1. WHO CAN APPLY TO THE <strong>IRU</strong> ACADEMY CPC DRIVER<br />

PROGRAMME?<br />

The CPC Driver Programme is open to any organisation with qualified CPC<br />

Driver instructors that wants to offer internationally recognised, high-quality<br />

CPC Driver training.<br />

The organisations that can apply under the CPC Driver Programme include<br />

(this list is not exhaustive):<br />

1) Road Transport Associations;<br />

2) Vocational Training Schools;<br />

3) Training Institutes;<br />

4) Universities;<br />

5) Road Transport Operators.<br />

2. HOW TO APPLY TO BECOME PART OF THE INTERNATIONAL<br />

NETWORK OF <strong>IRU</strong> ACADEMY ACCREDITED TRAINING<br />

INSTITUTES?<br />

To become a Member of the International Network of the <strong>IRU</strong> Academy<br />

Accredited Training Institutes you must submit an application.<br />

The following pages list the elements which must be included in your<br />

application. All information must be submitted in English only!<br />

The <strong>IRU</strong> Academy will only process applications which are duly<br />

completed.<br />

3. TWO SIMPLE APPLICATION STEPS<br />

To apply to become an <strong>IRU</strong> Academy Accredited Training Institute for the<br />

Course on “Initial Qualifications of Professional Drivers”, you must:<br />

TRANSFER THE APPLICATION FEE<br />

Application Fee<br />

Your Institute must transfer the applicable Application Fee as per the<br />

information provided in Table 1 of this booklet (see Section 6 &<br />

Appendix 4).<br />

The <strong>IRU</strong> Academy will not process Applications for which the<br />

Application Fee has not been received.<br />

SUBMIT YOUR INSTITUTE’S DULY COMPLETED APPLICATION<br />

The documents needed to make your application duly complete are:<br />

CPC DRIVER ATI Letter of Intent and Copy of Bank Transfer<br />

A “Letter of Intent” (See Appendix 3), showing your interest to join the CPC<br />

Driver Programme, with a Copy of the Application Fee Bank Transfer<br />

enclosed, must be sent to the <strong>IRU</strong> Academy.<br />

ATI Application Check List<br />

Your Institute must tick the appropriate boxes on the “Application Check<br />

List” (See Appendix 2).<br />

ATI Application Form<br />

Your Institute must duly complete and return the “ATI Application Form”<br />

(See Appendix 4).<br />

The information provided will appear on the <strong>IRU</strong> Academy Web Site<br />

through “<strong>IRU</strong> Academy Online”.<br />

Please do NOT submit an individual form for each branch!<br />

ADR ATI Branches Listing Form<br />

Your Institute’s ATI branches will benefit from your <strong>accreditation</strong>, including<br />

in the use of “<strong>IRU</strong> Academy Online”.<br />

The only requirement is for your Institute to list each of those branches<br />

using the enclosed “ATI Branches Listing Form” (See Appendix 5), which<br />

must be duly completed, if applicable, and submitted with your Institute's<br />

application.<br />

ATI Questions on Quality Processes<br />

Your Institute must submit the duly completed answers to the “Quality<br />

Control Questions” for your Institute (See Appendix 6).<br />

Instructors Data & Questions<br />

Your Institute must list all Instructors that will conduct <strong>IRU</strong> Academy CPC<br />

Driver Accredited Classes, including those of your branches, using the<br />

“Instructors Data & Questions” Form (See Appendix 7).<br />

Only those Instructors listed will be permitted to teach the Classes for<br />

which your Institute is accredited!<br />

ATI Agreement<br />

Your Institute must submit the duly completed and signed<br />

“<strong>IRU</strong> Academy ATI Agreement” and its Annex A (See Appendix 8).<br />

