maximum patron capacity f<strong>or</strong> a<br />
licensed area is generally no larger th<strong>an</strong> the<br />
maximum capacity allowed f<strong>or</strong> the internal area<br />
of the premises.<br />
This is to prevent overcrowding, s<strong>an</strong>itation <strong>an</strong>d fire<br />
safety risks associated with patrons moving from<br />
outdo<strong>or</strong> to indo<strong>or</strong> areas, f<strong>or</strong> example, to get a<br />
drink, to exit the premises <strong>or</strong> if it rains.<br />
In some circumst<strong>an</strong>ces, the <strong>VCGLR</strong> may consider<br />
increasing the overall maximum patron capacity<br />
to allow f<strong>or</strong> external areas.<br />
Applic<strong>an</strong>ts with external licensed areas who<br />
wish to apply f<strong>or</strong> this increase are encouraged<br />
to submit supp<strong>or</strong>ting inf<strong>or</strong>mation to the <strong>VCGLR</strong>,<br />
demonstrating that fire safety <strong>an</strong>d s<strong>an</strong>itation<br />
arr<strong>an</strong>gements f<strong>or</strong> the additional patrons will<br />
meet requirements specified under the Building<br />
Code of Australia.<br />
Features of <strong>an</strong> external area that may supp<strong>or</strong>t <strong>an</strong><br />
increase to the overall maximum patron capacity<br />
include:<br />
• <strong>an</strong> external area that is large compared to the<br />
internal area, such as a large beer garden<br />
• effective weather proofing<br />
• separate entr<strong>an</strong>ces <strong>an</strong>d exits<br />
• separate facilities such as bars <strong>an</strong>d toilets.<br />
Function <strong>an</strong>d accommodation areas<br />
Function <strong>an</strong>d accommodation areas may be<br />
excluded from the overall maximum patron<br />
capacity, <strong>an</strong>d may be given their own separate<br />
capacity limits.<br />
Patron capacity f<strong>or</strong> specific areas<br />
In addition to the overall maximum patron<br />
capacity f<strong>or</strong> the licensed area, the <strong>VCGLR</strong> may set<br />
separate patron capacities on specific areas within<br />
a licensed area, such as:<br />
• balconies<br />
• terraces <strong>an</strong>d courtyards<br />
• beer gardens.<br />
Patron capacities allocated f<strong>or</strong> specific areas are<br />
calculated in acc<strong>or</strong>d<strong>an</strong>ce with the methods listed<br />
above, as well as amenity considerations.<br />
While the <strong>VCGLR</strong> considers amenity as part of<br />
the patron number calculation, the relev<strong>an</strong>t local<br />
council also retains responsibility f<strong>or</strong> m<strong>an</strong>aging<br />
issues of amenity in each council region.<br />
How do capacities on a liqu<strong>or</strong><br />
<strong>licence</strong> relate to other patron limits?<br />
The <strong>VCGLR</strong> will make every eff<strong>or</strong>t to ensure<br />
that the patron capacities on a liqu<strong>or</strong> <strong>licence</strong><br />
are consistent with the limits prescribed by the<br />
pl<strong>an</strong>ning <strong>an</strong>d occup<strong>an</strong>cy <strong>permit</strong>s. However, the<br />
building owner is responsible f<strong>or</strong> ensuring that<br />
building occup<strong>an</strong>ts comply with all regulat<strong>or</strong>y<br />
<strong>an</strong>d other requirements.<br />