Important! In case of doubt, contact the <strong>IRU</strong> Academy at <strong>academy</strong>@iru.org<br />

to complete Annex A of the “<strong>IRU</strong> Academy ATI Agreement”.<br />

National Certificate of Approval as a CPC DRIVER Institute<br />

Upon signing the <strong>IRU</strong> Academy ATI Agreement, your Institute certifies to be<br />

in possession of a national (regional) CPC Driver training institute approval<br />

document.<br />

Documentation per Instructor<br />

Upon signing the <strong>IRU</strong> Academy ATI Agreement, your Institute certifies that<br />

its Instructors, including those of your branches, meet the strict <strong>IRU</strong><br />

Academy quality criteria and is able, upon request, to provide for each<br />

instructor at least one of the documents listed under each of the 3 bullets<br />

printed below:<br />

(1) Proof of Subject Knowledge:<br />

A proof of academic background,<br />

A valid certificate of approval to instruct CPC Driver courses<br />

issued by the competent national (Regional) Official<br />

Authority or,<br />

An attestation (statement) by your Institute's General<br />

Manager confirming for each CPC Driver Instructor their<br />

subject knowledge,<br />

(2) Proof of Working Experience:<br />

At least one letter by an employer (former or current) stating<br />

that he / she has working experience in dealing with “Initial<br />

Qualifications of Professional Drivers”, indicating for how<br />

long he / she performed this task.<br />

(3) Proof of Teaching Experience:<br />

A proof of academic background,<br />

A letter from a training provider for which he/she works or<br />

worked, stating that he/she has at least 12 months teaching<br />

experience or,<br />

A letter from the training provider stating that he/she is<br />

guided by another CPC Driver Instructor who is coaching<br />

your ‘new’ Instructor until he / she reaches a satisfactory<br />

level of 12 months teaching experience or,<br />

An official license (degree) as a teacher, instructor or<br />

professor.<br />

Your Institute’s CPCD Lesson Plan<br />

Your Institute must submit its CPC Driver Lesson Plan in English.<br />

Your Institute shall provide additional information to the <strong>IRU</strong><br />

Academy with its application and it may be submitted in your<br />

national language. Examples are:<br />

CPCD Course Books;<br />

CPCD Work Books, with Model Answers;<br />

CPCD Practise Tests, with Model Answers and Marking<br />

Scheme;<br />

CPCD Teaching Aids;<br />

CPCD Promotional Materials, e.g. ads, brochures, newsletters,<br />

etc.<br />

4. <strong>IRU</strong> ACADEMY CPC DRIVER TRAIN-THE-TRAINER<br />

As soon as possible following Accreditation, your Institute must have at<br />

least two CPC Driver Instructors trained by the <strong>IRU</strong> Academy, who will then<br />

train all other CPC Driver Instructors.<br />

This training will cover the following objectives:<br />

<strong>IRU</strong> and <strong>IRU</strong> Academy;<br />

<strong>IRU</strong> Academy CPC Driver Instructor Guide;<br />

Relevant international agreements and other applicable legislation;<br />

Instructor guidance through exercises and review activities;<br />

Instructor preparation to successfully undertake examinations;<br />

Best CPCD teaching methods.<br />

Participation is free of charge for one ATI Principal CPC Driver Instructor<br />

from your Institute. The second ATI Principal CPC Driver Instructor as well<br />

as any additional instructors (named ATI Additional CPC Driver Instructors)<br />

wishing to participate in this CPC Driver Train-the-Trainer will pay<br />

a Registration Fee (See Section 6, Table 2). This CPC Driver<br />

Train-the-Trainer event will be held at a location decided by the<br />

<strong>IRU</strong> Academy and most appropriate based on demand.<br />

5. WHAT WILL YOU RECEIVE ALONG WITH YOUR ACCREDITATION?<br />

Once accredited, your Institute and its branches, if any, will be permitted to<br />

operate and promote themselves as <strong>IRU</strong> Academy Accredited Training<br />

Institutes.<br />

Online”;<br />

An access to the Academy Content Management (ACM) to consult<br />

and download the <strong>IRU</strong> Academy CPCD Programme<br />

and the <strong>IRU</strong> Academy CPCD Instructor Guide (See Appendix 1);<br />

Regular updates on latest changes in the field of CPC Driver training<br />

An access to the <strong>IRU</strong> Academy events<br />

<strong>IRU</strong> Academy Promotional Materials;<br />

<strong>IRU</strong> Academy Supporting Materials, including<br />

ATI and Graduate Computer Based Training (CBT) packages<br />

and manuals in the use of the “<strong>IRU</strong> Academy Online”;<br />

<strong>IRU</strong> Academy ATI Logo for promotional purposes;<br />

Blank <strong>IRU</strong> Academy CPCD Certificates with colour Hologram<br />

and more.<br />

6. WHAT IS THE COST TO BECOME AN ATI ACCREDITED<br />

IN THE <strong>IRU</strong> ACADEMY CPC DRIVER PROGRAMME?<br />

All fees indicated are in Swiss Francs (CHF).<br />

APPLICATION FEE<br />

The following application fees concern the two first <strong>accreditation</strong>s only.<br />

For the third and subsequent <strong>accreditation</strong>s, <strong>accreditation</strong> fees are reduced<br />

by 50%.<br />

The Annual Fee is a flat rate of CHF 190, irrespective of which <strong>IRU</strong><br />

Academy CPC Driver programme the ATI holds <strong>accreditation</strong> for.<br />

For the third and subsequent <strong>accreditation</strong>s, the annual fee is reduced by<br />

50%.<br />

PER STUDENT FEE<br />

Your Institute and its branches, if any, commit to register its students in the<br />

“<strong>IRU</strong> Academy Online” (AOL) to maintain its <strong>accreditation</strong>. For each<br />

Certificate issued to a student registered in AOL, an “<strong>IRU</strong> Academy<br />

Certificate Fee Per Student” will be settled on a yearly basis and must be<br />

paid within 30 days of the invoice date.<br />

The “<strong>IRU</strong> Certificate Fee Per Student” is calculated as 2% of your Institute’s<br />

“Full Training Fee Charged to Students by ATI” that must be indicated in<br />

Appendix 9 (pages 10-14 – Annex A to the ATI CPC Driver Agreement).<br />

The “<strong>IRU</strong> Academy Certificate Fee Per Student” is due for all students who<br />

have graduated from the CPC Driver training programme and is based on<br />

the calculation indicated in your Institute’s completed form “Annex B” as<br />

given in Appendix 9 (pages 15-16 – Annex B to the ATI CPC Driver<br />

Agreement).<br />

At the end of the calendar year, there may be a need to reconcile any fee<br />

discrepancy due to difference in the number of students who have obtained<br />

a Certificate, any changes in the “Full Training Fee Charged to Students by<br />

ATI” made by your Institute in the course of the previous calendar year and<br />

the average annual exchange rate applicable for the conversion of the “<strong>IRU</strong><br />

Academy Certificate Fee Per Student” in Swiss Francs. Your Institute must<br />

submit to the <strong>IRU</strong> Academy Secretariat a completed form “Annex B” as<br />

given in Appendix 9 (pages 15-16 – Annex B to the ATI CPC Driver<br />

Agreement) for the purpose of reconciling any discrepancy with the <strong>IRU</strong><br />

Academy calculations.<br />

7. HOW TO UPDATE ACCREDITATION INFORMATION?<br />

The <strong>accreditation</strong> will remain valid until cancellation or termination of the<br />

<strong>IRU</strong> Academy ATI Agreement. Any update of information related to the<br />

training programme(s) delivered by the ATI under <strong>IRU</strong> Academy<br />

<strong>accreditation</strong> or by the <strong>IRU</strong> Academy will require renewal of Annex A that<br />

will need to complete, sign and return it to the <strong>IRU</strong> Academy secretariat.<br />

All Instructors from your ATI, including those of your branches, who deliver<br />

the <strong>IRU</strong> Academy CPC Driver Programme shall undertake the <strong>IRU</strong><br />

Academy CPC Driver Instructor Tests and obtain a pass rate of minimum<br />

80% to ensure high standards of training delivery of this programme.<br />

<strong>IRU</strong> Academy CPC DRIVER Instructor Guide and<br />

Interactive Training Programme<br />

This course is in full compliance with EU Directive 2003/59/EC which regulates the initial<br />

qualification of professional drivers of driving licence category C1, C1+E, C or C+E (truck)<br />

and a driving licence category D1, D1+E,D or D+E (bus & coach).<br />

The <strong>IRU</strong> Academy offers the CPC Driver Programme, jointly developed and implemented<br />

to meet each ATI’s specific national needs with <strong>IRU</strong> Academy standards, ensuring professional<br />

capacity-building for drivers in the road haulage and road passenger transport industry..<br />

1. PREAMBLE<br />

Through this agreement, the ATI confirms that it has fulfilled all the requirements of the<br />

application procedure for <strong>IRU</strong> Academy Accreditation and hereby agrees to undertake the<br />

following:<br />

2. GENERAL<br />

2.1. To take responsibility for its activities and those of its Branch Offices as well as for<br />

full compliance with the terms of this <strong>IRU</strong> Academy ATI Agreement and any<br />

applicable laws.<br />

2.2. To observe, support, promote and implement <strong>IRU</strong> Academy training programmes<br />

and to refrain from taking positions or communication, public or private, by the ATI<br />

or by its management, in contradiction with the policy of the <strong>IRU</strong> or the <strong>IRU</strong><br />

Academy.<br />

3. ATI ACCREDITATION RIGHTS<br />

3.1. The ATI is accredited by the <strong>IRU</strong> Academy as an <strong>IRU</strong> Academy Accredited<br />

Training Institute to conduct itself and through its Branch Offices the Programmes<br />

for which it is accredited in Annex A, which forms an integral part of this <strong>IRU</strong><br />

Academy ATI Agreement. This Annex should be duly completed by the ATI and<br />

returned signed to the <strong>IRU</strong> Academy together with the signed <strong>IRU</strong> Academy ATI<br />

Agreement.<br />

3.2. All new ATI <strong>accreditation</strong>, for another <strong>IRU</strong> Academy programme, will require the<br />

fulfilment of the same <strong>accreditation</strong> procedure and renewal of Annex A of this <strong>IRU</strong><br />

Academy ATI Agreement.<br />

3.3. The ATI will receive, upon Accreditation and full payment of the corresponding fee<br />

to the <strong>IRU</strong> Academy, for every <strong>IRU</strong> Academy Programme for which it receives <strong>IRU</strong><br />

Academy <strong>accreditation</strong>, an official <strong>IRU</strong> Academy Accreditation Certificate /<br />

Attestation.<br />

3.4. The ATI undertakes:<br />

3.4.1. To register all of its <strong>IRU</strong> Academy Accredited Classes, Students, their<br />

respective grades in percentage (%) and Graduates’ Diplomas / Certificates<br />

in the <strong>IRU</strong> Academy AOL Internet Application.<br />

3.4.2. To use the “<strong>IRU</strong> Academy Content Management” System (ACM) to access<br />

updated programme material, as required.<br />

3.4.3. To use the “<strong>IRU</strong> Academy Accredited Training Institute (ATI)” logo and<br />

name as well as other supporting materials to promote the <strong>IRU</strong> Academy<br />

Programmes for which it is accredited.<br />

3.4.4. To systematically print <strong>IRU</strong> Academy Diplomas / Certificates for each<br />

student having graduated from a training programme and publish these<br />

Diplomas / Certificates on the <strong>IRU</strong> Academy AOL Internet Application.<br />

3.4.5. To enable graduates from <strong>IRU</strong> Academy training programmes to publish<br />

their Diplomas / Certificates, together with their personal profile, on the <strong>IRU</strong><br />

Academy AOL Internet Application, with a view to opening access for<br />

potential business partners / employers.<br />

3.5. The ATI is promoted on the <strong>IRU</strong> Academy web site and presentations as an <strong>IRU</strong><br />

Academy Accredited Training Institute (ATI).<br />

4. ATI ACCREDITATION OBLIGATIONS<br />

4.1. The ATI cannot bind the <strong>IRU</strong> Academy in any manner whatsoever as a result of its<br />

<strong>accreditation</strong> by the <strong>IRU</strong> Academy.<br />

4.2. The ATI agrees to become accredited for each training programme it is delivering<br />

for which an <strong>IRU</strong> Academy equivalent programme already exists as soon as<br />

possible, but not later than within one calendar year of the signature of this <strong>IRU</strong><br />

Academy ATI Agreement.<br />

4.3. The ATI commits to systematically issue <strong>IRU</strong> Academy Diplomas and/or<br />

Certificates to each student who successfully graduates from any <strong>IRU</strong> Academy<br />

accredited programme.<br />

4.4. The ATI has the responsibility to promote the <strong>IRU</strong> Academy’s principles of high<br />

quality training standards, international recognition and excellence in professional<br />

road transport training towards its national authorities, students and other national<br />

stakeholders.<br />

4.5. The ATI agrees to establish links with the National Competent Authorities in order<br />

to have the <strong>IRU</strong> Academy Diplomas / Certificates countersigned by a high level<br />

official of the National Competent Authority.<br />

4.6. The ATI will maintain its premise(s) and classroom facility(ies) to the highest<br />

quality standards.<br />

4.7. The ATI and its Instructors commit to maintain the highest quality training for all of<br />

its <strong>IRU</strong> Academy Accredited Programmes and to deliver these training<br />

programmes in strict conformity with the related programme plans.<br />

4.8. To ensure high standards of training delivery, all ATI Instructors, including the<br />

Additional Instructors and those engaged in the ATI branches, who deliver <strong>IRU</strong><br />

Academy programmes shall undertake appropriate training for each accredited<br />

programme and succeed in the relevant <strong>IRU</strong> Academy Instructor Test(s) available<br />

on the <strong>IRU</strong> Academy Content Management system (ACM).<br />

4.9. The ATI commits to make available to the <strong>IRU</strong> Academy a copy of its training<br />

programme(s) and their related materials in electronic format in its native<br />

language, together with an English translation of the table of content.<br />

4.10. The ATI confirms that it is duly registered and holds all applicable licenses and<br />

documents as required by the laws of its respective country.<br />

4.11. The ATI commits to implement any modification required by:<br />

- a change in the National Legislation<br />

- the National Competent Authorities<br />

- the <strong>IRU</strong> Academy<br />

and inform the <strong>IRU</strong> Academy in writing without delay.<br />

4.12. The ATI commits to have at least one “ATI Principal AOL Administrator” trained in<br />

the use of the “<strong>IRU</strong> Academy Online”.<br />

4.13. The ATI commits to register and manage its classes by using the <strong>IRU</strong> Academy<br />

AOL Internet Application.<br />

4.14. The ATI accepts to inform its <strong>IRU</strong> Academy training graduates about the<br />

availability of the <strong>IRU</strong> Academy AOL Internet Application, provide access details to<br />

their personal pages and train them in the use of AOL.<br />

5. COMMUNICATION<br />

5.1. The ATI will assign at least one (1) ATI Liaison Person, fluent in English, who will<br />

ensure, to the <strong>IRU</strong> Academy’s full satisfaction, proper and timely communication.<br />

5.2. The ATI will, without delay, advise the <strong>IRU</strong> Academy of any changes to the<br />

information submitted within the Accreditation Process, including the names and<br />

qualifications of its Instructors.<br />

5.3. The ATI accepts to have at least one Principal Instructor trained per <strong>IRU</strong> Academy<br />

Programme (with the exception for the CPC Manager and CPC Driver<br />

Programmes that require preparation of at least two Principal Instructors), as<br />

required in Annex A, at a location decided by the <strong>IRU</strong> Academy.<br />

5.4. The ATI reserves the right to provide training to any additional instructor(s) itself or<br />

may have them trained by the <strong>IRU</strong> Academy in accordance with the terms<br />

mentioned in Annex A to this ATI Agreement. All <strong>IRU</strong> Academy training of<br />

Additional Instructors is at the cost of the ATI, but is not mandatory for <strong>IRU</strong><br />

Academy <strong>accreditation</strong>.<br />

6. FEES TO BE PAID TO THE <strong>IRU</strong> ACADEMY<br />

6.1. All fees per <strong>IRU</strong> Academy Accredited Programme are defined in Annex A and are<br />

non-refundable.<br />

6.2. The fee to be paid to the <strong>IRU</strong> Academy for each Diploma / Certificate distributed to<br />

a graduate and for any accredited programme will be invoiced by the <strong>IRU</strong><br />

Academy once a year. The amount to be charged per programme will represent<br />

2% of the full training fees charged to the graduates by the ATI for the respective<br />

programme as mentioned in Annex A.<br />

6.3. The <strong>IRU</strong> Academy is entitled to modify any applicable fees. However, to avoid any<br />

retroactive charge on students due to these adjustments, such changes can only<br />

be undertaken at the end of the calendar year.<br />

6.4. The ATI shall inform without any delay the <strong>IRU</strong> Academy Secretariat of any<br />

changes to the full training fees charged to students by itself.<br />

6.5. Any modification of the fees as per paragraphs 6.3 and 6.4 above would require<br />

the renewal of Annex A to this ATI Agreement.<br />

6.6. In order to ensure that data registered in the <strong>IRU</strong> Academy AOL Internet<br />

Application truly reflects the number of graduates who successfully passed the<br />

exams, and to allow the <strong>IRU</strong> Academy to properly inform the <strong>IRU</strong> Academy<br />

Advisory Committee (ADC) on the training activities undertaken by the ATI, every<br />

year, latest by 15th January, the ATI shall return to the <strong>IRU</strong> Academy Secretariat<br />

one duly completed and signed copy of Annex B for all programmes for which it<br />

holds <strong>IRU</strong> Academy <strong>accreditation</strong>.<br />

6.7. Taking into consideration information available in the <strong>IRU</strong> Academy AOL Internet<br />

Application and information provided by the ATI in Annex B, the <strong>IRU</strong> Academy will<br />

establish an invoice with the total number of ATI graduates from <strong>IRU</strong> Academy<br />

accredited programmes.<br />

6.8. The ATI shall settle all <strong>IRU</strong> Academy fees within 30 calendar days of the <strong>IRU</strong><br />

Academy invoice date.<br />

7. QUALITY CONTROL AND AUDIT<br />

7.1. The <strong>IRU</strong> Academy must be immediately informed about any modification in the ATI<br />

<strong>accreditation</strong> data.<br />

7.2. In case of any doubt in the ATI’s fulfilment of the <strong>IRU</strong> Academy <strong>accreditation</strong><br />

requirements, the <strong>IRU</strong> Academy may require the ATI to undertake a<br />

re<strong>accreditation</strong> process and / or to be audited.<br />

7.3. The ATI agrees to authorise the <strong>IRU</strong> Academy or its representative to inspect, at<br />

its discretion and without prior notice, the ATI premises, classroom facilities, official<br />

registration or any other related documents, and to audit instructors, classes and<br />

teaching methods as deemed necessary.<br />

7.4. The <strong>IRU</strong> Academy is entitled to conduct independent auditing on the full training<br />

costs charged to students by the ATI.<br />

8. USE OF <strong>IRU</strong> ACADEMY LOGOS AND NAMES<br />

8.1. The <strong>IRU</strong> Academy logos and names can only be used by the ATI and its branches<br />

throughout the period during which the training centre is accredited.<br />

8.2. The <strong>IRU</strong> Academy Accredited Training Institute logo may be used in promotional<br />

materials directly linked to the accredited programme(s).<br />

The logo may also be used on the ATI’s:<br />

- website<br />

- letterhead paper<br />

- business card<br />

- brochures<br />

Any other use of the <strong>IRU</strong> Academy logos and corporate identity should be agreed<br />

with and approved by the <strong>IRU</strong> Academy.<br />

In order to guarantee the trade mark and the quality of reproduction of the <strong>IRU</strong><br />

Academy and <strong>IRU</strong> Academy Accredited Training Institute logos, it is essential that<br />

only the logos provided by the <strong>IRU</strong> Academy via the Academy Content<br />

Management system (ACM) are used in any publication.<br />

8.3. In no circumstances may <strong>IRU</strong> Academy or <strong>IRU</strong> Academy Accredited Training<br />

Institute logos appear on non-<strong>IRU</strong> Academy Diplomas / Certificates issued by the<br />

ATI or its branches. It is also forbidden to use the <strong>IRU</strong> and <strong>IRU</strong> Academy names<br />

and logos after termination of the ATI’s <strong>accreditation</strong>.<br />

The institutes are advised against using photocopies of the logo for documents<br />

distributed outside of their administrative framework.<br />

8.4. The <strong>IRU</strong> Academy Graduate logo was created to give the possibility to directly<br />

associate a Graduate’s name with the values which the <strong>IRU</strong> Academy training<br />

programme stands for: international recognition and quality of training. This logo<br />

can only be used by students who have graduated from an <strong>IRU</strong> Academy<br />

Accredited Training Institute and have successfully completed an <strong>IRU</strong> Academy<br />

programme.<br />

9. COPYRIGHTS<br />

The logo may only be used on the following documents:<br />

- Graduate’s business card<br />

- Graduate’s CV<br />

- Graduate’s personal web page<br />

- The web page of the company, in direct connection with Graduate’s name.<br />

9.1. All contents of the <strong>IRU</strong> Academy training material made available to the ATI<br />

through <strong>accreditation</strong> is protected worldwide by copyright and other intellectual<br />

property rights. The use of this material is strictly limited to the ATI for programme<br />

delivery in the strict framework of its <strong>accreditation</strong>. All <strong>IRU</strong> and <strong>IRU</strong> Academy<br />

copyrights and intellectual property rights survive the termination of the ATI<br />

Accreditation.<br />

9.2. Any translation, representation, copy, reproduction, dissemination or use of all or<br />

part of the material, in any form by any means, for activities that are outside the<br />

scope of the ATI agreement is illegal.<br />

9.3. For use of <strong>IRU</strong> Academy material outside the framework of <strong>IRU</strong> Academy<br />

programmes, the ATI must ask for a written permission of the International Road<br />

Transport Union – Head of the <strong>IRU</strong> Academy. In cases of non respect of these<br />

provisions, offenders make themselves liable to legal proceedings and sanctions.<br />

10. DISCLAIMERS<br />

The user hereby is aware and agrees that neither the <strong>IRU</strong> Academy, nor any other party<br />

or anyone cooperating with the <strong>IRU</strong> Academy on a voluntary or paid basis, shall be liable<br />

for the contents of the <strong>IRU</strong> Academy programmes and their use and shall not in any way<br />

be liable for any loss or damage whatsoever, including the inappropriate, improper or<br />

fraudulent use of <strong>IRU</strong> Academy programmes.<br />

No user should act on the basis of programmes without referring to the relevant<br />

international and national regulations in force.<br />

The designation of countries, territories, cities and the presentation of related material in<br />

the <strong>IRU</strong> Academy programmes shall not be considered as implying any standpoint<br />

whatsoever on the part of the <strong>IRU</strong> Academy concerning the political or legal status of any<br />

country, territory or city, or of its authorities, or concerning the delimitation of its frontiers<br />

or boundaries.<br />

11. FAILURE TO RESPECT THE <strong>IRU</strong> ACADEMY ATI AGREEMENT<br />

AND TERMINATION OF THE ATI ACCREDITATION<br />

11.1. The <strong>IRU</strong> Academy or the ATI may cancel the <strong>IRU</strong> Academy ATI Agreement at any<br />

time, without any financial compensation or indemnity, subject to prior notice of at<br />

least 1 month sent by registered letter with acknowledgement of receipt addressed<br />

to the other party. The cancellation of the <strong>IRU</strong> Academy ATI Agreement<br />

automatically terminates the ATI Accreditation for all <strong>IRU</strong> Academy programmes.<br />

11.2. If the ATI fails to respect the obligations entered into by it by virtue of this <strong>IRU</strong><br />

Academy ATI Agreement, the Head of the <strong>IRU</strong> Academy shall:<br />

- issue a warning to the ATI, by registered letter with acknowledgement of receipt<br />

addressed to the ATI, detailing the observed irregularities and requiring it to<br />

rebut or redress the alleged situation to the satisfaction of the <strong>IRU</strong> Academy<br />

within a given time limit,<br />

- cancel this <strong>IRU</strong> Academy ATI Agreement, without any financial compensation or<br />

indemnity, with immediate effect or after a given time limit, in cases where the<br />

ATI does not remedy the situation to the satisfaction of the <strong>IRU</strong> Academy.<br />

11.3. Cancellation of the <strong>IRU</strong> Academy ATI Agreement may also result from but is not<br />

limited to:<br />

any action which may compromise the <strong>IRU</strong>, <strong>IRU</strong> Academy or its ATIs<br />

international credibility, image and reputation;<br />

misuse of the <strong>IRU</strong> Academy logos or name;<br />

unauthorised issuance or reproduction of <strong>IRU</strong> Academy Diplomas and / or<br />

Certificates;<br />

Unsystematic issuance of <strong>IRU</strong> Academy Diplomas and / or Certificates as per<br />

the provisions of paragraphs 4.3 and 11.4;<br />

unpaid fees;<br />

bankruptcy or similar proceedings against the ATI;<br />

mutual agreement.<br />

11.4. This <strong>IRU</strong> Academy ATI Agreement will immediately become null and void in the<br />

case of non-respect by the Accredited ATI of its obligation to systematically issue<br />

<strong>IRU</strong> Academy Diplomas / Certificates (to each graduate per each <strong>IRU</strong> Academy<br />

accredited programme) as per the current agreement.<br />

11.5. In case of cancellation of the <strong>IRU</strong> Academy ATI Agreement, the ATI has the<br />

obligation to:<br />

remove from all of its electronic, video or paper support the names and the<br />

logos of the <strong>IRU</strong>, of the <strong>IRU</strong> Academy and the <strong>IRU</strong> Academy Accredited<br />

Training Institute;<br />

hand over to the <strong>IRU</strong> Academy Secretariat all non issued Diplomas /<br />

Certificates still in its possession;<br />

hand over to the <strong>IRU</strong> Academy Secretariat all <strong>IRU</strong> Accreditation Certificates.<br />

11.6. As per the date of termination of the ATI Accreditation, the <strong>IRU</strong> Academy will<br />

publicly display and inform its stakeholders about the termination of the ATI<br />

Accreditation status.<br />

12. APPLICABILITY AND COMPETENCE<br />

12.1. This <strong>IRU</strong> Academy ATI Agreement, its form, validity and the resulting obligations<br />

shall be subject to Swiss law, and only the version in English, signed by the ATI,<br />

shall be applicable in its relations with the <strong>IRU</strong> Academy.<br />

12.2. The provisions of this <strong>IRU</strong> Academy ATI Agreement shall be governed with respect<br />

to and in accordance with the laws of Switzerland. Any dispute arising out of, or in<br />

connection with, or in the implementation of this <strong>IRU</strong> Academy ATI Agreement,<br />

shall be, whenever possible, settled amicably. Any dispute, which cannot be<br />

settled amicably, shall be settled before the Courts of the Canton of Geneva. An<br />

appeal to the Swiss Federal Court is admitted.<br />

13. ENTRY INTO FORCE AND VALIDITY OF THE <strong>IRU</strong> ACADEMY ATI AGREEMENT<br />

13.1. This <strong>IRU</strong> Academy ATI Agreement shall enter into force on the date of its signature<br />

by the Secretary General of the <strong>IRU</strong>.<br />

13.2. This <strong>IRU</strong> Academy ATI Agreement annuls and replaces all precedent Agreements<br />

separately signed between the <strong>IRU</strong> Academy and the ATI. It applies exclusively to<br />

all <strong>IRU</strong> Academy programmes for which the ATI is accredited.<br />

13.3. Annexes A and B form an integral part of this <strong>IRU</strong> Academy ATI Agreement.<br />
